明天，我们将迎来公历2015年的第1天。新年伊始，万象更新。在这辞旧

迎新的欢庆时刻，我谨向品保委同仁及其总部同事，向关心、支持、帮助品保

委发展的社会各界朋友恭贺新年。祝愿大家新年快乐，身体健康，家庭幸福，

事业进步。

2015年，品保委将迎来15周岁。15年孜孜以求，15年风雨兼程，15年携手

并肩。品保委已从蹒跚学步的稚气儿童，长成热情洋溢的追风少年。站在这个继往开来的时间节点，回顾过去，品保委是成功的。这种成功，是品保委始终秉承“同中国中央、地方

政府部门、执法机构、组织和企业合作，为中国知识产权事业的发展进步做出积极贡献”宗旨的结果；

是品保委准确把握“知识产权执法的积极参与者，知识产权立法的积极建议者，知识产权国际交流合作

桥梁的积极搭建者，内资企业知识产权能力建设的积极帮助者，知识产权文化建设的积极推动者”角色

定位并不懈努力的结果；是品保委始终坚持“以会员需要为导向、为会员服务为根本，广泛开展并积极

参与形式多样、效果引人的知识产权活动的结果；是每一位同仁、服务团队志愿投入、开拓进取、辛勤

工作的结果；是中国政府、机构、组织和国际社会关心、支持和帮助的结果。当然，品保委的诞生与成

长，是与时俱进的时代产物，是伟大的全球化的知识产权经济时代造就了品保委。品保委的成功，与会

员公司的业绩成长和各位同仁个人职业发展相辅相成。

行百里者半九十。展望未来，品保委面临千载难逢的发展机遇和前所未有的严峻挑战。在新的一

年里，品保委要紧紧抓住机遇，勇敢迎接挑战，开好头，起好步，以新的精神状态和新的工作要求，展

现新的工作面貌和新的组织形象。品保委的所有活动必须以会员需求为“导向”，以为会员服务为“目

2015 New Year Greetings

Jointly Write a New Chapter for the Development of QBPC

We will celebrate the first day of Year 2015 tomorrow. At the beginning of the New Year, as the new Chair of QBPC, I would like to express my best wishes to QBPC colleagues, colleagues in members’ headquarters, and friends who care about and support QBPC.

QBPC will have her 15th birthday in 2015. With 15 years’ joint efforts, QBPC has grown to an influential organization comprised of more than 200 multinational member companies. We can say it’s a big success. All the achievements cannot be

gotten without the right QBPC missions- to work cooperatively with the Chinese Central and local governments, judicial authorities, local industry and organizations to make positive contributions to intellectual property protection in the People’s Republic of China, the right role definition of QBPC- the positive participator of China’s IP Enforcement and Legislation, the bridge for international exchanges and cooperation in the IP field, the good partner of domestic companies and the promoter of IP culture building, the member driven mechanism, the contribution of QBPC service team, the caring and support of China government, law enforcement agencies, related organizations and the international society as well as supports from all QBPC members and their employees. The success of QBPC is also closely connected with members’ business increase and all QBPC colleagues’ career development.

Looking forward to the future, QBPC is facing valuable opportunities and serious challenges. As a result, in the coming New Year, QBPC should grasp the opportunities and overcome the challenges to show her professional and dynamic image. All QBPC activities should be oriented by members’ needs, aim at serving members, keep capacity building, and create more value for members. All QBPC activities should be in compliance with laws and regulations of China and the countries or regions members based, not violate the requirement of anti-corruption, not interfere the normal legislative, enforcement or judicial activities. QBPC cooperating projects must be practical, problem solving and efficient and aim at "forward-looking, professional, high-quality" to build and promote QBPC’s expertise on IP theory and practices. QBPC activities must have a global vision, keep being the bridge and link to the international and domestic society, accelerate the international fusion, and interconnect the new achievements of IP protection and innovation from member’s headquarter countries(regions) to other countries(regions). QBPC should positively build and promote the new type of connection among the government, enterprises and industry associations under the faith of “respect, mutual trust, collaboration and win-win”. At last, QBPC should also pay attention to her own organization and discipline building, make industry self-discipline function come into full play, and contribute to the common governance of the whole society.

I believe, with the joint efforts of all QBPC members, new QBPC service team and QBPC office as well as the support of all sectors of society, QBPC could write a new chapter with healthy and fast development under the objectives of mutual trust, collaboration, serving and progress in the path of “member driven, professional lead, activities in compliance, international fusion and common governance”!

2014年12月4日，中国外商投资企业协会优

质品牌保护委员会（以下简称“品保委”）在北

京市金茂万丽酒店召开12月会员大会。来自国

家机关、北京市有关政府职能部门、内资企业代

表、国外驻华使馆嘉宾、会员企业代表等150余

人出席会议。

会议的主题是：总结工作，布置任务，审核

决算，批准预算，培训会员，选举2015年新的服

务团队。

经过广大会员单位反复酝酿、逐级遴选、个

On 4 December, 2014, the General Membership Meeting of Quality Brands Protection Committee of China Association of Enterprises with Foreign

Investment (hereinafter referred to as QBPC) was held at the Renaissance Beijing Wangfujing Hotel. Over 150 representatives from state organs, functional government departments, Chinese enterprises, embassies of Beijing and QBPC members attended the meeting.

The agenda for the meeting included a work summary, task assignments, budget and final accounting approval, members training and the 2015 service team election.

