InMay 1940, the conservativeWinston Churchill becameBritishprimeminister,replacingNevilleChamberlain,whosegovernmentwasbroughtdownbylackofconfidenceafterthefailure of the appeasement policy towardsNaziGermany.

WinstonChurchilltookthehelmofacoalitiongovernmentthatled thecountry throughtheBattle forBritainandonwards tovictoryinWorldWarII,fiveyearslater.Thiscrisisgovernment,whichincludedLabourPartyleaderClementattlee,wentdowninhistoryasanindisputablesuccess.

InMay2010,DavidCameron, leaderof theConservativeParty which won the recent general election, became primeministerofBritainand,asChurchillhaddone70yearsbefore,formedacoalitiongovernment.Thisgovernmenthas the taskofrevivingBritain’seconomy.Thenewprimeministerdisplaysreadinesstotakeonthefight,andWinstonChurchill’sfamouswords,“Ihavenothingtoofferbutblood,toil,tearsandsweat”,wouldnot soundoutofplacecoming fromhis lips. Justhoweffective the Cameron­Clegg cabinet and how successful theparadoxicalalliancebetweenconservativesandliberaldemocratswillactuallybe,willprovesomethingthatonlytimecantell.Butwhicheverwaywelookatit,thecoalitiongovernmentseemstobeapromisingprojectcapableofgivingasolidfoundationtothe‘hungparliament’theelectionresultsproduced.

Theelectioncampaignitselfmadeanimpression,surprisinganalystsbyshakingthepublicoutoftheirpoliticalapathy.Forthe first time inBritishhistory televiseddebatesbetween thethreepartyleadersstirredpassionsandgot‘disillusionedvoters’interested inpoliticsagain.Thedebatesmadeabright starofliberaldemocratleaderNickClegg,andthecrowdsofdisgruntledcitizenswhodidnotmanagetocasttheirvotesclearlytestifiedtothecampaign’ssuccess.ThecampaignwascoveredwellandconscientiouslyingoodBritishtradition.Itwasagenuinelyhigh­techaffair­aTVcampaign,withthemediaturningthepoliticalprocessintoanexcitingdrama.

Intheend,Britishvotersremainedtruetotraditionalvaluesandgave theConservativeandLabourparties themostvotes,seemingto feel that lifeoffersenoughupheavalsas it isat themomentwithout agreeing to take upClegg’s offer of urgenttransformationaswell.Thecoalitiongovernment’scompromisesolutionofholdinga referendumonelectoral systemreformlookslikethewisestoptionfornow.

Theoverallimpressionisthatitwascricket.Theplayerskepttotherulesfromstarttofinish.Thecampaign,thedebates,election

night,andthe leaders’willingness toreachacompromiseandfindawayoutofthepoliticalcrisisallmadeaworthyimpression.GordonBrownleftthestagewithhonour.Iamoptimisticaboutthecoalitiongovernment’schancesand,watchingevents fromRussia,gavemywholeheartedsupport to the faircontest thattookplace.

Objectively speaking, thenew two­party cabinet has verystrongpotential in the talent, energy and ambitionofDavidCameron,NickClegg,andChancelloroftheExchequerGeorgeOsborne.This isbalancedby the solidexperienceofWilliamHague,LiamFox,KennethClarkandIanDuncanSmith.Nowthisteamhastomakeitallcometogether.ItisworthnotingtoothatbusinessdevelopmentinthecabinetwillbetheresponsibilityoftheLiberalDemocrats’chiefeconomistVinceCable.Ingeneral,theLiberalDemocratssupporttaxcuts,aboveallforlowincomepeople,butatthesametime,reducingthebudgetdeficitremainsan urgent priority, and thiswill not be possiblewithout taxhikes.Thegovernmentwillthushavetoconcentrateaboveallontrimmingspending,withtaxhikes,whichwouldnegativelyeffecteconomicgrowth,onlybroughtinasalastresort.

On25May2010,inherQueen’sSpeechbeforetheBritishParliament,QueenElizabethIIconfirmedthatthegovernment’sfirstpriorityistoreducethebudgetdeficit.Todaythisstandsat12%ofGDP(£163.4billion,arecorddeficitintheEU).Thenewgovernmenthasgivenitself50daystodrafta‘crisisbudget’for2010thatwouldtrimpublicexpenditureby£6,25billion(withnosectorguaranteedagainstpossiblespendingcuts,noteventhebudget for the2012Olympics).Meanwhile,unemployment inBritainhasnowhit8%(2.51millionpeople),andwithbudgetspending due to fall over the next 2 years this figure can beexpectedtorise.

Thenewgovernmentisworkingincloseto‘astateofwar’,having todeal simultaneouslywitha fallingnationalcurrencyandrisingtradedeficit,theeurozonecrisis,airlines’hugelossesfollowingthevolcaniceruptioninIceland,thepersonnelstrikeatBritishairways,andBP’sstrickenoilwellintheGulfofMexico.and the listdoesnotendhere.Goodnews suchas the latestreportsfromBTandSainsburyannouncingprofitsforthe2009financialyeararestillintheminority.

премьерН.Чемберлен.Возглавивкоалиционноеправи­тельство,У.ЧерчилльповелстранувБитвузаБританию,а спустя пять лет – привел ее к победе во II мировойвойне. История свидетельствует о безусловном успехеэтогокризисногокабинета,всоставкотороговходил,вчастности,лидерЛейбористскойпартииКлементЭттли.

Вмае2010годапремьер­министромВеликобританиистал Дэвид Кэмерон – лидер Консервативной партии,победившейнавсеобщихвыборах.Каки70летназад,сформированокоалиционноеправительство.Егозадача–возродитьбританскуюэкономику,иизустнынешнегопремьера,демонстрирующегоготовностькборьбе,впол­неможетпрозвучатьзнаменитаяфразаУ.Черчилля:«Мненечегопредложитьвам,кромекрови,пота,тяжкоготрудаи слез». Станет ли эффективным кабинет Кэмерона–Клегга,насколькоуспешнымокажетсяпарадоксальныйальянсконсерваторовилиберал­демократов–покажетвремя.Такилииначе, этокоалиционноеправительствовыглядит наиболее перспективным проектом, способ­нымвернутьустойчивость«подвешенномупарламенту»,избранномуподданнымиЕеВеличества.

Впечатлилаи самаизбирательнаякампания:неожи­даннодляэкспертовбылапреодоленаполитическаяапа­тия.Действительно,первыевисторииВеликобританиителедебатытрехлидероввызваливсплескпассионарнос­ти, «разочарованныйизбиратель»вернулсявполитику.Дебатызажглизвездулидералиберал­демократовНикаКлегга, а толпынеуспевшихпроголосоватьвозмущен­ныхграждан–однозначныйпризнакуспехакампании.Вообще,кампанияосвещаласьпо­британскидобротно.Онастала,действительно,высокотехнологичнойи«теле­визионной»: средства массовой информации сделалиполитическийпроцессзахватывающейдрамой.

В итоге, пока британцы отдали предпочтение тра­диционнымценностям:фракцииконсерваторовилей­бористовостаютсякрупнейшими.В условиях текущихпотрясенийгражданеВеликобританиинеготовыкпред­ложеннойКлеггомнемедленной«перестройке».Компро­миссныйвариантреферендумапо вопросу о реформеизбирательнойсистемы,выработанныйкоалиционнымправительством,выглядитнаиболеездраво.

Общеевпечатление:itwascricket.Игрокисыгралипоправиламотначаладоконца,иэтотзатяжнойматчполу­чилсякрасивым.Икампания,идебаты,иночьвыборов,

иготовностьлидеровидтинакомпромиссипреодолетьполитический кризис – смотрелись достойно. ГордонБраунушелсчестью,инаперспективукоалиционногоправительствасмотрюсоптимизмом:изРоссии,искрен­неболеюзачестнуюигру.

