    SUBCHAPTER C

    CERTIFICATE OF INSPECTION

    175.41. PROCEDURE.

    (a) Unauthorized Display of Certificate ofInspection- No certificate of inspection ortemporary inspection approval indicator maybe marked or affixed to a vehicle unless thevehicle has successfully passed inspection,meeting the requirements of 75 Pa. C.S.101-9701 (relating to the Vehicle Code)and this chapter.

    (b) Type- A certificate of inspection shallbe selected for the particular type of vehiclebeing inspected according to this chapter. Thecertificate of inspection insert shall correspondto the vehicles registration month basedon charts supplied by the Department. The

    certificate of inspection shall be examinedbefore using. If found to be incorrect, theinspection station supervisor and the VehicleControl Division shall immediately be notified.

    (1) TS-460 shall be used for motor vehiclesexcept motorcycles and motor-drivencycles.

    (2) TS-463 shall be used for all trailers,motorcycles and motor-driven cycles.

    (3) A temporary inspection approval indicatorshall be used to designate a vehiclewhich has successfully passed therequired periodic safety inspection, butwhich shall display a renewed emissioncertificate of inspection before a newsafety certificate of inspection stickermay be affixed to the vehicle.

    (c) Required Information- The information onthe rear of the certificate of inspection shallbe completed in its entirety in permanent ink.The odometer reading is not required to becompleted for trailers and motorcycles.

    (1) The temporary inspection approvalindicator shall be affixed as described insubsection (e)(5) so as to be visible to

    the vehicle operator (while seated in thedrivers location) without obscuring anyrequired information entered on the backof the safety certificate of inspection.

    (2) When replacing a certificate ofinspection for which a temporaryinspection approval indicator has beenissued, the back of the new certificate ofinspection shall be completed using theinformation recorded on the report sheet(Form MV-431) at the time of the originalinspection.

    (d) Affixing Certificate of Inspection orTemporary Inspection Approval Indicator -

    The certificate of inspection or temporaryinspection approval indicator shall only beaffixed to the vehicle on the premises of theofficial in spection station and on a portionof the premises located within 100 feet andon the same side of the street as the official

    inspection station. A certificates of inspectionor temporary inspection approval indicatormay not be issued or affixed at another areaor location.

    (1) It is the responsibility of the certifiedinspection mechanic who performedthe inspection to affix the certificateof inspection or temporary inspectionapproval indicator to the vehicle in thelocation prescribed by the Department.The certificate of inspection or temporaryinspection approval indicator shall beaffixed only after completion of the entireinspection, including the road test. Amechanic exempted by the Departmentfrom performing the road test under thischapter is responsible for affixing thecertificate of inspection or temporaryinspection approval indicator.

    (i) Inspection stations may not replacea certificate of inspection to whicha temporary inspection approvalindicator has been affixed if one ormore of the following apply:

    (A) The inspection station did notperform the original inspection ofthe vehicle or issue the temporary

    inspection approval indicatoraffixed to the current certificateof inspection.

    (B) The vehicle does not display arenewed emission certificate ofinspection.

    (C) The original safety certificateof inspection has expired.

    (D) The vehicle is in an obviouslyunsafe condition, including, butnot limited to, bald tires, exhaustleaks, broken glazing and brokenor missing lighting.

    (ii) Inspection stations may chargethe posted fee for inspection ofa vehicle to which a temporaryinspection approval indicator has beenaffixed, a fee may not be charged forthe temporary inspection approvalindicator. The posted fee for the newcertificate of inspection may onlybe charged when the new safetycertificate of inspection is affixed tothe vehicle.

    (2) The surface on which the sticker is to beattached shall be wiped dry and clean ofroad film, grease and moisture for properadhesion. The following apply:

    (i) The glass or body surface shall becleaned thoroughly.

    (ii) The protective slip sheet shall beremoved from the adhesive side of thecertificate of inspection or temporaryinspection approval indicator.

    (iii) The sticker shall be positionedcarefully, then squeezed until it istightly affixed to the windshield, bodyor existing certificate of inspection.

    (iv) Only the current certificate ofinspection shall be visible.

    (e) Certificate of Inspection Location -The certificate shall be located as follows:

    (1) On a motor vehicle, the certificate ofinspection shall be affixed in an uprightposition, to the extreme lower left-handinside corner of the windshielddriversside.

    (2) On a motorcycle or a motor-drivencycle, the certificate of inspection shallbe affixed in a clearly visible, uprightposition to one of the following areasof the vehicle:

    (i) On the left sidetraffic sideof the frontfork.

    (ii) On the left sidetraffic sideof the frontfender.

    (iii) On a plate attached by weld or rivetsto the left sidetraffic sideof thevehicle for purposes of mounting thecertificate of inspection.

