The SettlementCommissioner and Director of Land Records,Gandhinagar reservestheir right to
reject the tender or split the job between more than one bidders without assigning any reason thereof.
General Instructions to Bidders:-
1. A prebid meeting will be held on 14/07/2015at: 12.00hrs atSettlement Commissioner and
Director of Land Records office, Sector -14, kh-5 circle GIDC Road, Gandhinagarand suggestions on
the specifications and the terms and conditionsof bid may bediscussed. If it is decided to incorporate any correction or amendment in the terms &condition of the Tenderduring pre-bid
meeting, th e same will be conveyed through webpublishing of cor rigendums in this regard .
Bidders are required t o bid as per finalized Terms &Condit ion of the tender only. Bids will be opened online in the presence of Tenderer, opening Committee Members as well as Bidder's or
their representatives who choose to attend on the specified date and time. The TenderCommittee
has been empowered totake the final decision regarding the tender. Before opening of commercial bid, Bidder will have to make presentation before tender finalization committee.
2. Though the tenders areinvited for preparing Gamthan ( Abadi Area) Survey records, but it is
t o be clearly understood that Settlement Commissioner has the right to award the work to
separate Bidderin any of the divisions providedthat the Highest Scorer No: 2 / Highest Scorer No: 3 and others on techno – commercia l groundwill beready to t ake up the work at the rate &
quality offered by Highest Scorer No: 1 of that D iv ision/ divisions . SCNDLR can assign more
than one division to one Bidder also.
3 At any time prior to the deadline for submission of bids, SCNDLR may, for any reason, whether on
its own initiat ive or in response to a clarificat ion request by a prospective bidder, modify the
bidding documents. All prospective bidders who have received the bidding documents will have
to refer website regularly regarding any updates.
4. SCNDLR reserves the right to accept or reject any proposal, and to annul the proposal process
and reject all proposals at any time prior t o award of contract, without thereby incurring any liability t o the affected bidder(s) or any obligation toinform the affected bidder(s) of the grounds
for such decision.
5 Technical bid is to be submitted in both hard copies as wellas in through E-tenderingsystem,
using specific formats in RFP.
6 Commercial bid is to be opened ONLY through E-tendering system and NO HARDCOPY OF
Commercial bid submitted will be accepted.
7 It is als o t o be noted that bids should be compulsor ily be submitted as mentioned above in hard
copy and soft copies – as per the instruction and the submission shall be as per the dates and time mentioned in the RFP schedule. Even if the hard copy is submitted on time, but the electronic
submission was not done on time, such bids will be treated as late bids and will not be opened.

PRE-QUALIFICATION CRITERIA:-

The Prime Bidder & cons ortium shall be
registered in India under Companies Act 1956 at
least for 3 years as on 31/03/2015.
Certificate of Incorporation of both
prime Bidder & consortium need to
submit in this regard.
B.
The Prime Bidder’s Average Annual Net
Turnover (After deducting Service tax, VAT, etc.) during last 3 years, ending 31.03.15 shall be at
least Rs. 5 Crores each year in India.
Note: The annual turnover is taken for last three financial years ending 31.03.15. i.e. FY 2012– 13,
2013-14 and 2014-15.
Copy of the last three years (i.e. 2012-13, 2013–14and 2014-15)

C.
The Net worth of Prime Bidder during last 3
years, ending 31.03.2015 shall be more than Rs. 5 Crores average in India.
Note: The Net worth is taken for last three financial years ending 31.03.15 i.e. FY 2012– 13,
2013-14 and 2014-15.

The both prime Bidder and consortium should
not be blacklis ted/banned/ disqualified/
declared ineligible/ declared having dissatisfactory performance by any government
/ quasi-government authority in India for supply of materials/ carrying out operations and
maintenance work.
An undertaking by an authorized signatory of the both prime Bidder
& consortium need to be submitted
in this regard.
E.
The Prime Bidder should be registered for Sales Tax / VAT / Service Tax / Excise as applicable.

F.
The Prime Bidder / consortium partner should
have an office in Gujarat and should also have maintenance and service facility in Gujarat. If not
available then should provide undertaking to setup office within 1 month after award of

31.03.2015in terms of works like conducting Property Card or E-Dhara or Land measurement

The Consortium may be allowed. However the
prime bidder has to match all the eligibility
criteria except the experience for which experience of partner in consortium can be
considered for the purpose of meeting the
experience criteria.
a) Consortium agreement among
the members signed by the Authorized Signatories of the
companies dated prior to the
submission of the bid to be
submitted in original. It should be on
a Rs.100/- stamp paper and should be notarized.
b) The agreement shall clearly specify the prime bidder, stake of
each member and outline the roles and responsibilities of each
member.
Note:
1. Provide the copies of work order mentioned against which point it should be considered for
evaluation.
2. Proper indexing should be done with page no’s mentioned.
3. The above mentioned eligibility criteria should be necessarily met, and adequate documentary
proof be submitted for verification.
4. The bidder has to submit commercial for all 5 divisions. However, Sett lement Commissioner
and Director of Land Records ,Gandhinagar may assign one or more divisions only to Highest
Scorer No: 1 on techno – commercial gr ound& remaing divisions w ill be distributed among the other bidders (individual having maxium of 2 divisions) at the rate & quality of Highest Scorer
No: 1 on techno – commercial ground. In exceptional circumstances, Settlement Commissioner
and Director of Land Records,Gandhinagar reserves right to assign one or more divisionsto
Highest Scorer No: 1 on techno – commercial ground, if required.
5. Settlement Commissioner and Director of Land Records,Gandhinagar will have full right for any
reasons; add/ modify/ amend/ relax/ cancel any terms/ conditions/ criteria of the tender
document during any stage of the tendering process and such amendments shall be binding on all the bidders.

SECTION 1: INTRODUCTION
Introduction of project:
Objecti ve:T o cover and create more property recordsof 958VillagesAbadi Area (Gamthan) and
maintenance of created new property records.
Current status in the state:
In Gujarat, about 25 lakhs property cards for Records of rights (Gamthan and city suryedarea) in city as
well as in rural are under maintenance. Department has scanned all the property cards which are under maintenance. About 10 Lakhs property cards are computerized and remaining 15 lakhs property cards
are to be computerized.
State has also made an effort to prepare property cards by adopting outsourcing to cover about 25
Town Planning Areas covering approx. 2,03,650 properties covering Ahmedabad (19TPs), Rajkot
(5TPs), Jamnagar ( 1TP) districts.
In 323 Villages Gamthan property and in 2 Municipal Corporation Ares property measurement,
document collection and other related work is undergone in the financial year 2014-15.
In this process, measurement, Document collection and Record preparation is done by agency and
process of making order of enquiry (it being quasi-judicial process) is done by officer . After
Promulgation of this records will be under maintenance by City Survey Superintendent.
Measurement/ Settlement (Jamabandiand Classification)for NonAgricultureLandandRecords of Rights
of Urban area are maintained and updated by of fice s u n d e r c on tr o l of S e tt le m en t
C om m is s i on e r & D ire ct or of La nd Re cor d s ,Revenue Department of the State Government.
It is necessary to correct &update VillageProperty LandRecords a s well as City Survey Recor ds to
update land records for Development purpose/Construction is permissible /made as per Law.
Government introducesCity Surveyu/s 95,131 of LRC. District Collector/survey officer fixes such limit of
City Survey area u/s 126 of LRC.
City Survey Records is tobe preparedasshown in Parishist-1 of R.F.P. After Survey, under Chapter-10 and enquiry work u/s37/2, 119 of Land Revenue Code.
After Promulgation under Rule 105 of LRR., City Survey records become final record for the purpose of Records of Rights under Chapters-XA of Land Revenue Code.