Объективно, у нового двухпартийного кабинета– мощнейший потенциал: талант, энергия и амбицииД.Кэмерона,Н.Клегга,министрафинансовДж.ОсборнауравновешиваютсяопытоммаститыхУ.Хейга,В.Кейбла,Л.Фокса, К.Кларка,И. Дункана Смита. Теперь командадолжнасыграться.Примечательно,чтовопросыразвитиябизнеса в коалиционномкабинетепоручены главномуэкономистулиберал­демократовВинсуКейблу.Вообще,либерал­демократыстоятзаснижениеналогов–преждевсегодлямалоимущих.Ноприэтомясно,чтоглавнымвопросомявляетсясокращениебюджетногодефицита,ибезувеличенияналоговойбазынеобойтись.Такимобра­зом, в первую очередь, правительство пересматриваетрасходы,аповышатьналогибудетвкачествепоследнеймеры–ведьэтоскажетсянаростеэкономики.

25мая2010года,выступаявбританскомпарламентестроннойречью,королеваЕлизаветаIIподтвердила:пер­воочереднойприоритетееправительства–сокращениебюджетного дефицита. Сегодня он составляет 12% отВВП(£163,4миллиарда,рекордныйдефицитвЕвросою­зе).В50­дневныйсрокправительстворассчитываетпод­готовить«кризисныйбюджет»на2010года,предусмот­рев снижение государственных ассигнований на £6,25миллиарда (приэтомот сокращенийне гарантировананиодна сфера, в томчисле бюджетОлимпиады­2012).Втожевремя,уровеньбезработицывВеликобританиидостиг8%(2,51миллионачеловек),иочевидно,чтонафоне бюджетных сокращений в 2010–2011 гг. ее ростпродолжится.

Новоеправительстводействует«вусловиях,прибли­женныхкбоевым».Экономика страны–в зонериска:падениекурсанациональнойвалютынафонеростатор­говогодефицита, кризис еврозоны, гигантские убыткиавиакомпаний из­за извержения вулкана в Исландии,забастовкиперсоналаBritishairways,техногеннаякатаст­рофаBPвМексиканскомзаливе–лишьвнешниештри­хи.Хорошихновостей–таких,какотчетыBTиSainsburyоприбылиза2009финансовыйгод–покаменьше.

Сучетомвсехфакторов,вдвустороннихотношени­яхименнобизнесдолженвыйтинапервыйплан:Россияпо­прежнемузаинтересованавбританскихинвестициях.Торгово­экономические связи продолжат укрепляться,создаваяусловиядляполитической«перезагрузки».

A­nyvisitortoEnglandfromlateMayonwardswouldhaveto be pretty thick­skinned not to appreciate thatsomethingbigisshortlyhappeninginvolvingourcount­ry.Shopwindowsaredecoratedinredandwhite;many

advertisementsonhugebillboardshaveafootballtheme;andthenumberofcarsdrivingaroundflyingtheflagoftheCrossofStGeorgeincreaseseveryday.

Theseareall,ofcourse,signsthatonceagainweareonthevergeofThe Greatest Show on Earth–the(football,forthosewhostilldon’tknow)WorldCup!WithallduerespecttothosewhoreligiouslyfollowtheOlympicGameseveryfouryears,thereisnoothereventonthisplanetwhichsostirsthepassions,excitesthesoulandtearsatthenervesasmuchastheWorldCupdoes.There’llbejoy,tearsand,foronenationon11July,avictoriousstreetpartywhichwilllastfordaysafterwards.

Forpersonalandprofessionalreasons,IamverydisappointedthatRussiafailedtoreachthisyear’sFinals.IknowthatmanyofmyRussian friendswouldhavebeenasexcitedas Iamabout

рекламныхщитовпосвященофутбольнойтеме,аколи­чество машин, на которых развевается флаг СвятогоГеоргия,растетскаждымднем.

Всеэто,конечно,признакиприближающегосяВеличай-шего шоу на Земле –Чемпионатамирапофутболу(есликто­тоещеневкурсе)!Привсемуваженииктем,ктопри­стальноследитзаОлимпиадойкаждые4года,нетдругогособытиянапланете,котороетакбудоражитсердцеидушуитактерзаетнервы,какЧемпионатмира.Будутрадость,слезыи11июляпобедноеликованиенаулицаходнойизстран,котороепродлитсянеодиндень.

По личнымипрофессиональнымпричинамя оченьразочарован,чтоРоссиянедобраласьдофинала.Язнаю,чтомногиеизмоихрусскихдрузейбылибытакжерады,какиярадучастиюАнглии,увидеть,какихгероибудутста­ратьсяпревзойтидостижениякомандыРоссиинаЕвропей­скомчемпионатев2008году.ИкакиеинтересныевечерниемероприятияможнобылобыустроитьвЛондоне,МосквеилиСанкт­Петербурге, еслибывденьоткрытиянашегоБизнес­форумавЛондоне23июняАнглияигралабысРос­сией,анеСловенией(невобидуСловении)!

Каквидно,рольспорта–иособенноЧемпионатамира–великаидлябизнесаидляразвлечения.Спорт,какибиз­нес,можетобъединятьлюдей,сохраняяприэтомэлементсоперничестваиконкуренциидляинтриги.Вскорепослемоегоназначениянадолжностьисполнительногодирек­торав2007годумыпровеливечерниемероприятиявЛон­доне,которыесовпадалисдвумяиграмивквалификаци­онномтурниредляЕвро­2008междуАнглиейиРоссией.Врезультатебалансбылсохранен(Англиявыигралапервуюигру,Россия–вторую),агостивечерасмоглиустановитьполезныебизнес­контактывприятнойатмосфере.

Жаль,чтоэтотЧемпионатпройдетбезпротивоборс­тваАнглиииРоссии.Хотяяуверен,чтодажебезучастияРоссиироссийскиефанатыбудуттакжесильнововлеченывходЧемпионата,какиболельщикистран­участниц.Безсомнения,они,такжекакия,будутстроитьпредположенияоходесоревнования.

Мое сердце, конечно, говорит, что Англия выиграет,победивИспаниювфинале.Ноеслипопытатьсяподойтиквопросуобъективно(чтооченьсложно)идопустить,чтоАнглиявыйдетизигрыгде­топоходучемпионата,тогда,ядумаю,возможенфиналБразилия­Испания,вкоторомпобедитИспания.Каковыбынибыливашипредположе­нияопобедителеЧемпионатамира2010года,янадеюсь,вампонравитсяэтовеликоешоуи…ВПЕРЕД,АНГЛИЯ!

England’sparticipationtoseetheirheroestrytogoevenbetterthantheRussianteam’sexcellentperformanceintheEuropeanChampionshipsin2008.andthinkwhatagreatopportunityitwouldhavebeenfornetworkingeventsinLondon,MoscowandStPetersburgif,onthedayoftheopeningofourBusinessForuminLondon,23June,EnglandwereplayingRussia,notSlovenia(nooffencetoSlovenia)?

This is an illustration of the wider value of sport – andespeciallytheWorldCup–forbusinessaswellaspleasure.Sportis somethingwhich, like business, can bring people together,whilestillhavinganelementofcompetitionandrivalrytokeepthingsinteresting.ShortlyafterItookoverasExecutiveDirectorin2007,weheldnetworkingevenings inLondon tocoincidewiththetwogamesinthequalifyingtournamentforEuro2008betweenEnglandandRussia.Honourswereeven(Englandwonthefirstgame,Russiathesecond)andsomeveryusefulbusinesscontactsweremadeinaveryconvivialatmosphere.

Soit’sapitythatwewon’tbehavingarepeatofEnglandVRussiaat thisWorldCup. I’msure though, thatevenwithoutRussia’sparticipationfootballfansinRussiawillbedrawnintothe spectacle of theWorld Cup as intensely as those whosecountriesareinvolved.Nodoubt,too,RussianfanswilldoasIhavedoneandgothroughthedrawmakingtheirpredictionsastowhatwillhappen.

So...myheart,ofcourse,saysthatEnglandwillwin,beatingSpainintheFinal.ButifItrytotakeadispassionateapproach(verydifficult)andassumethatEnglandfall somewherealongtheway,thenI’llgoforafinalbetweenBrazilandSpain,whichSpainwillwin.WhoeveryouthinkwillwintheWorldCupIhopeyouenjoythisgreatspectacle...andCOMEONENGLaND!

Itis interesting towatchnaturaldisastersunfoldontheTVscreenfromthesafetyofone’slivingroom.Butifyou’restuckinanairportwithoutyourbelongingsor the slightest ideaofwhenyou’llactuallymakeithomeyouinevitablystart to

reflectonthereal impact thatnaturalphenomena,evensuchrareoccurrencesasvolcaniceruptions,haveonourlives.

