EversinceYuriGagarinblazedhis trail into thehistorybooks,Russiahasviedforprideofplaceintheannalsofspace science and research. Britain’s contribution hasbeen further off the radar but nonetheless valid. A

Russo­British venture looks to bring the fruits of Gagarin’slegacyandBritain’sreservedbutdoggedinterestinthecosmosbackdowntoearth.

Arevolutionarynano­satellite couldbecome thenewstarinthefirmamentofspacetechnology,trackingseismictroubleandtremorsonplanetEarthandgivinghumanitysomefore­warningonearthquakes,volcanoesandtsunamis,whichcutabrutalswatheintoJapanthisyear.UCL’sMullardSpaceCentreLaboratoryandtheRussianAcademyofScience’sInstituteofPhysicsof theEarthareplanningamini­satellite topickuponthewarningsthatnaturegives.AsreportedinTheMoscowNews,theyhopethatbygivingsomeadvancenoticeofdevas­tatingcataclysmstheycansavelives.

Thecollaborationgivesoffechoesofthe1960s,whenBrit­ainsnappedatthecosmicheelsofboththeUSSRandtheUS.Itholdsanow­forgottenthirdpositionintherockettechnologyraceandhadaviablesatellitelaunchprogrammeandambitiousplansformannedmissions.InOctober1971,theUKfollowedinthewakeoftheestablishedspacesuperpowersandlauncheditsownBlackArrowrocketfromalaunchpadintheAustraliandesert.Fundingwaslimitedandwascutevenbeforelaunchbutthesatelliteisstillinorbitandcouldpotentiallybereactivated.Itwillcontinuetoorbitearthforanother100years.Further­more,althoughBritsmayhavebeendisappointedbythefailureof2003’sBeagle2missiontoMars,itdid,theBBCnoted,showthatBritaincanlookbeyondthewavesandcouldstillhaveparttoplayinspaceexploration.

ThelatestventurewithRussiacouldnotonlyputtheUKbackontothestarchartsbutsavelives.

OPINION

Thesuccessofthejointprojectwouldmeancorrectlyinter­pretingtheelectro­magneticimpulseswhichbetrayimpendingseismiccataclysmsand set thealarmbells ringing.AlthoughMotherNatureistoostrongabeasttocontrol,theearlywarn­ingsystemswhichshegivesoffat leastpresentthischancetoevacuatepeopleandminimisetheeffects.

“Naturewarnsuswhenbignaturaldisastersarecoming,”ProfessorChmyrevof theRussian instituteofPhysicsof theEarthtoldjournalistsatabriefingorganisedbyMoscow’sInter­nationalScienceandTechnologyCentre.“Thereareindicatorsdays,weeksandsometimesevenmonthsbeforeanearthquakeoravolcaniceruption.”

Thelittlebundleoftrickschargedwiththisweightybur­denisanano­satellitedevelopedbyBritishscientists,aspartofanewTwinSatprogramme.Theideaisthatthelittlemachineanditsparentsatellitewillgiveawholenewlevelofprobingvisiontofault­linewatchers,aconsiderableimprovementonthecurrentandratherhit­and­missorbitalsystemofmoni­toringdangerzones.

Itisplannedtolaunchin2015andwithwell­knownseismicfaultlinesscientistswillhavethechancetotestthetheoriestheybuilt theirearlywarningsystemonandtakeanotherstepformankind,asArmstrongwouldhaveit.

Theobjectinquestioncouldfitinahandbagandmeasuresjust10x10x20cm,weighinginatjusttwokg.TheRusso­Britishteambelieveitcouldgetoffthegroundandintoorbitforamere$5million,asnippetofthe$100millionbudgetsofold.Atthatkindofpriceandsize,itcouldpiggy­backontotheplannedlaunchesofbiggerprojectsand,therocketeershope,beputtootherusestoo.

AcombinedprojectofthispotentialoffersobviousbenefitstoRussia,Britainandbeyond.Bothprestigeandagenuinecon­tributiontotheworldliewithingrasp,andperhapsanewerainRusso­Britishrelations.

Новым витком развития космических технологийможет стать революционный нано­спутник, которыйбудетнаблюдатьзасейсмическойактивностьюиопасно­стями на Земле и позволит предупреждать землетрясе­ния,извержениявулкановицунами,какте,чтопотряслиЯпониювэтомгоду.

Научная космическая лаборатория Mullard (MullardSpaceScienceLaboratory)приУниверситетскомколледжеЛондона(UniversityCollegeLondon—UCL)иИнститутфизики Земли РАН планируют запустить малый спут­ник, который будет регистрировать «предупреждения»Земли.Онинадеются,чтосвоевременноеоповещениеогрядущихкатаклизмахпозволитсохранитьжизнилюдей,сообщаетTheMoscowNews.

Это сотрудничество– отголосок 1960­х годов, когдаВеликобританиябросиласьдогонятьСССРиСША,дале­копродвинувшихсявобластиосвоениякосмоса.Сегоднямало кто помнит, что она была третьей в гонке косми­ческих технологий и разработала сильную программузапускаспутников,такжепланируяоткрытиепилотиру­емыхмиссий.Воктябре1971года,следуяпостопамкос­мическихсупердержав,Великобританиязапустиласвоюсобственную ракету «Черная стрела» с космодрома вАвстралийскойпустыне.Финансированиебылоограни­ченнымипрекратилосьещедозапуска,нозапущенныйспутниквсеещенаорбитеипотенциальноможетбытьреактивирован.СпутникостанетсянаорбитеЗемлиещеоколо100лет.Ипустьнеудачамиссии«Бигль­2»наМарсв2003годусталаразочарованиемдлябританцев,онавсежепоказала,какотметила«Би­би­си»,чтоВеликобрита­нияможетосваиватьновыегоризонтыивсеещеможетигратьважнуюрольвосвоениикосмоса.

Новый проект с Россией мог бы не только вернутьстране статус космической державы, но и способство­

ватьсохранениюжизней.Успехсовместногопредприятиязависит от точности интерпретации электромагнитныхсигналов,исходящихотземнойповерхностипередпри­ближающимсясейсмическимкатаклизмом.Ихотяприро­даслишкомсложна,чтобыееполностьюконтролировать,ее «системы раннего оповещения», – по крайней мере,даютшансэвакуироватьлюдейиминимизироватьущерб.

«Природа предупреждает нас, когда надвигаютсякрупные стихийные бедствия», – сказал журналистампрофессор Института физики Земли Чмырев на бри­финге, организованном московским Международнымнаучно­техническим центром. – «Эти показатели появ­ляютсязадни,неделиииногдадажемесяцыдоземлетря­сенияилиизвержениявулкана».

Этот маленький комплекс технологических ноу­хау,на который возложена важная миссия, – это наноспут­ник, разработанный британскими учеными в рамкахновойпрограммыTwinSat.Сутьвтом,чтоэтотмалень­киймеханизмиматеринскийспутниквыведутнановыйуровень систему наблюдения за тектоническими раз­ломами, что значительно улучшит существующую идовольно ненадежную орбитальную систему монито­рингаопасныхзон.

Запуск намечен на 2015 год, и поскольку главныелинии тектонических разломов хорошо известны, уче­ныесмогутпроверитьтеоретическиевыкладкисистемыраннегооповещенияисделатьновыйшагдлячеловече­ства,каксказалбыАрмстронг.

Самприборразмером10x10x20сммогбыпоместитьсявсумке,аеговесвсего2кг.Российско­британскаягруппаразработчиковнадеется,чтоспутникудастсязапуститьивывестинаорбитувсегоза$5миллионов,ничтопосрав­нению с предыдущими бюджетами в $100 миллионов.Такаяценаиразмерыпозволятспутникуучаствоватьивзапускеболеекрупныхпроектов,и,надеютсяразработчи­ки,использоватьсяегоивдругихобластях.

Такое внимание всего мира может сильно повлиятьнасудьбупостсоветскойРоссии.Вероятно,этонемногостранноспустя20летпослерасколаСССРвсеещегово­рить оРоссии как пост­советском государстве,но, нра­витсянамэтоилинет,онавсеещенеизбавиласьдоконцаотсоветскогонаследиянидома,низарубежом.

Многие россияне – особенно, но не только, бюро­краты–всеещеживутссознаниемсоветскихвремен(вкаждомдокументекаждаязапятаядолжнабытьнасвоемместе,ондолженбытьподписан,иметьпечатьибытьраз­множенвнесколькихэкземплярахит.д.ит.п.),чтооченьмешаетделу.Бизнессталкиваетсясэтимкаждыйдень.

Имногиеназападе–возможно,больше,чемобычнопризнается–всеещенеизбавилисьотбезусловногореф­лексапереходав«режимхолоднойвойны»приупоминанииоРоссии.Можетстоитизолироватьупомянутыхсоветских

бюрократоввместесэтимилюдьми,чтобыостальныемоглижитьв21векеистроитьболееконструктивныеотношения?

