Background

“The threat or use of nuclear weapons would generally be contrary to the rules of international law applicable in armed conflict, and in particular the principles and rules of humanitarian law… There exists an obligation to pursue in good faith and bring to a conclusion ne-gotiations leading to nuclear disarmament in all its as-pects under strict and effective international control.”

On 8 July 1996, the International Court of Justice (ICJ, also known as “World Court”) determined that the threat or use of nuclear weapons was generally illegal and that there exists an obligation to achieve complete nuclear disarmament.

The Court based its conclusion on customary interna-tional law, in particular the principles and rules of inter-national humanitarian law, which is universally binding and which prohibits the use of weapons or methods of warfare that:

Are not proportionate to what is required to respond to the provoking attack;

Cause unnecessary suffering to combatants; Are targeted against, or cause indiscriminate harm to,

non-combatants; Violate neutral territory; and Cause long-term and widespread damage to the

environment.

The Court’s decision has given legal weight to efforts by religious communities, non-governmental organizations and others to promote the abolition of nuclear weapons. In particular, it has generated a United Nations resolu-tion, adopted by an overwhelming majority of countries (including some nuclear-armed states), calling for mul-tilateral negotiations to achieve a nuclear weapons con-vention – a global treaty to prohibit and eliminate nuclear weapons. It has also spawned a proposal to the Interna-tional Criminal Court (ICC) to include in its jurisdiction any use of nuclear weapons as a crime against humanity.

る国際法の諸原則、そしてとくに人道法の原則及び

規則に、一般に違反するであろう。・・・（中略）・・

厳格かつ効果的な国際管理の下において、すべての

側面での核軍縮に導く交渉を誠実に行い、かつ完結

させる義務が存在する。」

1996 年７月８日、世界法廷としても知られる国際司

法裁判所は核兵器の使用または使用の威嚇は一般的

に違法であり、あらゆる国家は核兵器の完全軍縮を

達成する責務を負うと判断を下した。

国際司法裁判所は、その決定にあたり慣習的な国際

法に基礎を置き、特に国際人道法の原則や規則に基

づき、それは普遍的に拘束力を有し、以下の兵器の

使用や戦争手段を行使することを禁じた。

仕掛けられた攻撃に対応するのに必要とされる程

度を極度に超えるもの。

戦闘員に必要のない苦痛をあたえるもの。

非戦闘員を標的にし、非戦闘員に無差別的損傷を

与えるもの。

領土の中立性を蹂躙するもの。

自然環境に長期にわたり広範な損害をもたらすも

の。

国際司法裁判所の判断は、諸宗教共同体、非政府

組織やその他の主体が核兵器廃絶を推進する取り組

みに、法的な重要性を賦与することとなった。特に

核兵器禁止・廃絶のための国際条約である核兵器禁

止条約を実現するために、核兵器保有国を含む国連

加盟国の大多数によって採択された禁止条約のため

の多国間交渉を要請する国連決議を後押しする基盤

を提供した。またこの判断は、核兵器が人道的に悪

であることも広く国際社会に広めることとなった。

The Role of Religious Communities in Multi-stakeholder Partnership for Nuclear Disarmament

“Law after all is based on the moral sense of the commu-nity and the moral sense of the community draws deeply from the reservoirs of morality that are present in religion. All legal systems at their formative stages of development drew heavily upon religious principles, not in the sense of the dogma, or shall we say the ritual, or the high theology of religion, but upon the basic principles of morality which were contained in that body of religious teaching.”

Global, multi-stakeholders’ efforts have achieved in limit-ing nuclear testing and have slowed proliferation, but have not resulted in significant progress towards comprehensive disarmament. Religious leaders and communities have an important role to play in advocating, along with other civil society organizations, to ensure that governments and states prioritize disarmament and non-proliferation initiatives. They are in a unique position to call into question the morali-ty of nuclear weapons and the short sighted security strategies that claim to justify them.

Religions for Peace (RfP),* since its founding in 1970, has vigorously engaged world religious leaders, communities, governments and civil society for the advancement of world security and sustainable human development. RfP is strate-gically positioned to complement ongoing efforts through its global, regional and more than 90 national inter-religious councils, women of faith networks and youth networks.

RfP has taken a two-level approach to accomplish its disarma-ment goals: 1) mobilizing senior religious leaders to advocate at global and national levels for the development, ratification or implementation of key disarmament and non-prolifera-tion treaties, regional agreements and laws and 2) engaging religious communities in target countries and/or regions to conduct awareness-raising, public education, advocacy and campaigning, and other projects that advance human securi-ty in areas affected by weapons.

