Il “Rischio PAESE” è il rischio che la controparte sia inadempiente nella suaobbligazione di pagamento per cause alla stessa non imputabili, ma che dipendonodalla situazione del Paese in cui essa opera.
È legato alla stabilità economica e politica del Paese del debitore ed è oggetto dicontinua analisi e valutazione da parte di apposite agenzie di rating.

Il Rischio BANCA
Il rischio BANCA è il rischio collegato al rischio di insolvenza e diperformance della banca estera
Per valutarlo è necessario conoscere il relativo rischio paese, analizzare i bilanci dellabanca e considerare la diligenza e correttezza del suo operato. Data un’esposizionemassima globale, alle singole banche estere sono assegnati specifici limiti diaffidamento.

Il Rischio di Produzione: definizione di SACE
N.B: Qualora il contratto commerciale preveda la facoltà per l’Acquirente di recedere apiacimento dal contratto (c.d. clausola di “termination for convenience” o simile),l’esercizio di tale facoltà non configura un EGS e, pertanto, non può dar luogo alpagamento di alcun indennizzo da parte di SACE.

9. PAYMENT支付:
The Buyer, upon receipt from the Seller of the delivery advice specified in Clause 11hereof, shall, 10 days prior to the date of delivery, open an irrevocable letter of creditwith the Buyer’s Bank in favor of the Seller, for the total value of contract price. Atolerance of 3% of the total amount of the contract value shall be allowed. The creditshall be available against Seller's draft(s) drawn at sight on the opening bank for 100%invoice value accompanied by the shipping documents specified in Clause 10 hereof.Payment shall be effected by the opening bank by telegraphic transfer againstpresentation to them of the aforesaid draft(s) and documents. Il Rischio Giuridico e Contrattuale
Cosa vede la banca:
Gli esportatori nella maggior parte dei casi ricevono il testo di contratto commercialedal compratore. Gli esportatori non hanno un loro contratto adatto al loro prodotto ed ailoro mercati. Il testo proposto dal compratore ha impostazioni del tipo "win or lose".
Nella maggior parte dei casi l'esportatore chiede alla banca un anticipo export, unaconsulenza sul mezzo di pagamento, lo smobilizzo pro-soluto del suo credito ol'assicurazione del credito all'esportazione dopo aver formalizzato la trattativacommerciale: cioè a cose fatte con contratti già firmati.
Aumenta la casistica di truffe commerciali nei confronti degli esportatori che non sirivolgono preventivamente ad un legale esperto di contrattualistica internazionale o allaloro banca.

Sintesi del punto di vista della banca
Molti esportatori si affacciano alla vendita all'estero in modo:
"MINDLESS EXPORTING"
Sebbene vi siano molti strumenti a sostegno dell'internazionalizzazione intesa nelle suevarie accezioni non esiste un focus da parte di strutture pubbliche e bancarie sul"contratto commerciale" che è lo strumento di tutela e stabilizzazione di una relazioneindustriale con il compratore.
Per assurdo è facile trovare una controparte commerciale ma poi si è soli nelleproblematiche contrattuali.
Soprattutto le PMI sono penalizzate per l'assenza di sensibilizzazione sulla materia eforse la non conoscenza dei possibili supporti.
Il contratto commerciale di compravendita internazionale
Non sempre rileviamo la giusta attenzione alla fase di costruzione e negoziazionedel contratto.
Il Contratto è
“il primo strumento di prevenzione contro il mancato pagamento.

Con la stipula del contratto internazionale si possono raggiungere i seguenti scopi:
uno strumento per raggiungere gli obiettivi imprenditoriali che hanno determinatole parti alla conclusione della transazione commerciale di cui il contratto detta ladisciplina;
uno strumento per ridurre, per quanto possibile, i rischi connessi con la decisionedell’impresa italiana di avviare un percorso di internazionalizzazione con unacontroparte – un partner straniero;
uno strumento per identificare e disciplinare le specificità dell’accordo che siintende formalizzare con un partner straniero;
il “luogo virtuale” dove devono essere contemperate e rappresentate in manieraomogenea le esigenze del giurista e dell’imprenditore.