SECTION 2: INVITATION FOR BIDS & INSTRUCTIONS TO BIDDERS
A. Invitation for bids
This invitation for bids is forpreparing 958 Vi llage Gamthan ( Ab adi Area) Survey records. At the time of submission of the bid document the vendor has to submit the bid amount against a
nonrefundable fee of Rs. 5,000/- to“Settlement Commissioner and Director of Land Rercords”
&refundable EMD as mentioned in Schedule Tender Notice for division w ise of Gujarat in the form of Demand Draft only issued by a Nationalized Bank/Scheduled Bank in favor of “Settlement
Commissioner and Dire ctor of Land Rer cords” payable at Gandhinagar. Failure t o furnish the above mentioned demand draft would result in rejection of the bid.
Reserve Rights of Settlement Commissioner and Director of Land Records Gujarat State, Gandhinagar,
o Settlement Commissioner and Director of Land Records Gujarat State, Gandhinagar, may for any reasons; add/ modify/ amend/ relax/ cancel any terms/ conditions/ criteria of the tender
document during any stage of the tendering process and such amendments shall be binding on all the bidders.
o Settlement Commissioner and Director of Land Records Gujarat State, Gandhinagar, at its own
discretion reserves the r ight to reje ct any Proposal, m odify or scrap the whole tender at any time, without assigning any reason or incurring any liability.
o To assist in the evaluation, comparison and an examination of bids, Settlement Commissioner and Director of Land Records Gujarat State, Gandhinagar, may, at its sole discretion, ask the
Bidder for a clarification of its bid including breakdown of unit rates etc. The request for
clarification and the response shall be in writ ing. If the response to the clarificat ion is not received before the expiration of deadline prescribed in the request, Settlement Commissioner
and Director of Land Records Gujarat State, Gandhinagar, reserves the right to make its own
reasonable assumptions and take appropriate decision. o Settlement Commissioner and Director of Land Records Gujarat State, Gandhinagar, reserves the
right to modify/ change the dates of Bid opening/ submission/ technical presentation at its own discretion and these changes shall be binding on the bidders.
i ) Due Diligence
The Bidder is expected to examine all instructions, forms, terms and specifications in the bidding
document. The bid must be precise, complete and in the prescribed format as per the requirement
of the bid document. Failure to furnish all information required by the bidding document or submission of a bid not responsive to the bidding documents in every respect will be at the Bidder‘s
risk and may result in reje ction of the bidSettlement Commissioner and Director of Land RecordsGujarat State, Gandhinagarshall at its sole discretion be entitled to determine the adequacy/
sufficiency of the information provided by the Bidder.
ii) Cost of Bidding
The Bidder shall bear all costs ass ociated with the preparation and submission of its bid. Settlement Commissioner and Director of Land Records Gujarat State, Gandhinagar, referred to as “SCNDLR”in
the tender document, will in no case be held responsible or liable for these costs, regardless of the conduct or outcome of the bidding process.

B. Preparation of Bids
i ) Language of bid
The bid prepared by the Bidder, as well as all correspondence and documents relating to the bid
exchanged by the Bidder and Settlement Commissioner and Director of Land Records Gujarat State , Gandhinagarshall be written in English language only.
ii) Qualification of the Bidder
• Pre – qualification criteria — bidder has to upload all documents online and submit all
supporting documents in a separate envelop along with Tender fee and EMD clearly describing ―“E-Tender No.: Settlement/1/15-16
• The bidder shall submit an undertaking on their letter head from the Bidder stating the compliance with all the conditions of the Contract and Technical Specifications of the Bidding
Document since no deviation w ill be acceptable toSettlement Commissioner and Director of Land Records Gujarat State, Gandhinagar.
• In case the Bidder fails to submit the entire relevant documentary evidences, his bid is liable for rejection without assigning any reason thereof.
• The Bidder is one who has submitted the bid Response for provide complete services.
C. Evaluation Methodology
Settlement Commissioner and Director of Land Records Gujarat State, Gandhinagar will evaluate and compare the bids determined to be substantially responsive. The intent to select the Tender that is
most advantageous to Settlement Commissioner and Director of Land Records Gujarat State, Gandhinagarand each Tender will be evaluated using the criteria and points outlined below.

The technical score ‘Tb’ will be assigned to the bidder and it will be awarded based on the Technical Evaluation Criteria as specified above. SCNDLR’s decision in this regard shall be final and
binding and no further discussion will be held with the bidders whose bids are technically disqualified / rejected. Bidders with technical score of 60 and above will qualify for the evaluation
in the commercial pr ocess. The total te chnical scores achieved by the bidders shall be shared with
the bidders and.
Tb: Absolute Technical Score

Tn: Normalized technical score of the bidder under Consideration
Normalized technical score (Tn) = Tb/Tmax * 100
ii) Financial Bid evaluation:
The financial bids of only those bidders, who have scored at least 60 marks in the technica l
evaluation process, will be opened. The Financial Bids will be opened, in the presence of Bidders’
representatives who choose to attend the Financial B id opening on date and time t o be communicated to all the technically qualified Bidders. The B idder’s representatives who are
present shall sign a register evidencing their attendance. The name of Bidder and Bid Prices will be announced at the meeting. ‘Fb’ wil l be the tota l financial quote made by the bidder (excluding the
Optional Services quotes sought in the financial bid)
Fn = normalized financial score for the bidder under consideration
Fb = commercial quote for the bidder under consideration
Fmin = commercial quote of the lowest evaluated financial proposal
The lowest evaluated Financial Proposal (Fmin) w ill be given the maximum financial s core (Fn) of
100 points. The financial scores (Fn) of the other Financial Proposals will be ca lculated as per the formula for determining the financial scores given below:

iii) Final Evaluation of Bid

Proposals will be ranked according to their combined technical (Tb) and financial (Fn) scores
using the weights (T = 0.6 the weight given to the Technical Proposal; P = 0.4 the weight given to the Financial Proposal; T + P = 1). The final evaluation will be based on Final Score which shall
be calculated as shown below:
Final Sco re (S) = Tn x T + Fn x P
The bidder achieving the highest combined technical and financial score will be invited for negotiations for awarding the contract. In case of a tie where two or more bidders achieve the
same highest combined technical and financial score, the bidder with the higher normalized
technical score will be invited first for negotiations for awarding the contract.
D. Overview of Bidding Process
All evaluation will be carried out bySC & DLR,Gandhinagar as detailed below.The decis ion of SC&
DLR, G ANDHINAGAR will be final at any stage in this regard.
i ) Preliminary Scrutiny
The technical proposals will be opened on the mentioned date in this Bid Document at Settlement
Commissioner and Direct or of Land Records Gujarat State, Gandhinagar‘s Office. The bidders not
submitting tender fees & EMD shall be straight away rejected for further tender evaluation.
ii) Evaluation of Techni cal bids
The Technical Bid will be examined on the basis of responsiveness to the Evaluation Methodolog y
and the Scope of work and other details as mentioned herein the document. A l ist of bidders based on the compliance to all the terms and conditions of the tender will be prepared. The tenders who
do not conform to the partial / entire pre-qualification criteria mentioned in tender conditions shall
be straight away rejected. All eligible tenders will be considered for further evaluation.
TechnicalPresentations: The eligible bidders may be called for giving the Technical Presentation
to present their proposed approach.
iii) Final Negoti ations & Award of Contract
Commercial bids will be opened for the technically qualified bidders and the bidder who has the highest overall score (Technical + commercial score)may be awarded the contract. However, at the
completion of the selection process, SC & DLR, GANDHINAGAR may enter into negotiations with th e selected Bidder to identify any needed revisions to the proposal, both technical and commercial. SC &
DLR, G ANDHINAGAR, reserves the right to award the contract, based on initial offers received or
otherwise, without discuss ion and without conducting any further negotiations. Further, the selected Bidder may not reassign any award made as the result of this bid, without prior written consent from
SC & DLR, GANDHIN AG AR.
E. Documents Constituting the Bid
The bid prepared by the Bidder shall comprise of the following components. The bids not conforming
to the requirements shall be summarily rejected.
i ) Technical Bid
Technical Bid shall comprise Cover Letter , Technical Proposal , tender fees & EMD and other
required documents such as brochures, product details etc.P lease note that no price s chedule shall

be indicated/ submitted in/ as a part of the Technical Bid and it shall only be quoted in the Financial
Bid. The technical bid shall be submitted online only at https://nprocure.co mand in case of any discrepancy the bid submitted online will be considered final. The hard copy of the bid is for
reference purposes only.
Bidder is requested to note the following:
• Bidders shall include the details of solution archite cture of the integrated solution in the
Technical Bid
• Bidders shall include the COMPLIANCE STATEMENT as a separate section in the Technical Bid
clearly mentioning
• Bidders shall include any additional hardware or s oftware required to make their s olution fully
functional as per requirement.
ii) Financial Bid The bidder shall strictly adhere to the format of the Financial B id as specified in Annexure 9 of the
bid document. The Financial bid shall be submitted online only at https://nprocure. com. Thefinancial bid submitted in any other form and format shall not be considered valid and is liable
for rejection.
iii) Earnest Money Deposit (EMD)
The Earnest Money Deposit for various divisions is as per the quantity of the work allotted to that division. The details of the EMD/DIVISIONS are