TheEyjafjallajakullvolcanohasgone fromjustbeinganodd­soundingnametosymbolising thecollapseofEurope’s transportsystem,costingtheglobaleconomy$2billionincompanylosses,andthesuddenrealisationthatnooneshouldexpect‘mercyfromnature’,asRussianagricultureselectionspecialistMichurinputit.Eveninthetwenty­firstcenturynaturestillhasthefinalword.Suddenly,airtravel,adailyrealityformanypeopleinthebusinessworld,hasbecomelessreliable.

The volcano has quietened down now, but for how long?Modernlifemovesataneverfasterpaceandpeoplearetravellingaroundtheworldinincreasingnumbers.Whatwillwedowithoutaccesstothefastestmeansoftransport?atleastfromBritainonecantaketheEurostarortheferryfromDovertoCalaisandjoin

Причудливое сочетание звуков «Эйяфьятлайокудль»означаеттранспортныйколлапс,$2миллиардовпотерьдлямировой экономики и внезапное осознание того, что насамомделе«нестоитждатьмилостейотприроды»,какгово­рилрусскийселекционерИ.В.Мичурин, таккакдажев21векепоследнеесловоиногдаостаетсязаней.Этозначит,чтовоздушноесообщение–ежедневнаяпрактикадлямногихвмиребизнеса–сталоменеенадежнымибезопасным.

Сегоднявулканзатих,нонадолголи?Темпсовременнойжизнирастет,людибольшеперемещаютсяпомиру.Какбыть,еслисамыйбыстрыйвидтранспортавдругстановитсянедо­ступным?Скажем,изВеликобританиипоездомEurostarподпроливомЛа­Маншили, например, напаромеотДувра доКалеможнодобратьсянаматериковуюЕвропу,гдеотличнофункционируетгустаясетьжелезныхиавтомобильныхдорог.

Merger­and­acquisition (M&a)activity in theglobal tech­nologysectorcontinuedtoincreaseinQ12010evenasbig­ticket technologydealswereputonhold, according to themost recent quarterly technologyM&a report byErnst&Young.The report alsohighlights conditions that indicatesignificantgrowth in technologyM&aactivity for the restof 2010.GlobalTechnologyM&aUpdate, January­March2010,showsthatdealactivitycontinueditsupwardtrendforthe fourth consecutive quarter,with 628 announceddealscomparedto553dealsinQ42009—a14%increase.How­ever,Q12010totaldealvalueandaveragedealvaluedroppedsharply comparedwithQ42009 (total valueof dealswithdisclosedvaluesdeclinedby66%to$12.1billionfrom$35.4billioninQ42009).InQ12010,onlytwodealswereaboveone billiondollars, (one corporate andoneprivate equitydeal) compared tonone for the sameperiod last year (Q12009) and seven in the last quarter (Q4 2009). The lowerhouseof theRussianparliament, theStateDuma,has been considering amendments to a bill on easing entryandworkpermitproceduresforhighly­qualifiedprofessionals.TheRussianEconomicsMinistrywasquotedassayingthatthebillisapartofaprogramtoimprovethecountry'sinvestmentclimate.Themodernisationof thecountry's economy isoneof thekeypolicies initiatedby theRussianPresident,DmitryMedvedev. Under the new amendments, foreign specialistswouldhave the right towork inRussia regardlessofFederalMigrationService (FMS)quotas. Inorder to receivea three­yearworkpermittheywillonlyneedconfirmationfromtheiremployer of their position.Theworkpermit could thenbeextended every three years,whereas they are currently validforonlyoneyear.Underthebill,ahighly­skilledprofessionalis consideredapersonwho receives a salaryofno less thantwomillionroubles($67,000)ayear.Togetherwith theworkpermits,foreignspecialistsandtheirfamilieswouldalsoreceiveresidencypermits.Highly­skilledspecialistswouldpay13%tax,therateforRussians,insteadofthecurrent30%forforeignerswhoarenot tax residents.Russiancompanieshave said theywelcometheproposedchanges.However,accordingtotheCEOoftheleadingRussianmobileretailer,Euroset,alexanderMalis,thetwomillionwagerateistoohigh,giventhatitispossibletofindgoodspecialistsabroadfor1.5millionroublesayear.FMSspokesmanKonstantinPoltoranindeniedthattheamendmentstothemigrationlawweredirectlyconnectedwithRussia'snewhigh­tech research andproduction centre in Skolkovo, nearMoscow(formoredetailsseepage38).

Russia's­Reserve­Fund­Shrinks­Threefold­Year­on­Year­Russia's Reserve Fund, set up at the start of 2004 as theStabilisationFundtoaccruewindfallrevenuesfromoilexports,shrank 67% as of 1May 2010 year­on­year, to 1.19 trillionroubles ($40.6billion).TheRussiangovernment is stillusingthe Reserve Fund to cover its budget deficit. Inapril 2010alone,350billionroubles($11.9billion)werespent fromthefund. Pilot­Programme­to­Refinance­Consumer­Loans­Issued­by­Other­Banks­

VTB24has launchedapilotprograminsixcities torefinanceconsumerloansissuedbyotherbanks.ItisthefirsttimeVTB24hasissuedsuchloans.Thepilotprogramisscheduledtocontinueforthreemonths,attheendofwhichthedemandfortheservicewill be assessed. The project was launched simultaneously inKrasnodar,NizhnyNovgorod,Irkutsk,Krasnoyarsk,TyumenandNovosibirsk. Sergey, what are the origins of Transy ?It’s aRussian company,whichwas established in the1990s.TheBalticShippingCompanyhadceasedtoexist,andTransywasoneofmanyprivate forwardingcompanieswhichwereopened at that time.With the state monopoly on freightforwardinggone,itwasseenasagoodchancetostartbusinessinthisarea.

Do many of the companies formed then still exist?No, very few of those companies are still around due tochanging economic conditions. Ports are strategic areas,becausetheydealwithcountrytocountrycontacts,soastheRussian governmenthasnow taken a tighter gripover thecountry’s strategic resources, it follows that there shouldbegreatergovernmentcontroloftheports.Idon’thaveaproblemwith that.Theproblem is thatRussianportshave a limitedcapacity.There’s simplynot enough space for everyone.Forexample,StPetersburghasfewerthan100berthsforships.Toputthatinperspective,theportofantwerp­oneofEurope’sprincipalports–has1724berths.It’sjustoneindicationofthecurrentstateoftheinfrastructure.

But despite these difficulties, is Transy still surviving? Or is it thriving even?

Well, we’re certainly not thriving at present, but we aresurvivingbecausewe’redoingeverythingtowork.Wecan’tsaynotocargo.Wehadagoodstartinthe1990s.aftertheBalticShippingCompanyfoldedtherewasashortageofvessels.Westarted toprovide a feeder conventional service toantwerpand Rotterdam, another of Europe’smain ports, shippingprojectcargo,steelandnon­ferrousmetals,andfromtherewewereabletoprovideaservicearoundtheworld.Inthelate‘90swehadabigbreakthroughwhenweactedastheagentfortheUShumanitarianaidprogrammetoRussia.Thenwemovedontobiggerprojects.Weorganisedthemultimodaldeliveryofmagnetparts for theCERNProject–TheLargeHadronCollider inSwitzerland. Suddenlywewere in theworldofnuclearandhydro­electricpowerstations,miningandcementplants,breweriesandgasturbineswhichweshippedallaroundtheworld.

Eventually we became the only transport companyin Russia granted a licence by the Federal Space agency,Roskosmos, toperform“spaceactivities”as the sole shipperoftheSoyuz­STLaunchingComplex.IntheoryIsupposewecoulddevelopourownrocketsorlaunchaspacemissionbutwehaven’tgonedownthatroadyet!Wemadetheshippingofbig,moveableobjectsour stock­in­trade.Russiahas lotsofagreementswithformerThirdWorldcountries,and,eventhoughwe’reincompetitionwithFrance,Germany,theUSaandothers,thosecountriesstilllikeus.

The recent grounding of aircraft in Europe, thanks to the cloud of volcanic ash from Iceland, underlined the importance of the transport of cargo by sea. But maritime transport has long been a problem for Russia, due to the lack of ice-free ports around the country. And it’s not just the climate that causes problems for Russian shipping. The lack of infrastructure and the small size of the ports; the control of the ports; even the fact that Russia’s railway operates on a different gauge from the rest of Europe all contribute to a difficult situation for bringing goods into and out of Russia. Transy Ltd UK is a St Petersburg-based company which faces these questions every day.

