The Town and Country Planning Department was created as a small cell of the H.P. Public
Works Department in the year 1964 and the same continued up to 1979. During the year
1979, an independent Directorate was created but charge of the Director continued to be
held by the Engineer-in-Chief (B&R) or the Chief Engineer of H.P. Public Works
Department, till 1993, when an independent Director was appointed as Head of the
Department.
2.0 INTRODUCTION
Town and Country Planning is a social transformation development process to ensure
creation of functionally workable, economically viable, socially acceptable,
environmentally sustainable and aesthetically pleasing living environment for humanity in
both, rural and urban habitats, through optimum, just and balanced use of scarce land
resources in view of demographic, socio-economic, techno-legal dynamics, which is
foremost necessity of the day.
Town and Country Planning ensures planned, systematic, sustainable development of
urban and rural habitations and is a prerequisite for all modern development schemes.
Development Plans, Sectoral Plans and Town Planning Schemes go a long way in catering
to civic and other urban services infrastructure, transportation and other requirements that
ensure dynamism and a healthy living environment for humanity.
3.0 AIMS AND OBJECTIVES OF THE DEPARTMENT
Himachal Pradesh, being a hilly State, is endowed with rich eco-system and cultural
heritage. Although, there is a low level of urbanization in the State, yet during recent years
urbanization has been exerting high pressure on scarce urban land resources. There are 59
small and medium census towns in the State, with only Shimla as Class-I city. As per
2011 census, urban population of the State in these urban areas was 6,88,552 persons,
which is about 10.03% of the total population of the State. Due to various development
priorities of the Government activities and opening of new areas, a large number of new
growth centers are coming up very fast. The pressure on land in the State has increased
manifold, leading to haphazard and un-planned construction activities in towns, growth
centers and their surrounding areas. With a view to manage and regulate this increasing
trend in urbanization and to check the un-authorized construction activities, the
Government of Himachal Pradesh had enacted Himachal Pradesh Town & Country
Planning Act, 1977 and made it applicable to all major towns of the State.

6.0 EXTENSION OF ACT TO PLANNING AREAS
For planned development of various towns and growth centers of the State, the Himachal
Pradesh Town & Country Planning Act, 1977 has been extended to 33 Planning Areas in

7.0 SPECIAL AREAS AND SPECIAL AREA DEVELOPMENT
AUTHORITIES.
Besides 33 Planning Areas, Government has extended the provisions of the Himachal
Pradesh Town and Country Planning Act, 1977 to 34 areas of the State, by designating
these areas as Special Areas under Section–66 of the Act ibid. The areas which have
growth potential for urbanization and have no agency for development or for providing
basic services have been declared as Special Areas. For regulating planned and systematic
development in these Special Areas, the Special Area Development Authorities have been

constituted under Section-67 of the Act ibid, mostly under the Chairmanship of the
Deputy Commissioners and Sub-Divisional Officers (Civil).
In case of Tribal Areas of the State, concerned Hon’ble M.L.As are the Chairmen of the
Tribal Special Area Development Authorities. Local Officers of respective areas and
Pradhans of Gram Panchayats are Members of the Special Area Development Authorities.
Baddi-Barotiwala and Nalagarh Development Authority has been established under the
Chairmanship of the Hon’ble Chief Minister.
The Special Area Development Authorities have powers to impose taxes, fees and levies
at par to the Municipal Bodies. Functions of the Special Area Development Authorities, as
per Section 70 of the Act ibid are as under:-
1 To prepare the development plan(s) for the special areas;
2. To implement the development plan(s) after approval of the State Government;
3. For the purpose of implementation of the plan, to acquire, hold, develop, manage
and dispose of land and other property;
4. To carry out construction activity and to provide water, electricity, drainage and
other utilities and amenities;
5. To provide the municipal services as specified in the Himachal Pradesh
Municipal Act, 1994;
6 To provide for the municipal management of the special area in the same manner
as is provided in the Himachal Pradesh Municipal Act, 1994;
7 To otherwise perform all such functions with regard to the Special areas as the
State Govt. may, from time to time direct.