Caratteristiche del contratto commerciale
Per redigere un buon contratto è opportuno seguire alcuni principi generali.
Un buon contratto non dipende dal numero delle pagine
Un buon contratto deve avere, piuttosto, le seguenti caratteristiche:
Completezza deve comprendere tutti i punti oggetto del contratto stesso (leggeapplicabile, foro competente, arbitrato, lingua, ecc.);
Chiarezza deve prevedere tutto ciò che potrebbe creare dei problemi o conflitti,non lasciando spazi a equivoci e interpretazioni diverse da quanto definito dalleparti;
Semplicità il linguaggio deve essere comprensibile a tutti colore che sarannochiamati ad utilizzare il contratto stesso;
Organicità le clausole devono essere esposte all’interno di uno schema ordinatoe coerente, senza contraddizioni tra una e l’altra clausola.

Cosa vede la Banca sui mezzi di pagamento
Il Credito Documentario: un "falso amico" se non lo si conosce.
Molti esportatori pensano che, nella formalizzazione della vendita ordine-confermad'ordine o nel contratto commerciale, indicando che il pagamento sia effettuato amezzo credito documentario questo sia una "condizione necessaria e sufficiente" pertutelare il proprio incasso.
Il testo del credito documentario o quello di una garanzia internazionale sonoquotidianamente oggetto di negoziazioni tra le parti. Un credito documentario (LCExport) se non correttamente formulato nei suoi campi potrebbe essere un mezzo dipagamento costoso e senza copertura del rischio paese e del rischio Banca estera.

(1). Within 30 working days after the contract takes effect, Buyer shall pay Seller adeposit of 30% of the total value 879,624.00 Euro of this Contract by T/T, which is263,887.00 Euro
(2). The BUYER shall pay the balance 70% of the total value 879,624.00 Euro, which is615,737.00 Euro (the buyer shall pay 70% of each delivery prior to shipment of eachbatch of goods by irrevocable L/C at sight in favor of the seller ) after qualifyinginspection. Shipment of parts will only occur after the SELLER has received thispayment.

Performance Bond
As security for the due execution of this contract, the Seller shall deposit to the Buyer,within (15) fifteen days from the date of signing contract letter of guarantee in EnglishLanguage as per Annex (2).
The Letter of Guarantee will be written in English in the same currency as the contractand will be issued by an approved bank in Egypt, or by an established bank in theSeller’s country and endorsed by an approved bank in Egypt for the amount equal toTen percent (10%) of the total value of the Contract.

This contract shall not be final and binding to the Buyer or the Seller unless thisguarantee has been effected. The said guarantee will be held and maintained at its fullamount by the Buyer subject to conditions and stipulations of this Contract as apecuniary guarantee for the due execution and proper performance of this Contractand the recovery of overpayments or any penalties or damages to which the Seller maybecome liable until the expiry of (24) Twenty four months after the date of putting themachine into operation and acceptance. At the end of this time the Buyer will return thisletter of guarantee to the Seller’s bank with or max.(27) months from B/L date.
If at any time during the duration of this contract any sum shall be deducted from theguarantee issued by the Buyer in accordance with the conditions of this Contract, theSeller shall immediately upon receipt of a demand in writing from the Buyer increasethe guarantee to its full amount and shall always maintain it at its full amount until itsexpiration as mentioned above

14. FORCE MAJEURE不可抗力:
The Seller shall not be held responsible for the delay in shipment or non-delivery of thegoods due to Force Majeure, such as war, serious fire, flood, typhoon and earthquake, orother events agreed upon between both parties, which might occur during the process ofmanufacturing or in the course of loading or transit. The Seller shall advise the Buyerimmediately of the occurrence mentioned above and within fourteen days thereafter, theSeller shall send by airmail to the Buyer for their acceptance a certificate of the accidentissued by the competent government authorities where the accident occurs as evidencethereof.
Under such circumstances the Seller, however, is still under the obligation to take allnecessary measures to hasten the delivery of the goods. In case the accident lasts formore than 10 weeks, the Buyer shall have the right to cancel the Contract.
The Buyer shall not be held responsible for failure or delay to perform all or any part of thisContract due to Force Majeure.

