Sub: Invitation for consultancy service for detailed project report of FLY OVER
BRIDGES in RUDA AREA
Dear Sir,
1.0 Introduction:
Rajkot, an important Urban Centre located in Saurashtra region. It is fast emerging as a
center of trade and commerce, serving the state in general and the region in particular.
The increased intensity of traffic is due to rapid industrial and commercial development
which has resulted in manifestation of problems like traffic congestions, delays,
accidents, pollution etc.
Rajkot city is spread over 104.86 sq.kms and having population of 1.43 million. The
population growth rate is noted as 4% per annum, which is comparatively higher than
Indian city of similar size.
Gondal road and Jamnagar road is one of the national highway and district highway
road, which connects city area and also national highway & state highways traffic
gathered to chowkadi therefore problem of jam of vehicle traffic hence (RUDA) has
decided to construct Fly Over Bridges in lieu of the level crossing.
Therefore, you are invited to submit a technical and financial proposal for
consultancy services required for the assignment named above and referred to in the data
sheet attached.

2.0 Preparation of offers:
2.1 You are requested to submit a technical and a financial offer. Your offer must be
written in English. All pages of your offer must be properly numbered and initialed
by you or your authorized officer.
2.2 Along with the technical bid the Earnest Money Deposit amounting to
Rs.1,50,000/- shall have to be paid either in cash or in form of Demand Draft of any
Schedule Bank except Co-operative Bank. DD shall be in favour of "Rajkot Urban
Development Authority , Rajkot"
3.0 Technical offers :
3.1 You are expected to examine all terms and instructions contained in these
documents. Failure to provide all requested information will be at your risk
and may result in rejection of your offer.
3.2 During the preparation of the technical offer, you must give particular attention to
the following:
i. If you consider that your firm does not have all the expertise for the
assignment, you are requested to not to quote.
ii. Your offers should be based on a number of key professional staff –
months substantially in accordance with the requirement of the
consultancy services required for the project. The consultant may provide
for support staff as deemed necessary.
iii. The majority of the key professional staff proposed must be either
permanent employees of the firm, or should be associated with the firm on
a long-term basis unless otherwise as indicated in the data sheet.
iv. A good working knowledge of Gujarati is essential for key professional
staff of this assignment. Study reports must be in the English language.
3.3 Your technical offer must provide following information using, but not limited to,
the formats attached in appendixes- A to O.
i. A brief description of the consultant’s organization and an outline of
recent experience on assignments of a similar nature. The information you
will provide on each assignment should indicate, inter-alia, the profiles of
the staff provided, duration, contract amount and firm involvements;

ii. Any comments or suggestions on the TOR’s and a description of the
methodology(work plan) which the consultants propose to execute the
services, if require, illustrated figure/graph/drawing
iii. The composition of the proposed staff team and the tasks which would be
assigned to each and their timing;
iv. The consultant’s comments, if any, on the data, services and facilities to
be provided by client and those indicated in the TOR’s.
3.4 The Technical offer must not include any financial information.
3.5 FINANCIAL OFFERS
The Financial Offer should list the costs associated with the assignment. The
consultant shall work out the estimated cost on lump sum basis for Fly Over
Bridges in RUDA AREA along with draft tender documents.
4.0 OFFER EVALUATION
4.1 A two-stage procedure will be adopted in evaluating the offers for minimum
technical qualified consultant as explained below will be evaluated as per
Appendix-F
i. Technical evaluation: which will be carried out prior to opening any
Financial Offer; For minimum qualification, in last five year ending
31.10.2011, Consultant must have completed for Govt./Semi
Govt./Public Sector, as prime consultant up to physical completion of
the project for:-
a. One Major Bridge/ Road over Bridge (ROB)/ Fly Over bridge/
Road under Bridge (RuB) project with each ROB valuing not less than
Rs 20.00 Crores
b. Three Bridges with span not less than 25.0 meter, which should be of
PSC, Steel or Composite Girder.
c. Quality control / construction Supervision / proof checking of main
bridge Road Over Bridges/Flyover/Highway valuing not less than Rs.
20.00 Crores.