А эти спортивные мероприятия – прекрасная воз­можностьдля России показать миру, что СССР ушел висторию. Страна уже провела генеральную репетициюэтогоспортивногомарафонав2008году,когдасостоялсяфиналЛигичемпионовмежду«МанчестерЮнайтед»и«Челси».Янеприехалнаматч,посколькупривсейлюбвикфутболунеподдерживаюниоднуизэтихкоманд,ноте,кто там были, не могли не отметить четкость его орга­низации. Российские власти сделали все, чтобы оказатьхороший прием гостям: засчитывали билет как визу,арендовалитеплоходынаМоскве­рекеподдополнитель­ныеместадляразмещенияфанатов,собралианглогово­рящихмилиционеровсовсейстраны.

ТеперьвожиданииэтогоспортивногопраздникавРос­сииисовсемуважениемкпроявленномуусердиювприемефанатовхотелосьбыувидетьтакоежегостеприимствоидляиностранногобизнеса,которыймогбыпомочьподготовитьипровестиэтимероприятиянамировомуровне.ВВели­кобританииродилисьмногиеизсамыхпопулярныхвмиревидовспорта.Мытакжепреуспеливорганизацииспортив­ныхмероприятий.Дамыигоспода,унасестьуникальнаявозможность развить российско­британские отношениячерезспорт,идавайтенепозволимбюрократамупуститьее.

In the next few years, Russia can rightly claim to be thesportingcapitaloftheworld.ItallkicksoffinJune2013,whentheRugbySevensWorldCupwillbeheldinMoscow.ThenRussiagoesintoakindofsportingfeedingfrenzy:June2013:RugbySevensWorldCup,Moscow.July2013:

WorldStudentGamesinKazan.2014:WinterOlympicsandParalympics, Sochi. 2014: Motor Racing, Formula­1 GrandPrix, Sochi (then annually). 2016: International HockeyChampionships,Moscow.2018:FIFAWorldCup,Russia.

Thisexposuretotheworld’sattentioncouldbemakeorbreakforpost­SovietRussia.Itmayseemstrange20yearsafterthedis­appearanceoftheSovietUnionstilltobetalkingaboutmodernRussiainthoseterms,but,likeitornot,RussiastillhasnotshakenoffthelegacyoftheSovietsystem,eitherathomeorabroad.

ManyRussians–especially,butnotexclusively,bureaucrats–stillhavethefrustratingmentalityofSoviettimes(eachdocu­mentmusthaveasignature,anofficialstampandbeproducedinmultiplecopies,withnotsomuchasacommaoutofplace,etc,etc...)whichissuchanobstacletogettingthingsdone.Busi­nessinparticularcrashesintothisparticularbrickwalldaily.

AndmanyintheWest–more,perhaps,thanwouldactu­ally admit it – still have the mental knee­jerk reaction (aninterestingphysicalmetaphor)whichmeans thatwhentheyhear the word“Russia” they immediately go into ColdWarmode.Perhapswecouldputthesepeopleonadistantislandsomewherewiththeafore­mentionedSovietbureaucrats,thusleavingthoseofuslivinginthetwentyfirstcenturytogetonwithbuildingmoreconstructiverelationships.

ButthesemajorsportingeventsareamassivewayforRus­siatoshowtheworldthattheSovietUnionishistory.Rus­sia’salreadyhadadressrehearsalforthisforthcomingsport­ingbonanza:theChampions’LeagueFinalof2008,betweenChelsea and Manchester United. I was not at the match –thoughIlovefootballIsupportneitherteam–butthosethatwerehadnothingbutpraise for thearrangementscarefullyputinplace.Whetheritwasallowingamatchticketcountasa visa;berthing cruisevesselson theMoscowRiver topro­videextraaccommodation;orbringinginEnglish­speakingpolicemen from around the country to assist the fans, theRussian authorities went out of their way to make visitorswelcome.

Whatwenowneedinthismouth­wateringsportingfeastahead of us in Russia, and added to these laudable ways ofwelcoming fans to the events, is an equal welcome for for­eignbusinesseswhocanhelpthepreparationsfortheseeventstrulytobeonaglobalfooting.Britaingavetheworldmanyof itsmostpopular sports.We’realsoverygoodatorganis­ingsportingevents.LadiesandGentlemen,wehavebeforeusa unique opportunity to deepen Russo­British ties throughsport;let’snotallowthebureaucratstospoilit.

TwentyyearshaspassednowsincetheSovietcollapse,buttheneed tomodernise the infrastructure inherited fromthattimehasbecomeevenmoreacuteassystemshavecontinuedtoageover theseyears.Thisconcerns thecity’spipe systems,roads,industrialfacilitiesandsoon.Corruptionofcoursehashadahand in slowingdown theefforts,butobjectiveexter­nalfactorshavealsoplayedapart.The1998debtdefaultandroubledevaluationnotonlywipedoutpeople’ssavingsbutalsoerasedbudgetfundsthatcouldhavebeenspentoninfrastruc­turedevelopment.Whentheauthoritieswerebusybuildingupthestabilisationfundduringtheoilboomoftheearly2000s,therewerenumerouscallstoforgetaboutthespectreofvariousdisasters and spend thewindfalls insteadon repairing roads,buildinghospitalsandschools,overhaulingSoviet­erafactories

Запрошедшие20летсмоментараспадаСССРпробле­мамодернизациисоветскогоинфраструктурногонасле­дияпостепеннообостряласьпомереисчерпаниятехноло­гическихресурсов.Речьиогородскихкоммуникациях,иодорогах,ипромышленныхобъектахит.д.Причемеслиоставить«заскобками»коррупцию,очевидно,чтоблагимнамеренияммешаливоплотитьсявжизньивполнеобъ­ективныевнешниеобстоятельства.Ведьдефолт1998годаодинаковообесценилисбереженияграждан,ибюджет­ныесредства,которыемоглипойтинаинфраструктурныепреобразования.Вовремянефтяногобуманачала2000­хтакнастойчивы былипризывыобщественныхдеятелейзабытьофантомахвозможныхкатаклизмовипотратитьстабилизационныйфонднаремонтдорог,строительствобольниц,школ,регенерациюсоветскихфабрикизаводовит.п.Осенью2007годатогдаи.о.главыМинэкономраз­витияРФГерманГрефзаявлялонамерениинаправитьнаразвитиеинфраструктурыдо2020годанеменее$1трил­лиона.Агодспустяоказалось,чтосоломкустелилинезря,ископленныесредстваспаслибанковскуюсистемустра­ны,главныепредприятияикомпании,атакжеподдержа­лисоциальнуюсферу.В2008­2009гг.изинвестиционных

проектовотбюджетныхсокращенийнепострадалилишь«Сочи­2014»исаммитАТЭС­2012–очевидно,ввидуихособогомеждународногостатуса.

С2008годаРоссиявзяланасебяещерядобязательствпо проведению крупных международных мероприятий,каждоеизкоторыхпотребуетколоссальныхинвестицийвинфраструктуру.Так,например,дляЧМпофутболув2018годупредстоитподготовить16стадионовв13городах,изнихлишь5ужесуществуютибудутреконструированы,аостальные11будутпостроеныснуля.Безусловно,боль­шиенадеждывэтомвозлагаютсяназарубежныйопытиинвестиции(впроектеСочи­2014ужеработаетрядбри­танскихкомпаний,чейопытОлимпиадывЛондонев2012годубудетособенноважен).Иуженеразбылосказано,чтоолимпийскиеобъектывСочибудутвозводитьсяполучшимзападнымстандартам«зеленого»строительства.

Неужелилишьмеждународныеобязательствазастав­ляют искать высокотехнологичные инфраструктурныерешенияиобновлятьморальноустаревшие,новдругпона­добившиесяобъекты?Неужелинедостаточноназревшейвнутреннейпотребностистранывреконструкцииотрабо­тавшихсвойресурссистемипоискеболееэффективныхпутейихэксплуатации?Втакомслучае,РоссиибылобыполезновыигратьправонапроведениеЧемпионатамирапоскоростномуикачественномустроительствудорогипрокладываниюводопроводныхтруб.Апокабудемнад­еяться,чтополученныйопытбудетпонемногувнедрятьсяивменееразрекламированныепроекты.

Russia has committed itself to hosting a number of biginternationaleventssince2008,eachofwhichrequiresenor­mousinvestmentininfrastructure.TheFootballWorldCupin2018,forexample,willrequire16stadiumsin13towns.Onlyfive stadiums already exist, and will be reconstructed, whilethe remaining 11 will need to be built from scratch. Russiaisputtingbighopesinforeignexperienceandinvestment(anumberofBritishcompaniesarealreadyinvolvedintheSochi2014project,andtheirexperiencein2012LondonOlympicsisparticularlyvaluable).TheRussianauthoritieshavedeclaredtoothattheOlympicfacilitiesinSochiwillbebuiltaccordingtothebestWestern‘green’constructionstandards.

