A G R E E M E N T

The "Kirchlicher E n t w i c k l u n g s d i e n s t " KED (The Churches' Develop ment Service) and the P R O J E C T P A R TNER

agree on the u s e of the funds approved b y KED as f o l lows :

I. Purpose of grant

1. The use of the approved amount is r e s t r i c t e d to the m e a s u r e s agreed upon with the applicant. The c o n t e n t and financial volume of the p r o j e c t / p r o g r a m m e at the time of application, as well as the e s t i m a t e d p e r i o d for implementation, form the basis.

2. Where m a j o r changes occur in the vol u m e and/or timing of a p r o j e c t / p r o g r a m m e during implementation, these are possible, subject to mut u a l consent.

II. A d m i n i strative Procedures

1. As a rule the release of funds shall take p l a c e only on the basis of w r i tten r equests from a u t h o r i z e d r e ­p r e s e n t a t i v e s of the P r o j e c t / P r o g r a m m e Partner.

2. As a rule payments shall be m a d e by' i n s t a l m e n t s w h ich allow for progress on impl e m e n t a t i o n of the p r o j e c t / programme.

3. The P r o j e c t / P r o g r a m m e Partner shall a c k n o w l e d g e each p a y m e n t in w r i ting i m m e d i a t e l y on receipt. The amount rec e i v e d in local c u rrency shall be notified.

4. All income and e x p e n d i t u r e rela t e d to the p r o j e c t / p r o g r a m m e shall be shown up s e p a r a t e l y in the Project P artner's books of account. S u p porting v o u c h e r s shall be r e t a i n e d by the Project Partner.

5. The P r o j e c t / P r o g r a m m e Partner is asked to submit annual financial statements. Such s t a tements shall be signed by at least one r e p r e s e n t a t i v e of those in ch a r g e of the p r o j e ct/programme.

6. Where KED agrees to fund part of a p r o j e c t / p r o g r a m m e or activity a financial s t a t ement c o v e r i n g the w h o l e p r o j e c t / p r o g r a m m e or activity is requested. T h e KED c o n t r i b u t i o n shall be s e p arately identifiable.

The P r o j e c t / P r o g r a m m e P a r t n e r u n d e r t a k e s , subject to prior consultation, to p r o v i d e i n f o r m a t i o n on the b ookke e p i n g of the p r o j e c t / p r o g r a m m e and the related v o uchers and to p e r m i t c h e c k s o r e v a l u a t i o n s to be und e r t a k e n by KED or its r e p r e s e n t a t i v e s .

9. The use of funds w h i c h ha v e not b e e n us e d for the\ p r o j e c t / p r o g r a m m e as applied for shall be the subject of further n e g o t i a t i o n b e t w e e n the P r o j e c t / P r o g r a m m e P artner and KED.

III. Reports

In addition to the financial s t a t e m e n t s r e f e r r e d to u n derII (5) P r o j e c t / P r o g r a m m e P a r t n e r s are asked for annual reports on the p r o j e c t / p r o g r a m m e , p o s s i b l y supplemented by pictures. With these the P r o j e c t P a r t n e r helps KED to enable church c o n g r e g a t i o n s and d o n o r s in G e r m a n y to p a r t i c i ­pate in the progress of the p r o j e c t / p r o g r a m m e or the e x p e r i e n ­ces made with the programme.

I would like to add that I am happy to enter into this agreement with you on

behalf of the ECC.

I presume that this a l l o c a t i o n of DFi 10 000 is in terms of our 1986 budget

requirements ie. the budget 1 disc u s s e d with you when I met you in Stuttgart.

Our legal requirements will also mean that I will draw up an agreement with you

for 1986, similar to the one I sent you with a letter dated 8 November 19E5, for

the contribution you made during 1585.

I would also like to take this opportunity to inform you that we are more

effectively s t r e a mlining our i n t e r n a t i o n a l contacts and will have a far more

systematic approach to the i n f o r m a t i o n we send to our partners, such as y o u r ­

selves. On the f i n a n c i a l side our audited accounts for the 1985 f inancial year

should be completed w i thin the first quarter of 1986. As soon as these are

ready 1 shall send you a copy so that you are fully aware of how funds recieved

have been used. This will be a c c o m p a n i e d by annual reports which are to be

drawn up at our n a t i o n a l c o n f e r e n c e at the ned of Danuary 1986.

Concerning the t r ansfer of funds we would appreciate it if you could deposit

such funds in the Bank account of the Southern African Catholic Eishons

Recently I had the opportunity of meeting several of you and discussing this request with you. I soon realised that the request lacked clarity on certain practical points. Upon my return to South Africa I raised these with members of the National Council of the End Conscription Campaign. Our clarifications are contained below.

According to paragraph 5 of the Constitution of the End Conscription Committee (attached), the Committee is a "corporate body". The Constitution further explains thB structure and responsibilities of the Committee.The The Campaign itself is public, and legal according to the letter of the law in South Africa.

5. Sponsoring Church BodiesThe Western Province Council of Churches and the South African Catholic ‘Bishops Conference have agreed to be our sponsors (see letters from both bodies in the original project request, and letters attached to this document).However, the ECC itself will be responsible for submitting reports directly to the funding agencies, with copies to UPCC and SACBC.

6. Pattern of FinancingThis is the first year we are working from a national budget, so there are no previous budgets to compare this one with. However, included in the original project request is a budget for a single campaign conducted by the Cape Town ECC last year, being an example of how local costs have been covered up until now.

Due to the size of the budget, and the difficulty of getting financial support from local sources for opposition political projects, we were advised by the South African Churches (who funded various of our activities last year) to apply directly to the major church funding agencies overseas. This we did, in the project request of 23 January, 1985. There was one major inadequacy in that request though, and that was instating what our own material contribution to the Campaign is. This is rectified below. The National Council of the ECC feels that the R7D 000 we are requesting from the agencies should still stand, and what is listed below is supplementary to that. Our goal is to increase the proportion of "own contribution" in time, but is is very unlikely that we will ever attain complete self-sufficiency, because of the type of campaign it is.

All of the above agencies have expressed their willingness to support the ECC. No reply has been recieved from Swiss Federation of Churches, Oxfam, Church World Service, and Dunchurchaid, so ue are not presuming support from them this time round.

The agencies will deposit the money in the accounts of either the WPCC or the SACBC (see attached letters).

Time Needed for Implementation of ProjectThe project has already started. We envisage this to be a very long term project, with plenty of expansion along the way. However, we are thinking now of a three year cycle, so would appreciate support through the next three years at least.

AccountabilityAs the Constitution explains, ECC is primarily responsible to its member organizations. However, reports will be drawn up periodically, and distributed to relevant groups, including the WPCC, SACBC and funding agencies. ECC will undertake as well to share pamphlets, articles and other publications with the agencies, and will endevour to meet any special requirements agencies may have.The ECC affirms the concept and reality of "partnership" with its supporters.In particular, we feel that we can make a positive contribution to the debate on militerization and conscientious objection in the donor countries.