ii. Financial evaluation: The price proposal of only responsive offer will be
opened.
5.0 NEGOTIATIONS
5.1 Prior to the expiration period of offer validity, Client will notify the
successful consultant whose offer is lowest.
5.2 Negotiations will be held at the date and address indicated in the Data Sheet. The
invited Consultant will, as a pre-requisite for attendance at the negotiations,
confirm availability of all Professional staff. Failure in satisfying such
requirements may result in the Client proceeding to negotiate with the Consultant
whose Financial Proposal is second lowest. Representatives conducting
negotiations on behalf of the Consultant must have written authority to negotiate
and conclude a Contract.
5.3 Negotiations will include a discussion of the Technical Proposal, the proposed
technical approach and methodology, work plan, and organization and staffing,
and any suggestions made by the Consultant. The Client and the Consultants will
finalize staffing schedule, work schedule, logistics, and reporting. The Client shall
prepare minutes of negotiations which will be signed by the Client and the
Consultant.
5.4 Charges agreed upon will then be reflected in the Financial Offer as final offer.
6.0 AWARD OF CONTRACT
6.1 The contract will be awarded after successful Negotiations with the successful
Consultants.
6.2 The selected Consultant is expected to commence the Assignment on the date and
at the location specified in the Data Sheet.

AGREEMENT
This agreement made the __________________________________________
day of _______________________by and between chief executive officer , Rajkot Urban
Development Authority Rajkot , (hereinafter called “the Client”) of the one part and
___________________________________________________ (hereinafter called “the
Consultant”) of the other part

The Client desires that certain services as shown in the Scope of Services and Terms of reference
at Appendix B & C should be performed by the Consultant and has accepted an offer by the
Consultant for the performance for such services on the terms and conditions set out and defined
in this agreement.
Now this Agreement witnesses as follows :
1. In this Agreement words and expressions shall have the same meanings as are
respectively assigned to them in this agreement hereinafter referred to.

d) Schedule-I Financial Offer
3. In consideration of payment to be made by the Client to the Consultant as hereinafter
mentioned the Consultant hereby agrees with the Client to perform the services in
conformity with the provisions of the Agreement.
4. The Client hereby agrees to pay the Consultant in consideration of the performance of the
services such amounts as may become payable under the provisions of agreement at the
times and in the manner prescribed in the Agreement.

CONDITIONS OF CLIENT /CONSULTANT SERVICES AGREEMENT
GENERAL CONDITIONS
1.0 Definitions and Interpretation
1.1 Definition:
The following words and expressions shall have the meanings assigned to them except
where the context otherwise requires :
“Project” means the project for which the works are to be provided as described in
Appendix-A.
“Services” means the services to be performed by the Consultant in accordance with
the Agreement as specified under the Scope of Services and Detailed Terms of
Reference given at Appendix B & C, and comprise Normal services, Additional
Services and Exceptional Services.
“Client” means the party named in the Agreement, who employs the consultant, and
legal successors to the Client and permitted assignees.
“Consultant” means the party named in the Agreement, who is employed as an
independent firm by the Client to perform the services, and legal successors to the
Consultant and permitted assignees.
“Party” and “Parties” mean the Client and the Consultant and “Third Party” means
any other person or entity as the context requires.
“Agreement” means the conditions comprising the conditions of the
Client/Consultant Services Contract.
“Month” means the period of one month according to the Gregarioan Calendar
commencing with any day of the month.
“Contractor” means any person or persons, firm or company under contract to the
Client to perform work and/or supply goods in connection with project/Consultants
Agreement.