But can it really be that only international obligationsforce theauthorities to findhigh­tech infrastructuresolutionsandoverhaulagingandsuddenlyneededfacilities?Isthehugedomesticdemandforreconstructionofaginginfrastructureandmoreeffectiveoperationmethodsnotenough?If this isreallythecase,Russiawouldbenefithugelyfromhostingsuchaworldchampionshipinfastandhigh­qualityroadconstruction,orlay­ingwaterpipes.Fornow,wecanbuthopethattheexperiencegainedwillgraduallytrickledowntolessprestigiousprojectstoo.

VPK-Sooruzhenie­Develops­­Energy-Saving­Technologies

Followinganenergyauditatoneofitsproperties,realestatemanagement company VPK­Sooruzhenie has formulatedandbegunimplementingadesignsolutionforthere­layingof the electrical mains to introduce various energy­savingtechnologies. The property in question, with electricityconsumption totalling 19 megawatts, comprises more than20 hectares in land area and over 40,000 square metres ofbuildingspace.Themaintenantsofthecomplexareindustrialmanufacturing and logistics companies, and are extremelydependent on uninterrupted power supply. This factor wastaken into account in the development of the project andthe working schedule for its implementation.As a result oftheproject,electricalconsumptionwillfallbymorethan25per cent. This is not the first project of its kind thatVPK­Sooruzhenie has embarked upon in order to improve theenergy efficiencyof one of itsproperties. ICHARM­Sees­Russia­Progress­in­Fight­against­­­Non-communicable­Diseases

InSeptember2011,aHigh­levelSummitoftheUNwilldiscussand agree policies to control & combat non­communicablediseases(NCDs),includingheartdisease,cancersanddiseasesaffectingthelungs.InpreparationfortheSummittwomeetingswere recently hosted in Moscow byWHO: a global forum,“Addressingthechallengeofnon­communicablediseases,”andtheFirstGlobalMinisterialConferenceonHealthyLifestylesand Non­communicable Disease Control. The potentiallymodifiable risk factors associated with development ofNCDs–tobacco,alcohol,unhealthydietandlackofexercise–andproposals forreducingthem,werediscussedindetail.The consensus stressed that political will and intersectoralcollaborationatnationalandinternationallevelswereneededto introduce and implement legislative action and lifestylemodification.Russiahasalreadycommencedacomprehensive“Healthy Russia” programme involving education of thepublic,universalscreeningandriskassessmentfordevelopingheartattacks,diagnosisandtreatmentofexistingheartdiseaseanddiabetes.Preliminaryfiguresshow,since2009,afivepercent reduction in heart disease and 20 per cent reductionin stroke. Male life expectancy, since 2005, has increasedby four years. Eurasia­Drilling­Company­Limited­­and­Schlumberger­Announce­Completion­

of­Transactions­and­Strategic­AllianceEurasia Drilling Company Limited and Schlumbergerannounced today the completion of the sale and purchaseof each other’s drilling and service assets together with theformation of a StrategicAlliance in line with the Letter ofIntent announced on 4 October 2010. The key elements ofthe transactions completed on 28April 2011 are that EDChas purchased Schlumberger drilling and well servicingassets inRussiathat include19existingdrillingrigswith17drillingcrews,34workoverrigswith25relatedcrews,and23sidetracking rigs with 20 related crews, currently operatingmainly in Western Siberia. Primary clients of these rigsinclude Rosneft, TNK­BP, GazpromNeft and LUKOIL, witha total drilling output of approximately 700,000 metres in2010. Schlumberger has purchased EDC drilling servicesassets, includingdirectionaldrilling, cementingand drillingfluids engineering and materials supply. These service linesinclude24cementingcrews,57directionaldrilling/telemetrycrews and 50 crews for drilling fluids. Pharmaceutical projects worth 40 billion roubles ($1.4 bil­lion/€980million)arecurrentlybeingimplementedinRussia,the IndustryandTradeMinisterViktorKhristenkohas said.Of that amount, foreign investment totals25billion roubles($895million/€615million).InStPetersburg,Russianandfor­eigndrugmanufacturersarebuildingnineproductionfacili­tiesworth25billionroubles,KhristenkotoldtheInternationalPharmacyEngineeringandBiotechnologyForum(IPhEB)inStPetersburg.Inlate2010,thegovernmentapprovedafederaltargetprogramme forpharmaceutical industrydevelopmentuntil2020.Thedocumentcallsforanincreaseinproductionbylocalmanufacturersofmedicinesandmedicalequipment.

RussiannationaldevelopmentbankVnesheconombank(VEB)istoopena39billionrouble($1.4billion)creditlineforajointventurebetweenFordandRussiancarmakerSollers,VEBheadVladimirDmitriyev announced recently. The 10­year creditline will be opened at an interest rate equalling the centralbankrefinancingrate,currentlyateightpercent,plustwopercent.Thetotalcostoftheprojectamountsto75billionroublesandFordandSollerswillinvest18billionroubleseachintheventure, according to Dmitriyev. Британская компания Raven Russia инвестирует в 2011годувстроительствовторойфазылогопарка«Климовск»в Подмосковье около $40 миллионов. Проект реализу­ется за счет собственных средств Raven Russia. «Общаяплощадь второй очереди строительства составит 55тысяч квадратных метров, а ввод объекта в эксплуа­тацию намечен на начало 2012 год», – указано в мате­риалах. Логопарк класса А «Климовск» расположен наземельномучасткеплощадью18гектароввПодольскомрайоне Московской области в 21 километре от МКАД,а рядом с комплексом проходит шоссе, соединяющеетрассу М2 и Варшавское шоссе. Lord Mayor, you’re now just over half-way through your one-year term in office. How would you assess the year so far?I prefer to count my time not in daysbut in thenumberof speeches Imake;and last night I gave the 520th speechsince taking office last November! Thesignificanceofthisisthatitmeansalotof positive messages about the City ofLondonarebeingpassedontoa lotofpeople.ConfidenceintheCityisreturn­ing.ButI’mnotsimplyanAmbassadorfor the Square Mile [the financial dis­trict that is the City of London – SD].It’salsoaboutshowing that theUnitedKingdomasawholeisacentreofexcel­lence for wealth generation.As well asmy foreign visits, I’ve recently been inScotland, and in the north of England.So, there’s not just a“London” agenda;there’sa“UK”agenda.Thereare1.3mil­lionpeopleworkinginfinancialservicesin thiscountry; two­thirdsof themareoutsideLondon.

You say you’ve just visited Scotland; the Scottish National Party, which wants independence for Scotland, recently gained a majority in the Scottish Parlia-ment. Did that cause a problem for you?No, we were very well received.As youcan imagine, the SNP leader and FirstMinister,AlexSalmondhadawidegrinonhisface!Butwesupporttheirfinan­cialaspirations.InEdinburghandGlas­gow,forexample,theyareverystronginsuch fields as risk management, insur­anceandintellectualproperty.

You mentioned also that confidence in the City is returning. Would you say that

the City has emerged from the economic crisis, or is still emerging from it?Both.InsomewaystheCityhasemergedfrom the recession and is strong again;butthere’sstillworktobedone.Ithinkof it as there being an“ABC” of confi­denceinrecovery,andnoteverything’sinplaceyet.Letmeexplain,inreverseorder.

“C” stands for Capital. The bankshave to have capital to act as a bufferagainst future problems. The confidentbanksarenowwellcapitalisedagain.

“B” means Banking Resolution. It’svery important that the general pub­lic believe that they will never be heldresponsibleshouldabankgetintofinan­cialdifficultiesagain.Thecurrentinves­tigation into what happened duringtheeconomiccrisis, theVickersReport,is expected to recommend that“livingwills”willbeputinplacetoensurethatinanyfuturecrisisdepositorsdon’tlosetheirmoney.Bytheendofthisyear,thebanks should have liquidity in place tosafeguardagainstthis.

Andthe“A”standsforAuditingandRiskManagement.Thisisbothtoiden­tifywhereandwhotherisksare;andtomakesurethatpeopleunderstandwhattheauditorsandthecreditagenciesaresaying.

Having said that, I do understandwhy there is still anger out there –fuelledbythepress,Ithink–aboutthesize of bankers’ pay and bonuses, andthe banks need to sort this out. I’m agreat believer in the slogan, “Rewardmust follow quality”; and this goes forevery sector.So, it’sup to thebanks toensurethattheyareprovidingaqualityservicebeforetheydecideonremunera­tionandbonuses.