Is that part of the Soviet legacy?Yes.TheadvantagewhichwehaveisthatpeoplefromIndia,China, Latinamerica and other countries studied in theUSSR. They like Russia.also, theamericans rarely knowhowtodobusiness inRussia,althoughtheFrenchandtheGermansdo.

But if the ports are not easy to use in Russia, couldn’t many goods be shipped across Russia via land routes?Intheory,it’sagoodideatoshipgoodsacrossRussia,ratherthangoingbysea,butinpracticeit’saslowprocessandyoucomeupagainst a lotofbureaucracy.The lackof seaportsinRussia is a problem,but even ifwehadmoreports,westill couldn’t competewithRotterdam,antwerp,BremenorHamburg. It’ll bemany years beforeRussianports such asarkhangelsk,Murmansk,Novorossisk,Nakhodka,VladivostokorUstj­Lugacomeanywhereclosetothis.Someonewillneedtopayforitall!

So is the basic problem one of a lack of investment in infrastructure?Yes;alackofinvestmentandalackofspacewheretheportsarelocated.TheportinStPetersburgissurroundedbyresidentialareas,sothere’snoroomforexpansion.Itwouldbegreat ifinvestment couldbe targeted atUst­Luga to create a superport there. Manycompaniesare sufferingasa resultof thewaythingsarenow.

Transy’s survived, though, for many years. How do you compare the position now with, say, ten years ago?Thetransportbusinessismoredifficultnowthanitwastenyearsago.andthisisreflectedinthegeneraleconomy.Russianeedsmodernequipment,buttoimportheavy­liftsoroutofgaugecargoesyouhavetopayalotofmoneyandfacealotofdifficulties.Despitethis,there’sagoodandreliablecontainerservicebetween theUKandRussia. It’s a real challenge forfreight forwarding companies suchasTransy tokeep it thisway.actually,inonesenseTransyexistsbecausetherearesuchdifficulties.IfeverythingwasdonethewayitisinantwerporRotterdam–whereloadsareclearedinfiveminutes–there’dbenoneedforus.

You mentioned that you ship for the space agency, and that you specialise in shipping big items. How did this come about?asIsaid,aftertheBalticShippingCompanywentbankrupttherewas a gap to fill.We successfully chartered shipsuntilwewere in aposition tobuyourown, andall the timeweworkedonestablishinggoodcontacts.Weearnedourselvesagoodname,andthathelpedustoobtaintherightlicencestowork.Objectsdon’tcomemuchbiggerthanrocketlaunchers,so itwasnatural to specialise in shipping largeobjects.WenowworkinmostRussianportsandhaverepresentationinBelgium,Germany,China,India,theUK,theUS,UkraineandWestafrica.

That’s quite impressive expansion, given the problems you’ve already described. Does it suggest that the future looks promising?

That all depends on howRussian heavy industry does.atpresent,itlookstobeinprettygoodshape,andwe’vecurrentlygotquiteafewmorecontractslinedup.

And how many ships do you have, or have access to?Werunabout200sailingsayeartoandfromStPetersburg;butthisisn’tjustwithourownships.Wechartervessels,too.

So how would you sum up the freight transport position in Russia at present?Itdoesn’tmatterwhere you look–Vladivostok,Nakhodka,arkhangelskor StPetersburg– there are similarproblems.The outdated infrastructure and the lack of ice­free portsbeing themainones.as for land transport, the railwaysaretheonlyreliablemeansoftransporttoreachtheverydistantdestinations. The road infrastructure inRussianeedshugeimprovement, although this does seem tobehappening incertainregions.

But surely rivers are a reliable source of transport in Russia?Yes,theriversystemisgood,downtheVolgatotheBlackSea,CaspianandazovSea,andtotheeastasfarasPermandUfa.Butit’sclosed–frozen–forsixmonthsoftheyear.YoucanuseitonlybetweenMayandOctober,anditdoestendtobevery congested and therefore slow. as for other transportissues:ExportsfromRussia,suchasrawmaterialsorthekindofbig loadswhichwemove, canbe transported easily; butimportingintoRussiaisstillhardandtransportisslow,partlyduetocustomsregulations.Thisisapity,becausethereisalotofdemandwithinRussiaforforeigngoods.Wehavetowaitandseewhatwillcomenext;butallthetimewe’retryingtoanticipate when things will improve, so that we’ll be wellpositionedtobenefitfromit.

Недавние отмены авиарейсов в Европе из-за облака вулканического пепла из Исландии под-черкнуло важность перевозки грузов по морю. Но морской транспорт – давняя проблема Рос-сии, так как в стране не хватает незамерзающих портов. И дело не только в климате. Сложная ситуация с доставкой грузов в Россию и вывозом из нее усугубляется недостаточной инфра-структурой и размером портов, контролем над ними и даже тем фактом, что российские желез-нодорожные пути отличаются по размеру от европейских. Компания «Транси» базируется в Санкт-Петербурге и сталкивается с этими проблемами ежедневно.

И все же «Транси» удалось выжить. Как бы вы сравнили ее положение сейчас и, скажем, 10 лет назад? Вести транспортныйбизнес сейчас сложнее, чем 10 летназад, и это отражается на экономике в целом. Россиинужно больше современного оборудования, но чтобыимпортировать тяжеловесные или неформатные грузынадоплатитьмногоденегистолкнутьсяскучейпроблем.Несмотрянаэто,междуРоссиейиВеликобританиейнала­женнадежныйконтейнерныйсервис.Иэтонелегкоуда­ется транспортно­экспедиционным компаниям, такимкак«Транси».На самомделе, вкаком­тосмысле«Тран­си»существует,благодарятакимтрудностям.Еслибывсеработалотак,каквРоттердамеилиАнтверпене,гдегрудыгрузовразбираютсяза5минут,мыбылибыненужны.

The slump in the automobile market in Russia thatcontinuedinthefirstquarterof2010caninmanywaysbe explained by the following factors: the supply ofdiscountedcarshasrunout;thereisanexpectationthat

stateprogrammeswillstarttowork;theeffectofhighdutieshasbeenextended;andthereisstillalowlevelofconsumerconfidence.On thewhole, though,we expect that 2010willbring a smalldropor evenmoderate growth in themarketcomparedwithlastyear.

The pessimistic scenario envisages a drop in sales byaround fiveper centwith a totalmarket volumeof around1.3millioncars,causedbytheeffectofsignificantdiscountscoming to an end.Theoptimistic scenario envisages a15%growthinsalesinquantitativeexpression,withatotalvolumeofsalesofaround1.6millionautomobiles.Byapril2010,thegrowthoftheRussianautomobilemarketwas20%comparedtotheequivalentperiodinthepreviousyear,whichconfirmsthepositivedynamicon themarket.This is related to statesupportoftheindustry,anincreaseinconsumerconfidence,and gradual stabilisation of the macro­economic system.However,themarketdynamicmaywellslowdownagainafterstateprogrammesceasetohaveeffect.

Stimulating demand by recycling old cars has becomecommon practice during a crisis; in an ordinary situationthere is no need for this scale of state support.One quiteeffectivetacticistoprovideassistancewhenthemarketisatitslowestlevel,andwithdrawthisassistancewhenthemarketis developing. International practice has shown that programmes forrecyclingoldcarsarequiteeffectiveforstimulatingdemand.InGermany,whichwas the first to start the experimentofrecycling,growth in sales reachedaround27%in2009,andwhentheprogrammewasended,salesin2010dropped.Thesame effect is expected in theUK. It shouldbenoted thatherenotonlythegovernment,butautomobilemanufacturersthemselveshavetakenonresponsibilitytorestoretheeconomy:ifthegovernmentgivesadiscountof£1,000,manufacturersmatchtheschemepoundforpound.IntheUSa,consumersacquiredaround700,000newautomobiles(around6.5%ofthemarket)under thestateprogramme.Thespecial featureoftheamericanprogrammeisthatheresignificantdiscounts(upto$4,500,000)weregiventopeoplebuyingecologically­friendlyautomobiles.