9.1. None of the Parties is responsible for full or partial non-fulfilment of any of itsobligation as per present Contract if such non-fulfilment is a consequence ofcircumstances out of the control of the Party.
9.2 Force majeure mean any cause, which is beyond Party's reasonable control,including but not limited to flood, storm, fire, earth-quake and other natural calamities(“acts of God”), as well as lock-out, strikes (national or international), interruptions of/ordelay in transport, power or energy failures, embargo, governmental prohibition oftrade, interference by civil or military authorities, acts (including delay or failure to acts),regulations or orders of governmental authority, acts of war (declared or undeclared),national emergency, (such as blockade, limitations on export/import) arising aftersigning the Contract and/or influencing Contract fulfilment.
9.3 The Party unable to fulfil its obligations shall inform within 3 calendar days theother Party in written form of the start, expected time of remaining in force (expectedtime before cessation) of the said circumstances. Force-majeure circumstances shallbe supported by written documents and, as far as practical, evidenced by theChamber of Commerce of either the Seller’s or Buyer’s Country.

9.4 If such circumstances impact the fulfilment of the obligations within the timestipulated in the Contract, then their fulfilment time shall be correspondingly extendedby the time when such circumstances remain in force and impact the performance ofthe Contract.
9.5 If these force-majeure circumstances last more than 3 (three) months, then theParties shall meet and promptly discuss methods to resolve the difficulties arising fromthe event of force majeure.
If no agreement is reached by the Parties within a period of forty five (45) days after thenotice of the force majeure event, either Party may terminate the Contract by givingwritten notice thereof.
In this case neither Party shall have the right for damages by the counterpart. Buyerwill only pay Seller all outstanding amounts at the time of termination

If either of the Parties of the agreement shall be prevented from executing theAgreement due to cases of Force Majeure, such as war, fire , flood, typhoon andearthquake, or other events agreed upon between the two Parties, the time for theexecution of the Agreement shall be extended by a period equal to the effect of suchcases.
The prevented Party shall notify the other Party by cable of the occurrence of the ForceMajeure within the shortest possible time and within 14 (fourteen) days thereafter shallsend by registered airmail to the other Party a certificate issued by the relevantauthorities and/or competent entity for information to other Party.
Should the effect of the Force Majeure occurrence continue for more than 30 (thirty)consecutive days, both Party shall settle the further execution of the Agreementthrough friendly negotiations as soon as possible. In case such negotiations do nopurport to an acceptable solution for both Parties, each party shall be considered asrelieved of its obligations under the present Agreement.

Cancellation of the Contract:
Besides any other sanction mentioned in this contract, the Buyer has The absoluteright to cancel this contract in case the supplier does not execute any of thisobligations, this cancellation will be effected by a fax or registered letter sent to thesupplier and without need to legal or judicial or other formalities. The said cancellationmay lead to any of the following consequences:
1 - The Buyer either confiscates the guarantee deposit without being called Upon togive any explanation whatsoever and without any need to prove Damage or resort toany further formalities or judicial proceedings
2 - The Buyer may install / purchase the Materials contracted for by/from any other firmor country, the supplier remaining responsible for indemnifying the buyer for any loss ordamage or extra payment caused thereby.
The Buyer will have the right in the two above cases to recover damage the Supplierhas caused due to the nor execution of this contract, due to the cancellation of thecontract.

11. Liabilities And Legal Process to Resolve Possible Disputes:
(1) order forms, shipping documents, payment records, quality assessment reports andall correspondence shall all form part of the contract.
(2) For any possible problems during execution of the contract, both parties shall, in thespirit of the mutual cooperation and understanding, actively seek to resolve theseproblems through discussion and negotiation. The principles for resolving disputes are:
(2-1) Either party shall not assume any liability for failing to fulfill the respectiveobligations specified in the contract if such failure is caused by the breach of thecontract by the opposite party --For example, if the BUYER is not able to make thedeposit payment in time the SELLER shall not be held liable for not being able to timelymake delivery of the goods.
(2-2) Either party shall be entitled to seek compensation from the opposite party. (Forexample, the BUYER is entitled to seek compensation from the SELLER in the event ofloss caused by the SELLER’s failure to meet the required quality standard wherebyover 99% of the products shall be manufactured in accordance with quality of samples,even though the Purchaser has made adequate payments.)
(2-3) For Economic dispute that cannot be resolved by negotiation, both parties shallseek to resolve the dispute through legal avenues. The applicable law shall be theInternational Trade Laws. Both parties shall also be entitled to start litigationproceedings with Board of Arbitration.