In the wake of the economic crisis, there have been a number of new regulations brought in to control business; and also tax rises. Has this led to companies abandoning the City?No, we certainly haven’t seen peopleleavingtheCityindroves;indeed,there’sbeennosignificantexodusfromtheCity.However,weareawarethattheweightofpersonaltaxesandtheregulationswhichhavebeenbroughtincanscareoffnewbusiness.I’mawarethatmatterssuchaslocatingintheCityofLondonarenowbeing discussed at Board level, whichwasn’tpreviouslythecase.

What about visas? We frequently hear complaints from our members that it takes too long to arrange visas for their staff or their clients.We do make points to the governmentabout anything which hinders businessin the City, including visas.We’ve seenaparticularproblemwithvisasforpeo­ple coming on work experience, whenayearout in industry isapartof theiruniversity course. Unfortunately, therewere incidents of bogus educationalestablishments setting themselves upand bringing people over under falsepretences. This seemed to lead to con­fusion in the United Kingdom BorderAgency(UKBA)andI’mafraiditcausedthependulumtoswingtoofartheotherway.Wearetryingtogetbacktoasystemofequilibrium.It’sessentialthathereinthe City we ensure that people knowthattheycanemployworld­class,skilledpeople.Thereare300differentlanguagesspokenintheCityofLondon;andfortypercentofthosewhoworkherehaveaforeignpassport.

In the first of your 520 speeches to date you established the slogan, “City of Lon-don – City of Choice”. What in particular do you understand by “choice”?

It’s vitally important in the City to beaware that businesses have choices andpeoplehavechoices.IbelievethattherearefivekeyreasonswhytheCityofLon­don should be the City of Choice forbusiness.Firstly,theskillsavailablehereare unsurpassed anywhere else. We’rebusiness­friendly, sit in a convenienttimezoneandtransactionsaregovernedby business law. Thirdly, we have greatinfrastructure and buildings – subjectsveryclosetomyheartasthat’stheareawhereI’vespentmostofmybusinesslife– aswell asprovidingagoodwork/lifebalance.Fourthly,wehavegoodaccesstointernationalmarkets;Londonisa24/7city.Finally,theCityisthebestbusinesscluster there isofworld­classorganisa­tions. To put together an initial publicoffering (IPO) you need to engage 18different organisations; in the City youhave the choice you need within theSquareMile.GlobalfinancialindicesputLondonas thenumberonedestinationintheworldforbusiness;butthatiscer­tainly not a reason to become compla­cent!

Charitable work has long been a part of the Lord Mayor’s work, too. And you’ve made a play on your own name for this year’s appeal…Yes,“BearNecessities”isthenameofmyappeal!Theideaistogiveachanceinlifetochildrenwhoareonthefringeofsoci­ety;whodon’tevenhavethebareneces­sitiestogetoninlife.So,largelythrougha charity called Coram, we are givingchildren chances in education whichthey would not otherwise have had;there’s even a bursary scheme for uni­versities.We’realsodonatingtoacharitycalled RedR UK, which provides rapiddisasterreliefallaroundtheglobe.We’vealreadyraised threemillionpounds fortheappeal.

At the end of June you’ll be travelling to Russia, as a number of your predeces-sors have done in recent years. What priority do you give Russia for UK busi-ness?High priority. Russia is an extremelyimportant market; it’s the eighth larg­est retail market in the world and thefourth largest inEurope.We’re lookingto improve the UK’s business relationswith Russia. We’re keen to help Mos­cow’s development as an international

financial centre (IFC), which it shouldrightly be. I know there are problems,though;Russiaislisted146thoutof180countries for transparency in its busi­ness practices; and 120th out of 183countries looked at for ease of doingbusiness.

If Moscow were to become an IFC, would this not pose any threat to London’s position?Not at all. We live in a global market.Wecanmaintainourshareofthatcake,whilstgrowingitsothatmanyotherscanbenefit.Youneedthree“C”stobuildanIFC:Commodities,CashandCreativity.TheUKhashadthefirst,hasthesecondandisverywelloffforthethird.AnyIFCneedstobeabletoattractthenecessaryskillsinordertounlockitspotential.

Lord Mayor, your background is in con-struction and infrastructure. These are areas where Russia has had particular problems since the crisis. Is there any particular message on this matter you’ll be taking with you to Russia?

Certainly; and that is that you cannotoverestimate the positive effect whichgoodinfrastructurehasontheeconomyasawhole.It’sestimatedthatintheUKevery pound spent on infrastructurebrings the equivalent of £2.84 to theeconomy, ninety per cent of which isspent in this country. So let’s be clearabout it: investment in infrastructurereallyhelpstheeconomytogrow.We’veimplemented about 1,000 infrastruc­ture projects in the last 20 years usingpublic­private partnerships (PPP);whereas I understand that in Russiasome350PPPprojectshavebeeniden­tified but that many have stalled. Ibelievethatthekeytosuccessistohavea centralised policy unit to coordinatethese projects. This acts as a pool ofexpertise. I look forward to discussingthiswhenI’minRussia.

Нам кажется, что особуюпроблемупредставляетвизадлятех,кто приезжает получить профес­сиональный опыт в определеннойобласти как часть университетскойпрограммы.Ксожалению,былипре­цеденты фиктивных образователь­ныхучреждений,которыеобманнымпутеморганизовывалиприездлюдейвстрану.ЭтовызвалоответныемерыПограничного агентства Великобри­тании, и, боюсь, маятник качнулсяслишком сильно в другую сторону.Мы стараемся вернуться к равнове­снойсистеме.ДляСитиоченьважнообеспечить уверенность компанийв том, что они смогут нанять пер­воклассных квалифицированныхспециалистов. Во­первых,здесь находятся люди с превосход­ными компетенциями. Здесь всеустроенодлябизнеса,удобныйчасо­вой пояс и сделки совершаются попредпринимательскомуправу.Втре­тьих, у нас прекрасная инфраструк­тура и помещения – эта тема оченьмне близка, так как я занимался ейбольшуючастьсвоейделовойкарье­ры, – а также и правильный балансработыиотдыха.В­четвертых,унасхороший доступ к международнымрынкам,аработавЛондоненепре­

кращаетсянинаминуту.Инаконец,Сити – это лучший бизнес­кластерорганизаций мирового уровня. В конце июня Вы приедете Россию, как и Ваши предшественники в последние годы. Насколько важна Россия, по-Вашему, для британского бизнеса?Оченьважна.Россия–этооченьваж­ный рынок и это восьмой по вели­чине рынок розничной торговлив мире и четвертый по величине вЕвропе.Мыстремимсякулучшению

деловыхсвязейбританского бизнесас Россией. Мы также рады помочьМоскверазвиватьсякакмеждународ­номуфинансовомуцентру,которымона непременно должна стать. Но язнаю,чтоестьпроблемы,ведьРоссиязанимает146­еместосреди180странпо прозрачности ведения бизнеса, атакже120­еместосреди183странпоудобствуведениябизнеса.

Если Москва станет международным финансовым центром (МФЦ), это не по влияет на роль Лондона в этой области? Вовсенет.Мыживемвусловияхгло­бальногорынка.МывСитисможемсохранитьнашудолюрынка,развиваяеетак,чтобыдругиетакжевыигралиотэтогопроцесса.ДлясозданияМФЦнужнытри“C”:Commodities,CashиCreativity (продукты, наличность икреативность). Привезете ли Вы с собой в Россию особенный посыл?Да,конечно.Едвалиможнопереоце­нить положительный эффект отхорошей инфраструктуры для эко­номикивцелом.Понекоторымоцен­кам,вВеликобританиикаждыйфунт,потраченный на инфраструктуру,приносит эквивалент £2.84 в эконо­мику, 90% котороготратитсяв этойстране. Так что, без сомнения, инве­стиции в инфраструктуру действи­тельно помогают экономике расти.Мыосуществилиоколо1,000инфра­структурных проектов за последние20летспомощьючастно­государст­венногопартнерства(ЧГП);насколь­комнеизвестно,вРоссиинасчитыва­ется около 350 проектов ЧГП, номногие из них приостановлены. In Russia, the xxII Winter Olympic and ParalympicGames in Sochi look set to leave a rich Olympic legacy forlocal residents. In the Sochi 2014 Environmental Strategy,PresidentoftheOrganisingCommitteeforSochi2014Dmi­tryChernyshenko,hasoutlinedtheopportunityforasustain­abledrivethroughoutRussiafollowingthegames.

“PreparationsanddeliveryoftheGameswillbecomeacata­lystforpositivechangesregardingawarenessofthelevelofenvi­ronmentalresponsibilities,notonlyintheregionofthegamesbutalsothroughoutthewholeofRussia,andwillcreateadvan­tageousconditionsforimplementationofanumberofneededamplitudinousenvironmentalprogrammes.”

This is aviewsharedby theChairmanof theSuperviso­ryCouncilof theOrganisingCommittee,AlexanderZhukov,whose contribution to the Sochi2014 EnvironmentalStrat­egy reads:“TheseGameswillbe innovative–onemore stepforour countryon itsway towards practising theprinciplesof sustainabledevelopmentandenvironmentally responsibletechnologicalperfection.”