    (3) The new certificate of inspection maynot be placed over the old certificate ofinspection. The certificate of inspectionwhich expired or is about to expire shallbe removed prior to placement of thenew certificate of inspection.

    (4) On trailers, the certificate of inspectionshall be affixed, in an upright position,to the left fronttraffic sideof the trailer,approximately 6 feet high, if possible.The certificate may not be placed on thenose or front side of the trailer. A holderis permitted if it is in the proper locationand the certificate of inspection is affixedto prevent theft or transfer to anothervehicle. The new certificate of inspectionmay not be placed over the old certificateof inspection.

    (5) The temporary inspection approvalindicator shall be affixed to the top leftportion of the reverse side of the existingsafety certificate of inspection so as tobe visible to the vehicle operator (whileseated in the drivers location) withoutobscuring any required informationentered on the back of the safetycertificate of inspection.

    (f) Inspection Cycles- When selecting theproper type of certificate insert, the newexpiration date is based upon whether theinspection is an annual or semi-annualinspection.

    (1) An annually inspected vehicle willreceive an inspection for no more than15 months and no less than 6 monthsbased on the vehicles registration monthand charts supplied by the Department.

    (2) A semiannually inspected vehicle will

    receive an inspection for no more than9 months based on charts supplied bythe Department.

    (3) Insert stickers will be selected basedupon the expiration date on the newinspection. If the vehicle is subject toemission inspection as determined by anI/M indicator on the registration card, thevehicle will receive an I/M indicator tabon the safety certificate of inspection.

    (4) A temporary inspect ion approvalindicator shall be used to indicate thata vehicle has successfully passed the

    required periodic safety inspection,but shall display a renewed emissioncertificate of inspection before a newsafety certificate of inspection stickermay be affixed to the vehicle. Thetemporary inspection approval indicatordoes not extend the expiration of anycertificate of inspection to which it isaffixed.

    175.42. RECORDING INSPECTION.

    (a) Fraudulent Recording- Fraudulentrecording of an inspection report sheet will be

    considered cause for suspension of inspectionprivileges.

    (b) Signature - The certified mechanic whoperformed the entire inspection shall place hissignature in the appropriate column of FormMV-431 or MV-480 immediately following theinspection. Both the mechanic exempted fromperforming the road test under this chapterand the certified mechanic who performed theroad test shall place their signatures in theappropriate column.

    a T shall be entered in the areadesignated for the sticker number toindicate that a temporary inspectionapproval indicator was issued. Aninspection station may not impose asticker charge for the issuance of atemporary inspection approval indicator.

    (2) Upon the return of a vehicle for whicha temporary inspection approvalindicator has been issued, the stationwhich originally affixed the temporaryinspection approval indicator shall:

    (i) Verify the year, make, body style, VINand proof of financial responsibilityfor the vehicle presented for a renewedcertificate of inspection to ensure itis the same vehicle indicated on thereport sheet (Form MV-431) when theoriginal inspection was performed.This information shall be recorded asa new entry on the regular report

    sheet (Form MV-431) where allinspection sticker serial numbersissued are recorded.

    (ii) Record, on the Form MV-431, theserial number of the new certificate ofinspection to be affixed to the vehiclealong with the vehicle owners name,address, VIN, license plate number,vehicle year make and body style. Areference to the date and number ofthe original inspection performed shall

    be noted in the shaded area to the leftof the area designated for the stickerserial number and total cost (that is,See T-inspection number 123 dated01/01/97).

    (iii) Enter, in the appropriate area of thereport sheet (Form MV-431), the nameof the certified inspection mechanicthat verified the original inspectioninformation and that is replacing thecertificate of inspection.

    (3) The certified inspection mechanic

    replacing the certificate of inspectionshall sign the back of the new certificateof inspection and record the informationfrom the original inspection entry (wheelspulled, date of inspection, and the like)on the new certificate of inspectionbefore it is affixed to the vehicle. Theexpiring certificate of inspection shallbe removed prior to affixing the newcertificate of inspection as described inparagraph (2) .

    (1) When the inspection information istransferred from a work order to theForm MV-431 or MV-480 by anyoneother than the certified mechanic whoperformed the inspection, the work ordershall contain the certified mechanicssignature and be retained for a period

    of 2 years. The person who enters theinformation shall place the name of thecertified mechanic in the appropriatecolumn and the initials of the personputting the information on the form inthe appropriate column. A mechanicexempted from performing the roadtest under this chapter and the certifiedmechanic who performed the road testshall sign the work order. The personwho transfers the information shall placethe names of both certified mechanics inthe appropriate column.

    (2) A work order shall be available forinspection upon request by theinspection station supervisor or anauthorized representative of theDepartment.