At the meeting, the Y2015 QBPC Service Team Members including the Chairman, vice Chairman, committee

We express our sincere congratulations to these ladies and gentlemen! The new elected service team members will have the privilege of representing the interests of 205 members for the next 12 months and will continue QBPC’s mission of being the bridge on intellectual property matters between members, the government, and the international community and China.

The meeting was well organized with rich content and positive interactions between the parties and was adjudged by attendees to have been an unqualified success.

2014年11月13日上午，中国外商投资企业协

会优质品牌保护委员会（以下简称“品保委”）

与欧盟委员会进行了会谈。品保委代理主席王志

平、会员公司施维雅代表谭树棠与欧盟委员会内

部市场与服务总司副总司长Pierre Delsaux、欧盟

驻华代表团贸易处公使衔参赞Benoµt LORY、经济

与金融处参赞ThibaultHEUZÉ等官员参加会议。

王志平进行了题为《品保委如何在中国知识

产权保护领域做出积极贡献》的演讲。他首先从

品保委成立、发展历程、组织结构等方面简要

介绍了品保委的基本情况，然后从四个方面重点

介绍了品保委多年以来在知识产权保护问题上取

得的诸多成就，即推动立法机构完善有关知识产

权的法律制度，提高行政执法机关和刑事司法机

关的执法效率，解决会员普遍面临的共同问题，

以及积极开展知识产权保护方面的国际合作。最

后，王志平分析了当前品保委在知识产权保护方

面面临的主要挑战。

王志平指出，品保委的成长发展中有两点非

常关键。一是品保委长期以来坚持与中国中央政

府、地方政府、国内公司以及行业协会进行合

作，为中国的知识产权保护作出积极贡献的宗

年起，每年举办年度知识产权保护最佳案例与行

政执法、刑事司法衔接典型案例评选活动。这不

王志平表示，获得的成绩是可喜的，但问题

和挑战也客观存在。品保委将持续关注当前知识

产权保护方面的热点和难点问题，如网上售假

问题、新修《商标法》第60条的漏洞问题、知识

产权刑事保护中知识产权权利人的被害人地位问

题、没有国内商标权人合法授权的定牌加工出口

行为是否构成商标侵权的问题、商业秘密的保护

问题等。这些问题需要也必将在各方力量的合作

下得到解决。

PierreDelsaux副总司长对与王志平的演讲表示

感谢，并提出了三点问题：中国政府对知识产权

保护问题的态度是否已发生积极转变；中国政府

在知识产权保护问题上对内外资企业是否一视同

仁；上述谈及的几点难题，哪个是最难解决的？

王志平回应称：随着中国从中国制造向中国创造

转型，中国政府对知识产权保护的重视程度和采

取的有效措施都在不断加强；在保护程度上中国

政府对内外资企业采取同等保护；对于提及的难

点问题，品保委会员目前最大的关注点仍然在品

牌保护问题上特别是网络侵权问题，同时还有一

部分的会员较为关注商业秘密保护，反垄断和反

不正当竞争等问题。

with European Commission (hereinafter referred to as EU). Steven Wang, QBPC Acting Chair, Estee Tam, QBPC member representative from Servier, together with Pierre Delsaux, Deputy Director-General of Internal Marketing and Services in EU, Benoît LORY, Minister Counsellor of Trade Section in EU Delegation and Thibault HEUZÉ, Counsellor of Economic and Financial Affairs Section attended the meeting.

Steven Wang delivered his speech How QBPC has Made a Positive Contribution to IPR Protection in China during the meeting. Initially, he introduced the basic information of QBPC including its establishment, development history and organization structure. Secondly, he mainly introduced the achievements QBPC has made from four aspects. First, QBPC has successfully promoted legislation authorities to develop IP related legal institutions. Second, it has urged administrative law enforcement authorities and criminal law enforcement authorities to improve efficiency. Third, it has helped solve the common problems which members face. Fourth, it has always been developing the international cooperation relations with organizations in the field of IPR protection. Lastly, Steven Wang main analyzed the mainly challenges QBPC is facing in the aspect of IPR protection.

He also pointed out the two key points for the development of QBPC. First, QBPC always works cooperatively with the Chinese central and local governments, local industry, and organizations to make positive contributions to intellectual property protection in the People’s Republic of China. Second, QBPC encourages and leads member companies to involve in the communication and interaction with governmental and social cooperative partners. For example, QBPC held the Best-practice Cases of IP Protection and Model Cases of Harmonizing Administrative & Judicial IP Enforcement every year since 2002, which not only strengthens the relationship between QBPC and IP judicial authorities and IP law enforcement authorities, but also promotes the public impression of QBPC effectively.

The achievements we got is worthy of recognition, but problems and challenges exist objectively, said by Steven Wang. QBPC will pay close attention to hot and difficult problems in the field of IP protection constantly, such as the online counterfeit problem, the loophole in the Article 60 in the newly amended Trademark Law, the victim status of IP right holders issue in the process of criminal justice, OEM issue and trade secret protection issue, etc. All the problems will definitely be solved under the multi-party cooperation.