“Day” means the period of twenty-four hours commencing with the midnight of any
one day.
“Fees” means the amount of money to be paid to the Consultant by the Client for
services rendered by the Consultant to the Client.
1.2 Relationship between parties
Nothing contained herein shall be construed as establishing a relation of master and
servants or of agent or principal between the client and the consultants. The consultants,
subject to this agreement, have complete charge of Personnel performing the services and
shall be fully responsible for the services performed by them on their behalf hereunder.
1.3 Interpretations
1.3.1 The headings shall not limit, alter or affect the meaning of the agreement.
1.3.2 The singular includes the plural, the masculine includes the feminine, and vice-
versa, where the context so requires.
1.3.3 If there is conflict between provisions of the Agreement, the last to be written
chronologically shall prevail.
1.4 Consultant’s Personnel
i) General
The Consultants shall employ and provide such qualified and experienced
personnel as are required to carry out the Services.
ii) Description of Personnel
a) The title, agreed job description, minimum qualification in the carrying out of the
Services of each of the Consultants’ Key Personnel is described in Appendix-K.
b) The consultant hereby agrees to engage the personnel and sub consultants listed
by Title as well as by Name in the Appendix-J in order to fulfill the contractual
obligation under the contract.
iii) Changes in personnel
a) Except as otherwise agreed by the client, no changes shall be made in the Key
Personnel. If for any reason beyond the control of the consultants, it becomes
necessary to replace any of the personnel, then the consultants shall forthwith

provide as a replacement a person of equivalent or better qualification and
experience.
b) If the consultant finds (i) that any of the Consultant’s Personnel has committed
serious misconduct or has been charged with having committed a criminal action,
or (ii) has reasonable cause to be dissatisfied with the performance of any of the
personnel, then the consultants shall at the client’s written request specifying the
grounds therefore, forthwith provide as a replacement a person with equivalent
qualifications and experience acceptable to the client.
1.5 Commencement, completion, alteration and termination of the agreement.
1.5.1 Agreement Effective.
The Agreement is effective from the date of receipt by the Consultant of the Client’s
Letter of Acceptance of the Consultant’s offer.
1.5.2 Commencement and Completion
The services shall be commenced and completed at the times or within the periods stated
in Part-II subject top extensions in accordance with the Agreement.
1.5.3. Modification to Agreement
Should circumstances arise which call for modification of the Agreement, these may be
made by mutual consent given in writing. Offer in this respect from one party shall be
given due consideration by the other party.
1.5.4. Delays
If the services are impeded or delayed by the client or his agents so as to increase the
quantum or duration of the services;
i) The consultant shall inform the Client of the circumstances and probable effects
including increase in his fees;
ii) The increase shall be regarded as Additional Services and the fee will be
enhanced at the rate of a maximum of 10%;
iii) The time for completion of the services shall be increased accordingly.

1.5.5 Changed Circumstances
a) If circumstances arise for which the Consultant is not responsible and which make it
impossible for him to perform in whole or in part the services in accordance with the
Agreement he shall promptly notify the Client in writing.
b) In these circumstances, if certain services have to be suspended, the time for their
completion shall be extended until the circumstances no longer apply plus a reasonable
period not exceeding 30 days for resumption of these services.
c) If the speed of performing certain services has to be reduced, the time for their
completion shall be extended as may be made necessary by the circumstances.
1.5.6 Abandonment, Suspension or Termination
a) Failure to become effective:
If this agreement has not become effective within such time period after the date of the
contract signed by the parties as shall be specified in part-II, either party, may by not less
than four (4) weeks notice to the other party, declare this agreement to be null and void,
and in the event of such a declaration by the either party, neither party shall have any
claim against the other party with respect hereto;
b) By notice of the Client:
i) The Client may suspend all or part of the services or terminate the agreement by giving
notice, in writing of at least 60 days to the consultant who shall immediately make
arrangements to stop the services and minimize expenditure.
ii) If the Client considers that the Consultant is without good reason not discharging his
obligations under this agreement, the Client shall give a notice stating the grounds for the
notice. If a satisfactory reply is not received within 30 days the Client can by a further
notice, in writing, terminate the Agreement provided that such further notice is given
within 45 days of the Client’s earlier notice.
c) Force Majeure
Neither the Client nor the Consultant shall be considered in default in performance of the
obligations under this Agreement if such performance is prevented or delayed by events
such as, but not limited to, war, hostilities, revolution, riots, civil commotion, strikes,
lock-outs, conflagrations, epidemics, accident, fire, wind, flood, drought, earthquake or