    (c) Records Retention- The original officialinspection report sheet shall be retained asa garage record and kept on file at the stationfor 2 years. At the close of each inspectionperiod, the official inspection report sheetshall be placed in the stations files, eventhough all spaces may not have been used

    and a new inspection report sheet shall bestarted for the new inspection period.

    (d) Content- The inspection report sheet (FormMV-431 for passenger cars, trucks and busesor MV-480 for motorcycles and trailers) shallbe neat and legible and completed in itsentirety. Details pertinent to every vehicleinspected, including rejections, shall berecorded on the report sheet. Items inspected,adjusted or repaired shall be recorded. If thereport sheet lists a piece of equipment whichdoes not apply to the specific type of vehicle

    being inspected, a dash shall be placed in thecolumn to indicate it has not been overlookedor neglected. Certificates of inspection issuedshall be listed in numeric order.

    (1) Temporary inspection approvalindicators, if issued in lieu of a certificateof inspection, shall be recorded ona separate report sheet (Form MV-431) and shall be indicated in the areadesignated for the sticker number. Thisseparate report sheet shall be completedas described in this subsection except

    (4) Inspection stations may not replacea certificate of inspection to which atemporary inspection approval indicatorhas been affixed if one or more of thefollowing apply:

    (i) The inspection station did not performthe original inspection of the vehicle

    or issue the temporary inspectionapproval indicator affixed to thecurrent certificate of inspection.

    (ii) The vehicle does not display arenewed emission certificate ofinspection.

    (iii) The original safety certificate ofinspection has expired.

    (iv) The vehicle is in an obviously unsafecondition, including, but not limitedto, bald tires, exhaust leaks, brokenglazing, and broken or missinglighting.

    (e) Nonrelated Items-Gas, oil, or othernon-related items shall not be included inthe total charges for repair and inspection.

    (f) Classifications-The form numbers andcolors listed in this subsection explain thegeneral classification of vehicles to berecorded on each type of inspection recordsheet:

    (1) Form MV-431. Motor vehicles exceptmotorcycles and motor-driven cyclesshall be recorded on this form.

    (2) MV-480. Trailer, motorcycle, andmotor-driven cycles shall be recorded onthis form.

    175.43. SECURITY.

    (a) Check for Errors- When inspection stickersare received by the inspection station, theyshould be checked for errors. If errors arediscovered, they shall be reported to theVehicle Control Division at once.

    (b) Not Transferable- An inspection certificateis not transferable. It shall only be affixedto vehicles as designated on the inspection

    record sheet of the inspection station towhich the certificates were issued.

    (c) Removal- Except as provided in paragraphs(1) and (3), a certificate of inspection maynot be removed from a vehicle for which thecertificate was issued, except to replace itwith a new certificate of inspection issuedunder this chapter and Chapter 177 (relatingto emission inspection program).

    (1) A person replacing or repairing awindshield in a manner that requiresremoval of a certificate of inspectionshall, at the option of the registrant ofthe vehicle, cut out the portion of thewindshield containing the certificate ofinspection and deliver it to the registrant

    of the vehicle or destroy the certificate.The vehicle may be driven up to 5 daysif it displays the portion of the oldwindshield containing the certi ficate.Within the 5-day period, an officialinspection station may affix to the vehicleanother certificate of inspection for thesame period without reinspecting thevehicle, in exchange for the portion ofthe old windshield containing thecertificate of inspection. Example: A #1certificate of inspection shall be replacedwith a #1 certificate of inspection. The

    replacement may be made any time priorto the expiration of the certificate ofinspection. A fee of no more than $2.00plus the fee paid to the Department forthe certificate may be charged forexchanging the certificate of inspection.

    (i) A replacement certificate ofinspection may not be issued in thefollowing circumstances:

    (A) Acceptable proof of financialresponsibility is not provided.For the purpose of this chapter,

    financial responsibility shall beproven by one of the followingdocuments:

    (I) A valid financial responsibilityidentification card issued inaccordance with 31 Pa. Code(relating to insurance).

    (II) The declaration page of a validinsurance policy.

    (III) A valid self-insuranceidentification card.

    (IV) A valid binder of insurance

    issued by an insurancecompany licensed to sell motorvehicle liability insurance inthis Commonwealth.

    (V) A valid insurance policy issuedby an insurance companylicensed to sell motor vehicleliability insurance in thisCommonwealth.

    (g) New Signature Cards- A new signature cardshall be ordered from the Vehicle ControlDivision immediately whenever one or more ofthe following occur:

    (1) The station copy is lost or stolen. Theloss shall be immediately reported to theVehicle Control Division.

    (2) Any employe, whose signature appearson the card is no longer employed by thestation.

    (3) The card is defaced, torn or illegible.

    (4) A signature is to be added.

    175.44. ORDERING CERTIFICATES

    OF INSPECTION.