EU representatives led by Pierre Delsaux showed their gratitude to Steven Wang’s presentation and raised three questions. The first question is that on the enforcement side, whether the Chinese government has changed its attitude to the IP protection issue in a positive way. The second one is that whether the Chinese government treats domestic enterprises and foreign enterprises equally. The last one is that in terms of the above problems QBPC mentioned, which is the most difficult one. For the first question, Steven Wang replied that China is changing from a manufacturing country to an innovative one, and the Chinese government has constantly increase attention to IP protection and strengthen IP protection measures. For the second question, he said that nowadays Chinese government treats both domestic and foreign enterprises equally which benefits both types of enterprises generally. 张为安名誉主席首先简要介绍了品保委的发展历

品保委与相关部门建立的互信与交流机制帮助会

在促进知识产权法律制度的完善上，张主席名誉

为大家介绍了品保委在《商标法》第三次修正过

程中所作出的贡献及所获得的积极成果。在品保

On the afternoon of October 22th, Quality Brand Protection Committee of CAEFI (QBPC) had an exchange meeting with Danish Patent and Trade

Mark Office (DKPTO) accompanied with Wang Han, the Economic Officer of The Danish embassy in Beijing. Jack Chang, the Honorary Chairman of QBPC, Colin Chen, the Vice Chairman of QBPC, Xiaoyang Qu, the Chairman of Patent & Innovation Committee of QBPC, Anne Rejnhold Jørgensen, the Director of Policy & Legal Affairs of the DKPTO, Thomas Xavier Duholm, the Deputy Director of Policy & Legal Affairs , Lone Frosch, the Director of Trademarks & Design , Thea Bang, the legal Adviser of Trademarks & Design, Allan Stagaard Toft, the Counsellor, Head of Department Economic Affairs, Growth and Sector Policies of the Danish embassy in Beijing, Doctor Larsen Peter Halvor, QBPC membership representative from Danfoss, as well as other QBPC membership representatives from Novozyme and Bestseller attended the meeting together.

Attendees exchanged their opinions on the current intellectual property environment of China, including the progress China has made, the new problems it is facing, as well as the methods foreign investment companies may take to meet the challenges. As the keynote speaker of this meeting, Jack Chang mainly introduced the development history and organizational structure of QBPC, and then introduced the achievements QBPC has got in the field of intellectual property (IP) protection from 6 aspects. For details, 1) help strengthen criminal judicial protection in the field of IP protection effectively;2) help reduce inventor remuneration risks; 3) help promote the IP legal system; 4) establish a multi-industry platform for members learning and sharing the messages and information in IP area; 5) enhance the communication and cooperation with international intellectual property organizations; 6) draw a roadmap in the intellectual property industry. Among the above 6 points,

Jack Chang mainly explained the 1st, 2nd, 3rd and 6th aspects in detail. The first is that QBPC seeks commons while reserving difference, reaches a consensus and finally fulfills mutual support with criminal enforcement agencies. He also mentioned that QBPC drives transparency of criminal public prosecution by promoting IPR holders to participate in IP criminal litigation and helps members deal with special local protection to strengthen criminal intellectual property protection. And for promoting the intellectual property legal system, QBPC has made a good contribution to the 3rd amendment of the Patent Law, said by Jack Chang. In terms of the international communication and cooperation with other organizations, Jack Chang enumerated the friendly cooperation relationships QBPC has developed with Confederation of Indian Industry (CII), Brand Protection Group (BPG), Vietnam Anti-counterfeiting & IP Protection Association (VACIP), the World Customs Organization (WCO), Rus Brand, IP Group in China (IPG) ,Vietnam Customs, International Trademark Association (INTA) and International Criminal Police Organization (Interpol) by signing MOU. Finally, when he mentioned drawing a roadmap in IP area, he mainly talked about how to develop the legal system of trade secret protection in China, how to prevent applicant’s technology secrets from leaking out in the process of the administrative examination & approval and administrative licensing, attempts to balance the overwhelmingly strong administrative enforcement power and the value of patent administrative protection in the 4th amendment of the Patent Law, effectively tackle malicious trademark registration issue, help confirm OEM production of trademark goods for exportation constitutes infringement, industrial and commercial administration authorities should have the power to confiscate and destruct destruct the trademark infringing goods in the distribution channels, effectively tackle the issue of the network copy infringement and network selling fake goods, solve the problem of the low civil damages and administrative fines in IP cases, promote the IP owners be recognized by Judicial Office as the “victims” of IP crimes so that they can exercise the rights available to the victims under the Criminal Procedure Law, improve transparency of public & private sectors’ procurement for software and promote foreign investment companies get national treatment in China.

thorough exchange on some particular concerns. As a result, both DKPTO and QBPC agreed that all the achivements which QBPC has got reflect the change of IP evironment of China. Meanwhile, they showed how foreign investment companies sucessfully met challenges in the IP area. In the interacitve communication segment, DKPTO representatives raised questions such as what problems companies might meet in trademark protection, whether QBPC had statistic in the patent and trademark conterfeit issue, how to tackle the evidence problem in the patent infringment judicial proceedings. Jack Chang, Colin Chen and Xiaoyang Qu

answered these questions successively.

At the end of the meeting, Jack Chang said that many new problems may occur in the IP protetion area, but the IP protection system will certainly be more developed in China. Anne Rejnhold Jørgensen agreed with Jack Chang, and said that the whole Europe including Denmark face endless and various IP protection problems, which needs expreinces and powers from domestic and overseas to solve. Both QBPC and DKPTO are looking forward to seeking more chances to strenghten communication and cooperation in IP protection area.