ordinance of any Government or of any sub-division there of, or because of any act of
God, or for any other cause beyond the reasonable control of the party affected, provided
notice in writing of any such cause with necessary evidence that the obligation under the
agreement is thereby affected or prevented or delayed is given within 10(ten) days from
the happening of the event and in case it is not possible to serve the notice within the said
ten days period, then within the shortest possible period without delays. As soon as the
cause of force majeure has been removed, the party whose ability to perform its
obligation has been affected shall notify the other of such cessation and of the actual
delay incurred in such affected activity adducing necessary evidence in support thereof.
From the date of the occurrence of a case of force majeure, the obligations of the party
affected shall be suspended during the continuance of any inability so caused until the
cause itself and the inability results the respective obligations under the agreement shall
stand extended by a period equal to the period of delay occasioned by such events.
d) Default by the Client
The Consultant may by written notice to the Client terminate this Agreement.
i) If he has not received payment of that of any invoice which is not contested
within sixty(60) days of submission thereof;
ii) If the services have been postponed as provided for in Clause 1.5.6(b) and the
period of postponement has exceeded six(6) months.
e) Entitlement of Consultant upon postponement or Termination
Upon postponement of the Services or termination of this Agreement under clause
1.5.6(b), (c) or (d) and subject to the obligation of the Consultant to reduce expenditure to
a minimum as stated in clause1.5.6(b) the Consultant shall be entitled to receive the
remuneration due up to the effective date of postponement or termination and
reimbursement in full for such of the costs specified in Schedule-I, in proportion and
equivalent to the actual expenditure have been incurred prior to the effective date of such
postponement or termination and for all costs incidental to the orderly termination of the
services, including return travel of the Consultant’s personnel.

f) Claims for Default
Any claim for damages arising out of default and termination shall be agreed by and between the
Client and the Consultant or, failing agreement , shall be referred to arbitration in accordance
with clause 1.5.6(g) of this Agreement.
g) Arbitration
Any dispute or difference arising out of this Agreement which cannot be amicably settled
within thirty days(30) including those considered as such by only one of the parties, shall
be finally settled under the provisions of the Indian Arbitration and Conciliation Act 1996
and the rules made there under, as amended from time to time. The decision of the
Arbitrator shall be final and binding on both parties. The resulting award shall be in lieu
of any other remedy.
1.5.7. Exceptional Services
a) Upon the occurrence of circumstances described in clause 1.5.6 or abandonment
or suspension or resumption of services or upon termination of the Agreement
otherwise than under the provisions of Clause 1.5.6(b) any necessary work or
expense by the Consultant extra to the Normal and Additional Services shall be
regarded as Exceptional Services.
b) The performance of Exceptional Services shall entitle the Consultant to extra time
necessary for their performance and to payment for performing them.
1.5.8 Rights and Liabilities of parties
Termination of the Agreement shall not prejudice or affect the accrued rights or
claims and liabilities of the parties.
1.5.9 Assignment
a) The Consultant shall not, without the written consent of the Client, assign the
benefits, other than the assignment of any monies due, or to become due under
this Agreement.
b) The Consultant shall not without the written consent of the Client, in any way
assign or transfer the obligations of this Agreement or any part thereof.