ARBITRATION
Any dispute, difference arising from this contract shall be referred to and decided bythe Cairo regional arbitration center. The court of arbitration shall be composed of threearbitrators. One to be appointed by the buyer and one by the Supplier and upon thisnomination a third by the two parties jointly. In case no agreement between them couldbe reached within sixty (60) days after the appointment of the two arbitrators the thirdshall be appointed by the Cairo regional arbitration center.
The third arbitrator shall be neither of A.R.E. nationality nor of the supplier’s nationality.
The party requesting arbitration shall notify the other party of his intention by registeredletter facsimile, or telex with indication of this claim and the name and the address ofhis arbitrators. If the other party has not appointed and forwarded the name andaddress of his arbitrators to the first mentioned part within thirty (30) days of receipt ofthe notice, such arbitrator shall appointed the president of the concerned court ofarbitration.

The same procedure shall apply when an arbitrator fails without excuse acceptable tothe other arbitrators, to attend two successive meetings.
Each party may replace the arbitrator appointed by him or on his behalf provided thatno matter shall be pending before the court at the of such replacement each party shallreplace within thirty (30) days the arbitrator by him or his behalf in case of death orresignation.
It is furthermore understood that both parties have irrevocable agreed to applyEgyptian laws and to choose Cairo as the seat of the court of arbitration . arbitration willbe in English language.
The court shall make its decisions by a vote of the majority, each party shall bear theexpense and the fees of the arbitrator appointed by him, and the court of arbitrationshall determine the division of the remaining costs between the two parties the cost ofthe arbitration proceedings have to be Born by the losing party.
The decision of the court shall be final and binding and cannot be made subject to anyappeal or other recourse.

16. ARBITRATION
All disputes among the Seller and the Buyer in connection with this Contract or theexecution thereof shall be settled friendly through negotiations. In case no settlement canbe reached, the case may then be submitted for arbitration to China InternationalEconomic and Trade Arbitration Commission in accordance with its Rules of Arbitrationpromulgated by the said Arbitration Commission. The arbitration shall take place in Beijingand the decision of the Arbitration Commission shall be final and binding upon the Sellerand the Buyer; neither party shall seek recourse to a law court nor other authorities toappeal for revision of the decision. Arbitration fee shall be borne by the losing party. In thecourse of arbitration, all the parties shall continue to execute the present Contract exceptthose under arbitration. The Contract shall be interpreted in accordance with the laws ofPeople’s Republic of China.

11.1. All disputes and differences between parties, which may arise out of the presentContract or in connection with its fulfillment, shall be settled during negotiations, ifpossible.
11.2. In case of any disputes or differences arising out of interpretation or performance ofthe Contract, or the contents thereof, or the rights and obligations of the Parties thereto,the Parties shall endeavor to settle the same by mutual agreement. If the Parties fail tocome to such agreement, such disputes or differences shall be finally settled by ArbitrationInstitute of the International Chamber of Commerce in Stockholm (Sweden) under itsRules, by three (3) arbitrators appointed in accordance with its Rules,
11.3. For this Contract the substantive law of Sweden shall be applied. Conflict rules andjurisdiction to courts of the general jurisdiction are excluded.
The place of arbitration shall be Stockholm. The language to be used in arbitralproceedings shall be English. The arbitration award shall be final and binding for bothparties.
11.4. The arbitrators shall apply the substantive applicable law to the merits of the disputeand, in all cases, shall decide in accordance with the terms of the Contract.

Il Credito Documentario è una operazione separata e distinta dal contratto commercialesottostante cui fa riferimento.

Un credito irrevocabile costituisce un impegno inderogabile per la banca che lo haemesso. Essa diventa l’obbligato principale e, da quel momento in poi, non è piùpossibile modificare o annullare il credito senza il consenso di tutte le parti interessate
Le NUU 600 sui crediti documentari, che disciplinano i rapporti giuridici e le procedurein tema di crediti documentari, specificano che il credito è irrevocabile anche inassenza di un’indicazione in tal senso (vedi art. 3).

Come appare evidente, la conferma è un importante strumento di copertura del rischiodi credito ed un credito documentario irrevocabile e confermato rappresenta la formain assoluto più sicura di incasso per il venditore e, per questo, in particolare la piùopportuna per forniture verso paesi ad elevato rischio politico ed economico.

