M E M O R A N D U M

Henderson Date: September 13, 2013 Re: 2012‐2013 Report to the Membership on Executive Director Activities I am pleased to provide you with a summary of the activities on which I have worked over the past year. My attention continues to be primarily on: maintaining and updating the website; ELA webinars; Annual Meeting preparation; helping to launch the industry groups; coordinating marketing/sponsorship opportunities; client‐related activities; joint projects; and day‐to‐day contact and correspondence with members. ELA WEBSITE: The ELA website currently has more than 9300 registered users. Among the most notable increases this past year are people finding the site, visiting multiple pages, and using our Global Employer Handbook. The first eight months of 2013 saw nearly 4100 visits to the Handbook Landing Page (with thousands more to individual chapters), while that same time period in 2012 saw approximately 3500 visits – all the more reason for members to regularly ensure their chapters are up to date. Interestingly, the top 25 Handbook pages visited between January 1 and August 31, 2013 are all international jurisdictions. My website work includes updating Handbook chapters and editing and posting new chapters; posting law firm articles, events, seminars, etc., adding new members, updating current members’ pages; adding new content; and periodically reviewing sections to be sure they remain current and user‐friendly. We have recently added several new features to the website, including the first round of Immigration Law Overviews, a companion to the Global Employer Handbook. We also will be adding over the next several months the information culled from the project we are doing jointly with Employment Screening Resources on international background checks.

Users would need to log in for a more general, higher level overview similar to the Global Handbook. ELA members would also have access to an “internal” version, which would be a compilation of all the data, including specific citations to laws, cases, regulations, etc. with more detail that would be a tool for advising clients, but would not be made public. Finally, in response to requests from members, the website will soon have search capabilities within and among the Global Handbook chapters. Website Factoids:
The ELA home page had 30,405 page views
The Member Directory had 22,500 page views
The Global Handbook landing page had 4,100 page views, with thousands more page views of individual chapters
More than half the visits to the site were via a Google search
There were 270 visits originating from the NACUA website, with an average visit of 11:27
The ACC online ad campaign yielded 135 visitors
Referrals from SHRM yielded 878 visitors
Referrals from Aperian Global yielded 536 visitors Goals for the website for next year:

Employment Law in Bangladesh Our webinars routinely receive very high marks for their content and the quality of speakers, as evidenced by both the evaluation forms and the number of repeat attendees. Although still predominantly a U.S. phenomenon, they are catching on with more and more of our members, who see them as an opportunity to further demonstrate the value, breadth, and potential benefits of the ELA relationship. 2013 ANNUAL MEETING PREPARATION: The format for this year’s Annual Meeting is changed a bit to include an extended General Session on Day 1 to enable a more in‐depth and inter‐active discussion of membership fees, RFPs, and other issues that will help us to plan programs and activities that benefit the members and their clients for the coming year. The agenda also features a “Hot Topics in Employment Law” panel, a client panel featuring in‐house counsel from five major multi‐national companies, and the traditional regional discussion groups. Day 2 sees the return of Richard Susskind, who will discuss his latest research findings and their specific applicability to the practice of employment law, as well as the ELA. That will be followed by how one ELA member firm has successfully applied Susskind’s words to its work for clients. MARKETING/SPONSORSHIP ACTIVITIES: We continued to market the ELA this past year through generally the same channels as in the past as a way to continue branding the ELA and ensuring greater name recognition. We are looking to expand this list over the coming year to include more international venues.