Against the background of the continuing crisis, unstable economy and ongoing threat to the world financial system, we have seen a major slump in the automobile industry both in Russia and in the world as a whole. The negative consequences of the global crisis for the Russian automobile market were among the most evident in the world in 2009, as the strong dependence on the import of automobiles and the previous significant growth of the market was replaced by a swift weakening of the rouble, increase of interest rates on loans and a drop in consumer confidence.

In Russia, the scheme of government support of theautomobile industry began working only in March, butdespitecertaindelaysinitsrealisation,currentstatemeasurestostimulatetheautomobilemarket(therecyclingprogrammeand subsidised loans) draws considerable interest fromconsumers, and makes a significant contribution to theshort­termdevelopmentofthemarket.accordingtothenewprogramme,ownersofcarsmorethantenyearsoldreceivedthe right to exchange for a certificate for 50,000 roubles,whichcouldbeusedtopayforpartofthecostofanewcarmanufacturedinRussia(includingforeigncarsmanufacturedin Russia). For these purposes, the Russian governmentallocatedaroundtenbillionroubles.Iftheconsumerreceives50,000roublesforeacholdcar,thismeansthattheschemecansupporttherecyclingofover200,000cars.

ThevastmajorityofRussianregionsaretakinganactivepart in the recycling programme. Over the two monthsthat the recycling programme has been in effect, 118,000certificateshavebeenissued,butaround38,000carshavebeensoldwiththem.TheMinistryofTradeandIndustryintendstoslowdowntheratesofissuingcertificatesbecauseofthis.aVTOVaZ dealers alone have already taken over 150,000applicationsinthefirsttwomonthsthattheprogrammehas

beenineffect.Intotal,Russianbrandsaccountforaround82%ofthecarssoldundertherecyclingprogramme,andthevastmajorityareaVTOVaZcars.TheRussiangovernmenthasnotyetannouncedplanstoextendorexpandtheprogrammeofrecyclinglightvehicles.Whentheprogrammeisstopped,thismayhaveanegativeeffectonthemarketsituation,butthisisallaquestionofactingattherighttime:theprogrammewillfulfil itskeyfunctionifatthemomentit isstopped,marketmechanismsbegin toworkwhichwill allow themarket tostarttherecoveryprocess.

WestillbelievethattheRussianautomobilemarkethasconsiderable potential for development in the long­term.However, the path to this long­termgoal is unlikely to besmoothandeven,giventhestrongdependenceoftheRussianeconomy on the world economy. In the short­termperspective, there will still be some uncertainty on themarket,inrelationtosuchfactorsasexchangerates,thelevelof trust among consumers and interest rates.at the sametime, in the medium­term perspective, the Russianautomobile market, which has a sufficiently developedinfrastructureofdealer chains and logistics,may relativelysoon“convert”generaleconomicgrowthintoaswiftrecoveryoftheautomobilemarket.

На фоне неотступающего кризиса, нестабильной экономики и сохраняющейся угрозы мировой финансовой системе мы наблюдали масштабный спад в автомобильной отрасли как в России, так и по миру в целом. Негативные последствия глобального кризиса для российского автомо-бильного рынка оказались одними из самых заметных в мире в 2009 году, поскольку сильная зависимость от импорта автомобилей и предшествующий существенный рост рынка сменился быстрым ослаблением рубля, увеличением процентных ставок по кредитам и падением пот-ребительской уверенности.

П­родолжившеесяв1­омквартале2010годападениеавтомобильногорынкаРоссииобъясняетсявомно­гомисчерпаниемзапасовмашин,продававшихсясоскидками,ожиданиемначаладействиягосударс­

politicalhistory.Butwhile thepoliticianswere focusedonadebate which could influence the outcome of the Election,British airlines had their minds elsewhere.Thatmorning, the aviation authorities took thedecision tocloseUKairspaceinitsentirety.EveryairportfromnorthernScotlandtothecornerofsouthernEngland,andincludingthewholeofNorthernIrelandandIreland,wasclosedwith littlewarning.

UKairspacewasclosed for sixwholedaysbecauseof theeruptionof the Icelandicvolcano,Eyjafjallajokull.Plumesofashwerebillowingthousandsofmetresintothesky,affectingflightstoandfromtheUKandhundredsofotherdestinations.Itwasaphenomenon the likeofwhichhadneverbeen seenbefore, andwas to test thecrisisplansofairlines likeBritishMidlandInternational(bmi)onagreaterscalethaneventhetragedyof9/11hadnearlyadecadeago.

It alsoprovidedrefundstocustomerswhoseflightswerecancelledoroffered the option of rebooking for travel at a later date.Seventyfivepercentofbmi'sinternationalscheduleoperatedonWednesday21april,thefirstfulldayofUKairspacebeingre­opened.Crucially,bmioperateditsentireinternationalflightprogramme,includingtoandfromMoscow.Itwasanall­roundlogisticalsuccessachievedbymanybmistaffmembersworkingtirelesslythroughthenighttore­bookpassengers,trackdowncustomerswhose flightshadbeen cancelled in thepreviousdaysandprovideaconstantstreamofupdatestocustomersviaTwitter,Facebookandthecompanywebsite.

Overthe75yearsoftheMoscowmetro’sexistencemanyofitsstationshavebeennamedafterfriendlycitiesnearandfar.Paradoxically,notoneofthesestationsbearsanamehonouring the countries and cities whose experience

playedabigpartinbuildingtheRussiancapital’smetrosystem.There isnostationhonouringBerlin,Paris (though theParismetro has a stationnamed Stalingrad) or London. Itwas inLondonthatthefirstmetroline,3.6kminlength,wasopenedin1863,markingthestartofaneweraintransporthistoryandinpeople’s daily lives. Soviet developers borrowed the Londonmodel when they began building a rapid transit system inMoscowmorethanfiftyyearslater,althoughthefirstplansfora“high­speedundergroundelectricrailway”hadbeenputforwardin tsaristRussia.Thoseoriginalplanswere thwartedby tramoperators,theclergy,interestsofMoscowcityofficialsthathadnotbeentakenintoaccount,andfinally,therevolutionsoftheearlytwentiethcentury.Thebestengineers,architectsandartists,nottomentionanarmyofvolunteerswereputtoworkonthe

grandiosemetroconstructionproject thatbegan in the1930s.TheMoscowmetrowasbuiltasahymntoSovietideology,anopulentmonument toanentirenation’s toil,andalsoahugedefence installation. In the midst of celebrating the 65thanniversaryoftheendofWorldWarII,itisfittingtolookbackontheimmenseimportanceassumedbythemetroduringthosedifficultdaysinLondonandMoscow.

ThestartofGermanairraidsinBritaingaveLondon’smetrostrategicimportance.Itservedasanairraidshelterforordinarypeopleandtopgovernmentofficials,andmuchofthecountry’slifewas run fromtheunderground.TheDownStreet stationonthePiccadillyline,closedin1932,gainednewlifein1939asa shelter for theEmergencyRailwayCommittee,andWinstonChurchillheldseveralcabinetmeetingsinthestationintheearlydaysofthewar.Hewassaidtolikethestation,asitwastheonlyplacewherehecouldsleep inpeaceandquiet.TheBromptonRoadstationbetweentheKnightsbridgeandSouthKensingtonstations fulfilled a similar purpose. It had not served as ametrostationsince1934,andduringthewaryearsbecametheoperationscentrefortheDefenceMinistry’sLondonairdefenceheadquarters.Neitherstationisinusetoday.Fromtheoutside,theonlysignof theirexistence isbrick insets in thewalls.Butrightupuntil2000, theLondonTransportMuseumorganisedvisitstotheseandotherclosedstations,manyofwhichstillhouseobjectsandequipmentfrommorethanfiftyyearsago.

The Soviet authorities had an inkling that war wasapproaching,andin1937combinedconstructionofMoscow’smetrowithconstructionofabunkernotfarfromtheKirovskaya(nowChistiyePrudy)metrostation.Thebunker, locateddeepunderground, was intended to serve as the headquarters forMoscow’s air defences. Thearmed ForcesGeneral Staff andStalin’smilitaryheadquarters tookover fulluseof the facilityfromthestartof thewar.Bunkers forStalinwerealsobuiltatKuntsevoandnext to thePartizanskayametro station,where

themiddletrackthatexiststothisdaycouldbeusedasaspecialtrackforStalin.Thesecrettunnelsbuiltbackthenlaidthestartofthesystemknownas‘Metro­2’–asecretnetworkduplicatingthemainmetrosystemandreservedforgovernmentuse.This‘Metro­2’,saidtolinkMoscow’smaingovernmentbuildingstothetransportnetwork,hasbecomearichsourceforlegendsandrumours.