RussiawillusetheWinterGamesasabenchmarkforsus­tainableconstructioninthefuture.Coupledwiththewilling­nessfromexpertssuchasMacetosharebestpracticefromtheUK and worldwide, and the values shared within the Sochi2014 Environmental Strategy, Russia has the foundations tocreateaRussianlegacyofsustainabledevelopmentformanyyearstocome.

Keepinginmindmajoreventsbesides2014SochiWinterOlympics,suchasthe2013UniversiadeinKazan,the2016IceHockeyWorldChampionshipinMoscowandSt.Petersburgandthe2018WorldCuptakingplaceacrossmultipleRussiancities,it’stherighttimetobuilduponthisvaluableexperience,hereinRussia.

Rising costs of green­field sites as well as increasedconstructioncostsandpoortransportinfrastructureto“out of town” sites means that many investors anddevelopers are increasingly attracted to the idea of

regeneratingindustrialareasandcreatingmodern,mixed­usezones.

Ascitiesgrewanddevelopedindustriestocreateemploy­ment,primelandwasusedtobuildfactories,warehousesandaffordablehousing.Atthesametimepeoplewereflockingtothecitiesforworksotheseindustrialsitesbecameenvelopedintothecities.

Theadvantagesofdevelopingtheselandplotsareclear–theindustrialzonesareoftenlocatedneartocitycentresonexpensiveland.Manyofthefactories,warehousesandbuild­ingsarestructurallysound,aestheticallypleasing–andidealcandidatestobegivenanewleaseoflife.

Onealsooftenfindsthatthesesitesareinattractiveloca­tions – places where people would want to live and work.Many of the factories and warehouses are located close towater–usedaspowerbeforetheindustrialrevolutionandasameansoftransportingrawmaterials.

IntheUKwecantracethestartofindustrialandurbanregenerationbacktothelate19thcenturywhereoldmanu­facturing plants were simply demolished and replaced withnewerversions–andthenagaininthemid­20thcenturyaswebegantoliveinaworldthatwas(andremains)largely“de­industrialising”.Overtime,urbanrenewalhasevolvedandisnowbasedlessondemolitionanddestructionandmoreonrenovationandinvestment.

It is, however, expensive for developers and investors toclean up the pollution on these industrial sites and makethemattractive,habitableareas.Therearemanypeoplewhobelieve that the state (or local authorities) should have anobligationtopart­fundorheavilysubsidiseclean­upopera­tions–aseffectivelythesesiteshavenocommercialvaluetoadeveloperunlesssomebodyeithermakesthemdevelopable–orgivesthemawayforfreetothedevelopertooffsetclean­upcosts.

The danger of local authorities not subsidising thesedevelopmentsmeanthatcitieswillinvariablyexperiencewhatis commonly known as“the doughnut effect”. The Britishdoughnut,acircleofbland,uninspiringbreadwithjaminthemiddle,isusedtodescriberichinner­cityzonessurroundedby dilapidated and run­down suburbs (not to be confusedwiththeAmerican“donuteffect”–asugarysweetringwithnothinginthecentre).

Birmingham­EastsideOnce known only as a concrete wasteland, Eastside in thecentreoftheUK’s“secondcity”hasbeentransformed.ThishasbeenachievedwithamixtureofpublicandprivatemoneyandisoneofthemostsuccessfulregenerationprojectsintheUK.

Duringthe18thand19thcenturies,thisareawashometohundredsoffactories,warehousesandworkshops,and,likeStPetersburg,usedalargecanalnetworktoprovidebothpowerand access. By the late 1880s an efficient tram network ranthrough the area and helped make Birmingham one of theleadingindustrialcentresinEurope.

Astheindustriesdeclined,theoldVictorianfactoriesandother buildings became derelict and were no longer main­tained. The canals fell into disuse and became clogged andpolluted.Thosepeoplewhocouldafforditbegantomoveoutoftheareaandasthenumberofinhabitantsdeclined,smallbusinessesandshopsalsobegantoclose.

Bythe1980sthelocalauthoritiesrealisedtheyhadtoact,andinconsultationwitharchitects,engineersandplannerstheysetinprocessatransformationthathasbeentrulyincredible.

Industrial­Regeneration­Boosts­Economic­Development­in­City­CentresIn a country as vast as Russia, regeneration of industrial or “brownfield” areas has largely been seen as unnecessary – why spend time cleaning up old industrial zones and creating fresh modern areas when you can simply select a clean, green plot of land and start all over again? In many ways this is exactly what has been happening in Russia – until recently.

ARUP worked extensively on this project which wasplanned to redevelop the area around a park which followsthecurveofCurzonStreetandeffectivelylinksEastsidetothecitycentre.

Manyeffortsweremadetosaveandrestoremanyofthehistoricbuildingsinthearea–includingCurzonStreetSta­tion. Built in 1838, it is the world’s oldest surviving railwayterminus.

Thecanalsandwaterwayswerecleanedupandrestaurantsandcafesarenowsituatedalongthebanks–providingpleas­antplacestowalkandrelax.Businessesandshopshavecomeback to the area and the“New Bullring” is proving to be amajorsuccessaswellasapieceoficonicarchitecture.Situatedonthesiteofamedievalmarketplace,theBullringhasbeenamarketplacesince1154andremainsavibrantcolourfulplacemorethan850yearslater.

Case­Study­–­Liverpool­docks­and­waterfrontOncethebiggestportintheUK,Liverpool,likeBirmingham,was an industrial powerhouse. Factories and warehousesstretchedalongthecitycentrewaterfrontandemployedmanythousandsofpeople.Asshipsgotbiggerinthelate19thandearly 20th centuries, Liverpool’s port became too small tohandle the enormous amount of goods and raw materialsflooding into the UK, so a new port was developed furtheralongthecoast,closertotheIrishsea.

Thisport, in turn,declined in the1970sandLiverpool’sonce­wealthyindustrialbasefellintodecay.Peoplemovedoutof the area and the once greatVictorian buildings fell intodisuseandbecamederelict.

InrecentyearsLiverpoollocalauthorities(alongwithpri­vatedevelopersandinvestors)havemanagedaprogrammeofurbanandindustrialregenerationthathasmeantrealupturninthecity’sfortunesandagrowingshareofthetourismmar­ketintheUK.

The Albert Docks (named after the husband of QueenVictoria)havebeenrestoredtotheirformergloryandware­housesandfactorieshavebeenturnedintoshops,restaurantsandluxurycitycentreapartments.

The canals that linked the port to the important neigh­bouringcitiesofSheffield,Manchester andLeedshavebeencleanedandrestored–andhavebeenahugeboostfortourism.

Environmentalworksoverthelast20yearsyieldedvisualimprovementbutfailedtoattractpeopletousethecorridor.ThenewLiverpool­Leedscanallinkcreatesanamazingexpe­rienceforboatersastheynavigateLiverpool’shistoricwater­front.BookingshaveexceededBritishWaterways’expectations,attractinganestimated4,500boattrips,200,000extravisitorsandboostingtheLiverpooleconomyby£1.9millionannually.

The­“Bilbao­Effect”Another interesting theme in industrial and urbanregenerationisthe“BilbaoEffect”(sometimesalsoreferredtoasthe“GuggenheimEffect”).Thisisthetermthatisappliedtotheresultsof investingmoneyinnewbuildings–usuallyarchitecturallystunning–inrun­downorindustrialareasinordertorevitaliseandregeneratethem.

The Guggenheim in Bilbao (designed by Frank Gehry)set in motion a city­wide revitalisation.Within a matter ofmonths, this building saw Bilbao change froman industrialcity thathadfallen intodecay intooneof themostpopulardestinations for tourists in Europe. This encouraged invest­mentintheareaandbusinessesandresidentialdevelopmentsreturnedtowhathadoncebeenadecayinganddisusedareaontheriverside.

The theory that architecture is the only truly public artformleftwasnotonlyprovedtobetrue,butshowntohavearegeneratingeffectonanentirearea!

Regeneration­in­RussiaJust prior to the economic crisis, there were some effortsunderway in several Russian cities to regenerate areas. The“EkatCity”projectinEkaterinburgwasoneofthese.Thecitycentrefactoriesandoldmanufacturingplantswerere­zonedand new skyscrapers planned – a mix of the regenerationprogrammesasseenintheUKandthe“BilbaoEffect”.

In Moscow, following several successful transformationsofoldfactories(RedOctoberandLootchbeingtwoexamples)intocommercialandresidentialcomplexes,planstosave,re­useandregenerateother industrialzoneswerebeginningtobeconsidered.

WhatiscertainisthatthisisatrendthatwillincreaseinRussia,buttobetrulysuccessfulitneedstheactiveandfinan­cial co­operation of local authorities – and a real desire torevivethegreatcitycentresofRussia.