Deposit comes into effect. The EMD shall be furnished in Indian Rupees (INR).
• Refund of EMD to Unsuccessful Bidder
Unsuccessful Bidder’s EMD shall be refunded within 60 days after the LOI issued to the successful bidder.
• Refund of EMD to Successful Bidder

The successful Bidder’s EMD will be refunded against the submission of Security Depositupon the
Bidder signing the Contract.
• Forfeiture of EMD

In case the successful Bidder fails
• To sign the Contract within the specified time or
• To furnish security deposit within the specified time
iv ) Tender Fees
The bidders must submit, along with their Bids, non refundable tender feesofRs. 5,000/- (Rupees
Five Thousand o nly), in the form of Demand Draft (DD) issued by a nationalized bank / scheduled bank in favor of “Settlement Commissioner and Director of Land Records” payable at Gandhinagar.
v ) Undertaking
An undertaking from the Bidder stating the compliance with all the conditions of the Contract and
Technical Specifications of the B idding Document will be required since no deviation will be
acceptable to SC & DLR, GAND HINAG AR.
F. Bid Price
i ) Prices in the Price Schedule
The Bidder shall quote price in clear terms. Break up shall abide by the Format for Financial Bid
described in Annexure 9. The rates quoted shall be exclusive of Service Tax only.
ii) Fixed Price
Prices quoted by the Bidder shall be fixed and no variation will be allowed under any circumstances
during the project period. No open-ended bid shall be entertained and the same is liable to be rejected straightway.
iii) Separation of Pri ce Components
The price components furnished by the Bidder shall be solely for the purpose of facilitating the
comparison of bids by Settlement Commissioner and Director of Land Records and shall not in any way limit Settlement Commiss ioner and Director of Land Record‘s right to contract on any of the
terms offered.
G. Period of Validity of Bids
Bids shall remain valid for 9 0 days after the date of bid opening prescribed by the Settlement Commissioner and Director of Land Records Gujarat State, Gandhinagar. The SC & DLR,
GANDHIN AGAR holds the rights t o reject a bid valid for a period shorter than 90 days as non-responsive, without any correspondence.

H. Format and Signing of Bid
i ) Number of copies of bids The Bidder shall submit Technical Bid online only at https://nprocure.co m and shall also submit
the two copies (one original and one duplicate) of technical bidin physical form in sealed cover separately. No financial bid submi ssion in physi cal form. In the event of any discrepancy
between them, the onlinesubmitted bid shall be govern. The physical bid shall be submitted at the
below address:
Settlement Commissioner and Director of Land Records,Sector– 14, kh-5 circle, GIDC Road,
Gandhinagar -382014.
ii) Authentication of Bid
The original and all copies of the Bid Document shall be type written in indelible ink and shall be
signed by a person or persons duly authorized to bind the Bidder to the Contract. A duly stamped
Power-of-Attorney accompanying the Bid Document shall support the letter of authorization. The person or persons signing the Bid Document shall initial all pages of the Bid Document, including
pages where entries or amendments have been made. All the pages of the proposal should be
serially numbered.
iii) Validation of interlineations in Bid
Any interlineations, erasures, alterations , additions or overwrit ing shall be valid only if the person or
persons signing the bid have authenticated the same with signature.
I. Sealing and M arking of Bids
i ) Enclosing of Bid
The hard copy of the all the Technical Bids along w ith brochures/ specifications / other documents
shall be placed in sealed envelopes clearly marking “Technical Bids”. The Bidder shall submit the
Technical Bids , Tender fees and EMD, sealed in separate covers, shall be placed in one big cove r clearly marked as:

All the pages of the technical and bid shall be signed and stamped by the authorized signatory of the
prime bidder, except published materials such as brochures, product catalogues etc.
ii) Responsibility of Bidder
If the outer envelope is not lacquer sealed and marked as required, SC & DLR, GAND HINAG AR will
assume no responsibility for the Bid’s misplacement or premature opening.
iii) Rejection of Bid
Any condition put forth by the bidder non-conforming the bid requirements shall not be entertained
at all and such bid shall be rejected. The Technical B id shall be submitted in the form of printed
document and uploaded online only through https:// npro cure.co mwhile commercial bid must be uploaded online only. Bids submitted by Telex, fax or email will not be entertained. Any bid not
secured in accordance with above mentioned will be rejected straightaway by SC & DLR, GANDHIN AGAR w ithout any further correspondence, as non-responsive. A bid that does not meet
partial / all pre-qualification criteria or is not responsive or not fulfilling technical evaluation w ill b e

rejected by SC & DLR, G ANDHINAGAR, and may not subsequently be made responsive by correction
or withdrawal of the non-conforming deviation or reservation by the Bidder.
J. Modification and Withdrawal of Bids
i ) Written Notice
The Bidder may modify or w ithdraw its bid after the bid‘s submission, provided that SC & DLR,
GANDHIN AGAR receives written notice of the modification or withdrawal, before the expiration of deadline stipulated for submission of bids.
ii) Signing and Marking of Notice
The Bidder‘s modification or withdrawal notice shall be prepared, sealed, marked and dispatched in
accordance with the prov isions of tender. A duly s igned withdrawal not ice may a lso be sent by fax or post so as to reach the designated office before the expiration of deadline for submission of bids.
iii) Last Date for Noti ce
No bid shall be modified subsequent to the deadline for submission of bids. No bid shall be
withdrawn in the interval between the deadline for submission of bids and the expiration of period
of bid validity specified by the Bidder on the bid form. Withdrawal of a bid during this interval shall result in forfeiture of the bid security (EMD) paid by the bidder.
K. Deadline for Sub mission of Bids
i ) Last date for Sub mission
In the event of the specified date for the submission of Bids being declared a holiday for the SC &
DLR, GANDHIN AGAR, the Bids will be received up to the appointed time on the next working day.
ii) Extension for Last date for Sub mission
SCNDRmay, at own discretion; extend this deadline for submission of bids by amending the bid
document, in which case all rights and obligations of the SCNDRand Bidders previously subject to the deadline, shall thereafter be subject to the deadline as extended.
L. Late Bids
Any bid received by SC & DLR, GANDHINAGAR after the deadline for submission of bids stipulated by the SC & DLR, G ANDHIN AGAR, shall be summarily rejected and returned unopened to the Bidder. SC
& DLR, GANDHINAGAR shall not be responsible for any postal delay or non-receipt / non-delivery of
the documents. No correspondence for this shall be entertained.
M. Opening of Bids
i ) Opening of Techni cal and Co mmercial Bids
SC & DLR, G ANDHINAG ARwill open all Technical Bids at SC & DLR, G ANDHINAGAR’s office in the
presence of SC & DLR, G ANDHINAGAR offic ials along w ith bidders’ representatives as per date mentioned in the tender document.
Commercial Bids w ill be opened at SC & DLR, GANDHINAG AR’s office in the presence of SC & DLR, GANDHIN AGAR officials along with technically qualified successful bidders’ representatives as per
date mentioned in the tender document.
ii) Bids Not Considered For Evaluation