ButthereisnothingmadeupabouttheairraidsthatolderMuscovitesremember,whichforatimeturnedthemetrointoasecondhome.Thefirstrealairraidhappenedon22July1941,amonthafter theNazis invadedtheSovietUnion.Bombshitthecity’smainwatersupplypipelinesbetweenthearbatskayaandSmolenskayametrostations,andonthesquareinfrontofBelorusskyRailwayStation,floodingundergroundinstallations.Metroworkersmadeheroiceffortstoevacuateallthepeopleandcleanupthedamage.

Bytheendof1941,themetrowasrunningonlyuntil6p.m.andstationplatformswereequipped toreceivepeople takingshelterinthestationsduringairraidalerts.Womenandchildrenwereallowed toenter the sheltersas soonas theywere ready.Wartime life tookover.Thestationswere fittedwithdrinkingfountains, toiletsandother facilitiesneeded forhandlingsuchlargenumbersofpeople.Medicalcentres,shopsandhairdressersstartedworkunderground,andtheKurskayametrostationevenhadalibrary.Duringtheairraidalerts,150littleMuscoviteswereborninmetrostations.afterthefirstNaziairraidinJuly1941,plansweredrawnuptoevacuatetopgovernmentofficialsfromMoscow,blowupthecity’smainindustrialfacilitiesandfloodthemetroiftheenemymanagedtocapturethecapital.WiththeNazisclosingin,equipmentwasdismantledinahurryonthenightof16October,andpanicsweptthecity,butStalindecidednottogoaheadwiththeplanstofloodthemetro.Themetroresumedoperation andprovided shelter to hundreds of thousands ofMuscovitesandpeoplefromotherpartsofthecountry.

Balhamstationon theLondonmetro’sNorthern linealsoservedasoneofthecity’snumerousairraidsheltersduringthewar.On14October1940,thestationwasfloodedforrealwhenabombbrokethroughtheroadsurfaceandhitthewatersupplylinesabovethetunnel.Watersurgedintotheshelter,killingmorethan60of theapproximately100peoplesheltering there.ThetragedyfiguresinIanMcEwan’snovelatonement,andinthefilmofthesamename,inwhichtheheroinediesintheevent.

ButLondon’smetrowasnot immediatelyusedfordefencepurposes.Thecityauthoritiesopposedtheideaatfirst,butthenallowedthestationstobefittedouttoreceiveupto8000peopleeach.TheBethnalGreen station,whichgained sadnotoriety,longservedasashelteronanunofficialbasisandwasnotfullyfittedoutforthepurpose.Whentheairraidsirenswentoffon13March1943,peoplebeganmaking theirway to thestationentrancetotakeshelterunderground.atthesoundofapowerfulexplosion,theydidnotrealisethatwhattheyhadheardwasthesoundofairdefencesbeing tested. Instead theypanicked,and172peoplewerekilledintheresultingcrush–thebiggestciviliantragedyofthewaryearsinLondon.

Thesearejustafewepisodesinthemetrosystem’swartimehistory.Themetroservedaninestimablyimportantroleduringthe war, and even after returning to its everyday peacetimeoperationsitremainsasymbolofmilitaryandciviliancourageanddedicationinbothcapitals.

What’s­New­in­Russian­Migration­Legislation:­­Hope­and­Disappointment

The­Highly­Qualified­Foreign­SpecialistTheLawsinglesoutanddefinesaspecialcategoryofforeignemployee­ thehighlyqualifiedforeignspecialist­ themaincriterion for entering this‘highlyqualified’ bandbeing thesizeofthesalarythespecialistreceivesinRussia(atleasttwomillionroublesperyear).Beyondthis,employersthemselvesmustassessthequalificationsandcompetencyofanypotentialforeignspecialistemployee.

­TheLaw limits the list of entities that canhirehighlyqualifiedforeignspecialists.Thislistincludes:

­Russiancommercialorganisations;­Russianscientificorganisations;­Professionaleducationinstitutions(exceptforinstitu­

tions engaged in professional religious education(seminaries));

­Healthcareinstitutions;­Otherorganisationsengagedinscientific,technicaland

innovativeactivities,experimentaldevelopment,tests,trainingofpersonnelinaccordancewithstateprioritiesindevelopingthescientificandtechnologicalbaseoftheRussianFederation,incaseswherestateaccreditationisrequiredbylaw;

­Branchofficesofdulyaccreditedforeignlegalentities.Representative offices of foreign legal entities, non­

commercialorganisationsandreligiousorganisationsarenotincludedinthislist.

For those who are defined as highly qualified foreignspecialiststheLawestablishesapreferentialworkpermitandworkvisaregime.Toobtainworkpermitsforsuchspecialiststheiremployersarenotrequiredto:

­obtainaquotaforworkpermits;­registervacancieswiththeemploymentauthorities;­obtainpermissiontohireforeigners.Inpracticethismeansthatanemployerwishingtohirea

highlyqualifiedforeignspecialistmustsimplyfiletherequired

documents directly with the FederalMigration Service. aworkpermitforahighlyqualifiedforeignspecialistmayrunforthreeyears,withthepossibilityofrepeatedextensionsforaslongasthespecialisthasavalidemploymentcontract.SuchaworkpermitmaybevalidforanumberofmemberentitiesoftheRussianFederation.

Correspondingly, if aworkpermit is issued that allowsthe bearer to work in several RF subjects, the restrictionsregardingthelengthofbusinesstripsinsideRussia(atpresent10or60daysperyeardependingonthenatureoftheforeignemployee’swork)willnotextendtosuchspecialists.

Theother important change is that aworkpermit for ahighlyqualified foreign specialistwill constitute abasis forobtaining a permanent RF residency permit, both for thespecialistandforthemembersofhisorherfamily.Thatsaid,the residency permit will be issued only at the specialist’srequest.

However, along with the above privileges, the Lawestablishes several conditions for employers hiring suchspecialists. For instance, the employermust not have beenpenalised for illegallyhiring foreigncitizens in theprevioustwoyears.

Inaddition,employersmustprovidetheFederalMigrationServicewith confirmation that thehighlyqualified foreignspecialisthasbeenregisteredwiththetaxauthoritieswithin30daysofobtainingaworkpermitandalso(onaquarterlybasis)thatsalarypaymentshavebeenmadetosaidspecialist.The Federal Migration Service must also be informed ifemploymentandcivillawcontractswithaspecialisthavebeenterminatedorifheorshehasbeenprovidedwithlong­termunpaidleave.

Furthermore, ifanemployer isguiltyofnot fulfilling itsobligationsunder a contractwith ahighlyqualified foreignspecialist, theywill beunable to engage such specialists fortwoyears.Withallthisinmind,employerswillneedtostudyclosely the contracts they enter into with highly qualifiedforeignspecialists.

Changes to Russian migration legislation have long been anticipated. For years the business community has found the migration rules governing foreigners working in Russia to be unduly complicated and bureaucratic, and this has substantially spoiled the investment climate in the country. At last, on 21 May 2010, Rossiyskaya Gazeta published RF Federal Law No. 86-FZ dated 19 May 2010, “On Amending the Federal Law ‘On the Legal Status of Foreign Citizens’ and Other Legislative Acts of the Russian Federation.” Most of the amendments introduced by this law will enter into force on 1 July 2010. Here we outline the most important changes made to the Federal Law “On the Legal Status of Foreign Citizens”1 (hereinafter the “Law”).

Thechangesreinforceexistingrulesonthelistofnon­quotaprofessionsandpositions.Nowthislistbecomespermanent.Ifnecessarytheregulatoryauthoritiesareauthorisedtoamendit;howeverchangesforthefollowingyearmustbeintroducedbefore31Marchofthecurrentyear.Thiswillallowemployersto choose under which procedure they will obtain workpermitsfortheirforeignemployees­thegeneralone,orthatforhighlyqualifiedspecialists.