По мере того, как города росли и развивали про­мышленность для создания рабочих мест, первичныеземли использовалась под строительство фабрик, скла­довидоступногожилья.Втожевремялюдистекалисьвгородавпоискахработы,иэтипромышленныеобъектысталичастьюгородов.

Промышленная­реконструкция­–­вторая­жизнь­городского­центраВ такой огромной стране, как Россия, реконструкция промышленных или застраиваемых вторично площадей до сих пор считалась ненужной. Зачем тратить время на расчистку старых промышленных территорий и создавать новые, современные пространства, когда можно просто выбрать чистый нетронутый участок и построить все заново? И до сих пор именно это в основном и происходило в России.

Построенная в 1838 году станция на Curzon Street остается самым старым железнодорожным вокзалом.

Здание Гуггенхайма в Бильбао (спроектированноеФранком Гери) запустило процесс реконструкции повсему городу. Буквально за несколько месяцев это зда­ниепревратилоБильбаоиззахолустногопромышленно­гогородаводноизсамыхпопулярныхместпосещениятуристоввЕвропе.Этопривлеклоинвесторов,бизнес,нанедавнодеградирующуюзапущеннуюприбрежнуютер­риториювернулсяижилищныйдевелопмент.

Теория, что архитектура – единственная оставшаясяформаобщественногоискусства–нетолькоподтверди­ласвоюправильность,ноиоказалавосстановительныйэффектнавсютерриторию!

Реконструкция­в­РоссииКакразпередэкономическимкризисомвнекоторыхрос­сийских городах предпринимались некоторые попыткиреконструировать территории. Среди них был проект«Екат­сити» в Екатеринбурге. Фабрики в центре городаистарыезаводыбылиреструктурированыинаихместебылиспроектированыновыенебоскребы–комбинацияпрограмм реконструкции по опыту Великобритании и«Бильбао­эффекта».

В Москве по опыту некоторых удачных преобразо­ванийстарыхфабрик (например, «Красныйоктябрь»и«Луч») в коммерческие и жилищные комплексы сталирассматриватьсяпланыпосохранению,реконструкцииирегенерациидругихпромышленныхтерриторий.

Очевидно,чтоэтатенденциябудетрастивРоссии,нодлянастоящегоуспеханеобходимаактивнаяифинансо­ваяподдержкаместныхвластейиистинноежеланиевоз­родитьпрекрасныецентрыгородовРоссии.

Sincethebeginningofthe1990s,therehasbeenactivediscussionof theproblemsof stimulating investmentandcreatingalegislativeframework,encouraginglocaland foreign investors to invest production capital in

the Russian economy, including by introducing concessionand other agreements. Compared to the legislation of thattime,majoradvanceshavebeenmadeinthisdirection,amongthemadoptionoftheimportantFederalLawof21July2005No.115­FZ“OnConcessionAgreements”(theLawonCon­cessions).

YettheRussianlegislationonPPPisstillnotfullydevel­opedandthelistofformsofPPP,forwhichspecialregulationisenvisaged,isverylimited,whilethatofPPPformsusedinpracticeisevenshorter.

The majority of Russian PPP projects are implementedas concession agreements. This form is particularly used insuch projects as the concession agreement on the Moscow­StPetersburgExpressHighway–Km.15­58, theconcessionagreement on the“New exit on to the Moscow Ring Roadfrom the Moscow­Minsk“Belarus” Federal Highway” andmanyotherprojects,includingregionalandlocalones.

TheRussianPPPlegislationalsogivesaverynarrowdefi­nitionofconcessionrelations.

Under Russian legislation, the essence of a concessionagreementconsistsintheconcessionaireundertakingtocre­ate and (or) renovate, at its own expense, certain propertyownedortobeownedbythegrantor(thatis,stateormunici­pally owned) and conducting business using this property,and the concessionaire being provided with given propertyforpossessionanduse(butnotthetitlethereto)foraspecificperiodoftime.

Initially, the Law on Concessions envisaged even greaterrestrictions, insisting that thepropertyprovidedto thecon­cessionairebefreeofanythirdpartyrights.Ifthesubjectoftheconcessionagreementconsistedinutilityfacilities,itwasextremelydifficulttomeetthisrequirement,sincemostsuchmunicipal infrastructure facilities in the Russian Federationareundertheoperatingcontrolofspecialisedenterprises.

The Law on Concessions was amended on 6 July 2010so that, if a concessionagreementwas related to municipalinfrastructure systems and other such facilities, at the timeoftransfertheycouldbelongtoastate­ownedormunicipalenterprisebyrightofoperatingcontrol.

It was also established that the given enterprises mightexerciseindividualpowersasthegrantor,includingbytrans­ferringtotheconcessionairetherightstopossessanduserealestateandtherighttolandplots.Beforetheamendmentswereintroduced into the legislation, a public enterprise was notpermitted to sublet landplotsor transfer rightsandobliga­tions under lease agreements to third parties. In addition, anumberofchangeswereintroducedtosimplifytheprocedurefor raising credits (although the given rules engender manyquestionsfromthepracticalpointofview).

In general, the given amendments promoted greater useoftheconcessionformofco­operationandalsohelpedelimi­nateanumberofdifficultiesinvolvedinimplementingpro­jectslaunchedpreviously.

Specialists also include production­sharing agreementsamongPPPforms.Aspeciallawwaspassedontheseattheend of 1995 (Federal Law of 30 December 1995 No. 225­FZ“On Production­SharingAgreements”).A production­sharingagreement isoneunderwhich theRussianFedera­tiongrantsaprivatepartner,forapaymentandforaspecificterm,exclusiverightstoseek,surveyandextractmineralrawmaterialsona subsoil sector,whereas theoutputproducedis to be divided between the state and the private partner.Despite the federal law, thegivenformofco­operationhasonly been used for three projects – Sakhalin­1, Sakhalin­2andKharyaga.

Some experience has been gathered in Russia of otherforms of PPP, too, including the BOOT (Build Own Oper­ateTransfer)/BOT(BuildOperateTransfer)models,underwhichpublic infrastructurefacilitiesbuiltbyaninvestorarealsooperatedtherebyforacertainperiod,afterwhichtheyaretransferredtostateownership.

One of the first examples consisted in the projects toexpandthepurificationplantinZelenograd,aswellasseveralprojects for mechanical dewatering of waste water residues,which were launched back in 1997–1998. So, in accordancewitharesolutionoftheGovernmentofMoscowof17March1998,aninvestmentcontractwasconcludedbetweentheGov­ernmentofMoscowandaGermaninvestorgrantingthelattertherighttobuildthepurificationplantinZelenogradaccord­

ingtotheBOOTmodel,ontheconditionofcompensationoftheinvestor’scostswithin12.5yearsandsubsequenttransferofthefacilitiestoownershipbytheCityofMoscow.Forthesepurposes,theDepartmentforEconomicPolicyandDevelop­mentofMoscowwaschargedwithallocatingannualcapitalinvestmentlimitsunderinvestmentprogrammes.Preparationandimplementationofthegivenprojectswasbasedprimarilyon subjudicial regulatory acts of a regional level, given thattherewasnoproperregulationofrelationsregardingexpendi­tureofbudgetfundsatthefederallevelandtheLawonCon­cessionhadnotyetbeenpassed.

Relatively recently,Moscow launchedyetanotherBOOTproject for construction of a“Production unit (plant) forsodium hydrochloride” in accordance with directive of theGovernmentofMoscowof27September2007No.2144­RP,“Onconstructionofanurbanconstructionfacility,constitut­ingthesubjectofinvestmenttenders,locatedat:Nekrasovka,LyubertsyPurificationPlantPUMosochistvodMGUPMos­vodokanal, implemented on the BOOT model (Build OwnOperateTransfer)”.

The structure of the given project is the following: thedeveloperisalegalentityspeciallysetupbytheinvestorandbelonging 100 per cent thereto. Once construction is com­plete,thedeveloperistoleasethefacilitytoaspecialisedcom­pany(alimitedliabilitycompanysetupbytheGovernmentofMoscow,theDeveloperandMGUPMosvodokanal).Whentheinvestmentpay­backperiodisover,Moscowmustbuyup100percentofthesharesinthedeveloper.

ThepossibilityofusingtheBOOTmodelisenvisagedbyLawofStPetersburgof25December2006No.627­100“OnParticipationbyStPetersburginPublicPrivatePartnership”(Clauses2,6,and7,Article5).Atthesametime,BOOT­struc­turedprojectswereimplementedinStPetersburgevenbeforethegivenlawwaspassed.Oneexampleistheprojecttocon­struct theSouth­WestPurificationPlant,underwhichGUPVodokanal St Petersburg is to buy up the built facility intoStPetersburgownership,usingbothequityandraisedfunds(LawofSt.Petersburgof21June2002No.263­22“OntheSt.PetersburgTargetProgramme‘OncompletionoftheSouth­WestPurificationPlant’”).