Regional Plans

The Department is in the process of regionalization of the State. District has been adopted
as a planning unit with reference to Regional Planning as per the point of the 73rd
and 74th
Constitutional Amendment. Proposals for constitution of 12 Regions in the State have
been submitted to the Administrative Department.
Interim Development Plans and Development Plans
For ensuring sustainable growth and regulated Spatial Planning, Interim / Development
Plans are prepared for the prospective period of 15-20 years. Presently there is only one
Interim Development Plan i.e. for Shimla Planning which was notified on 23.4.1979.

In order to replace the Interim Development Plan, a Development Plan of Shimla
Planning Area had been sent to the Govt. for approval. However, as the State Govt. didn’t
approve the same, the exercise is proposed to be got done by way of outsourcing
now.The Development plans of Kullu-Bhunter Agglomeration of Kullu Valley Planning

Area and Development Plans for Theog, Rohru and Mehatpur Planning Areas have been
sent to the respective field offices for attending observations, work on which is under
progress. The revised Development Plans for Rampur, Dharamshala and Parwanoo
Planning areas earlier submitted to the Govt. for approval, have been returned to the
department for incorporating the changes that have occurred in the interim period since
their submission to the Government. The same have been sent to field offices for carrying
out necessary amendments, which is in progress.

9.0 THE HIMACHAL PRADESH APARTMENT AND PROPERTY
REGULATION ACT, 2005
In view of the changed housing demand scenario, the Government of Himachal Pradesh
enacted the Himachal Pradesh Apartment and Property Regulation Act, 2005 and Rules
there under in the Department of Housing, to regulate development of colonies and
apartments as well as transaction of built properties.
The custodianship of this Act was given to HIMUDA by notifying C.E.O- cum-Secretary
as Competent Authority to exercise and perform all or any of the powers and functions of
the Competent Authority under the Act ibid. However, of late it was felt that assignment
of regulatory process under Act ibid to HIMUDA, which itself is a promoter, is not
appropriate. Therefore, in addition to normal duties and responsibilities of the Director,
Town & Country Planning under the H.P. Town & Country Planning Act, 1977, the
statutory duties and responsibilities as envisaged in the Himachal Pradesh Apartment &
Property Regulation Act, 2005 of the Competent Authority have been assigned by
declaring the Director, Town and Country Planning as Competent Authority vide
notification No. HSG-A (3)-I-3/2010 dated 22.11.2010 of the Principal Secretary
(Housing) to the Government of Himachal Pradesh.
In view of above, the Department has assumed this new assignment by taking over
complete record thereof from HIMUDA. The following statutory functions are being
performed by the Department:-
1. Registration & Licensing of Promoters/Estate Agents.
2. To watch the interests of buyers by way of exercising check on sale agreements
between promoters & buyers.

3. To inspect & audit accounts of Promoters/Estate Agents.
4. To ensure provisioning of amenities by the Promoters till transfer of area to local
Bodies.
5. To issue completion and occupation certificates.
6. To ensure proper documentation & enforcement on Registration of Conveyance
by the Promoters.
7. To inspect working of Promoters and Estate Agents for ensuring compliance of
provisions of the Act ibid and rules made there under.
8. To publish annually in the Official Gazette the Report of the activities financed
from the Development Fund and the statement of Accounts.
9. To take cognizance of offences by persons or Promoters or Estate Agents and
initiate penal action.
Thereafter, the H.P. Apartment and Property Regulation Act, 2005 has been repealed
and its provisions incorporated in the H.P. Town & Country Planning Act, 1977 vide
Government Notification dated 21.09.2013 and Rules framed thereunder notified on
01.12.2014. The detail of the Registration as well as license cases issued under above
Acts w.e.f. 01.04.2014 to 31.03.2015 is as under:-