Bids that are rejected during the bid opening / Pre – qualification evaluation criter ia / non recipt of
enough technical score (i.e. 60 out of 100) during the technical evalauation shall not be considered for further evaluation, irrespective of the circumstances.
N. Preliminary Examination
i ) Completeness of Bids
All the necessary documents required for the bid submission should be strictly complied. No documents/papers that are found essential as a part of bid submission/evaluation shall be accepted
after the bid submission closing time . If any required document is missing as a part of bid
submission, then that bid may be liable for rejection straightaway.
ii) Rectification of Errors
Arithmetical errors will be rectified on the following basis: -
• If there is a discrepancy between the unit price and the total price that is obtained by multiplying the unit price and quantity, the unit price shall prevail and the total price shall be
corrected.
• If there is a discrepancy between the rates in words and figures, the rate in words will govern. If
the supplier does not accept the correction of errors, his bid will be rejected and his EMD may be forfeited.
O. Project Schedule
The vendor shall complete and implement the project within 12Months (Twelve Months) from the
date of award of contract. The implementation schedule specified in the agreement shall be strictly adhered to. SC& DLR, GANDHINAGAR have final rights to make extension of project schedule. SC&
DLR, GANDHI NAG AR may extend the contract as required with the same terms and conditions along with commercial & the successful bidder is liable to execute the same without any change.
P. Notification of Award
i ) Notification to Bidder
The Bidder whose B id has been accepted shall be notified of the award by the SC & DLR, GANDHIN AGAR, prior to the expiration of the period of validity of the proposal, by registered letter.
This letter (hereinafter the “Letter of Intent”) shall state the sum that SC & DLR, GANDHINAGAR,
shall pay the Bidder in consideration of the execution, completion and maintenance of the wor k a s prescribed by the Contract (hereinafter the “Contract Value”) in accordance with Payment Terms.
The Bidder shall acknowledge in writ ing, the receipt of the Letter of Intent and shall send his acceptance to enter into the Contract within five (15) clear working days from the receipt of the
Letter of Intent.
ii) Signing of agreement
Pursuant to the Bidder acknowledging the Letter of Acceptance, the Bidder and that SC & DLR,
GANDHIN AGAR, shall promptly and in no event later than 7 working days from the date of acknowledgement of the Letter of Intent, sign the Contract. This shall be subject to the furnishing of
the Security Deposit as stated in clause.

ii i) Expenses for the agreement
The incidental expenses of execution of agreement / contract shall be borne by the successful bidder.SC & DLR, GANDHINAG AR shall have the right and authority to negotiate certain terms with
the successful Bidder before signing of the Contract. The signing of the Contract shall amount to
award of the Contract and the Bidder shall initiate the execution of the work as specified in the Contract.
Q. Security Deposi t Within fifteen (15) working days of the receipt of the acknowledgment of the Letter of Acceptance
from SC & DLR, GANDHINAGAR, the successful Bidder shall furnish a Security deposit for an amount equivalent to 5% of the Contract Value in accordance with the conditions of the Contract, in th e
form of a Bank Guarantee or Demand Draft / Bankers’ Cheque issued from a Nationalized bank /
scheduled bank drawn in favor of “SC & DLR, Gandhinagar” payable at Ganhdinagar. The EMD submitted earlier by the successful Bidder shall be refunded against the submission of Security
deposit and such Security deposit shall be retained by the SC & DLR, GANDHINAGAR during contract execution period and may be refunded on successful execution and handing over of the project.
If the bidder fails to deposit this amount of Security Deposit within the stipulated time which shall include any extension granted by the Company at its own discretion, the Earnest Money deposited by
the Bidder shall stand forfeited as and by way of liquidated damages and acceptance of his tender
shall stand withdrawn. The Company shall reserve in such an event, the right to accept any tender which is considered suitable.
The Security Deposit furnished by the bidder shall carry no interest. The validity of the Security
deposit will be of 1 year or till the completion date of the contrat,which may be extendable for further
period.
The Security Deposit shall remain at the entire disposal of the Company as the security for the
satisfactory execution and completion of the work in accordance with the terms and conditions of
the Contract. The Company shall be at liberty to deduct and appropriate from the Security Deposit
such losses, damages, penalties and dues as may be payable by the bidder under the contract and the amount by which the Security Deposit is reduced by such appropriation shall be made good by
further deduction from the bidder‘s subsequent interim bills until the Security Deposit is restored to
its full as limit as mentioned in clause above.
On satisfactory performance and completion of the contract, in all respects , and upon return in good
condition of any property belonging to the Company, which may have been issued to the bidder, the Security Deposit shall be returned to the bidder after completion of 1 (One) years Contract.
R. Annulment of Award
Failure of the successful Bidder to comply with pre-qualification criteria , evaluation criteria and
other terms and conditions set out in the Tender Document shall constitute sufficient ground for the annulment of the award of Contract and forfeiture of the EMD, in which event SC & DLR,
GANDHIN AGAR, may make the award to the next lowest evaluated Bidder after negotiations.
S. Payment Terms, Schedule of Payment:
Payment to the bidder will be released on village wise work completion of below mentione d milestones. The bidder’s request(s) for payment shall be made to the SC & DLR, GAND HINAGARin

T. Additional / change of Work
The bidder is informed that if there is an increase in the work during the course of th e implementation, including additional vil lage abadi sites / Non Agricultural plotted areas, the bidder
will be given the additional work on a pro-rata basis. Similar ly, if due to some reasons there is
reduction in the nos. of properties / abadi sites to be surveyed, there shall be payment as per the
actual work done.
SCNDLR may also allot the wor k of measurement, document collection and preparation of property cards outside the village site area where NA property is mentioned in Non agriculturan Paniya of
Village Form-7 property cards. the bidder will be given the additional work on a pro-rata basis

U. Suspension
SC & DLR, G ANDHIN AGAR, may, by wr itten notice t o the successful bidder, suspend a ll payments if failed to perform any of its obligations under this Contract including carrying out of the services,
provided that such notice of suspension
a. Shall specify the nature of failure.
b. Shall request the Bidder to remedy such failure within a period not exceeding thirty (30) days
after receipt of such notice of failure.
V. Termination of Contract
i ) Termination for Def ault
The SC & DLR, GANDHINAGAR shall, without prejudice, t o any other remedy for breach of contract ,
by written notice of default sent to the qualified Bidder, terminate the contract in whole or in part if:
• The qualified Bidder fails to deliver any or all of the obligations within the t ime period(s)
specified in the contract or any extension thereof granted by the SC & DLR, GANDHINAGAR,
• The qualified Bidder fails to perform any other obligation(s) under the contract. However, the disputes if any shall be referred to Arbitration.
ii) Termination for Insolvency, Dissolution,etc.
• The SC & DLR, G ANDHINAG AR shall at any time terminate the contract by giving writ ten notice
to the qualified Bidder without compensation to the qualified Bidder, if the qualified Bidder becomes bankrupt or otherwise insolvent or in case of dissolution of firm or winding up of
company, provided that such termination shall not prejudice or effect any right of action or
remedy which has accrued thereafter to the SC & DLR, GANDHIN AGAR,
a. Termination for Conveni ence
The SC & DLR, GAND HINAG AR reserves the right to terminate by prior written notice, the whole or part of the contract without compensation to the bidder. The notice of termination shall
specify that termination be for SC & DLR, GANDHINAGAR’s convenience, the extent to which performance of work under the contract is terminated and the date on which such termination
becomes effective.
b. No Claim Certificate
The qualified Bidder shall not be entitled to make any claim, whatsoever, against the SC & DLR,
GANDHIN AGAR under or by virtue of or arising out of this contract nor shall the SC & DLR, GANDHIN AGAR entertain or consider any such claim after Bidder shall have signed ― No Claim
certificate in favor of the SC & DLR, GANDHIN AG AR in such forms as shall be required by the SC & DLR, G ANDHIN AGAR after the works are finally accepted.
W. Rights to Data& Patent Rights
SC & DLR, GANDHIN AG AR shall retain all right, title and interest in and to any and all data, entered or
generated by the Selected Vendor for SC & DLR, GANDHIN AG AR pursuant to this agreement and any modifications thereto or wor ks derived there from.The Service Provider shall indemnify SC & DLR
against all third- party claims of infringement of patent, trademark or industrial design rights arising
from use of the data orany part thereofin India.