    (a) Forms- The following requisition forms shallbe used to order certificates of inspection andinserts:

    (1) MV-436A - For vehicles. (2) MV-467A - For inserts and temporaryinspection approval indicators.

    (b) Contents- Required information shall beentered on the order form.

    (1) The correct name, address and stationnumber, as shown on the certificate ofappointment, shall be entered on everyrequisition form.

    (2) A requisition shall be personally signedby one of the persons whose signatureappears on the signature card, FormMV-417. The signature shall be identicalto the one on file or the requisition will berejected. No one may order certificatesof inspection unless his signature ison the signature card on file with theDepartment.

    (c) Additional Instructions - The following alsoapply:

    (1) When special delivery is desired, aseparate check shall be enclosed forpostage. Do not enclose cash or addthe amount for postage to the check forcertificates of inspection.

    (2) Each sticker requisition shall beaccompanied by a separate check.Certificates of inspection may be orderedon one requisition form. Checks shallbe made payable to the Department ofTransportation or PennDOT.

    (3) Requisitions may be snap-out forms withtwo sheets in each set. All copies shallbe forwarded to the Department. No copyshall be detached.

    (B) The vehicle is in an obviouslyunsafe operating condition.

    (ii) The portion of the windshieldcontaining the certificate ofinspection may be retained for auditby the inspection station supervisors.

    (iii) Record all information from old

    certificate of inspection on FormMV-431. The replacement certificateof inspection shall be recorded onthe same Form MV-431 and markedreplacement sticker issued.

    (iv) Replacement shall be marked onthe reverse side of the replacementcertificate of inspection.

    (2) Only one current, valid certificate ofinspection shall be visible on a vehicle.The old certificate of inspection shallbe removed and completely destroyed

    before a new sticker may be affixed. (3) A vehicle that has an expired

    emission certificate of inspectionaffixed and which no longer has anI/M Registration Indi cator on theregistration card, shall have the expiredemission sticker removed by the safetyinspection mechanic who is affixing anew safety certificate of inspection.

    (d) Security- Inspection certificates andtemporary inspection approval indicatorsshall be kept under lock and key in a safe

    place. The station owner shall be solelyresponsible for their safety and shall accountfor certificates of inspection and temporaryinspection approval indicators issued to thestation.

    (e) Unused- Unused certificates of inspectionfor an expired period shall be retained bythe inspection station until audited by theinspection station supervisor. TheDepartment will refund 75% of the purchaseprice of the unused certificates of inspectionafter the audit has been completed.

    (f) Issuance of Certificates of Inspection- Certificates of inspection will not be issued

    by the Bureau to anyone who cannot displayan executed signature card, Form MV-417.The signature card may not be entrusted to

    anyone except an employe or other personfor whom the inspection station owner ormanager will accept full responsibility forcertificates of inspection delivered to thatperson.

    (3) Furnish, loan, give or sell certificatesof inspection and approval to otherofficial inspection station or other personexcept upon an inspection made inaccordance with this chapter. See 75 Pa.C.S. 4730(b).

    (4) Orders for certificates of inspectionshall be in multiples of 25, with aminimum of 50 certificates, except that,Common wealth and fleet inspectionstations shall order a minimum of 25certificates.

    (5) All incomplete or improper certificate of

    inspection requisitions or checks shall bereturned to the official inspection station

    for correction. To avoid unnecessaryinconvenience or delay, information shallbe rechecked carefully.

    (6) If certificates of inspection are to bedelivered to a mailing address insteadof the inspection station address, themailing address shall be includedon every requisition submitted to theDepartment.

    (d) Copies- A copy of the requisition or a

    Department receipt will be returned with theorder of certificates of inspection shippedfrom the Department. Station copies of allrequisitions or Department receipts shall bekept on file at the station for 2 years and shallbe made available for inspection upon requestof the inspection station supervisor or anauthorized representative of the Depart ment.

    (e) Suggested Schedule- Certificates ofinspection should be ordered as needed.Thirty days should be allowed for delivery.

    (f) Additional Certificates- An inspection

    station should anticipate their need foradditional certificates of inspection.

    175.45. VIOLATION OF USE OF

    CERTIFICATE OF

    INSPECTION.

    A person may not do any of the following:

    (1) Make, issue, transfer or possess animitation or counterfeit of an officialcertificate of inspection or temporaryinspection approval indicator and shall besanctioned consistent with 75 Pa. C.S.

    4730(c) (relating to penalty). (2) Display or cause to be displayed on a

    vehicle or have in his possession acertificate of inspection or temporary

    inspection approval indicator knowingit is fictitious, stolen, issued foranother vehicle or issued without aninspection having been made and shallbe sanctioned consistent with the

    provisions of 75 Pa. C.S. 4730(c)(relating to pen alty).
