Tredoux, Liezel Gaynor (LLD) Liezel Tredoux obtained the degrees BA (Law) (1996) and LLB (1998) from the University of Stellenbosch and holds an LLM in Tax Law from the University of Pretoria (2003) and a Certificate in International Tax Law from the University of Cape Town (cum laude) (2008). She was admitted as an attorney in 2001, and as an advocate in 2002. She practised as a member of the Pretoria Society of Advocates. She lectured at Damelin, the University of Pretoria, and Bond University. Ms Tredoux has been a senior lecturer in tax law at the University of South Africa since 2008. During her doctoral studies she was a visiting researcher at the UNSW Business School, (University of New South Wales, Australia), Osgoode Hall Law School (University of York, Canada), the University of British Columbia (Canada), and the International Bureau for Fiscal Documentation (The Netherlands). She has three children: Gizelle, Kelira and Jason. In her thesis, Ms Tredoux compares how different corporate tax structures provide relief against the economic double taxation occurring when income that has been taxed in the hands of the company is again taxed upon its distribution to shareholders. She investigates the Australian imputation system and the Canadian hybrid integration model but concludes that the current South African hybrid dual-rate corporate tax system provides adequate relief and should be retained. She finds, however, that certain significant differences in the taxation rules for returns of an income nature (dividends and income) and returns of a capital nature (returns of capital and distribution of assets in specie) are inequitable, erode the tax base, and conflict with the government’s policy of taxing all net accretions of wealth. She proposes improvements to protect the tax base against erosion and profit shifting, promote equity and certainty, and align South African tax law with international trends.
