新聞稿 Creative Commons 開啟自由創作之門 猪頭皮、「CD-PRO2」作者劉裕銘與魔戒譯者朱學恆現身說法 【2004 年 9 月 4 日台北訊】 美國麻省理工學院（MIT）投入全校資源，將課 程教材及錄影開放給全世界，英國 BBC 也放棄收費方式，將新聞影音資料 庫允許全球自由使用。Creative Commons 的出現，是讓 BBC 與 MIT 的美意 得以落實的關鍵。九月四日，台灣 Creative Commons 計畫也正式展開。同 時，創作人朱約信（豬頭皮）將其即將發行的「搖滾主耶穌（Jesus Rocks）」 專輯，將全數使用 Creative Commons 授權，成為亞洲首張使用 CC 授權的實 體專輯。 目前全球已有加拿大、日本、法國、德國等二十三個國家投入當地的 Creative Commons 計畫，台灣是率先加入 Creative Commons 計畫的亞洲國 家之一，由中央研究院資訊科學研究所協助推動國內 Creative Commons 授 權條款本地化與推廣工作，未來將邀請國內更多的合作機構與創作者進行推 廣。 今天的Creative Commons Taiwan發表會，由中研院院士兼資訊科學所所長李德財 主持，Creative Commons創辦人，史丹福大學法學院 Lawrence Lessig 教授親自來 台，介紹Creative Commons計畫及其精神。知名音樂人朱約信透過現場創作歌曲 表演，傳達現行著作權制度可能對於創作活動造成的限制，朱約信同時推出全亞 洲首張以Creative Commons授權方式釋出的音樂專輯「搖滾主耶穌（Jesus Rocks）」，開放所有的權利，允許全世界自由地進行非商業利用。 以翻譯〈魔戒〉聞名、日前發起麻省理工學院開放課程翻譯計畫的朱學恆，以及 創作CD-PRO2 的劉裕銘，也都以自身體驗，介紹Creative Commons相關概念。劉 裕銘更協助將Creative Commons上的簡介影片，以風趣的方式配上國語。 台灣 Creative Commons 主持人莊庭瑞指出，在目前著作權法「all rights reserved」的預設規定，造成創作者無法得知創作素材是否經過明示授權， 若貿然進行任何使用的行為，都有可能觸法。法律為保護一般使用者而留下 的「合理使用」範圍，在著作權所有的精密法律授權規則下，使用者若要主 張合理使用，恐怕只有收到律師函或進到法院，付出一大訴訟費用後，才能 透過法院判決伸張自己的權利。 然而， 無可否認的，另一方面，我們也面臨創作者雖然享有寬廣的自由空間， 但卻受到非法商業剝削，盜版、不尊重著作人權利的情況層出不窮，形成盜