X. Relationship between the Parties
Nothing mentioned herein shall be constructed as relationship of client and contractor or of principal
and agent as between SC & DLR, GAND HINAG AR and Bidder. The Bidder subject to this contract has
complete charge of personnel, if any, performing the services under this Project from time to time. The Bidder shall be fully responsible for the services performed by them or on their
behalfhereunder.
Y. Standards of Perfo rmance
The party awarded with the contract shall perform the services and carry out their obligations under the Contract with due diligence, efficiency and economy in accordance with generally accepted
professional standards and practices. The party shall always act in respect of any matter relating t o this contract as faithful advisor to SC & DLR, G ANDHIN AGAR and shall always support and safeguard
the legitimate interests of SC & DLR, GAND HINAG AR, in any dealings with the third party. Th e
awarded party shall abide by all the provisions/Acts/Rules etc. of compliance prevalent in the country. The bidder shall conform to the standards laid down in Bid Document in totality.
Z. Delivery and Documents
The Bidder shall submit all the deliverables on due date as per schedule. In case of termination of the
Contract, the entire document used by Bidder Members in the execution of project shall become property of SC & DLR, GANDHIN AG AR.
AA. Confidentiality
i) The Selected bidder and its personnel shall not, either during the term or after expiration of this contract, disclose any proprietary or confidential information relating to the services, contract or
the SC & DLR, GANDHINAGAR's business or operations without the prior written consent of SC &
DLR, G ANDHIN AGAR. ii) The Service Provider shall not, without the Settlement Commiss ioner andDirect or of Land
Records , Gujarat State, Gandhinagar prior written consent, disclose the Contract, or any
provision thereof, or any specification , plan, drawing, pattern, sample or information
furnished by or on behalf of SC &DLR in connection there with, to any person other than a
person employed by the Service Provider in performance of the Contract. Disclosure to any such employed person shall be made in confidence and shall extend only asfar as may be
necessary for purposes of such performance.
ii i) Any document, Soft data, Software, Applications , other than the Contract itself, shall remain the property of SC &DLR and shall be returned (in all copies) to SC &DLR on completion of the SERVICE Provider’s Performance under the Contract if so required by SC & DLR.
iv) The Service Provider shall permit SC &DLR t o inspect the Service Provider’s accounts and
records relating to the performance of the Service Provider and to have them audited.
v) Any Software provided by Department orData Collected by the Bidderfrom property owners or any documents collected or any information gathered by authorized person of the Biddershall
exclusively the property of the Government through Settlement Commissioner and Director of Land Records. The B iddershall neither use any such software, Data, Docum ent sor information
for its own purpose nor transfer any of this to any other through Bidder.Any misuse may untruly
to criminal proceedings each of this. vi) Service Provider cannot out s ource or sublet for any kind of Activ ity in any manners of this

BB. Legal Jurisdi ction and Arbi tration
All legal disputes between the parties shall be subject to the jurisdict ion of the Gandhinagar. In cas e of any dispute or difference arising out of or in relation to this Agreement, same will be referred to
arbitration of an Arbitrator (other than the employee of the company) to be appointed by SC & DLR,
GANDHIN AGAR in consultation with the company and whose decision shall be final and binding upon the Bidder and the Corporation. Arbitration & Conciliation Act, 1996, will govern the dispute
resolution.
CC. Notice
Any notice , request or consent required or permitted t o be given or made pursuant to this contract shall be in writing.
DD. Miscellaneous
• The end product of the work assignment carried out by the Bidder, in any form, will be the sole
property of SC & DLR, GANDHINAG AR.
• In the event the Bidder Company or the concerned Division of the company is taken over /
bought over by another company, all the obligat ions under the agreement with SC & DLR, GANDHINAGAR, should be passed on the compliance by the new company new division in the
negotiation for their transfer.
EE. Force Majeure
Force Majeure means such of the following factors which substantially affect the performance of the
contract, such as: natural phenomena, including but not limited to floods, draughts, earthquakes and
Epidemics; acts of any Government, domestic or foreign, including but not limited to war, declared or undeclared, quarantines, embargoes; Illegal strikes and legal lockouts in respect of bidder scope of
work provided.
Either party shall within fifteen (15) days from the occurrence of such a cause notify the other in
writing of such causes. The Bidder shall not be liable for delays in performing their obligations
resulting from any Force Majeure cause as referred to and/or defined above. No compensation / rebate shall be entertained to the bidder on behalf of such incidents or damage to the work.
FF. Inspection
The Bidder shall:
• Facilitate the SC & DLR, GANDHINAGAR or its nominated/delegated authority to inspect,
supervise, access all the equipment installed at the premises and other infrastructure arrangements to ensure the effectiveness, after giving prior notice of 7 days in writing or by way
of surprise check if any malfunctioning or deficient operation is reported and the SC & DLR,
GANDHINAGAR or its nominated/delegated authority is of opinion t o conduct such surprise checks to ensure the consis tency of performance or any other aspect of the services covered
under the contract.
• Facilitate and provide all assistance to the inspections by SC & DLR, GANDHINAGAR.

GG. Fraud and Corruption
In pursuit (pursuance) of this policy, SC & DLR, GANDHINAGAR,
o Defines, for the purposes of this provision, the terms set forth as follows:
� Corrupt practice means the offering, giving, receiving or solic iting of anything of
value to influence the action of SC& DLR, GANDHINAGAR official by any personnel in procurement process or in contract execution.
� Fraudulent practice means a misrepresentation of facts, in order to influence a procurement process or the execution of a contract, to the detriment of SC & DLR,
GANDHINAGARand includes collusive practices among the bidders (prior to or
after Proposal submission) designed to establish bids at artificially high or non-competitive levels and to deprive the SC & DLR, GANDHI NAG AR, of the benefits of
free and open competition;
o Unfair trade practices mean supply of services different from what is ordered on.
o Coercive practices means harming or threatening to harm, directly or indirectly, persons or their property to influence their participation in the execution of contract.
• SC & DLR, GANDHI NAGAR will reje ct a proposal for award, if it determines that the bidder
recommended for award has engaged in corrupt, fraudulent, unfair trade practices or coercive
practices.
• SC & DLR, GANDHINAGAR shall declare a firm ineligible, either indefinitely or for a stated period
of time, for awarding the contract, if it at any time determines that the firm has engaged in
corrupt, fraudulent, unfair trade and coercive practices in competing for, or in executing, the
contract.
HH. Negotiation
It is absolutely essential for the bidders to quote the lowest price at the time of making the offer in their
own interest. SC & D LR, G ANDHINAGAR, however, shall have the discretion t o choose to enter into any price negotiations or not.
II. Award of Contract
� SC & DLR, GANDHINAGAR’s right t o accept any Bid and to reject any Bid or all Bids without
assigning any reason. � SC & DLR, GANDHINAGAR reserves the right to annul the bidding process and reject all bids at
any time before the contract award, without thereby incurring any liability to the affected Bidder
or Bidders. � The SCNDLR reserves the right to award more than two divisions to Highest Scorer (technical +
commercial) No: 1 in exceptional cases. � If any Bidder is willing to wor k at marking of Highest S corer (technical + commercial) N o: 1 for
any division, SCNDLR has right to assign the work t o the will ing bidder provided that the bidder
has to supply the quality of materials as defined by Highest Scorer and also to match the commercial of the highest scorer.
� If the difference between Highest Scorer (technical + commercial) No: 1 & No: 2 is marginal / narrow then SCNDLR has right to invite and carry negotiation process with both bidders.
SCNDLR have right to allot / share work among these both bidders.

� Settlement Commissioner and Director of Land Records, Gandhinagar reserves the right to
increase / decrease order ease by up to15% of quantity of work and services originally specified in the schedule of Requirements (rounded off to then exact whole number) without change in
the terms and conditions, at the time of awarding the Contractor after wards.
JJ. Contact Details
i ) No B idder shall contact SC &D LR, Gandhinagar on any matter relating t o it s bid, fr om the time of the bid opening to the time the contract is awarded. If he wishes to bring additional
information to the notice of SC &DLR, Gandhinagar, he should do so in writing. SC
&DLR,Gandhinagar reserves the right as to whether such additional information should be considered or otherwise.
ii) Any effort by a Bidder to influence SC &DLR, Gandhinagar in its decision on bid evaluation, bid comparison or contract award may result in disqualification of the Bidder’s bid and also
for featureof his bid security amount.

KK. Intellectual Property Rights and Rights to Integrated Application System
SC & DLR, GANDHI NAG AR shall retain all rights, tit le and interest in and to any and all software, firmware and hardware designed and developed forSC & DLR, G ANDHINAG AR by the vendor
pursuant to this agreement, and any modifications thereto or wor ks derived there from : Vendor shall have no right, title or interest in or to such designs, programs, modifications for any purpose,
except the right to use, modify, enhance and operate such designs, programs, modifications in order
to perform services hereunder, and as may be expressly set forth herein or in a separate written agreement executed between the parties.
The terms software, software programs and programs shall include specifications, documentation, technical information, and all correct ions, modifications, additions, improvements and
enhancements to any of the foregoing provided to SC & DLR, GANDHINAGAR by the vendor pursuant to this agreement. The terms firmware and hardware shall include the designs, drawings,
specifications , custom designed electronic devices, documentation and technical information, and all
corrections , modificat ions, additions, improvements and enhancements to any of the foregoing provided to SC & DLR, GANDHINAGAR by the vendor pursuant to this agreement.
LL. Modification of Work quantity
If there is an increase/decrease in the number of locations / list of described properties during /
after the course of the implementation, the bidder shallbind to execute the modified & acutal work on a pro-rata basis depending on the quoted rate.

