    ARTICLE I. DESCRIPTION OF LOCALSection 1.The term of office for all officers of the Local shall be for two (2) years of even numbered years,with those elected taking office no later than May 1st of that year.Section 2.All officers of the Local shall be elected by secret ballot.Section 3.The Local President shall appoint an Elections Committee to prepare, distribute, receive andcount the ballots; to certify the election results and to perform any other task required forconducting Local elections. .Section 4.In the event of a vacancy in any area representative office of the Local, a replacement shall beappointed by the Local Officers at the first meeting following creation of the vacancy. Thereplacement shall be from the area in which the vacancy occurred if possible, and shall be electedby a majority vote of the Local Officers.Section 5.In the event of a vacancy in any office ofPresident, Vice President, Secretary and Treasurer,there shall be a replacement of the President by the Vice President; and there shall be areplacement of the Vice President, Secretary and Treasurer by election of the Local Officers forthe remainder of that term of office.Section 6.Ample and reasonable notice shall be given to the members that the Local is receiving names ofpotential nominees. Each potential nominee will be contacted to determine the individual swillingness to serve. Those individuals indicating a willingness to serve shall be listed on theballot. In addition, any member may submit his or her own name directly to the nominatingcommittee. No person shall be a nominee for more than one office. The list of nominees shall besubmitted to Headquarters by mail orin person. After the list of nominees for the Local offices hasbeen submitted to Headquarters, additions to the list, or deletions in the case of any nomineeswho decide not to be candidates, may be made. The decision to waive the deadline will be up tothe Executive Committee.

    ARTICLE II. DUTIES OF OFFICERSOfficers shall be elected by vote of the members. Each member shall be provided a written ballot.The elected officers are determined by a simple majority of the votes cast.

    Section 1. President.

    Delegate for both General Council and Bargaining and presides at all meetings of the Local.a. The president shall preside over all meetings of the Local and the Executive Committee.b. Serves as a member of the Labor/Management Committee during the two (2)-year termof office.c. Build agendas for meetings.d. Serves on and make appointments to agency committees that include SEIU Local 503,OPEU member representatives.e. Participates in the political program.f. Attends statewide Union meetings acting as an official representative of Local 733.g. Appoints the Nomination/Elections Committee.h. Acts as the chief spokesperson for Local 733.i. Serves as a voting member of the Executive Committee.j. Works on an ongoing basis to enhance skills, knowledge, and abilities by attendingtrainings, conferences, meetings, reading mail, and educational material.k. Appoints interim vacancies as needed for no longer than three (3) months before holding

    a special election.Section 2. Vice-President.Delegate for both General Council and Bargaining and presides at meetings of the Local andperforms other duties in the absence of the President.

    a. The Vice President shall be responsible for the Local s communications system-sendingout meeting notices, updating Union bulletin boards, and email announcements.b. The Vice President shall, in the absence of or upon the request of the President, performthe duties of the President.c. Stands ready to take part and assist the President as needed in any and all Local and

    District activities.d. Serves as a voting member of the Executive Committee.

    e. Provides orientation for new employees regarding the Union.f. The Vice President shall replace the President for the unexpired term in the event of the

    death, incapacity, resignation, or removal from office.Section 3. Secretary.Alternate Delegates for both General Council and Bargaining. Keeps accurate minutes of allLocal and Executive Committee meetings. Notifies all Local Officers of meeting dates and times.

    a. The Secretary shall keep a record of the proceedings of all regular and special meetingsof the Local, as well as keep permanent record of the minutes and log of members inattendance at each meeting.

    b. Distributes notices of regular and special meetings and other Local activities to themembership, staff organizer, and special guests, if any. Minutes of the meetings shall beposted on the Union bulletin board for each floor within seven (7) days of the meetingdate. A copy of the minutes also will be sent to each steward not located in the Salemoffice.