Additions­to­the­List­of­Cases­where­Foreigners­Can­Be­Employed­Without­a­Permit­to­Hire­Foreigners­or­a­

Work­Permitaccreditedemployeesofrepresentativeofficesofforeignlegalentitieshavebeen added to this list.However, a stipulationhas been made that hiring employees of this category ispossibleonlyon thebasisof reciprocity inaccordancewithinternationaltreatiestowhichtheRFisaparty.

Itshouldbenotedthatatpresentthereareveryfewbilateralagreements and these, as a rule, are related to particularindustrialsectors.Therefore,inthenearfuturetheexceptionfor accredited employees of representative offices is hardlylikelytobebroadlyappliedinpractice.

New­Rules­for­Hiring­“Visa-Free­Foreigners”­Previously,theLawobligedforeigncitizensofcountrieswithwhichtheRFhasestablishedavisa­freeregimetoobtainworkpermits irrespectiveof thecategoryofemployerwithwhichsaid foreignerwasplanning towork.However,whilst thesedemands couldbe easilymetby employerswhowere legalentitiesor entrepreneurs, forwork relationswith individualemployersnumerousquestionsarose.Theseincludedquestionsonquotas,paymentoftaxes,submissionofnotificationstothestateauthorities,andsoon.andsincenowadaysonefrequentlyfindsworkersfromthe“nearabroad”hereinRussiatohelpinthehousehold,regulationofthisissuehadbecomeurgent.

asbefore,itisthevisa­freeforeignersthemselveswhoareresponsibleforobtainingmigrationpermits.However,thosevisa­freeforeignerswhoarrivetoworkforthepersonalneedsofRFcitizensmustobtainnotaworkpermit,butapatent.Thispatent gives a visa­free foreigner the right towork intheRFsubject inwhich itwas issued.apatent is issued foraperiodofonetothreemonthsandcanbe“automatically”prolongedfortheperiodforwhichincometaxhasbeenpaidin the formof a fixed advancepayment, but forno longerthanone year. In short, thepatent is consideredprolongedfor thatperiod forwhichpaymenthasbeenmade.and thepayment, in turn, is considered a taxon individual incomewhichtheforeigncitizenpaysasanadvance.Ifthatforeignerhasnotmade the advancepayment, the termof thepatentterminatesonthedayfollowingthelastdayoftheperiodforwhichpaymentwasmade.

Hope­is­GrowingOf course, the new law did not satisfy all the hopes ofmajor international corporationsdoingbusiness inRussia.The “fate” of accredited representative offices of foreigncompanies remainsunclear. Manypeopleproposed freeingsuch representatives from theneed toobtainworkpermitsatall,asusedtobethecase.afterall,Russianorganisations

havealreadyaccreditedthem,that is,assumedresponsibilityfortheir“behaviour”.However,Russia’sdiplomatsturnedouttohave the stronger voice; itwas theywho insistedon theprincipleof reciprocity. It remainsonly tohope thatRussiawill find common ground in that area, at leastwithmoredevelopedcountries.

Thetermforaworkpermitforhighlyqualifiedspecialistshasbeenbroughtupto3years,butsuchapermitdoesnotyetcovertheentirefederation,althoughinseveralregionsitwillbecomesignificantlyeasiertoobtainone.

The amendments simplify, but do not remove, therequirements on registration for migration monitoringpurposes (notifying the state authorities about the hiring,comingandgoingofemployees),whichremainsaburdenforemployers.

ItalsoshouldnotbeforgottenthatwhenandhowtheLawwillworkwillbegreatlyinfluencedbythebylawsthathavetobepassedtoimplementthenewprovisions.accordingtothestateauthoritiestherearelikelytobemorethantwentysuchbylaws;however,atpresenttheyareyettobeprepared.1July2010–whentheamendmentswillcomeintoforce­isnotthatfaraway.Itwouldbegoodifthenewrulesallowedemployersto hire qualified foreign specialists without complicationsfromthatdate.

Overall, the amendments to the Law promise to easesignificantly the lives of those employers taking on highlyqualifiedspecialists.Oneverymuchhopesthatthefirstbigstephasbeen taken towards turningRussia intoacountrywithastableandhospitableclimateforlong­terminvestments.

наработувысококвалифицированногоиностранногоспе­циалиста,нужнообратитьсяскомплектомнеобходимыхдокументовнепосредственноворганыФедеральноймиг­рационнойслужбы.Срокдействияразрешениянаработудлявысококвалифицированногоиностранногоспециалис­таможетсоставлять3годасвозможностьюнеоднократ­ногопродлениянатакойжесрокврамкахсрокадействиятрудовогодоговора.ТерриториядействияможетвключатьнесколькосубъектовРФ.

Соответственно, при наличии разрешения на рабо­ту,позволяющегоосуществлятьтрудовуюдеятельностьвнесколькихсубъектахРФ,натакихспециалистовнебудутраспространятьсяограниченияпосрокамкомандировокнатерриторииРоссии,которыевнастоящеевремя,взави­симости от характера работы иностранного работника,составляют10или60днейвгод.

Другимважнымнововведениемявляетсяположениеотом,чторазрешениенаработувысококвалифицирован­ногоиностранногоспециалистаявляетсяоснованиемдляполучениявиданажительствовРФкакдлясамогоспеци­алиста,такидлячленовегосемьи.Виднажительствоприэтомоформляетсяпожеланиюспециалиста.

Уже не один год бизнес-сообщество сетует, что российские миграционные правила, предназначен-ные для иностранцев, приезжающих к нам для целей трудовой деятельности, излишне усложнены, забюрократизированы и существенно портят инвестиционный климат в стране. Наконец, 21 мая 2010 года в «Российской Газете» опубликован Федеральный закон РФ от 19 мая 2010 г. № 86-ФЗ «О внесении изменений в Федеральный закон «О правовом положении иностранных граждан в Россий-ской Федерации» и отдельные законодательные акты Российской Федерации». Большинство попра-вок, внесенных данным законом, вступят в силу 1 июля 2010 года. В этой статье мы рассмотрим наиболее важные из новелл, вносимых в Федеральный закон «О правовом положении иностранных граждан Российской Федерации»1 (далее «Закон»).

ПоложенияЗаконаобязываютработодателейвтечение30­ти дней с момента получения разрешения на работупредставитьвФМСподтверждениепостановкивысокок­валифицированного иностранного специалиста на учетвналоговыхорганах, атакжеежеквартальноуведомлятьФМСовыполненииобязанностиповыплатезаработнойплатытакомуспециалисту,ослучаяхрасторженияснимтрудовыхигражданско­правовыхдоговоровипредостав­ленияемудолгосрочныхнеоплачиваемыхотпусков.

Теперь Закон также устанавливает ответственностьработодателя,которыйпособственнойвиненевыполняетсвоиобязательстваподоговорусвысококвалифицирован­ныминостраннымспециалистом:онсможетпривлекатьтакихспециалистовнеранее,чемчерез2годасодня,когдасоответствующие обстоятельства стали известны ФМС.Учитываявсеэтиособенности,работодателямнеобходимотщательнооцениватьобъемобязанностей,принимаемыхнасебяпризаключениидоговоровсвысококвалифициро­ваннымииностраннымиспециалистами.

Изменениязакрепляютсуществующееправилооспискевнеквотныхпрофессийидолжностей.Теперьэтотсписокявляетсяпостоянным.Принеобходимостирегулирующиеорганымогутвноситьвнегоизменения.Однакоизменениянаследующийгоддолжныбытьвнесеныдо31мартатеку­щегогода.Поэтомутеперьработодателисмогутвыбрать,вкакомпорядкеонибудутполучатьразрешениенаработудлятогоилииногоспециалиста–вобычном(длянеквоти­руемойпрофессии/должности)иливпорядке,предусмот­ренномдлявысококвалифицированногоспециалиста,

Без­разрешенияВпереченьслучаев,когдаработодателиимеютправопри­влекатьиностранныхработниковбезполученияразреше­ниянапривлечениеиностраннойрабочейсилыиразреше­нийнаработу,дополнительновключеныаккредитованныеработники представительств иностранныхюридическихлиц.Однакоонимогутпривлекатьсяктрудовойдеятель­ностивРФбезуказанныхмиграционныхразрешенийнаосновепринципавзаимностивсоответствиисмеждуна­роднымидоговорамиРФ.Внастоящеевремясуществуетограниченноеколичестводвустороннихсоглашенийиони,какправило,носятотраслевойхарактер.Поэтомувбли­жайшеевремяисключениевотношенииаккредитованныхсотрудниковпредставительствврядлиможнобудетширо­коприменитьнапрактике.