MM. Insurance
i ) General
The Bidder shall at his own expense arrange, secure and maintain with reputable insurance
companies to the satisfaction of the SC & DLR, GANDHINAGAR as follows .
The Bidder at his cost shall arrange, secure and maintain insurance as may be necessary and to it s
full value for all such amounts to protect the works progress from time to time and the interest of the SC & DLR, GANDHINAGAR against all risks as detailed herein. The form and other limit of such
insurance, as defined herein together with the under works thereof in each case shall be as
acceptable to the SC & DLR, GANDHINAGAR. H owever, irrespective of acceptance of the works, the responsibility to maintain adequate insurance coverage at all times during the period of contract
shall be that of the Bidder alone. The Bidder’s failure in this regard shall not relieve of any of his responsibilities and obligations under this contract.
Any loss or damage to the material during movement till such time the work is taken over by the SC & DLR, G ANDHINAGAR shall be to the Bidder.Statutory c learances, if any, in respect of foreign
supply required for the purpose of replacement of material loss in transit and / or during
installation shall be made available to the SC & D LR, GANDHIN AGAR. The Bidder shall, however , responsible for requisite licenses and other clearances relating to such import. The scope of such
insurance shall cover the entire value of supplies of all materials.
All costs on account of insurance liabilities covered under contract shall be Bidder‘s account and
shall be included in the contract price.
ii) Employee state insurance act
The Bidder agrees to and does hereby accept full and exclusive l iability for the compliance w ith all obligations imposed by the employee‘s state insurance act 1948. The Bidder further agrees to
defend, indemnify and hold Owner harmless for any liability or penalty which may be imposed by the central, state or local authority by reason of any asserted violation by the Bidder of the
employees state insurance act 1948, and also from all claims suited or proceeding that may be
brought against the SC & DLR, GANDHINAGAR arising under, growing out of or by reasons of the work provided for by this Bidder or Technology Partner whether brought by employees of the
Bidder or Technology Partner, by third parties or central or state Government authority or any political sub-division thereof.
The Bidder agrees to fill in with the employee state insurance corporation, the declaration forms , and all forms which may require in respect of the Bidder‘s employee, who are employed in the work
provided for or those covered by ESI from time to time under agreement. The Bidder shall deduct
and secure the employees’ contribution as per first schedule of the ESI act.
iii) Any other insurance
The Bidder shall also carry any and all other insurances, which he may be required under any law or
regulation from time to time without any extra cost to the SC & DLR, GAND HINAG AR

Accident or injury to wo rk men
The SC & DLR, GANDHINAGAR shall not be liable for or in respect of any damages or compensation
payable at law in respect or in consequences of any accident or injury to any wor kmen or other
person in the employment of the Bidder.
iv ) Transit insurance
In respect of all items are to be transported by the Bidder to the site of work , the cost of transit
insurance shall be borne by the Bidder and the quoted price shall be inclusive of this cost.
NN. Time period of Contract and ConcernedPenalty
The Bidderis required to complete the work within a period of 12 monthsfrom the date of award of the contract.Thisperiod of 12 months would not includethe timetakenby Enquiry Officer in taking
decision after the collection of documents bythe Bidderand in deciding the objections received , ifany.
The Settlement Commissioner may, extend the time on the representation by the Bidderprovided the reasons advanced forthe same are satisfactory.
If the bidder fails to execute the contract in time SC & DLR, GANDHINAGAR may impose any or all of the following:
a) For any delay in completion of the task beyond the date specified in the contract for PREPARE
GAMTHAN (ABADI AREA) SURVEY RECORD at Various div isions of GujaratRegion forSC & D LR,
GANDHIN AGAR, the SC & DLR, G ANDHIN AG AR shall without prejudice to its other remedies under the contract, deduct by way of penalty from the Contract value, a sum equivalent a maximum of to
2% of contract value (on the basisofestimated no. of properties). Once the maximum (50%) is
reached, the SC & DLR, GANDHINAG AR may consider termination of the contract. Provided that penalty on this ground shall not be more than 50% of the total amount.
Also provided that this penalty may bein addition to the penalty imposed in Clause SS [C - Quality
Standards and Penalty] andrelating to quality of work. But the total penalty on both counts shall not
exceed 75% of the contract amount.
b) Terminate the contract without giving any notice and get the work executed at the cost and
responsibility of the bidder.
c) On the bidder failing to rectify the faults, SC & DLR, GANDHINAGAR may get them
attended/rectified by any other agency at the risk and cost of the bidder and the same shall be recovered from the bidder.
OO. Third Party Inspection
The prime applicant shall facil itate at its own cost , SC & DLR, GANDHINAGAR or its
nominated/delegated authority to inspect, supervise, and accessall the equipment installed at th e premises and other infrastructure arrangements.

QQ. Definitions
In this Contract, the following terms shall be interpreted as indicated:
a) “TheContract” means the agreement entered into between Settlement
Commissioner and Direct or of Land Records, Gandhinagar and the Service Provider Bidder, as recorded in the Contract Form Signed by the parties, including all the
attachments and appendices there to and all documents incorporated by reference
therein;
b) "Bidder" meansany Bidderthat is participating in the tenderprocess.
c) "Service Provider" means any Bidderwho is a successful bidder and to whom thecontract
hasbeen awarded.
d) “The Contract Price” means the price payable to the Service Prov ider under the
Contract for the full and proper performance of its contractual obligations.
(e) “Appointed person “means aperson provided by the Bidderand authorized by the department who knows about Record of Rights and Title of Properties. Such Person may be:
1. Ret iredEmployee/ Officer from Revenue or Land Records Department or retired Talati or a person who has worked for atleast 5 years in Property tax or
townplanning (Building Permission) department of any urban local body or urban/ area development authority, and ifsuch Retired Employees are not available in as
many numbersasrequired to complete the work in prescribed time forthen

(f) Servicesmeans work required by Tendering Authority.
RR. Change Orders
i) Settlement Commiss ioner &Direct or of Land Records may at any time, by wr itten order given to
the Service Provider, make changes within the general scope of the Contract in the Services t o be provided by the Service provider.
ii) If any such change causes an increase or decrease in the cost of, or the time required for , the
Service Provider’s Pe rforman ce of any prov isions under the Contract, an equitableadjustments
shall be made in the Contract Price or delivery schedule, or both, and the Contract shall accordingly be amended. Any claims by the Service Provider for adjustment under this clause
must be asserted within thirty (30) days from the date of the service provider’s receipt of Settlement Commissioner &D irector of Land Record’s modified order.
SS. Quality of Work :
The Biddershall maintain good quality in various process entrusted to them. Bidder will provide
quality check certificate to the departmental officials. After issuing such certificate, if any kind of error found in any records, B idder will have to rectify the error in form at its own cost. Bidder is
bound to maintain quality standards in records and soft data as well.
(a) Criterions: Thequality of work may bejudged based on following criterion.
i ) Service of Notices: All notices should be servedindividually and get signed by holder as proof of
notice acceptance / the property holderswho are outside; notices w ill be served by Registered
Post. Where either holder in person or notice address is not available all such unserved notices should be returned to Enquiry Officer with reasons. List of Unserved notices w ill be published in
Local News Paper also. ii) Preparation of records, GIS based applications, Dataentry and scanning of the record as per
decision of Enquiry Officer will be made in software.
iii) Collection of all documents from the occupant/ holder of the property and/or Society/ Assciat ion for all the latest transactions in curred in respect ofthat property in Abadi Area of Villages uptopresent Occupant.( eg . Property d ocument from owner A and now the owner is C , then the document from A toC is required t obe colle cted
iv ) Quality of stat ionerie s used at the tim e of final submis sion of records in form of regis ters,
maps, n otices shou ld be as per su ch standard that can preserve the record a lteas t for 20-30 years .
(b)Quality Check s:
Based on above criterions–
i ) The Bidderis expected to get the quality of 100% work checked with their own Supervis or first
and furnish a certificate that effect. ii) Settlement Commissioner would get the sample checking done through either his own staff or
an empowered third party.
iii) The sample size for checking may extend upto50% of the record. iv ) The representation andobjection from the property occupants/holderswhichbringoutthe
deficiency in work of document collection, services of notices or data entry may be in addition