1.5.10 Cessation of Rights and Obligations
Upon termination of this agreement pursuant to the provisions of this agreement
or upon expiration of the agreement, all rights and obligations of the parties
hereunder shall cease, except
i. Such rights and obligations as may have accrued on the date of termination
or expiration;
ii. The obligation of secrecy of service and confidentiality;
iii. Any right which a party may have under the Applicable Law.
1.6 Fee & Terms of Payment
1.6.1 The Client shall pay the Consultant for the Consultancy Services in accordance with the
conditions and details stated in Schedule-I and in accordance with clause 1.6.3 as agreed
while signing the agreement for the scope of work contained in the Scope of Services and
TOR.
1.6.2 Unless otherwise agreed in writing the client shall pay the Consultant in respect of
additional services not covered in the Scope of Services and TOR.
a) as for additional services for extra time spent by the Consultant’s personnel in the
performance of the services.
b) The net cost of all other expense incurred by the Consultant. The additional payments
shall be decided on a mutually agreed basis.
1.6.3 Payments
a) Contract Amount
An all inclusive cost of the services payable in Local currency is set forth in Schedule-I
b) Currency of payment
All payments shall be made in Indian rupees
c) Mode of Billing and Payments
i. Payments will be made by the client to the consultant as per Appendix - D
ii. The consultant shall submit the invoices in duplicate to the client on firms printed bill
forms indicating the work done by him during the period for which payment is sought

iii. The client shall cause to pay to the Consultants an interest free mobilization payment as
specified in Part-II, and as otherwise set forth below. The mobilization payment will be
due after provision by the Consultants to the client of an unequivocal bank guarantee
given by a Schedule bank except Co-operative bank acceptable to the client in an amount
(or amounts) specified in the part-II such bank guarantee (i) to remain effective for twelve
months after submission, and (ii) to be in the form set forth in Appendix-G hereto or in
such other form as the client shall have approved in writing.
iv. The client shall cause the payment of the consultant periodically as given in the Break up
of Fee Payment Schedule (Appendix – D) within thirty(30) days after the receipt by the
client of invoices with supporting documents. If the progress is not satisfactory and
according to the agreed work program/schedule the payment may be withheld until
such times the consultant rectifies the required shortfall. Interest at the rate specified
in the part-II shall become payable to the Consultant as from the above due date on any
amount due by but not paid on such due date.
v. The final payment under this Clause shall be made only after the final report and a final
statement, identified as such shall have been submitted by the Consultants and approved
as satisfactory by the client. The services shall be deemed completed and finally accepted
by the Client and the final report and final statement shall be deemed approved by the
client satisfactory ninety(90) calendar days after receipt of the final report and final
statement by the client unless the client within such ninety(90) day period, gives written
notice to the Consultants specifying in detail deficiencies in the services, the final report
or final statement.
The consultants shall thereupon promptly make any necessary corrections, and upon
completion of such correction, the foregoing process shall be repeated. Any amount
which the client has paid or caused to be paid in accordance with this clause in
excess of the amounts actually payable in accordance with the provisions of this
contract shall be reimbursed by the Consultants to the client within thirty(30) days
after receipt by the consultants of notice thereof. Any such claim by the client for
reimbursement must be made within twelve(12) calendar months after receipt by the
Client of a final report and a final statement approved by the Client in accordance with
the above.
vi. All payments under this contract shall be made to the accounts of the consultants with the
Consultants Banker specified in part-II.

1.7 General Provisions
1.7.1 Documents prepared by the Consultants to be the property of the Client.
All plans, drawings, specifications, designs, reports, other documents prepared by the
consultants in performing the services for the client under this contract shall become and
remain the property of the Client and the Consultants shall not later than 30 days upon
termination or expiration of this contract, deliver all such documents to the client together
with a detailed inventory thereof. The Consultants may retain a copy of such documents.
1.7.2 Copyright
The client retains copyright of all documents prepared by consultants. The client shall be
entitled to use them or copy them only for the work and the purpose for which they are
intended, and need not obtain the consultant’s permission to copy for such use. The
consultant shall express permission from the client for copying the documents for the
purpose for which they are intended.
1.7.3 Conflict of interest
a) Unless otherwise agreed in writing by the Client, the Consultant and his personnel shall
have no interest in or receive remuneration in connection with the project except as
provided for in the Agreement
b) The Consultant shall not engage in any activity which might conflict with the interests of
the Client under the Agreement.
1.7.4 Notices
Notices under the Agreement shall be in writing and will take effect from receipt at the
address stated in Part-II. Delivery can be by hand or facsimile message against written
confirmation of receipt or by registered letter or by telex subsequently confirmed by
letter.
1.7.5 Publication
Unless otherwise specified the Consultant, either alone or jointly with other, can publish
material relating to the works and services. Publication shall be subject to approval of the
client if it is within two years of completion or termination of the services.
1.7.6 No patented or patent pending articles, methods, or devices shall be used or supplied in
connection with the work or incorporated in the work without the prior written approval