RfP works to transform violent conflict, advance human development, promote just and harmonious societies, and protect the earth. 核軍縮に向けた多様な関係主体の協働における宗教共同体の役割

「要するに法とは、共同体の道徳意識に基づい

ており、その共同体の道徳　意識は、宗教に存

在する道徳の宝庫のはるか深い源から引き出さ

れる。形成段階の過程にあるすべての法制度は、

宗教的原理から多くを享受している。それは宗教

の教義や儀礼あるいは高邁なる宗教神学を意味

するのでなく、むしろ宗教の教えの本質に含まれ

る道徳の基本原理のことである。」

世界の様々な関係者によるこれまでの努力は、

核実験を制限し、核拡散を抑制するのに多大な

役割を果たしてきた。しかし包括的な軍縮に向け

ては、明白な進展を見るまでには至っていない。

宗教指導者や宗教共同体は、その他の市民社会

と共に、各国政府が軍縮・不拡散を政策の優先

課題にするよう、提言する重要な役割を持ってい

る。その意味で、宗教指導者や宗教共同体は道

義面から、核兵器を正当化する近視眼的な安全

保障戦略に対して、根本的な疑義を呈すことがで

きるという、極めて重要な立場である。

世界宗教者平和会議（RfP）は、*1970 年の創立当

初より、世界の真の安全といのちの尊厳を優先

する持続的な開発を促進するため、世界の諸宗

教指導者や宗教共同体、また政府や市民社会と

共に精力的に取り組んできた。RfP は、これま

での取り組みを世界レベル、地域レベル、そして

90か国以上の国々での諸宗教評議会、女性宗教

者ネットワーク、青年宗教者ネットワークの力を

駆使して、さらに強化できる極めて有利な基盤を

持っている。RfPは、軍縮の目標を達成するため

に、主に次の２点に取り組んできた。

RfP has implemented a range of disarmament and non-pro-liferation advocacy initiatives. It successfully launched the “Arms Down! Campaign for Shared Security” mobilizing youth from around the world to gather 21 million signa-tures in petitions urging governments to abolish nuclear weapons and redirect ten percent of all military expendi-tures to achieve the UN Millennium Development Goals (MDGs). It has held major multi-religious roundtable dis-cussions to identify points of agreement for multi-religious advocacy on nuclear disarmament and non-proliferation and inform the drafting of global multi-religious statements on nuclear weapons that were widely disseminated. It or-ganized multi-sectoral workshops, meetings and events to strengthen partnership and collaboration to advocate for a nuclear-weapons-free world. It coordinated participation of religious communities in the Review Conferences and facilitated them in taking on more active advocacy and en-gagement in the diplomatic proceedings as well as hosting, or co-hosting side meetings during high level meetings.

RfP, Parliamentarians for Nuclear Non-proliferation and Disarmament (PNND) and Mayors for Peace have issued a joint statement on nuclear disarmament on the occasion of 70th anniversary of nuclear bombing of Hiroshima and Nagasaki and jointly presented it to the President of the UN General Assembly in September 2015.

The Special Session of RfP International Standing Commission on Disarmament and Security

RfP International Standing Commission on Disarmament and Security helps guide the RfP International’s Disarma-ment Program which focuses on:

increasing awareness of disarmament issues (particularly from a moral and ethical perspective); The RfP resource guide** on nuclear disarmament has been used at the workshops;

** RfP has developed a multi-religious resource guide to equip religious leaders and communities to promote nuclear disarmament. The guide articulates religious warrants against the use of nuclear weapons. It details out concrete and practical steps that would assist in promoting and protecting the fundamental dignity of all, including related rights and duties, and advances nuclear disarmament. It provides an in-depth analysis of the problem, the urgent need to eliminate all weapons of mass destruction, religious warrants in support of these, role of religious leaders, inclusion of leadership role for women and youth and practical strategies for multi-religious cooperation. This guide has been translated into Arabic, French, Japanese and Spanish.