to(iii)above.
v ) Material for city map/sheet should be made of thermally bounded HDPE non-woven, high tear strength, water resistant, puncture resistant, anti-static coated, eminently printable, GSM(gram
per square meter) should be >105 and thickness should be <400 micron and should be bright
white in color. vi ) Paper quality of first copy of property cards shall be thickness of 170 GSM . Paperquality of all
regesters should be such that it can be maintained for atleast 30-40 years
(c)Quali ty Standards and Penalty:
The quality standard and corresponding penalty may be as under:-
i ) If 98% or more of records out of sample checked as per (b) (ii) to (b) (v) above is found correct,
no penalty may be imposed. ii) If correct record is between 95% to 98%, a penalty may be up to 10% of the total concerned
village wise payment may be imposed. iii) If the correct record is between 90% to 95%, penalty may beup to 20% of total concerned village
wise payment.
iv ) Below 90%, the work may be rejected and Bidder shall be asked to re do the work with a penalty may be up to 30% total concerned village wise payment.
v ) The imposition of penalty of any amount would not absolve the Bidderof itsresponsibility to correct the mistakes/ errors/ deficiencies in the record of such properties inrespectof which
such deficiencies have occurred and no extra cost/ charge may bedemanded/payable in their
respect. (d)Not withstandingany penalty which is imposed as per Clause (c). TheSettlement Commissioner
mayinvoke all or any ofthe following steps:
i ) Forfeit the performance guarantee amount.
ii) Terminate the contract. iii) If the conduct or quality of work is unsatisfactory.
(e) Bidder will be black listed for next coming project , if Bidder found incompetent to fulfill work with
respect to poor quality of work, insufficient manpower to complete work within time limit or disobey of
the instructions given by SCNDLR during project.

The output of the entire exercise shall be as follows:
� Accurate geo-referenced digital map using established control survey net work around existing GCN of re-survey control points of a particular village.

topographic details shall be generated from the ETS data.
� Data base standards:SQL-92 (Rational Model)/ SQL-1999 (Object Model ) or compatible
latest version to be adopted as a standard for Relational Database Management Systems (RDBMSs)
� UNICODE- character encoding for each and every alphabet of all the languages. The most commonly used encodings are UTF-8 (Unicode Transformation Format) and UTF-16 should
be the character encoding. All deliverables should be in Gujarati language (Shruti Fonts).
� Seamlessly mosaiced village properties (GAMTHAN) map digital database with a provision to
show various layers of various topographical details in customized web based GIS Software developed by department. Interpreted Topographical layers should be cons idered. The
standard list of topo details will be provided to the selected survey agencies.
� Digitized copies of the V illage property (GAMT HAN) maps showing features like City Survey
No, Name, Chalta No., ward no, sheet no etc. Chalta No. can also be marked on the digitized
copies of maps as it will provide linkage/reference to city survey nos.

color coding needs to be done as per following guidelines:

unique number as prescribed.

RFP documents. Hard copy of all the registers, maps, is also required to be submitted after
enquiry and promulgation process. Record w ill be generated on software provided by Department.

SECTION 3: SCOPE OF WORK
A. SCOPE OF WORK
As, village Form-6 and 7 is an important document for Agricultural Land Holder in Gujarat, same way property card is a very important document for property holders in abadi area properties so it is highly
required to prepare a property card for all property holders of the state.
The following are the various components of the work envisaged under the current RFP process. It is
proposed to select a Single Bidder to carry out the end-to-end responsibilities in respect of the carry out survey activities, document collection and preparation of records for GAMTH AN (Abadi area) of
villages.
Due to rapid technological upgradation, there is lot of scope to develop public centric activ ity in la nd /
property related records and record management. Now expert agencies in survey related activ ity f ield become available to enhance our record related activ ity. It is materialized in Resurvey activit y in
Gujarat. So we are hopeful to create, update and maintain the property records of GAMTHAN (Abadi
area) also.
As a project, 958 villages of 32 Districts will be covered to (30 village s/District) carryout measurement
work,collection of documents of measured properties (Open plots, Tenaments, Flats, Financialsh ops , Industrial properties etc) and scanning, data entry work, Preparation of soft & hard copy of record s on
GIS based software.
After mesurment of properties and collection of documents by Bidder, Enquiry process (Hak choksi – It
is quasi-judicial work) will be done by department officers Enquiry will be under taken by departmental officer.
After completion of inquiry process agency will prepare final record on GIS based software.
The activities to be carried out as part of the proposed project shall consist of the following components:
� The activity regarding GAMTH AN survey preparation is to be conducted in the confined GAMTHAN
area confined by LRC 126 decided by SLR/Collector for that village.
� The vendor has to opt ground truthing in which a detailed measurement of each property using
ground survey method. DGPS is only allowed to establish control netw ork of G AMTHAN area and only ETS is allowed for detailed property measurement activity . Co- ordinates will be generated for
each property
� The selected Bidder is allowed to use only purely ground survey method ology for the survey
process, activities would include all the necessary tasks to conduct the survey process and create
spatial data fabric and collate required and relevant textual information to generate the required outputs – using DGPS and ETS equipment. The Bidder shall also assist the SC&DLR during title
enquiry process.
� Integration of textual and graphical records in prescribed format by using GIS based software. � Before starting of actual measurement work bidder will take care of IEC activity for awareness of
property holder, conduct gramsabha activities in the presence of department officials and establish toll free number for registering the grievances.
� Establish Ground Control Points across the Project Site

� Measurement of each property.
� Map the identified boundary vertices � Prepare notices for document collection of measured properties and get it signed by competent
officer.
� Distribution of notices to holders and collection of documents. � After submission of document to the officer (enquiry officer), enquiry process will be conducted by
enquiry officer prepare the finalized property records in standard software prepared by the department.
� GIS based IT related activity also covered by bidder for the preparation of final record in prescribed
formats. � Assistance to enquiry officials at the time of enquiry, correction of records as per the order of
enquiry officer and preparation of final record.
� After promulgation property records will be integrated with respective SRO offices so data should
be in such a form that can be directly integrated with a SRO offices.
� After completion of proje ct B idder has to g ive operational training t o the each district officials and handle the project for the one year under maintenance.
Vendors may submit bid in more than one division but in that case they need to submit EMD for every division as mentioned in rfp. & offer rate for every division separately.
The SC&DLR reserve the rights to allot or not to allot survey work for more than 1 division.
B. Steps involved for Work flow of the project:
1. Government Sanction for Survey and settlement activity in propose village sites under BLRC-
95,131 2. Power Delegation to officer to carryout survey and settlement under BLRC-1879
3. Selection of Bidder to carry out the measurement, document collection and preparation of
records (this work may be done by the agencies which are engaged in resurvey work in Gujarat for pilot project purpose).
4. Development of software which is GIS based. 5. Formation Local Panchayat Committee before carrying out property measurement.
6. IEC activity by Bidder before starting of mesurment of property and collection of documents.
7. Carryout measurement in the presence of property holder 8. Serve notices to give document to the Bidder
9. Collection of document from property holder/panchyat /local bodies 10. Enquiry order by designated officer
11. Deliver final notices to land holder regarding the order of an enquiry officer
12. To keep record open for Promulgation and maintenance of property records.
C. Role of Bidder:
After appropriate selection of Bidder, Main task of the Bidder will be
1. Arrange Gram Sabha in the presence of Government officer and panchayat resolutions. Agency will submit videograph & photograph of Gramsabha
2. Carryout measurement of each property of confined Gamthan area in the presence of
property holder, surveyor and acknowledges the same.