权精品案件中的法律问题，扩大精品案件的社会

影响，北京市高级人民法院知识产权庭于10月24日

（星期五）召开了知识产权精品案件交流会。会议

邀请了最高人民法院法官、部分省市法院法官、专

家学者、律师、代理人和品保委会员企业等代表参

加。此次会议从第五届和第六届北京市法院精品案

件研讨会入选案例中选定了8件典型案例进行深入

研讨。专题演讲之后为交流互动和专家点评环节。

会议首先由北京市高级人民法院审判委员会

专职委员、知识产权庭庭长陈锦川致辞，张雪松

副庭长主持。

第一节，在专利案件中，王东勇法官就施特里

克斯有限公司诉佛山市富士宝电器科技股份有限公

Intellectual Property Tribunal of Beijing Higher People's

Court held a remarkable intellectual property case seminar on October 24 (Friday). Judges from the Supreme People's Court, judges from some provincial and municipal courts, professionals, scholars, lawyers, agents, and QBPC member

Education Science and Technology Co., Ltd. Judge Hui Song detailed the computer software copyright infringement lawsuit that Microsoft filed against Beijing Mingwan Information Technology Co., Ltd.

In section 3 concerning copyright cases, Judge Jing Yang introduced the copyright and privacy infringement lawsuit that Jikang Yang filed against SUNGARI International and Guoqiang Li. Judge Zhifu Su analyzed the photographic works copyright infringement lawsuit that Huake Xue filed against Yaya Yan.

In section 4 concerning unfair competition cases, Judge Renjing Liu elaborated on the trade secret infringement lawsuit that Beijing Pianshi Bookstore Co., Ltd. filed against Taihai Publishing House. Judge Xiao Ye disclosed the trademark infringement and unfair competition lawsuit that The Affiliated High School of Peking University filed against Xianghe Futai Real Estate Development Co., Ltd.

At the end of the seminar, Gorge Li, Vice Chairman of QBPC Legal Committee made a concluding speech. He extended his gratitude to the hosting party and the audience and expressed his expectation for the next wonderful cooperation between both sides.

了阿里巴巴集团发布的关于利用大数据技术打击

网络侵权假冒措施和成效的工作报告，肯定了阿

里巴巴集团加强网络打假工作的努力，并就加强

针对性强、可操作的实施方案，开展多行业、多

品牌、多平台的深入合作。在品牌方面，除了已

有合作的奢侈品、运动品牌外，还可拓展个人护

理、小家电等其他品牌。在平台方面，除了淘

宝、天猫，还可以拓展到1688、AE等平台。在合

作内容上，不仅是品牌保护、打假维权的合作，

还可以帮助会员企业拓展电子商务，促进生意增

长。在合作方式上，不仅是目前成功的个案合

作，开展涉及品保委会员企业的线下案件打击工

作，如莆田耐克集群、3M打假集群、常州三星集

群、上海UGG打假案件等，还可以拓展到共同推

动电子商务法律、法规的完善，共同推动互联网

行业安全管理标准的建立，共同研讨互联网领域

知识产权保护合作课题，共同推动电子商务的国

际合作。二是在宣传知识产权保护与创新政策、

法律、法规，宣传、提升网店经营者尊重、爱护

他人知识产权的自觉意识，促进互联网领域知识

产权文化建设、征信体系建设等方面开展深度合

Victor Shao of Eaton, Jensen Xu of Nike and Amanda Wu of Philips) attended the meeting. The participants listened to the report on methods and achievements of Alibaba anti-counterfeiting work via big data technology, confirmed their efforts and progress on improving the anti-counterfeiting work, and reached several consensuses on strengthening the cooperation of government and enterprise and on-line anti-counterfeiting work. The participants also made deep discussion on topics such as how could the e-commerce enterprises take their social responsibility. Mr. Colin Chen in his speech called for enhancing the cooperation of government and enterprise and the cooperation between

the e-commerce platform and right owner, to further promote the on-line anti-counterfeiting work. He hopes QBPC and QBPC members could be the strong ally of Alibaba on on-line anti-counterfeiting. In terms of deepening the cooperation with Alibaba, Mr. Colin Chen advised in the following aspects:1) According to the consensus reached by both parties on the MOU and regular communication mechanism in early 2014, QBPC and Alibaba will sign a framework agreement in 2015. Under this agreement, related QBPC industry working group and the security department of Alibaba will sign specific, targeted and operational implementing strategies to develop deep cooperation. Regarding the brands, except for luxury and sports brands which already have cooperation with Alibaba, we could also expand brands to personal care and small appliances. Regarding the cooperating platform, we could also expand to 1688 and AE besides Taobao and Tmall. Regarding the cooperation content, in addition to brand protection and anti-counterfeiting, we could also help members to develop their e-commerce business. Regarding the cooperation method, we should not only cooperate on individual cases, but also develop the off-line anti-counterfeiting cases involved QBPC members. We could also promote the e-commerce law legislation, set up the Internet Security Managing Standard, do research on on-line IPR protection and enhance the international cooperation. 2) Promote the policy, laws and regulations on IPR protection and innovation; promote and increase the on-line shop owners’ conscious of respecting and protecting others’ IP; accelerate to build the IP culture


1. Alibaba is taking multiple measures to prevent from the issue that counterfeit dealer registers Taobao shop with forged ID information. For example Alibaba requires every applicant to provide the photo in which he/she must hold ID card and local newspaper at the date when he/she applies for registration; also the applicant needs to make a special gesture that Alibaba requires by random in the picture; furthermore Alibaba is developing the technology of face and voice recognition which will be used for telling real shop operator.

2. Alibaba will set up credit system for brand owners next year. For the brand owner with high credit, Alibaba would accept its IPR complaint without any reason as long as the brand owner signed undertaking letter beforehand.