In some constituent entities of the Russian Federation,legislative acts have been passed proclaiming the possibilityofimplementingsimilarprojects(see,forexample,Clause1,Article5of Lawof theRepublicof Udmurtiaof 9 October2009No.39­PZ,“OnParticipationbytheRepublicofUdmur­tiainPublicPrivatePartnerships”,Article4ofthelawoftheRepublic of Tyva of 2 November 2009 No. 1552VХ­2,“OnParticipationbytheRepublicofTyvainPublicPrivatePart­nerships”).

Recently,therehasbeenincreasingtalkabouttheneedformoreactiveuseanddevelopmentofotherpublicprivatepart­nershipinstruments,suchas“lifecyclecontracts”,long­terminvestmentagreementsandinfrastructurebonds.

Despitetheexistenceofregionallegislativeacts,however,the federal legislation includes restrictions impeding use ofthegiven formsofPPP(including theBOOTmodel).Yet itshouldalsobestressedthattheinstitutionofPPPisacom­plexoneandreliesprimarilyonfederalratherthanregionallegislation.

Thegivenrestrictionsareassociatedmostlywith(i)pro­visiontotheprivatepartnerofalandplotorrealestate(thelegislation lists the grounds for such provision and relatedprocedures);(ii)complicationsinsettingtariffs(iftheprivatepartner is to conduct business at state­regulated prices/tar­iffs);(iii)difficultiesinthestateacceptinglong­termfinancialliabilitiesandthespecificsof theRussianbudget legislation;(iv) lack of proper regulation of the procedures for select­ing the private partner and other circumstances, includingobjectivedifficulties in compelling the state to discharge itsobligations.

So, letus return to the lawofSt.Petersburg,whichpro­claimsthepossibilityofstructuringPPP­projectsinavarietyofforms.Inparticular,theprojectforcreating,renovatingandoperatingPulkovoairport facilitieson a PPP basis is struc­tured proceeding from regional legislation, rather than fed­eral.Evenso,duringpreparationsforandtheinitialstagesoftheproject,problemscausedbyobjectivefederalrestrictionshadtoberesolved.

Overall,however,itshouldbenotedthattherearesignifi­cant,positivedevelopmenttrendsintheRussianPPPlegisla­tion.TheStateDumaExpertCouncilforlegislationonpublicprivatepartnership,variousfederalexecutiveauthoritiesandinterestedorganisationsaredrawingupamendments to theRussianPPPlegislationtoimproveanddevelopthisinstitu­tion. Practical implementation of PPP is also expanding inRussia–withrespectnotsomuchtolarge­scaleprojectsastosmallregionalones.

странных инвесторов к вложению производственногокапитала в российскую экономику, в том числе путемвнедрения концессионных и иных договоров. Сейчасможно смело говорить, что по сравнению с законода­тельствомтоговременибылисделанысерьезныешагивэтом направлении.В том числе был принят такой важ­ныйакт,какФедеральныйзаконот21июля2005года№115­ФЗ«Оконцессионныхсоглашениях»(далее–«Законоконцессиях»).

Вместестем,по­прежнему,российскоезаконодательст­вооГЧПнельзяназватьхорошоразвитым:переченьформГЧП,длякоторыхпредусмотреноспециальноерегулиро­вание, очень ограничен, а перечень форм ГЧП, которыефактическииспользуютсянапрактике,ещеболееузкий.

БольшинствороссийскихГЧПпроектовреализуетсяв форме концессионных соглашений.В частности, кон­цессионная форма использована в таких проектах, какконцессионное соглашение в отношении скоростнойавтомобильноймагистрали«Москва–Санкт­Петербург»научастке15­йкм–58­йкм»,концессионноесоглашениевотношении«НовоговыходанаМосковскуюкольцевуюавтомобильную дорогу с федеральной автомобильнойдорогиМ­1«Беларусь»Москва–Минск»имногиедругиепроекты,втомчислерегиональногоиместногоуровней.

Сущность концессионного соглашения по россий­скому законодательству состоит в том, что концессио­нер обязуется за свой счет создать и (или) реконструи­ровать определенное имущество, право собственностинакотороепринадлежитилибудетпринадлежатьконце­денту(тоестьнаходитсявгосударственнойилимуници­пальной собственности), осуществлять деятельность сиспользованиемэтогоимущества, аконцедентобязует­ся предоставитьконцессионеруна установленныйсрокправовладенияипользованияданнымимуществом(нонеправособственности).

ИзначальноЗаконоконцессияхпредусматривалещебольше ограничений, например, подразумевалось, чтопередаваемоеконцедентуимуществодолжнобылобытьсвободнымотправтретьихлиц.Выполнитьтакоетребо­ваниевслучае,еслиобъектомконцессионногосоглаше­

ния являлись объекты коммунального хозяйства, былоочень проблематично, так как большинство объектовкоммунальной инфраструктуры в Российской Федера­циинаходятсявхозяйственномведенииспециализиро­ванныхпредприятий.

ПочтигодназадвЗаконоконцессияхбыливнесеныизменения(изменениявступиливсилу6июля2010г.),согласнокоторымеслиобъектомконцессионногосогла­шения являются системы коммунальной инфраструк­туры и иные объекты коммунального хозяйства, такойобъект на момент его передачи может принадлежатьгосударственному или муниципальному предприятиюнаправехозяйственноговедения.

Такжебылоустановлено,чтоуказанныепредприятиямогутосуществлятьотдельныеполномочияконцедента,в том числе передавать концессионеру права владенияи пользования недвижимым имуществом и права наземельные участки. До внесения изменений законода­тельствонепозволялопубличнымпредприятиямсдаватьземельные участки в субаренду или передаватьправаиобязанностиподоговорамарендытретьимлицам.Крометого,былвнесенрядизменений,направленныхнаупро­щение порядка привлечения кредитных ресурсов (хотяданныенормывызываютмноговопросовсточкизренияпрактикиихприменения).

Вцелом,данныеизмененияспособствовалиувеличе­ниюиспользованияконцессионнойформысотрудниче­ства, а такжепомоглиустранитьрядсложностейвреа­лизациипроектов,начатыхещедовнесенияизменений.

Зеленограда, а такженесколькопроектоввобластимеханическогообезвожи­вания осадков сточных вод, реализация которых быланачатаеще1997­1998годах.Так,всоответствииспоста­новлениемПравительстваМосквыот17марта1998годамеждуПравительствомМосквыинемецкиминвесторомбылзаключенинвестиционныйконтракт,согласнокото­ромуинвесторубылопредоставленоправоосуществитьстроительствоочистныхсооруженийвг.Зеленоградепомодели BOOT, с условием о компенсации инвестору втечение12,5летзатрат,ипоследующегопереходасоору­женийвсобственностьгородаМосквы.НаданныецелиДепартаментуэкономическойполитикииразвитиягоро­даМосквыбылопредписанопредусматриватьежегодноевыделение лимитов капитальных вложений в инвести­ционныхпрограммах.Подготовкаиреализацияданныхпроектов основывалась, прежде всего, на подзаконныхнормативных актах регионального уровня, в условияхотсутствия надлежащей регламентации отношений порасходованиюбюджетныхсредствнафедеральномуров­не,атакжедопринятияЗаконаоконцессиях.

ОтносительнонедавноМосквойбыланачатареализа­цияещеодногопроектаBOOT,построительствуобъекта«Производство(завод)гипохлориданатрия»всоответст­виисраспоряжениемПравительстваМосквыот27сентя­бря2007года№2144­РП«Остроительствеградостроитель­ногообъекта,являющегосяпредметоминвестиционныхторгов, расположенного по адресу: поселок Некрасовка,Люберецкие очистные сооружения ПУ «Мосочиствод»МГУП«Мосводоканал»,реализуемогопомодели«BOOT»(строить,владеть,эксплуатировать,передавать)».

Обращаетнасебявниманиеструктураданногопроек­та.Застройщикомвыступаетюридическоелицо,специ­альносозданноеинвестором,ипринадлежащеена100%инвестору.Послезавершениястроительствазастройщикпередаетобъектварендуспециализированнойкомпании(обществусограниченнойответственностью,учреждае­момуПравительствомМосквы,ЗастройщикомиМГУП«Мосводоканал»). После завершения срока возвратаинвестицийгородМосквадолжнавыкупить100%акцийзастройщика.

ВозможностьиспользованиямоделиBOOTпредусмо­тренаЗакономСанкт­Петербургаот25декабря2006года№627­100«ОбучастииСанкт­Петербургавгосударственно­частныхпартнерствах»(п.2,6,7ст.5).Приэтом,проекты,построенныепомоделиBOOT,реализовывалисьвСанкт­Петербургеидопринятияданногозакона.Вкачествепри­мераможнопривестипроектпостроительствуЮго­Запад­ныхочистныхсооружений,всоответствиивкоторымвыкуппостроенныхобъектоввсобственностьСанкт­ПетербургапредусмотренпосредствомГУП«ВодоканалСанкт­Петер­бурга»,втомчисле,засчетсобственныхипривлеченныхсредств(ЗаконСанкт­Петербургаот21июня2002№263­22«ОцелевойпрограммеСанкт­Петербурга«ОзавершениистроительстваЮго­Западныхочистныхсооружений»).