3. To get Signature on Notice of competent officer to collect the document from property
holder /panchayat /government 4. Agency will maintain proper record and documentation of measurement, document
collection and data entrywork,preparation of final records , signatures of property holders
and acknowlwdge slips of notices etc. 5. Agency will take photograph during the measurement in the presence of prpety holder,
government surveyor, agencyteam, neighbours of the property holders if available. 6. Collection of documents from property holder/panchayat/local bodies /Government offices
7. Submit the document to the officer for enquiry process.
8. After Enquiry order, serve the final notice of order of an enquiry officer 9. If Measurement, document collection or data entry activity found incorrect at any level of
project Agencywill correct the releted work without extra charges.
10. Remain present at the time of promulgation if any question regarding measurement dispute,
document verification etc
11. Scanning of collected recoreds and Data Entry of the enquiry properties and generate all deliverables after enquiry process as described in the RFP Document.
12. Submission of records in digital/Hard copy form to the concern officer
13. Preparation of property cards and Maintenance of the records, training to the staff for one year after completion of inquiry and promulgation.
14. GIS files & database should be submitted in .shp, .mxd files & database is in Microsoft SQL 2012 compatible only. It should be integrated with Google map API also.
15. The Detail prepration of records after promulgation may be as per Parishistha 1.
16. Bidder will open a publicity cell before starting its work for Public awareness. Bidder will give press notes, circulate Handbills and will arrange ward/ society meeting w ith help of
government officials before starting measurement, document collection act ivity in the field. Bidder will conduct ward wise meeting before measurement operation in the presence of
Officer.
D. Preparation and measurement activity
(1) Bidder will have to set up minimum 4-5 contr ol point stones before measurement of village properties.Size of the stone is 30cmx30cmx75cm-sand stone/Rock Stones.
(2) Control points should be 15 cm above the ground and) per Village and will take observation by
DGPS (Differential Global Positioning System) for 72 hours. (3) Control Points should be established away from High Tension Electric lines, transformers
Mobile Towers , Jammers, high frequency dish antennas and high rise buildings which interfers with GPS signals, should be strictly avoided. This is required to avoid overlapings –gapings
between village abadi Area and revenue survey number Area.
(4) This control points should be connected with primary/ secondery Control Points of Resurvey Net Work of a particular village.
(5) Bidder will carry outproperty measurement of each and every property by ETS (Electronic Total Station) of an abadi area/ with reference to this control points. To m inimise the error
Bidder will traversing of particular area at the time of measurement.
(6) After measurement of village properties, onthe basis on Col.1to13of Enquiry Register, (Form-1) prepared by Measurement unit, the documents of individual/ Properties (individual land
parcels) will be collected through Bidder.
(7) Bidder will convert the Graphical Data into GIS based on the software prepared by Department / NIC.

E. Filling of Col.1 to 18 of Enquiry Register for Single as well as Mult-
storiedproperties:
(1) Form-(1/A) prepared by Measurement Unit, the document of Multistor iedBuilding's units (Flats, shops etc.) als o will be collected through Bidder. Bidderwill also colle ct the all required
documents of owner.
(2) Multistoried Building means building which issituated havingone or more floors and hasmore than one occupant for each unit.
(3) To collect document, Bidderwill serve n otices in form No. 2/2A. N otice will be served to all holders in person, by registered post to last known address and collect documents as in Form-3.
After collecting documents; bidderwill submit it to Enquiry Officer appointed by Govt.
(4) Enquiry Officer will take decision on the basis of documents which are collected by Bidder.
(5) Agensywill fill Col .5 to16 of Form-1 and 1/A (Enquiry Register). And enquiry officer will make changes if required and After decisionis taken by Enquiry Officer record will be prepared by the
agency
(6) The Bidder will integrate the texual and graphical data in prescribe formats of property cards
and Sanad if required. Scanning of documents, data entry of all registers and final records after discion taken by Enquire officer.
(7) The Final intimation notices are to be prepared by Enquiry Officer through Bidderon computerand issue them to the Property Holders through Bidder.
(8) Bidder will fill column no.1 to 18 after due verification of the document and enter the text of the
decision by way of data entry then the decision will be taken by the competent officer. This data entry of the column No. 13 will also be entered ( column 14 in case of Multi- storied building) in SI (Self
Index) case or the documents re-entered by the applicant. The text so entered by the Agency will be
checked & approved/ disapproved by the Enquiry officer. In case of the disapproval on the basis of the documents not collected by the Agency, the agency will have to submit the documents firstly
as demanded by the Enquiry officer. In case of the non availability of the document after due efforts, the agency has t o submit notice
published in the newspaper / newspapers.
F. Procedure will be as under for collection of documents.
(A) To Collect Documents of Individual Properties.
1.Notice in Form-2 will be printed by the Bidderand signed by concerned Enquiry Officer.These signed notices will served by Bidderto theHolder.
2. Bidderwill send a “Appointed Person” (Clarified as under) to concerned Property H older with Identity Card which is given by Settlement Commissioner or his subordinate officer. Employee of
Bidderwill serve the notice, and explain the details to property holders and communicate
surelythe date and time of collection of the Documents.
3. The “Appointed Person”would visit the Property Holder on such dateand time and collect the
documents. Bidder will have to carry out ward meetings of society, distribution of pamphlets, and
toll free telephone numbers and have to establish a public grievance redressal mechanism before
starting the measurement activity.

(B) To Collect Documents for Multi – StoriedBuilding (Units) as Form -1A
1. Enquiry Officer will issue signed Notices in Form-2A after printing by the Bidderand
Bidderwill serve it to the concerned Property/Flat/Shop Holder.
2. Bidderwill send an“Appointed Person” (defined as under)to the concerned President /Secretary of Association/Society and collect Document Prescribed in Form-2/A.
3. The “AppointedPerson” would also visit the property/ flat/ shop holder.
a) If the property holder is same as in Society’s Ass ociation record, he would colle ct
details about the encumbrance on the property (with documents) and, in case,
property holder discloses no encumbrance, then an affidavit to that effect.
b) If the property holder is different from the owner showingSocieties/ Ass ociat ion
record,then colle ct documents oftransaction establishing his occupancy and also colle ct details of encumbrances as in (a) above.

2. Service Provider’s Integrity
The Service Provider is resp onsible for and obliged conductall contractedactivities
as defined in the scope of work in accordance with the Contract.
3. Service Provider’s Obligations
The Service Provider is obliged to work closely with Settlement Commissioner
and Director of Land Records staff, act within its own authority and abide by
directives issued by Settlement Commissioner and Director of Land Record.
The Service Provider will abide by the job safety measures prevalent in India and
will free Settlement Commissioner and Director of Land Records from all demands
or responsibilities The service provides shall be a responsible solely and
exclusively for all liabilities responsible , demands arises including third party
liabilities, arising out of any accident infringement or mishap during the exaction of
work. The Supplier will pay all indemnities arising from such incidents andwill not
hold Settlement Commissioner and Director of Land Records responsible or
obligated.
The Service Provider is responsible f or managing the activities of its personnel and

will hold it self responsible for any misdemeanor. All data and information collected
during excruciation of contractshall be of ownership of settlement Commissioner and
Director of Land Records.
The Service Provider will treat as confidential all data and information about SC &DLR, obtained in the execution of his responsibilities, in strict confidence and will
not reveal such Information to any other party without the prior written approval of
SC & DLR.
Any Software provided by DepartmentalData Collected By the Bidderfrom property
owners or any documents collected or any inf ormation gathered by authorized
person of the Biddershall exclusively be the property of the Government
through Settlement Commissioner and Director of Land Records. The Biddershall
nighter use any such software, Data, Decorum's or information for its own purpose or
other purpose or transfer any of this to any other through Bidder. Any misuse may
untruly to criminal proceedings each of this.
1. Additional conditions:
1. TheBiddershall maintain the project for one full year and during the said period,
the final processed data supplied by the Bidder, must match with the accuracy
standard fixed in tender document. If at the time of using the data, it is found that
the result varies from the standard, the Biddershall resurvey that particular part of
propertiesor area at their cost and time.
2. TheBiddershall transferall electronic and soft data in the data server of
Department of City Survey Superintendent.
3. The Bidder shall maintain the consistency in accuracy. The Biddershall use same
standard of equipments, computer software and processes for one complete job.
4. The Biddershall train at least 5 personnel at district level employee/officers and
also provide manual for the same.
2. The Biddershall upload all data on the software suggested by department.
6. The Biddershall submit the final record as per Enquiry officer’s order in Enquiry
register and allied formats.
7. The Biddershall download the map as supplied by department, and print it at their
own cost.
8. All digitized data shall be on standard GIS based customized software. If Bidder
uses any other software for integration of texual and graphical data, the data should be compatible with software andin that case the Bidderhas to supply the licensed
version of that software free of cost with user license to the department,if any.
9.The Bidder cannot outsource/ sublet the assigned work in any manner at any
stage of the project .If it found to the SCNDLR will take immediate action for this
activity.