3. Alibaba is discussing with a local government about the strategy of cleaning related markets on Sportswear (next maybe IT). The initial plan is that Alibaba picks up four brands who face serious problem and then block all the products of those brands at very low price on taobao.com.

4. Alibaba will strengthen the cooperation with brand owners and authorities on raid action. They will pay more efforts to dig out the connection between different sellers and report the key target to authorities periodically.

5. Alibaba will upgrade the takedown rule on Taobao to “3-strike” from current “4-strike” since 2015 so that it’s consistent with the rule on Aliexpress.

品牌保护委员会（以下简称“品保委”）召开各

委员会工作会议。会议的主题是品保委如何在

新形势下积极参与和推动建立“尊重互信服务

合作共赢”的新型政府和企业、政府和行业组

织的关系。会议分两个讨论环节，分别由最佳案

例与执法委员会主席鞠延河、法律委员会主席雷

凌飞、专利与创新委员会主席曲晓阳主持。两场

讨论主题相同，又各有侧重。包括品保委名誉主

席张为安、副主席陈小东在内的多位主席参与讨

论，并提出了自己的独到见解。

随着今年以来政府反腐败力度的不断加强，

国家机关对公务员队伍的纪律约束也越来越大。

这为品保委的活动开展带来较大困难，具体表

现在诸多研讨会、培训等活动政府机关代表参与

度越来越小。鞠延河主席以自身所在的委员会为

例说明，委员会去年计划了十个项目，但由于目

前的形式只做了六个。对此主席团各抒己见，都

认为品保委有必要、有机会、更有能力将挑战转

会。张为安就此问题分享了两个品保委有效推动

国家决策层改变对定牌加工出口问题，刑事诉讼

合作的关键，他计划在2015年推动品保委知识产

权刑事保护论坛与中央和重点省市警察院校开展

的经侦论坛进行深入合作，实现共赢。最后，本

环节主持人鞠延河进行总结。他认为，品保委需

要提升服务团队综合素质、提升国际影响力、加

强与媒体的合作以扩大宣传、建立专家顾问团以

提高专业性等方面来面对挑战，化问题为机遇。

如何在新形势下继续运作项目，切实发挥桥

梁作用，实现社会组织与政府的共治，成为第二

环节发言人着重探讨的焦点问题。法律委员会

副主席李亚平认为，政府机构有诸多内部活动同

样需要外部的意见，这对于我们而言是个机会。

我们应当密切关注这些机会，与政府及时交流，

参与到政府的内部活动中。创新与专利委员会副

主席向虎表示，获得机会的前提是进一步提升品

保委的社会知名度，使政府机构充分认识到品保

委的价值，愿意主动倾听品保委的声音，征询品

保委的建议。法律委员会主席雷凌飞补充说，做

到这一点的关键是不断寻求品保委自身的进步空

间，主动提升品保委发表意见的专业品质，唯此

才能获得外界的认可。对此，专利与创新委员会

副主席陈安慧提出，品保委对外的声音主要来自

于会员的意见，如何有效整合会员的多样化意见

是我们能否既代表数百家会员企业发声，同时引

起政府关注和兴趣的关键。除此之外，法律委员

会主席雷凌飞、副主席刘淼、副主席于帮清等还

就引起会员企业和政府机构共同密切关注的热点

问题——商业秘密保护、网络售假等发表寻求政

阳主席进行总结。他认为，中国正在改变，这里

The work conference of working committees of Quality Brands Protection Committee of China Association of Enterprises with Foreign Investment

(hereinafter referred to as "QBPC") was held on the afternoon of December 4, 2014, under the theme of “How to Proactively Participate in and Drive Establishment of a New Relationship Between the Government and Enterprises and Industries that Features Mutual Respect, Trust, and Benefit in the New Conditions.” It was divided into two discussion sections hosted by Chairman of Best Practices/Enforcement Committee Frank Ju, Chairman of Legal Committee Lingfei Lei, and Chairman of Patent and Innovation Committee Xiaoyang Qu. Although the sections shared the same theme, their focuses differed. Many chairpersons, including QBPC Honorary Chairman Jack Chang and QBPC Vice Chairman Colin Chen, presented their views in the discussions.

As the government steps up anti-corruption efforts this year, state organs keep enhancing regulation on civil servants. This greatly hinders QBPC’s activities. Specifically, a decreasing number of representatives from state organs attended QBPC’s seminars and training sessions. According to a case provided by Chairman Frank Ju, his committee arranged 10 activities last year but only 6 of them has been carried out due to the current situation. Such situation has raised the above-mentioned concern. The chairpersons contributing their opinions in this regard shared the same idea that it is necessary for QBPC to leverage its capability and this opportunity to convert the challenge into another development force, while the key issue lies in how to grasp this opportunity. Chairman Jack Chang provided two relevant cases where QBPC has managed to change national policy makers’ understandings of and opinions on OEM product export and victims’ power and status in criminal prosecution. These cases indicate that, QBPC can achieve mutual benefits with the government and bridge gaps in the IRP domain

by providing the government with solutions for key issues based on consideration of interests of all parties involved and sincerely promoting the government’s effective efforts and achievements through QBPC’s platforms, especially its international platform. This idea has been echoed by Vice Chairman Colin Chen, Chairman of Government Cooperation Committee Allen Zhou, and Chairman of Government Cooperation Committee for 2015 Haijian Ma. Colin Chen added that, QBPC must fully play its role in the new government-enterprise relationship, which has also been defined in the quarter-4 work report of the National Leading Group against Intellectual Property Infringement and Producing & Selling Counterfeits as a key task to effectively drive co-governance with the society. QBPC will typically serve as a role model for co-governance in the IPR domain. QBPC’s platforms boast talents specializing in theories and practices from various fields. We can achieve co-governance by leveraging our researches and studies to