    c. Maintains Local files, including such material as:1. Local Constitution and Bylaws, with amendments;2. Minutes of meetings;3. Local correspondence, broken down by major classes of correspondents, such as

    members, the District Director, Headquarters staff and business firms;4. Committee activities;5. Reference material, including OPEU Handbook, rules and regulations of the PERSBoard, pay scales, and Retirement Board Rules.

    d. At the time of biennial elections, distributes ballots, forwards tally of votes to SEIU Local503, OPEU Headquarters, and performs other work related to the conduct of elections.

    e. Serves as a voting member of the Executive Committee.Section 4. Treasurer.Alternate Delegates for both General Council and Bargaining. Keeps accurate records of thefinances of the Local and reports to the Local Officers on the financial status of the Local at eachLocal Officers meeting.

    a. The Treasurer shall maintain the financial records of the Local and shall be responsiblefor all requests for disbursement of funds on behalf of the Local. All requests fordisbursement of funds shall be made to SEIU Local 503, OPEU Headquarters in care ofthe Statewide Treasurer of the Union, who shall comply with such requests when they arein compliance with the Constitution and Bylaws of the Union.

    b. Reports all changes in names and addresses of members, officers, and delegates to

    SEIU Local 503, OPEU Headquarters.c. Maintains Local membership records for SEIU Local 503, OPEU accounting purposes.d. Reports all incoming interoffice transfers to Headquarters.e. Maintains appropriate accounting and other financial records, covering the disbursementof all Local funds.f. Prepares financial reports for presentation to the Local at business meetings or wheneverspecifically requested by the President.g. Serves as a voting member of the Executive Committee.

    Section 5. General Council Delegates.Every Local in SEIU Local 503, OPEU has the right to a minimum of one delegate. Delegatestrength is based on membership, with one delegate for each one hundred (100) members ormajor fraction thereof. The number of delegates will be determined by the December membershipreport or by the average annual membership of the previous twelve (12) months, whichever ishigher. Vacancies occurring in the office of General Council Delegate may only be filled byelection, not appointment.

    a. Delegates to the General Council of the Union shall be elected from the membership ofthe Local during the election of Local officers. If no delegates are elected, they may beappointed by the Executive Committee.> -

    b. Delegates shall be present at General Council sessions during their term of office, andtake an active part in and give thoughtful consideration to, the business brought beforethe Council.c. Delegates attend the Union s biannual General Council as voting members; present anyresolution which the Local may deem necessary for the good of the Union; and work for

    the adoption of said resolution in conjunction with member delegates of other Locals.d. Delegates shall furnish the officers and members of their Local with a comprehensivereport of all business transacted at the General Council.e. Delegates are to take an active part in Local affairs, and discuss problems and programs

    with members in order to keep abreast of what is transpiring and become better qualifiedto serve as a representative of the membership.f. Alternate delegates are elected for the purpose of filling any delegate vacancies that mayarise.g. After General Council, it is the responsibility of the delegate(s) to bring any newinformation to the Local meeting.h. General Council Delegate can serve as Delegate while holding another elected postwithin Local 733.

    Section 6. Steward s .A Steward is defined as someone who (1) has completed Levels 1-3 of the Leadership Trainingworkshops sponsored by SEIU Local 503, OPEU, and (2) meets the approval of members of theExecutive Committee and current Stewards team. The Chief Steward shall abstain from grantingapproval in this process.

    a. Stewards shall attend steward meetings.b. Handles grievances through the steps within the agency and work closely with the Union

    Organizer in the handling and investigation of grievances.c. Serves as a main communication channel between Union leaders and staffd. Is a primary provider of direct services to the Local members.

    Section 7. Chief Steward.a. A Steward is appointed to Chief Steward by a vote of the Executive Committee in

    conjunction with the Stewards team.b. Processes and resolves worksite issues and grievances through all steps of the grievanceprocedure as outlined in the Collective Bargaining Agreement.c. Serves as a voting member of the Executive Committee .