１．諸宗教共同体の高位宗教指導者に呼びかけ、

全世界的レベルとそれぞれ国内レベルで、重要な軍

縮・不拡散条約や地域的合意、法律の制定、批准、

それらの遵守に取り組むことを促す提言活動の推

進。２．特に重要な国々や地域の諸宗教共同体に

呼びかけ、直面する問題の理解・意識啓発、公教育、

アドボカシー・キャンペーン等や、様々な武器により

多大の損害を被った地域の人間安全保障プロジェク

トの推進。

RfPは、これまで、一連の軍縮・不拡散を提言行動

に取り組んできた。RfPは世界中の青年宗教者に呼

びかけ、「ARMSDOWN!共にすべてのいのちを守る

ためのキャンペーン」を展開し、2,100 万名の署名

を達成する成果を挙げた。このキャンペーンを通し

て、世界の政府に核兵器廃絶を呼びかけ、それぞ

れの国の全軍事費の10％を国連ミレニアム開発目標

に充て、2015 年までに達成することを呼びかけた。

RfP は、核軍縮や不拡散を諸宗教共同体が呼びか

けるにあたって、それぞれの合意可能な共通点を探

るための諸宗教間円卓会議を開催し、世界中で広く

共有された核兵器に関する国際レベルの諸宗教声

明文を公表した。またRfP は核兵器のない世界の

創造を呼びかけ、多分野間のワークショップや各種

会合・イベントを開催し、協力関係の構築に努めて

きた。NPT 再検討会議にあたっては、諸宗教者に

よる積極的な参画を促しながら提言を行い、各国

代表による外交交渉にも関与し、ハイレベル会合期

間中もサイドイベントを主催・共催した。

RfP 国際軍縮・安全保障常設委員会RfP 国際軍縮・安全保障常設委員会は、次のような

取り組みを中心に、軍縮プログラムを展開する。

軍縮問題に関する認識、理解、とりわけ道義、

倫理的側面の理解を促進する。RfP の核軍縮に

関するリソースガイドをあらゆる会合で活用す

る。

可能な限り広範の高位宗教指導者、女性宗教者・

青年宗教者ネットワークを含む諸宗教指導者・宗

教共同体による核軍縮・不拡散を呼びかける提

言活動を調整し実施する。

supporting coordinated advocacy efforts by a wide range of reli-gious leaders and communities (including senior religious leaders, women of faith networks and youth networks) on nuclear disar-mament and non-proliferation; and

engaging and empowering religious leaders and communities to more effectively partner with other civil society, governmental and inter-governmental actors to advance coordinated action.

The United Nations General Assembly voted on 7 December 2015 to set up a working group that will develop “legal measures, legal provisions and norms” for achieving a nuclear-weapon-free world. This new UN body – which has the backing of 138 nations – is wide-ly expected to focus its efforts on devising the elements for a treaty prohibiting nuclear weapons. The working group has met in Geneva, Switzerland, in February and May, and will meet again in August 2016. All UN member states have been invited to participate. In the interests of achieving real progress, the working group will not be bound by strict consensus rules. It will submit a report to the Gen-eral Assembly in October 2016 on its substantive work and agreed recommendations.

In its preambular paragraphs, the Mexican-sponsored resolution that set up the working group acknowledged “the absence of concrete out-comes of multilateral nuclear disarmament negotiations within the UN framework for almost two decades”. It stated that the “current international climate” – of increased tensions among nuclear-armed nations – made the elimination of nuclear weapons “all the more urgent”.

On the occasion of the 20th anniversary of the Advisory Opinion of the ICJ on the legality of nuclear weapons and in advance of the third session of the UN Open-ended Working Group in August 2016, the upcoming Special Session of the RfP International Standing Com-mission on Disarmament and Security will consist of the following key activities:

Public Symposium at the United Nations University commemo-rating the 20th anniversary of ICJ Advisory Opinion (August 3);

Meetings with senior Japanese parliamentarians and government officials, as well as representatives of states including nuclear weapons states (August 3);

Press Conference (August 3); Business Session of the RfP International Standing Commission

(August 2); Optional for Foreign Guests: Joining the Tendai Religious Leaders’

Summit on Mount Hiei, Kyoto (August 4) and Optional for Foreign Guests: Visiting Hiroshima (August 5)

2015 年 12 月７日、国連総会で核兵器のな

い世界を実現するための法的枠組みや法規

範を促進するためのワーキンググループを

設置した。138ヶ国の後押しを受けている

この新しい国連の機関は、幅広く核兵器禁

止条約のための要素を考案することを期待

されている。ワーキンググループは、２月

と５月にスイスのジュネーブで会合を持ち、

この８月にも会合が開催される。すべての

国連加盟国はこの会合に招待される。現実

的に達成されることとして、このワーキング

グループは、厳格なコンセンサスの規則に

よって縛られるものではない。ワーキング

グループの実質的な討議と合意された提言

は、2016 年 10月に開催される国連総会に

そのリポートが提出される。