of the client, if the terms of purchase involve or require the payment of any license fee or
royalty in addition to the purchase price, and do not contain patent identification in a form
satisfactory to the client.
1.7.7 Secrecy
The Consultant shall use all the documents, drawings and other data and information of a
proprietary nature received from the client, solely for the purpose of performing and
carrying out the obligations on his part under the agreement and shall not disclose the
same to any other person except to the extent required, in the performance of the work for
the project and shall maintain the utmost secrecy. The consultant shall bind his employees
who are involved in engineering of the project by a suitable secrecy agreement. The
documents, drawings and other data and information received from the client shall not be
used by the consultant for any other purpose.
1.7.8 Applicable Laws
The rights and obligations of the client and the consultant under this agreement will be
governed by the laws of the land.
2.0 Obligations of the Consultant
2.1 Scope of Services
The Consultant shall perform services relating to the project. The scope of the services is
stated in Appendix-B.
2.2 Normal, Additional & Exceptional Services
2.2.1 Normal services are those described as such in Appendix-B and Appendix-C
2.2.2 Additional services are those described as such in Appendix-B & Appendix-C or
which by written agreement of the parties are otherwise additional to normal
services.
2.2.3 Exceptional services are those which are not normal or additional services but
which are necessarily performed by the Consultant consequent to such changed
circumstances for which consultant is not responsible and in accordance with the
agreement or arising out of abandonment or suspension or resumption or services.
2.3 Care and Exercise of Authority
2.3.1 The Consultant shall exercise reasonable skill, care and diligence in the
performance of his obligations under the agreement.

2.3.2 Where the services include the exercise of powers or performance of duties
authorized or required by the terms of the agreement between the client and any
third party, the Consultant shall;
a) act in accordance with the agreement provided that the details of such
powers and duties are acceptable to him where they are not described in
Appendix-B
b) if so authorized, certify, decide or exercise his discretion fairly between
the client and third party not as an arbitrator but as an independent
professional by his skill and judgment.
2.4 Performance Guarantee
2.4.1 The Consultant shall carry out the services in conformity with generally accepted
norms as have been recommended IRC/BIS/MOST and sound standards of
engineering and be responsible for the technical soundness of the services
rendered. In the event of any deficiency in services, the consultant shall
promptly redo such design and engineering, at no additional fees to the
client.
2.4.2 The consultant shall guarantee the performance of the works as per designs and
specifications prepared by him. In the event of the failure to achieve the
guaranteed performance as laid down in the agreement due to reasons directly
attributed to the consultant, he shall be liable for such failure and the liability shall
be limited to a maximum on all accounts up to 10% of the fees received by the
consultant
2.4.2 The consultant shall be responsible for obtaining final approval of Railways /
Authority or Competent authority of Govt of India/ Govt of Gujarat as case
may be.
2.5 Fairness and Good faith
2.5.1 Good Faith
The parties undertake to act in good faith with respect to each other’s rights under
this contract and to adopt all reasonable measures to ensure the realization of the
objectives of this contract.