    . d. Serves as a member of the Labor Management Committee.e. Attends and presides over all Steward meetings.f. Serves as a main communication channel between the Executive Committee, the

    Stewards, the Local membership and staff.g. Mentors and support stewards as needed.h. Works on an ongoing basis to enhance skills, knowledge, and abilities by attendingtrainings, conferences, and meetings, and by reading mail and educational material.i. Educates, communicates, and organizes around bargaining, politics, and worksite issues,

    and explains how these issues are inter-related.Section 8. Pres ident of Sub-Local.Delegate for both General Council and Bargaining and presides at all meetings of the Local.

    a. The president shall preside over all meetings of the Local and the Executive Committee.b. Serves as a member of the Labor/Management Committee during the two (2)-year term

    of office.c. Build agendas for meetings.

Appoints interim vacancies as needed for no longer than three (3) months before holdinga special election.

    Section 9. Bargaining Delegate s .a. Bargaining Delegates, as part of the Collective Bargaining Agreement negotiating

    committee, play the leadership role in developing proposals based on input frommembers, take part in the actual bargaining with management, provide information formembers about the progress of negotiations, and act as a team to urge ratification ordefeat of a tentative agreement. The number of Bargaining Delegates wiJl be determinedby the annual average of bargaining unit employees in the year ending the previousJanuary, per Article IX of the SEIU Local 503, OPEU Administrative Policies andProcedures. Vacancies occurring in the office of Bargaining Delegate may only be filledby election, not appointment.

    b. Duties of the Bargaining Delegates:1. Attend all scheduled bargaining meetings.2. Educate and inform Local members of bargaining issues at regular intervals.3. Represent the Local at bargaining sessions.4. Assist in the creation of a communication system to communicate bargaining issues.

    5. Select a team chairperson.6. Bargaining Delegate can serve as Delegate while holding another elected post

    within Local 733.

    Section 10. Removal From Office.Any officer or representative who fails to attend two (2) consecutive meetings without areasonable excuse, or by dereliction of duty, may be removed from office by a majority vote of theLocal Officers.

    Section 11. Executive Committee.The Executive Committee will deal with emergency situations. The Executive Committee willreport to the Local Officers all its actions within seven (7) days of such action. The ExecutiveCommittee consists of officers of the Local and the President of the Sub-Local.Section 12. Labor Management Committee.The LMC representatives shall consist of the local officers.

    ARTICLE III. FUNDINGSection 1.The primary source of funds for Local 733 shall consist of the Local rebates allotted in the SEIULocal 503, OPEU ByLaws.Section 2.

    The Executive Committee, under the direction of the Treasurer, shall prepare a budget for theLocal funds each year.ARTICLE IV. DELEGATES TO THE GENERAL COUNCIL

    Section 1. The Local s delegates to the General Council shall first come from the Local Officers, and shall bein this order: President, Vice President, Secretary and Treasurer.

    Section 2.General Council Delegates and their alternates will be part of the elected officer s responsibilities,which will be stated on both the nomination and ballot forms. If the officers are not able to fulfilltheir delegate responsibilities then nomination and ballot forms will be sent to each member perArticle III, GENERAL ELECTION REQUIREMENTS of the Union s ByLaws. If not enoughdelegates are elected, then the Executive Committee may appoint interested members to thoseunfilled positions. The number of delegates must not exceed the appropriate number allotted perArticle XIV - THE GENERAL COUNCIL, of the Union s ByLaws.

    ARTICLE V. MEETINGSSection 1.Meetings and Agendas shall be scheduled by the President.Section 2.The Local Officers shall hold at least two (2) meetings per year.

    Section 3The Local President has the right to call an emergency meeting with less notice than ten (10)days.Section 4A quorum for a meeting shall be simple majority of the Local Officers.

    ARTICLE VI. AMENDMENTSAny provision of these ByLaws may be changed or deleted, or any provision may be added, by a 2/3majority vote of the Local Officers present, provided said change is on the agenda.ARTICLE VII. NEWSLETTER

    Section 1

    The Local shall produce/publish and distribute to all Local members a newsletter.Section The production, publishing, and distribution of the newsletter may only be altered, stopped orchanged by a majority vote of a quorum of Local Officers.