Quando all’impegno della banca emittente va ad aggiungersene uno autonomo edirrevocabile da parte di un’altra banca (confirming bank, che normalmente è anche laadvising bank), il credoc si dice confermato; altrimenti il credoc è non confermato.
Con la conferma sarà la stessa confirming bank, che esaminerà i documenti, e se liriscontra conformi, dovrà accreditare l’importo al beneficiario, in via definitiva eliberatoria, senza cioè possibilità di rivalsa nei confronti del beneficiario.
In base all’art. 2 delle NUU 600:
Conferma significa un impegno inderogabile della banca confermante, che si aggiunge a quello dellabanca emittente, di onorare o negoziare una presentazione conforme.
Banca confermante significa la banca che aggiunge la propria conferma a un credito su autorizzazioneo richiesta della banca emittente.

I principali presupposti affinché il beneficiario/esportatore possa ottenere l’aggiuntadella conferma dalla propria Banca sono i seguenti:
1. Presenza del mandato: nell’apposito campo del messaggio Swift di apertura del creditodocumentario devono essere presenti le istruzioni di conferma /CONFIRM/ oppure/MAY ADD/
2. La forma tecnica complessiva del credito deve essere di gradimento della Bancarichiesta di aggiungere la conferma
3. La Banca richiesta di aggiungere la conferma deve essere disponibile all’assunzione delrelativo rischio.
Va sottolineato che una Banca richiesta di aggiungere la conferma ha comunque ladiscrezionalità di decidere se aggiungere o meno la conferma al credito e se essa nonè disposta ad aggiungere la conferma deve informare senza ritardo la Banca Emittente(vedi art. 8 d. NUU 600).

È consigliabile per l’esportatore quando stipula un contratto che preveda il regolamentoa mezzo credito documentario confermato verificare preventivamente con la propriaBanca la sua disponibilità di massima o meno al rilascio della predetta conferma edin caso affermativo i relativi costi.
Occorre però evidenziare che in questa fase solitamente la positiva disponibilità dimassima di una Banca ad aggiungere la conferma viene comunicata all’esportatore,futuro beneficiario del credito documentario, sulla base della valutazione del rischioPaese/Banca esprimibile in quel momento e senza alcun impegno o responsabilità. Allostesso modo deve essere considerata a titolo indicativo la quotazione dei relativi costi.
Per neutralizzare il rischio che la Banca possa non essere più disponibile adaggiungere la conferma quando il credito perverrà e soprattutto se il periodo chetrascorre tra la stipula del contratto e la disposizione del credito documentario èabbastanza lungo, l’esportatore può richiedere alla propria Banca il rilascio di un“commitment”.

La Camera di Commercio Internazionale, in stretto contatto con le Associazionibancarie e professionali dei Paesi Aderenti, ha codificato sin dal 1933 le Norme ed UsiUniformi relativi ai Crediti Documentari, rivedendole ed aggiornandole periodicamente.
Dal 1 °Luglio 2007 si applicano le Norme ed Usi Uniformi relativi ai CreditiDocumentari, Revisione 2007, Pubblicazione ICC N. 600 (NUU 600) / UniformCustoms and Practice for Documentary Credits, 2007 Revision, ICC Publication no.600 (UCP 600)
Ovviamente la regolamentazione giuridica dei rapporti nascenti dai crediti documentariè disciplinata dalle varie legislazioni nazionali, ma le Norme ed Usi Uniformi della C.C.I.costituiscono un importante riferimento laddove le norme giuridiche facciano rimandoalla consuetudine ed alla prassi.
Le NUU 600 si applicano quando il credito documentario indica espressamente che èsoggetto alle norme in questione (vedi art. 1 NUU 600).

Nelle operazioni internazionali hanno assunto sempre maggiore importanza, in quantol’acquirente di una merce, il committente di un servizio ed il fornitore di una merce – aseconda dei casi – si assicurano l’adempimento di un obbligo contrattuale assuntodalla controparte
La garanzia, non rappresentando versamento immediato di denaro, ma solo unimpegno a fronte di insolvenze o inadempienze rientra nella categoria di “Crediti diFirma”
La caratteristica dell'accessorietà della fideiussione (così come da artt. 1936-1957 delns/ Codice Civile) ha fatto sì che in campo internazionale si sia sviluppata la figuradella garanzia autonoma - la cosiddetta garanzia a prima richiesta (“on firstdemand”) o bond – che è svincolata dall’obbligazione principale instaurata tra leparti. La garanzia a prima richiesta offre una maggiore “solidità” in quanto garanziaautonoma che non grava il beneficiario di alcun onere probatorio.
Un impegno assunto in forma scritta da una Banca di effettuare ilpagamento di un importo a favore del Beneficiario nel caso in cuil’obbligato principale non adempia ai propri obblighi determinaticontrattualmente e richiamati nel testo della garanzia stessa