12.0 POWERS AND DUTIES OF THE OFFICERS AND OFFICIALS:
All the Officers and Officials of this Department perform their duties and exercise
powers in accordance with the delegations made by the Government and Director, from
time to time.
• Administrative and Financial discipline in the Department is ensured in accordance with
HPFR, FRSR, CCS (CCA) Rules and CCS (Conduct) Rules.
• As regards to specific activities of Town & Country Planning Department, the duties and
powers of the Director have been assigned and delegated to all the field officers of this
Department with a view to expedite the works of general public in a prompt and time
bound manner. The statutory duties of the officers and officials have been prescribed in
the Rules and Regulations, in operation for regulating the activities.

15.0 HIMACHAL PRADESH TOWN AND COUNTRY PLANNING ACT,
1977.
In view of the directions of the Government, the Himachal Pradesh Town & Country
Planning Act, 1977 has been amended by bringing about necessary changes in it. The
provisions of new repealed Himachal Pradesh Apartment and Property Regulation Act,
2005 have been incorporated under the amended Town & Country Planning Act.

16.0 HIMACHAL PRADESH TOWN AND COUNTRY PLANNING
RULES, 2014

The State Government has repealed the Himachal Pradesh Town and Country Planning
Rules, 1978 with the Himachal Pradesh Town and Country Planning Rules, 2014 on
01.12.2014. The new Rules have been made more logical, practical and simplified.
17.0 REGULATORY MEASURES ADOPTED BY THE DEPARTMENT TO
ENSURE PLANNED DEVELOPMENT
In order to ensure planned development, following steps have been taken:-
(a) The provision of parking on plots abutting vehicular roads has been made compulsory
, so that problem of parking on the roads is tackled.
(b) The regulations of Shimla, Manali, Dharamshala and Dalhousie pertaining to Green,
Heritage, Core, Restricted and Other Zones were adhered to, so that their tourist
character is maintained.
(c) The Architects were given licenses under the provisions of H.P. Town and Country
Planning Act, 1977, for ensuring public convenience.
(d) The provisions of rain water harvesting tank have been incorporated in the Rules and
are being ensured in each structure at the stage of approval of Plans and completion
of structures.
(e) The provisions of sloping roof and hill architecture were incorporated in the designs
of buildings, so that the same reflect hill development imperatives.
(f) Efforts are being made to see that the provisions of Section 16-C regarding proper
Sub-Division of land are strictly followed, so that well dimensioned developed plots
are made available to the common man.
(g) In order to restrict development on slopes above 45 degree in accordance with
regulations, the provision for same has been adhered to in the interest of preservation
of eco-fragile environs and hilly terrain.
(h) To curb hill cutting, provision of cutting only upto 3.50 metre height has been
adhered to strictly.
(i) The provisions have been made in the Rules for Barrier Free Environment in public
and semi-public buildings and recreational areas to facilitate persons with disabilities
and the same are being adhered to.
(j) The regulations for Solar Passive Building Technically have been approved by the
Government for comfortable living, on one hand and to effect energy saving, on the
other.