Association of Corporate Counsel Advertising and Sponsorship: Advertising. This year, the ELA advertised in the ACC Docket (both the print and online versions) and on the front page of the ACC website. The online ad rotated among a general ELA click‐through ad, a Global Employer Handbook click‐through ad, and occasionally, an ad promoting a specific webinar. The return on our investment was generally positive, as demonstrated by the number of people who clicked on a given ad and then went on to view multiple pages on our website. Sponsorship. This year, the ELA was again accepted by ACC as a sponsor of and exhibitor at two of its meetings:
ACC Europe in Barcelona, May 12‐14; attended by nearly 250 in‐house counsel from major corporations in the EU. Steve participated on behalf of the ELA in a session entitled “Corporate Social Responsibility: Multinational Companies Adopting Corporate Codes of Conduct with Social Provisions.” Other ELA members who volunteered at the booth were: Vicente Calle, (Spain), Sasha Stepanova (Czech Republic), Roland Kaufmann (Switzerland), Vibeke Jaggi (Switzerland).
2013 Annual Meeting, Los Angeles, October 27‐30. Nearly 2,000 in‐house counsel from major corporations in the U.S. are expected to attend. The ELA is a “Blue Level” sponsor this year; thus, we do not have any members participating in a panel session. However, we do have an exhibit booth, staffed by 10 ELA member volunteers (including Steve) from the U.S. Canada, and Europe, including: Bruce Cross (Arkansas), Erin Kuzz (Ontario), Gary Simpler (Maryland), Leonard Court (Oklahoma), Glen Kraemer (California), Jan Lelley (Germany), Todd Photopulos (Tennessee), Juan Carlos de la Vega (Mexico), John Wheelen (Ireland).
As with past ACC meetings, we will host a strictly social dinner in L.A. for any clients of ELA members who want to attend. There is no underlying agenda other than to encourage better name recognition in hopes they might visit the website and ask you (as their attorney) how they can more fully benefit from your membership.
National Association of College and University Attorneys Sponsorship (June 22‐15, 2013):
Twelve member firms participated in ELA’s sponsorship of the 2013 NACUA Annual Conference; each contributed $2,000.
“Platinum Level” sponsorship entitled us to sponsor the Saturday Networking Breakfast and Saturday morning coffee break.
The ELA and all participating firms were listed in the NACUA sponsorship brochure, featured on the special NACUA Annual Conference website, and included in signage in the registration area for the duration of the conference, as well as outside the room where the breakfast was held.

Capitalizing on the success of past ELA member/client dinners, we hosted a similar event this year. About 35 people attended the dinner.
In conjunction with the NACUA meeting, the Higher Education Council in cooperation with Reed Smith put together an invitation‐only video conference at the Reed Smith offices focusing on key immigration issues for faculty and staff in international programs. Moderated by Natasha Baker, it featured ELA members Leigh Cole (US) and Pablo Laresgoiti (Mexico) “live” and, by video conference, Atul Gupta (India) and Jeffrey Wilson (China).
Association of Caribbean Corporate Counsel (December 5‐6, 2013)
Anticipated attendance is 200‐250, primarily from Caribbean jurisdictions. Ideal opportunity to market the ELA to this group of lawyers. ELA will have an exhibit booth and Steve is the scheduled featured speaker for the luncheon event on December 5 to talk about the ELA. In addition, our ELA members in Costa Rica (Anna Jimenez Karina) and the Dominican Republic (Luis Pererya) will participate in a panel session on “Distribution and Franchising in Puerto Rico, Costa Rica, and the Dominican Republic.” There may be one or two other opportunities to include an ELA member in a session, pending the final agenda. In addition, our ELA member in the Virgin Islands, Adriane Dudley, will attend to help at the ELA exhibit booth.
Additional Name Recognition and Branding: We continue to encourage all ELA members to include a link from their law firm’s website to the ELA website. Instructions for doing this are in the Members Only section. It is such an easy (and user‐friendly) way to direct clients to our site, register, and view a Handbook chapter or listen to a past webinar. Our analytics show that clients actually do click the link from firms that currently include the ELA logo, which helps our search engine optimization, as well as theirs. OTHER:
I continue to work with Les Rosen at Employment Screening Resources on a project focusing on
international background checks in various countries around the world. We have sent a
questionnaire to approximately 35 member firms and will begin to post the information on the ELA website. Some of the information will be public from a high‐level perspective (similar to the Global Handbook chapters) and some will be private for use by ELA members for their clients, specifically.
Recruited ELA speakers for a client event hosted by Kim & Chang, highlighting the top legal trends in labor and employment law around the world during the IPBA meeting in New Delhi. Eight ELA members participated. We plan to do something comparable with Roper Greyell in Vancouver for the May 8‐11, 2013 IPBA meeting.
Worked with our Canadian members to produce their Canadian Overview, “Critical Distinctions between U.S. and Canadian Labour and Employment Law,” co‐authored by all eight Canadian member firms.

Have made contact with the president of the World Alliance for Retail Excellence and Standards (formally NARMS International) to host a webinar introducing their members to the ELA in anticipation of establishing a relationship with them that makes many of our members their “go‐to” lawyers for employment matters for their respective companies.

If your jurisdiction is not included in the list below, we have not received an updated version of your Handbook in at least the last 12 months. Many of the chapters haven’t been updated in several years – some in as long as five years. Please assign this task to someone in your office and send your updated chapter (in a red‐line/track changes) version to Linda Henderson.
Handbook chapters need to be reviewed and updated annually to ensure that the information stays current. Your chapter is one of the best marketing tools we can offer you as part of your ELA membership. Out‐of‐date information, however, can reflect poorly on your firm and on the ELA overall.