help the government identify and resolve issues. Allen Zhou remarked that the new situation causes a noticeably positive effect, which enables enterprise representatives to carry out more pragmatic and professional exchanges with government scholars and officials. Haijian Ma noted that, identifying connection between governmental activities and QBPC activities is key to cooperation success. He planned to drive in-depth cooperation between QBPC’s forum on protection against IPR crimes and the economic investigation forums of critical central and provincial police academies next year for mutual benefits. At the end of section 1, emcee Frank Ju made a concluding speech. He stressed that, QBPC should improve the comprehensive competency of its service team, increase its international influence, enhance cooperation with media for better promotion effects, and establish a professional consulting team, so as to handle challenges and convert problems into opportunities.

In section 2, the speeches focused on how QBPC can continue project operation, fully play its gap-bridging role, and achieve co-governance between social organizations and the government under the current situation. George Li, Chairman of Legal Committee, noted that, many internal activities of state organs require external opinions, thus providing opportunities for QBPC. QBPC should watch closely these opportunities and communicate with the government in a timely manner for participating in the internal activities. According to Andy Xiang, Vice Chairman of Patent and Innovation Committee, QBPC can be rewarded

the opportunities only after improving its social reputation to make state organs fully recognize the value of QBPC and willingly request voices and opinions from QBPC. Chairman of Legal Committee Lingfei Lei added that, to achieve this effect, it would be critical for QBPC to continuously seek opportunities to add value to its opinions for higher external recognition. In this regard, Vice Chairman of Patent and Innovation Committee Ann W. Chen pointed out that, QBPC’s opinions are mainly contributed by its members and therefore QBPC should effectively combine the diversified opinions of hundreds of enterprise members to draw the government’s attention and interest. Chairman and Vice Chairmen of Legal Committee Lingfei Lei, Miao Liu, and Michael Yu also expressed their views on how to seek cooperation between the government and enterprises for addressing highlighted issues including trade secret protection and online counterfeit sales that concern both enterprise members and state organs. At the end of section 2, emcee Xiaoyang Qu made a concluding speech. He believed that the current situation change in China represents both challenges and opportunities and QBPC needs to pay close attention to the change and respond proactively to the challenges. At the end of the conference, conference emcee Chairman Lingfei Lei, reiterated that the opinions contributed during the conference can be turned into positive results only with active participation of member representatives. He wished that all members will proactively take part in QBPC’s activities to help QBPC grasp opportunities in the new situation for future success.

The Patent and Innovation Committee (“PIC”) lunch meeting is held in the noon of Dec. 4th. Mr. Qu Xiaoyang hosts this meeting to seek members’ suggestions on PIC’s projects in 2015. Below are the summaries:

1. Whether we can clarify the QBPC process on requesting, receiving, collating and posting (final) comments on draft laws and regulations;

Possible Action: We may need a formal QBPC process approved by SC.

2. Whether we can conduct a member survey and/or analyze PRB decisions to identify cases invalidated for lack of inventive step based on “common knowledge” (without evidence);

3. Whether we can hold seminars with local IP owners (e.g., PPAC);

4. Whether we can study “patent squatting” as an abuse of

patent (and violation of AML), including how to prove bad faith of filing junk patent and how to avoid low quality patent owner(eg UML) abusively issue warning letter;

5. Whether we can develop a position paper on trade secret laws in China (and possible amendments);

Possible Action: We may involve academia and institutions, such Professor Huang Wushuang, who is designated by SAIC to research on trade secret issue.

6. Whether we can share experience with trade secret protection;

Ann advised the evidence law and related procedure law are also very important to trade secret protection.

7. Whether we can advise on prior (public) use defense.

8. Whether we could make analysis on PRB decisions published and see if any improvement can be made?

取得的成果，并明确了2015年的工作目标和任

务。会议期间，上海市公安局经侦总队与大型电

商平台企业举行了谅解备忘录的签字仪式，创建

追究，以加强对供应链的管理和控制。部分影响

力较大的电商平台企业，如阿里巴巴、京东、1

号店、苏宁、国美等共同签署了《互联网企业可

信交易诚信自律公约》，旨在规范电商运营的自

律策略和规则。

通过本次会议，广大品牌所有者与电商平台

企业进行了深入交流，增进了相互了解，取得了

诸多共识，搭建了合作平台。近期，还将根据实

际需要，安排工作层面的跟进会议，巩固这次会

议的成果。

Shanghai Leading Group Office had a meeting on Nov. 4th . Leaders of Shanghai law enforcement agencies such as AIC, TSB and PSB etc., big ecommerce

platforms such as Taobao, No.1 Store, Jingdong, Tencent, etc. and QBPC members attended the meeting. The Shanghai Leading Group Office introduced their IPR protection achievements throughout the whole year and stated their objectives and missions for 2015. There was a MoU signing ceremony between Shanghai ECID and big e-commerce platforms laying down a report system of suspicious

transactions and setting strict responsibilities on ecommerce websites to enhance the management and control of their supply chains. Some influential ecommerce platforms like Alibaba, Jingdong, No.1 Store, Suning, Guomei, etc. also co-signed on an Industrial Convention of Honest Online Transaction which aims to set some self-discipline policies and rules on ecommerce operations. This meeting offered a good opportunity for brand owners to associate with over 24 ecommerce platforms. The follow-up working level meeting will be arranged later.