La garanzia autonoma a prima richiesta (“on first demand”) è un impegno:
autonomo
indipendente
astratto
rispetto al contratto sottostante da cui trae origine.
Requisiti principali:
essere irrevocabile
essere incondizionata e pagabile a prima richiesta, cioè il pagamento da parte dellabanca emittente avverrà a prima e semplice richiesta, senza che sia possibile addurrepretesti motivati a elementi connessi al contratto sottostante
avere una data di validità, elemento fondamentale di qualsiasi impegno assunto dallebanche
essere emessa per un importo definito o definibile che potrà essere utilizzatoparzialmente fino alla sua concorrenza oppure in un’unica soluzione
fare espresso riferimento alla fornitura del bene o del servizio oggetto della transazione
essere emessa a favore del beneficiario, direttamente o per il tramite di una bancastabilita nel paese del beneficiario stesso

Fin dal 1978, con la Pubblicazione n.325 “Regole Uniformi per le garanzie Contrattuali”la Camera di Commercio Internazionale ha cercato di introdurre regole standard perl’emissione e l’utilizzo delle garanzie nel commercio internazionale, in particolare perattenuare le problematiche relative alle indebite escussioni delle stesse. Tali normesono state poco utilizzate.
Nel 1992 la CCI ha pubblicato le Regole Uniformi per le garanzie a prima richiesta,Pubbl. n.458 (ICC Uniform Rules for Demand Guarantes - URDG 458), che hannoavuto una maggiore diffusione sebbene tuttora non siano universalmente accettate
Il 1 Luglio 2010 è entrata in vigore la nuova versione delle Regole Uniformi denominatacon il n.758 di Pubblicazione della CCI (URDG 758).

Usi e consuetudini di alcuni Paesi (es. Stati Uniti e Canada) ove vigeva il divieto per leBanche di rilasciare garanzie bancarie in favore di non residenti.
Cos’è?
La Stand-by letter of credit è una garanzia bancaria che ha l'aspetto formale di uncredito documentario, ma a differenza di quest'ultimo non è uno strumento di pagamento.
Le possibili applicazioni della SBLC sono svariate sia in operazioni di natura commercialeche di natura finanziaria.
Un suo uso frequente è con funzione di “Garanzia di pagamento”, sia per garantireforniture singole che flussi di forniture ripetitive.

Solitamente il venditore richiede al compratore di far disporre tale strumento in suo favoreper avere garantito in tutto o in parte il rischio di credito su forniture di merce o di servizida regolarsi contrattualmente a parte a mezzo ordine di bonifico posticipato. In caso dicorretto adempimento delle obbligazioni di pagamento garantite la SBLC scadeinutilizzata.
Qualora invece il compratore (ordinante della SBLC) non provveda a pagare l'importodovuto nei termini previsti il venditore (beneficiario della SBLC) provvederà ad utilizzare laSBLC presentando la documentazione richiesta che solitamente è rappresentata da:
una semplice dichiarazione del beneficiario sottoscritta con la quale egli attesta chel'ordinante non ha adempiuto alle sue obbligazioni di pagamento alla scadenza prevista
copie/fotocopie di fattura ed eventualmente del doc. di trasporto
Spesso la SBLC prevede un numero di “grace days” che devono trascorrere dopo iltermine previsto per il pagamento e prima dei quali la SBLC non può essere utilizzata.
La SBLC presenta le caratteristiche fondamentali formali del credito documentario (puòprevedere anche l’aggiunta della conferma da parte della Banca Designata) ed èdisciplinata dalle Norme ed Usi Uniformi relativi ai crediti documentari, Rev 2007,Pubbl. N. 600 della CCI (è da scoraggiare l’assoggettamento delle SBLC alleInternational Standby Practices 1998, ICC Publication n. 590 - ISP98).