Дополненные­правила­привлечения­к­работе­в­РФ­«безвизовых­иностранцев»

Ранее Закон обязывал иностранных граждан из стран, скоторыми у РФ есть соглашения о безвизовом режимевъездаивыезда,получатьразрешениянаработувнезави­симостиоткатегорииработодателя,укоторогопланировалтрудитьсятакойиностранец.Однако,еслиустановленные

правиламоглибытьвыполненыработодателями­юридичес­кимилицамиилииндивидуальнымипредпринимателями,топриоформлениитрудовыхотношенийсработодателями­физическимилицаминапрактикевозникаломножествотрудностей,связанныхсквотой,суплатойналогов,спода­чейуведомленийвгосударственныеорганы.Апосколькусегоднявсемьяхроссийскихгражданчастотрудятсяпомо­гающиепохозяйствуработникиизближнегозарубежья,урегулированиеданноговопросабыловесьманасущным.

Законодатель,какираньше,возлагаетвсеобязанностипополучениюразрешительныхдокументовнасамихбезви­зовыхиностранцев.Однакотеизних,ктоприезжают,чтобытрудитьсядляличныхнуждгражданРФ,должныполучитьнеразрешениенаработу,апатент.Такойпатентпредостав­ляетправобезвизовомуиностранцуосуществлятьтрудо­вуюдеятельностьвтомсубъектеРФ,вкоторомонвыдан.Патентвыдаетсянасрокот1до3месяцевсвозможностьюпродлениянасрокдо1­гогодаипродлевается«автомати­чески»натотпериод,закоторыйуплаченналогнадоходыфизическихлицввидефиксированногоавансовогоплате­жа.Еслижеиностранецнепроизвелавансовыйплатеж,срокдействияпатентапрекращаетсясодня,следующегозапос­леднимднемпериода,закоторыйпроизведенаоплата.

Надежда­сильнееРазумеется,новыйзаконнеполностьюучелинтересырабо­тодателейизчислакрупныхмеждународныхкорпораций,ведущихбизнесвРоссии.Остаетсянеясной«судьба»аккре­дитованных представительств иностранных компаний.Многиепредлагали,какраньше,освободитьтакиепред­ставительстваотнеобходимостиполученияразрешенийнаработу,ведьроссийскиеорганизацииужеаккредитовалиих,тоестьвзялинасебяответственностьзаих«поведение».Однако интересы российской дипломатии перевесили,отсюдаиссылканапринципвзаимности.Остаетсятольконадеяться,чтоРоссиясумеетдоговоритьсяхотябысраз­витымистранами.Срокразрешениянаработудлявысо­коквалифицированныхспециалистовдоведендо3лет,нотакоеразрешениепоканесталообщефедеральным,хотяполучатьеговнесколькихрегионахтеперьбудетзначитель­нолегче.Упрощаются,нонеустраняютсяполностьюитре­бованиямиграционнойрегистрации (уведомлении госу­дарственныхоргановоприеменаработу,въездахивыездахработников).

Когда и как начнет работать Закон, вомногом будетзависетьотподзаконныхактов,которыенеобходимопри­нять для его реализации на практике. По информациисотрудниковгосударственныхорганов,регулирующихдан­нуюсферу,такихподзаконныхактовдолжнобытьбольшедвухдесятков,нопоканеготовниодинизних.Хорошобы,чтобыновыеправилапозволилиработодателямбезособыхсложностей принимать на работу квалифицированныхиностранныхработниковименносдатывступленияЗаконавсилу 1июля2010года.Темнеменее,поправкивЗаконобещаютзначительноупроститьжизньтехработодателей,которыепригласятвысококвалифицированныхспециалис­тов.Хочетсянадеяться,чтосделанпервыйшагвсторонупревращенияРоссиивстранусдружественнымклиматомдляиностранныхинвестиций.

An interesting article on the organisation of USSR shipping was published in the August number of the Economy Survey issued by the USSR Chamber of Com-merce, Moscow. It observes that general supervision and control of shipping is carried out by the Commissariat for Water Transport, which directs the state mercan-tile marine and the ports, as well as river transport. It is organised into two administrations, namely, the North-ern Central Shipping Administration (Sevtsumor) and the Southern Central Shipping Administration (Yuzhtsumor). The nationalisation of shipping was one of the first acts of the Soviet Government, although petty craft serving their owners as a means of livelihood and craft belonging to small co-operative enterprises (artels) were exempted. Thus a Soviet citizen may own not more than one vessel with a cargo capacity not exceeding 50 tonnes or with mechanical propulsion not exceeding 15-20 h.p., or, in the case of fishing and whaling craft with a gross capacity not exceeding 20 registered tons.

The State mercantile marine is operated by State steam-ship lines, which were organised under a decree dated March 15th, 1934. Their legal status was defined by a decision of the of the Council of People’s Commissars dated December 9th, 1934, which states that “the State steamship lines are independent business organisations which enjoy the right of legal entity and are not liable for the obligations of the State or of other enterprises and organisations, and in par-ticular each line is not liable for the engagements of other lines; neither is the State is responsible for the obligations of the steamship lines.” Seven steamships lines were origi-nally organised: the Baltic line in Leningrad, the Northern line in Archangel, the Black Sea Passenger and Dry Cargo line in Odessa, the Black Sea tanker line in Tuapse, the Azov line in Rostov-on-Don, the Caspian Line in Baku and the Far East line in Vladivostok. Eventually their number was increased to eight with the establishment of the Sochi line. Each line has its own statutes on the basis of which it operates. These were approved by the Commissariat for Water Transport in March, 1935, and published in the Commissariat’s collected injunctions, volume 5, 1935. The principal functions of the lines are to organise and carry out coastal and overseas carriage of cargo and passengers. They are entitled to charter foreign tonnage through the All-Union chartering organisation Sovfracht. They are also responsible for administration of the ports situated in their respective regions; thus, the Black Sea Passenger and Dry Cargo State Steamship Line manages the Black Sea ports of the USSR, with the exception of Tuapse and Sochi,

which are controlled by the Black Sea tanker line and the Sochi line respectively. The lines are also specifically enti-tled to hire out ships on charter, purchase and build every kind of gear and structure essential to their operations, issue warehouse receipts and warrants against goods taken in for warehousing, and make contacts for the repair of the ships operated by them.

Shipments are made according to plan, which is designed to make the most rational use of the mercan-tile marine’s carrying capacity. The majority of the soviet consignors have contracts of carriage with the respec-tive steamship lines which are concluded before the New Year to cover shipments throughout the coming year. The relationship between consignors and the lines are on a commercial basis and are governed by the rulings of the Merchant Shipping Code of the USSR and subsequent Government decisions.

Ports are divided into the special loading and unloading sections, each of which is run on a commercial basis and is provided with the necessary gear and labour. Loading and unloading is performed at the request of the consignors or consignees. In the event of the contract of affreight-ment stipulating that winch men and stevedores are to be selected by the vessel from ashore, the master of the vessel tenders a corresponding request to the port sec-tion handling the vessel, usually through the agent looking after the vessel. In some ports, however, timber loading is carried out by Exportles (timber Export Corporation) which utilises its own loading gear and longshoremen. Lighters and other auxiliary craft used in the loading of the timber cargoes belong to the timber trusts, which are independent organisations having no legal nor commer-cial subordination to Exportles.

Foreign shipping is chartered by Sovfracht, which exercises a monopoly of such chartering in the USSR. Sovfracht conducts its business under statutes approved by the commissariat for Foreign Trade in 1932. It is an independent organisation on a commercial basis enjoying the status of a legal entity. In chartering foreign tonnage it acts in most cases as agent on behalf of the charterers, i.e. the Soviet foreign trade organisations. The charter par-ties accordingly stipulate that Sovfracht's signature thereto is given in the capacity of agent only; generally, but not essentially, the name of the principal is disclosed. When Sovfracht charters in the capacity of agent, all rights and obligations under the charter party are taken up by the principals and not by Sovfracht, and Sovfracht is not liable for claims proffered against its principals.