Chair Jack Chang interpreted in details the significance of IP protection for cracking down on infringement crimes, especially trademark counterfeiting and copyright infringements, and mainly analyzed hot issues such as OEM and online sale of counterfeits. Vice Chairman Colin Chen introduced rights of criminal victims and specific problems encountered in judicial practices and thoroughly analyzed typical cases to explain victims' legal status identification and right protection in criminal proceedings brought by IP right owners. Vice Chairperson Michael Yu of QBPC Legal

Committee analyzed the Foshan APC criminal retrial case in details. Mr. Yu introduced the retrial reason, analyzed opportunities and difficulties in the retrial, and provided relevant suggestions to interpret the role of brand owners in criminal proceedings.

Moreover, the preceding chairmen communicated hot IP protection issues with representatives of member enterprises. The seminar came to a successful conclusion in a pragmatic and lively discussion atmosphere.

员大会在北京召开。会议期间，品保委海关委员

会进行了年度工作报告。除此之外，邀请了海关

总署知识产权保护处处长李群英给会员代表介绍

了知识产权海关保护的最新进展。

海关委员会工作报告

海关委员会主席齐雪峰、副主席李亚敏代表

海关委员会进行了工作报告，他们主要就近一年

来海关委员会在促进品保委与政府、社会组织

密切合作方面所做出的努力和获得的成果进行报

告。2014年，海关委员会着力于以下五点工作。

一是支持海关知识产权保护，完善立法及执法政

策。二是支持海关不断加强知识产权保护执法，

具体包括：加强与公安机关合作；总署备案与保

护系统升级；强化与执法官员交流与培训；支持

行业小组与海关开展活动。三是加强海关对会员

的培训和双向交流。四是开展国际合作，具体包

括：支持海关总署国际合作项目；实施品保委与

越南海关合作备忘录；在华与外国海关的交流与

培训。五是加强宣传，提高海关知识产权保护意

识，具体包括：通过中国海关知识产权保护展示

厅更新；通过参观中国海关博物馆；通过中国海

关保护“年鉴”等方法实现。

知识产权海关保护最新进展

李群英处长给与会人员介绍了知识产权海

关保护的最新进展。他指出，2014年海关查获

侵犯知识产权货物9096批次，扣押货物数量

69,991,682件。他特别介绍了2014年保护世界杯

知识产权“绿茵行动”等专项执法活动。在宣传

方面，总署正在建立海关博物馆永久展厅，预计

2014年12月底建成。在技术方面，海关也在不断

升级设备来提高查验的准确度和效率。在出口定

牌加工产品问题上，海关将根据《商标法》侵权

损害方面的认定标准依职权进行处理。在联合执

法方面，李处长介绍了国内海关与公安机关联合

行动的案例和国内海关与国外海关联合执法的精

彩案例。最后，在加强国际交流与合作方面，他

还特别介绍了中国海关与中欧组织等进行联合培

训、研讨等方面的经验。

与会代表对李处长的精彩演讲表示衷心感

谢，并对海关委员会做出的成绩表示祝贺！会

The December general membership meeting of Quality Brands Protection Committee of China Association of Enterprises with Foreign Investment (hereinafter

referred to as QBPC) was held in Beijing on 4th and 5th in December 2014.During the meeting, QBPC Customs Committee made an annual work report. In addition, Qunying Li, Director of Intellectual Property Protection Division under the General Administration of Customs was invited to brief QBPC member representatives on the latest progress of intellectual property protection by customs.

Work Report of QBPC Customs CommitteeChairman Chuck Qi and Vice Chairperson Karen Li of the Customs Committee made a work report on behalf of the committee. The report mainly included efforts by the committee to promote close cooperation between QBPC and the government and social organizations, as well as its achievements. In 2014, the committee has focused on five tasks. First, it helped customs improve policies addressing the situation where intellectual property protection laws were formulated but not enforced. Second, it helped customs continuously improve enforcement of intellectual property protection laws. Specifically, it cooperated with public security organizations, upgraded the filing and protection system of the General Administration of Customs, communicated with provided training for law enforcement officials, and assisted activities jointly hosted by industrial groups and customs. Third, it invited customs to provide training sessions for QBPC members and boosted bilateral communication between customs and QBPC. Fourth, it extended international cooperation by supporting international cooperation projects of the General Administration of Customs, implementing the memorandum of cooperation signed between QBPC and Vietnamese customs, and carrying out exchanges and training with foreign customs. Fifth, it stepped up efforts to raise awareness of intellectual property protection by customs, such as updating information displayed in China Customs Intellectual Property Protection Showroom, organizing visits to China Customs Museum, and making publicity for China Customs Protection Yearbook.

intellectual property protection by customs to the audience. He pointed out that, China Customs had seized 9096 batches of goods suspected of intellectual property infringement in 2014 and had detained a total of 69,991,682 pieces of goods. He specially introduced the dedicated law enforcement actions such as the “Pitch Action” against intellectual property infringements related to 2014 FIFA World Cup. To enhance publicity, the General Administration of Customs was establishing a permanent showroom in China Customs Museum and it was expected to be completed by the end of December 2014.In addition, China customs kept their equipment updated for higher inspection accuracy and efficiency. China customs would handle OEM product export cases based on their duties and the criteria in the Trademark Law for determining infringements. With regard to joint law enforcement, Director Li provided some cases that involved joint actions by customs and public security organizations of China, as well as some cases that involved joint actions by Chinese and foreign customs. Finally, He shared some experience in training and workshops carried out by China customs jointly with Central European organizations to promote international exchange and cooperation. The representatives at the meeting extended their gratitude to Director Li for his presence and their congratulations to the achievements of the QBPC Customs Committee. After the meeting, QBPC member representatives actively interacted and communicated with representatives of the QBPC Customs Committee and Director Li. The working seminar met the expectation and was a great success.