(k) Regulations for Information Technology Park at Waknaghat were prepared and the
same have been approved by the Government.
18.0 HERITAGE CONSERVATION
The buildings/ areas in Shimla and Chamba towns, which are of historical, religion and
tourism importance on account of their distinct architectural design features/elevations
have been identified and notified as Heritage Zones. Heritage regulations are in force in
respect of Heritage Zone of Shimla. Heritage reports of Shimla, Chamba, Mandi,
Dalhousie and Rampur were notified for inviting public objections and suggestions. In
compliance to minutes of meeting held under the Chairmanship of the Hon’ble Minister
(TCP) the said reports as prepared, were again decided to be deliberated with various
stakeholders and public representatives. The comments as received have been
incorporated in the reports and the same are under finalization. It is pertinent to mention
here that Archeological Survey of India has recently amended the Ancient Monuments
and Archaeological Sites and Remains Act, 1958 (amendments and validation) Act, 2010
vide which monuments having unique heritage background have been identified and
listed for their conservation and preservation. The purpose of the new Act is to preserve
and protect our heritage. The Government is determined to ensure that no construction,
including public projects takes place within the prohibited areas around the monuments
of national importance. In view of said amendment in Central Act, the Heritage
regulations are being re-examined.
19.0 POLICY ON URBANISATION OF STATE
The policy document, focusing on diffusion of development from urban areas to rural
areas; to create counter magnets; to ensure creation of serviced land/planned urban
infrastructure by a Development Authority; eco friendly development; protection of local
heritage etc. has been prepared by the Department. It dovetails the mechanism for
optimization of scarce urban land resources, necessity for planned sub-division of land
and Land pooling & re-constitution of plots having joint ownerships. Suggestions on the
draft Urbanisation Policy have been received from Urban Development Department,
HIMUDA, H.P. Pollution Control Board, Science & Technology Department, Urban
Local Bodies and HIMUDA have been received and examined in the Department.
Accordingly, the Policy stands submitted to the State Government.
20.0 SINGLE WINDOW SYSTEM For convenience of the public in getting their planning permissions cases cleared under
Municipal as well as TCP legislations, at one place, the “Single Window System” was
introduced in 12 Municipal areas namely-Shimla, Nahan, Hamirpur, Una, Mandi,
Rampur-Bushehar, Parwanoo, Paonta Sahib, Chamba, Solan, Bilaspur and Nalagarh. The
Urban Local Bodies are being assisted by the field officers of this Department. Besides
this, powers have also been delegated to the Deputy Commissioner(s), Kullu, Kangra and
Chambas in respect of Manali, Dharamshala and Dalhousie towns respectively.

to be covered under the ambit of the Himachal Pradesh Town & Country Planning Act,
1977 and preparation of Development Plans for the same is the target of the Department.

23.0 IMPLEMENTATION OF PROVISIONS OF RIGHT TO INFORMATION
ACT, 2005.
The updation of publication in terms of Section 4(1) (b) of the Right to Information Act,
2005 has been made by this Department. Special attention has been ensured for
compliance of provisions of the Right to Information Act, 2005 and the status of receipts
and disposals of applications under RTI is as under;-

23.1 IMPLEMENTATION OF TRAINING POLICY OF THE DEPARTMENT
In order to equip the employees of the Department with specific knowledge, skill and
attitude to enable them to play their role effectively, training on different topics like
Disaster Management, RTI Act, 2005, gender budgeting, office procedures & financial
management, GIS and remote sensing, basic computer training on MS Word/ MS Excel/
internet has been imparted to the officers/officials working on various posts in the
Department through HIPA, IIPA New Delhi, NRSC Hyderabad etc.

25.0 FUTURE PROGRAMMES On line submission of the planning permission to enhance the service delivery of
the Department. To comply with the orders of the Government of India, the Department
will soon outsource the work of Development Plan preparation of various towns in the
State, so that Development Plans could be ready in time.

• Extension of the provisions of H.P. Town and Country Planning Act, 1977 to the entire
State
Realising the necessity of Development Plans for regulation of development activities in
Urban areas and to comply with directives of the Central Government, the State
Government vide Cabinet Memorandum dated 25.09.2013 has decided to extend
provisions of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12
of 1977) to all existing notified towns and Urban Growth Centers in the State and to
prepare Master / Development Plan for each such town / Urban Growth Centers by the
end of 12th
Five Year Plan 2012-17. It has also been approved to accomplish task of
regionalization and Plan preparation in out sourcing mode in view of resource constraints
in the Department. The Department therefore is taking necessary steps to take up the task
in a systematic manner, so that planned & sustainable Urbanisation may be ensured in the
state in future.
• Technological up-gradation of the Department by computerization for speedy plan
preparation and implementation.