В некоторых субъектах РФ также приняты законо­дательныеакты, декларирующиевозможностьреализа­цииподобныхпроектов(см.,например,п.1ст.5ЗаконаУдмуртскойРеспубликиот9октября2009года№39­РЗ«ОбучастииУдмуртскойРеспубликив государственно­частныхпартнерствах»,ст.4ЗаконаРеспубликиТываот2ноября2009года№1552ВХ­2«ОбучастииРеспубликиТывавгосударственно­частныхпартнерствах»).

В последнее время все больше говорится также онеобходимостиактивнееиспользоватьиразвиватьиныеинструменты государственно­частного партнерства(например, «контракты жизненного цикла», долгосроч­ные инвестиционные соглашения, инфраструктурныеоблигации).

Однако,несмотрянаналичиерегиональныхзаконо­дательных актов, в федеральном законодательстве име­ются ограничения, которые препятствуют использова­нию данных форм ГЧП (включая модели BOOT). Приэто подчеркнем, что институт ГЧП является комплек­сным и опирается, прежде всего, на законодательство,находящееся в ведении Российской Федерации, а не нарегиональное.

Данныеограничениясвязаныпреждевсегос(i)пре­доставлением частному партнеру земельного участкаилиобъектанедвижимости(законодательствомпредус­мотренисчерпывающийпереченьоснованийдляпредо­ставленияисоответствующихпроцедур);(ii)сложностя­миприустановлениитарифов(есличастномупартнерупредстоитосуществлятьдеятельностьпорегулируемымгосударствомценам/тарифам);(iii)сложностямивпри­нятии со стороны государства долгосрочных финансо­выхобязательствиособенностямироссийскогобюджет­ногозаконодательства; (iv)отсутствиемдолжногорегу­лированияпроцедурвыборачастногопартнераиинымиобстоятельствами, включая объективные сложности впринуждениигосударствакисполнениюобязательств.

Так, вернемся к Закону Санкт­Петербурга. Даннымзаконом провозглашена возможность структурирова­нияГЧП­проектовразличныхформах.Вчастности,про­ектсоздания,реконструкциииэксплуатациинаосновеГЧПобъектов,входящихвсоставимуществааэропорта«Пулково»,структурированнаоснованиирегиональногозаконодательства,анефедерального.Приэтомприпод­готовкеинаначальномэтапепроектапришлосьрешатьпроблемы, вызванные объективными федеральнымиограничениями.

Вцеломже,необходимоотметитьзначительныеполо­жительныетенденциивразвитиироссийскогозаконода­тельстваоГЧП.ВнастоящеевремяЭкспертнымсоветомпозаконодательствуогосударственно­частномпартнер­ствеГосударственнойДумы,атакжеразличнымифеде­ральнымиорганамиисполнительнойвластиизаинтере­сованными организациями осуществляется разработкаизменений в российское законодательство о ГЧП,направленныхнадальнейшеесовершенствованиеираз­витие данного института. Расширяется и практическоеприменениеинститутаГЧПвРоссии,причемнетолькоинестольковчастимасштабныхпроектов,ноивотноше­ниинебольшихрегиональныхпроектов.

Russian­RugbyForthoseofyouwhodonotknowthebackgroundofRussianrugbywecansaythatRussianrugbyhasalonghistory,start­

ingfrom1923.TheUSSRRugbyUnionwasfoundedin1936,and USSR Championships were regularly played through1935–1939.Afterthistimethesportofrugbywasbannedasresultofideologicalconsiderationsuntil1957,atwhichdatethefirst internationaltournamentwasstagedinRussiawithparticipation from Romania andWales. In 1966, the USSRrugbychampionshipswererevivedwiththeparticipationofeight clubs, and since then thishasbeenplayedeachyear–however, since1990, this has been in the formof aRussianChampionship.

In1990RussiainheritedtheUSSRlegacyandsojoinedtheInternationalRugbyBoard.Indeed,theRussianNationalTeamwas invited (butdidnotparticipate) in the inauguralRugbyWorldCup1987inNewZealandandattemptedtoqualify,with­outsuccess,forthe1995,1999,2003and2007RugbyWorldCupTournaments.

Despitethis,theRugbyUnionofRussiahasenjoyedunpar­alleledsuccessoverthelastoneandahalfyearswithrugbynowbecominganOlympicSport(soimportantinRussia),qualify­ingforthefirsttimetoparticipateintheRWCFinals inNewZealandlaterthisyearand,ofcourse,winningtherighttohostthelasteverRWCSevensFinals.

AsPresidentoftheRugbyUnionofRussia,IamveryproudofourachievementsbothonandoffthefieldandIcherishtherelationsthatwehavesetupwiththeRugbyUnionsoftheBri­tishIsles.Itwouldbeextremelyspecialtome,andforrugbyinRussia,ifmembersoftheRBCCcouldplayasignificantroleintheRWCSevens2013inRussia.

British construction industry visits St PetersburgTrevor Barton of Clyde & Co reports

The highlight of the past month was the visit of a mission representing the British construction industry to the city. The mission we led by James Clappision MP, Minister of Construction, and included representatives of nearly a dozen major companies. Broadly, these can be divided into contractors (Taylor Woodrow International Plc., Miller (Russia) Ltd, Bovis CIS); project managers (Hanscomb, Symonds Travers Morgan Ltd, George Corderoy& Co) and consultant engineers (Graham Con-sulting Group Ltd, Ove Arup Partnership, Sir William Halcrow&Ptrs, Rust Kennedy &Donkin Ltd).

Moscow v St PetersburgMost, if not all, of these companies already have con-

siderable experience of working on project in Russia, but many were looking at St Petersburg for the first time. The mission had already visited Moscow, and the mission members were struck by the contrast they saw between the two cities. Moscow is undoubtedly attracting much greater foreign investment at present, and every week seems to be marked by the initiation of another major building project.

Progress in St Petersburg, on the other hand, is cer-tainly slower especially as the authorities are, quite rightly, determined to keep development in the historic heart of the city under strict control. Architectural headaches such as the Hotel St Petersburg do not bear repeating. How-ever, a number of the mission members were impressed by the attitude of most local government representatives here and felt that not only are they more willing to make themselves available for discussion than their counter-parts in other cities, but they are also more frank and realistic in their plans for the future.

This approach can be seen to be bearing fruit, with a number of substantial projects under way. Examples include the Nevsky Corporate Centre which is a total refurbishment of an historic building next to the Kazan Cathedral at 25 Nevsky Prospect to provide 8, 100 m² of office accommodation at a reasonable price, will be inter-ested to learn that a new medium-priced hotel, developed by a Turkish company, is on schedule to open at the end of the year.

Intercity link – end of the lineA number of projects were formally presented to the

mission members, including the planned St Petersburg terminal for the Moscow to St Petersburg high-speed railway line. Presently budgeted at $ 316m, and with British architects already involved, there may be poten-tial for further involvement by British companies in the design and construction of the terminal. While formal planning permission has yet to be granted, approval has been given for the terminal at the Moscow end of the line. Thus it is unlikely that St Petersburg will want to be seen to b slowing the process down. It is an ambitious plan-the trains are intended to travel the 392 miles to Moscow in 2 ½ hours – but there is an impetus in this project which is lacking in others. A wry comment by one of the local newspapers: « The new terminal will b designed for maxi-mum passenger comfort, which should make it unique in Russia».

Developments in NovgorodStaying on the construction theme, an interesting

development is that Cadbury Schweppes has decided to build a substantial factory in Novgorod, some two hours drive south of St Petersburg (see June `95 Bulletin). Novgorod is an historic city which unfortunately suffered very badly in the war, although many fascinating build-ings, including the ancient Kremlin, still stand. The city is a popular destination for «expats» wanting a change of scene for the weekend. From the business point of view, property prices are still considerably below those in the major cities and, as a distribution centre, it is conveniently located between St Petersburg and Moscow. Road, rail and river communications are good. There is also a good hotel, the Beresta Palace, which was built and formerly owned by the Austrian Marco Polo chain, which runs the Nevsky Palace in St Petersburg. They sold the hotel on to Russian owners about a year ago, and standards have on the whole remained high. It is the best hotel I have stayed in the former Soviet Union outside Moscow or St Petersburg.

Incidentally, Novgorod is twinned with Watford which is (a) not an historic city with many fascinating buildings, and (b) your correspondent`s birthplace, so a jolly nice town nevertheless.