A training session on standard and patent policies was held in China national Institute of Standardization on the morning of December 3. Doctor Xianghua

Zhu of the institute explained relevant issues to the 20 QBPC members at the training.

She mainly introduced China’s standard and patent policies and international disputes over SEP. China’s standard and patent policies are mainly reflected in the Regulatory Measures on National Standards Involving Patents (Interim) (hereinafter referred to as the Interim Regulatory Measures) issued by Standardization Administration of PRC and in the

GB/T 20003.1 Special Procedures for the Development of Standards. Part 1: Standard Related to Patents (hereinafter referred to as GB). The Interim Regulatory Measures function as the basic principles, while the GB includes implementation details. The Interim Regulatory Measures consists of 5 chapters and 24 articles, including general provisions, special provisions on patent information disclosure, patent implementation licensing, mandatory national standards involving patents, as well as supplementary provisions. The GB consists of 6 chapters that cover the scope, normative reference documents, terms and definition, patent disposal requirements, special procedures for creating and revising national standards involving patents, patent disposal during standard implementation, and appendix A (normative appendix) tables for disposal of patents involved in standard creation procedures. For SEP issues, Doctor Zhu mainly elaborated on the specific implication of “being reasonable”, value of patented technologies, limit on the total amount of patent licensing fees, basis for calculating a patent licensing fee, the implication of “without discrimination”, injunctive relief for SEP, and mutual benefit/cross-licensing for SEP.

The training generated a positive result and all the members attending the training remarked that they benefited a lot from it.

12月3日上午，标准与专利政策培训会在中

国标准化研究院召开。标准化研究院的朱翔华博

士就相关问题向参会的20位会员进行了讲解。

朱博士主要介绍了我国的标准和专利政策，

以及国际上对SEP问题的争议。我国的标准和专

利政策主要体现在国家标准化管理委员会发布的

《国家标准设计专利的管理规定》（以下简称

“暂行规定”），以及GB/T 20003.1《标准制

定的特殊程序第1部分：设计专利的标准》（以

下简称“GB”）。暂行规定是基本原则，GB是实

施细节。暂行规定共5章、24条，包括总则、专

利信息的披露、专利实施许可、强制性国家标准

设计专利的特殊规定及附则。GB一共分为6章，

包括范围、规范性引用文件、术语和定义、专利

处置要求、涉及专利的国家标准制修订的特殊程

序、标准实施中的专利处置、附录A（规范性附

录）标准制定过程中处置涉及的专利所使用的表

格。对SEP问题，朱博士主要探讨了是否要“合

理”的具体含义，专利技术的价值，专利许可费

总额的限制，专利费计算的基础，“无歧视”的

含义，SEP禁令救济，SEP的互惠和/或交叉许可

问题等。

参会会员都表示在此次培训中受益匪浅。培

训取得了圆满成功。

This training is a part of the industrial enterprise IPR cultivation project. Chang Limin, Director of the Science and Technology Division of the Ministry, based on the international and domestic situations that the industrial enterprise IPR work faces, analyzed and interpreted relevant national policies and documents, introduced content related to the industrial enterprise IPR management guideline, and proposed ideas about and requirements on how to properly complete the subsequent IPR work. The meeting closely centered on the theme of IPR creation, application, management, and protection. Experts from research institutions, colleges, and large enterprises were invited to give topic-specified training. Experts from the Electronic Intellectual Property Center of the Ministry and School of Pharmacy Lanzhou University made speeches and communicated with each other in aspects of patent analysis

and portfolio, enterprise patent document review and quality control, and patent issue handling in the standards. Senior experts from SINOCHEM Group and Changhong Group analyzed typical cases concerning electronic enterprise IPR warning and gave systematic explanations and shared experience on patent management and adoption and IPR commercialization and management.

Participants generally reflected that this training was fully combined with the economic characteristics and industrial enterprise IPR work status, had abundant content and reasonable design, had strong pertinence, practicability, and operability, and fully fulfilled the actual requirements of the industrial enterprise IPR work. The training plays a positive role in improving the industrial enterprise IPR application capability in Gansu Province.

2014年10月20日，QBPC农业IWG组织了为时一

天的专题讨论会。部分会员公司代表与相关行

业专家参加。会议讨论了农业领域知识产权保护

问题。代表们就其关心的问题交流经验，并就如

何改善农业领域的知识产权保护交换了意见。讨

论会涉及多个议题，包括种业知识产权保护中遇

On Oct 20 2014, members of QBPC Agricultural IWG gathered together for a one-day workshop discussing their most pressing agriculture-business

specific IP issues. AIWG also invited speakers who gave presentations on hot topics in the field. The participants shared experiences on such issues and exchanged intelligence for improving IP protection for the industry. Topics broadly

included seed IP protection, update of recently issued patent cases, draft regulation for service inventions, current issues of seed movement etc.. In the workshop, with efforts of the participants, a plan was made to educate the relevant government authorities, such as presenting comments on the draft regulation for service inventions.