2.5.2 Operation of the Contract
The parties recognize that it is impractical in this contract to provide for every
contingency which may arise during the life of the contract, and the parties hereby
agree that it is their intention that this contract shall operate fairly as between
them, and without detriment to the interest of either of them, and that, if during
the term of this contract either Party believes that this contract is operating
unfairly, the Parties will use their best efforts to agree on such action as may be
necessary to remove the cause or causes of such unfairness, but no failure to agree
on any action pursuant to this clause shall give rise to dispute subject to
arbitration.
3.0 Prints, Drawings & Specifications
The consultant will furnish free of cost to the client fifteen sets of project reports,
estimates, drawings, design reports, tender documents, specifications, schedules, etc. soft
copy of final drawings in Autocad format in CD or DVD. Additional copies required by
the client will be furnished by the consultant on payment. The consultant shall also
make available two nos. of computer compact discs (CD) and one set of DVD of all
documentation including power point presentation of the project and all drawings in
Autocad format as described in details at Para titled as deliverable.
4.0 Obligation of the client
4.1 Survey and past report / study Data
The client shall provide information regarding existing traffic pattern and
past report like City development Plan, City Mobility plan, BRTS plan etc.,
etc.,.
4.2 The client shall, so as not to delay the services and within a reasonable time, give
to the consultant free of cost all information which is in his power to obtain and
which may pertain to the services.
5.0 Decisions
On all matters properly referred to him in writing by the consultant, the client shall give
his decision in writing within a reasonable time so as not to delay the consultant’s
services.

APPENDIX-A
OBJECTIVES AND DESCRIPTION OF THE PROJECT
1.0 Preamble:
Rajkot, an important Urban Centre located in Saurashtra region. It is fast emerging as a
center of trade and commerce, serving the state in general and the region in particular.
The increased intensity of traffic is due to rapid industrial and commercial development
which has resulted in manifestation of problems like traffic congestions, delays,
accidents, pollution etc.
Rajkot city is spread over 104.86 sq.kms and having population of 1.43 million. The
population growth rate is noted as 4% per annum, which is comparatively higher than
Indian city of similar size.
Gondal road and Jamanagar road is one of the major road, which connects city center
residential area. Traffic vehicle from ahemedabad and morbi passes through theses
chowkadi instead of city area hence every day traffic jam problem created at these
junction places , Therefore, Rajkot Urban Development Authority (RUDA) has decided
to construct Fly Over bridges at these locations.
2.0 Terms of References for the Consultant:
The Terms of References for the consultant can be list in broad way as under:
1) Detailed field survey (Topographic survey) with road junction square or level crossing
junction at proposed site
2) Required Geo technical investigations as per codal provisions (at least at five locations
for ROB/RuB)
3) Preparation of General arrangement drawing for ROB or RuB (as per guideline of
Railway) as well as getting approval of GAD from railway with cost estimates
4) Detail design & drawings of Substructure & superstructure including good for
construction drawings
5) Submission of the final report in five hard copies and one soft copy
6) Preparation of tender document for construction of Proposed ROB/ RuB
7) Support during construction of ROB/RuB

APPENDIX – B SCOPE OF CONSULTANCY SERVICES
Rajkot Urban Development Authority invites proposals for providing consultancy services
for which the scope are as described below:.
Scope of Consultancy Services shall include :
1. Review of all the available reports, drawings, and information, site details
already available and consider the same while planning of the work.
2. Consultant shall discuss and understand from RUDA and Railway Department the
requirement of the project and the data available and if necessary suggest collecting
further data required for the project. The data for survey traffic characteristic will be
made available by RUDA, while soil investigation to be carried out by the consultant.
3. Consultant has to suggest various options for RuB and RoB including suitability for 2-
lanes, 3-lanes, 4 –lanes for the work based on collected data. RUDA may, if desired,
present the feasibility report to lending agencies and Consultant shall make necessary
documentation for the submission and carry out the modification as may be suggested.
4. In order to visualize the project the feasibility report considering the data available with
block estimate shall be prepared and submitted to RUDA for suggestion if any and then
finalizing the proposal incorporating the suggestion. The feasibility report shall be
submitted within one month from the date of issue of work order.
5. Consultant shall submit a detailed value engineering report clearly indicating
various options of proposed RuB/ROB with the recommendation on most
economical, technically feasible and constructible designs of RuB/ROB.
6. Consultant shall submit a detailed design basis report clearly highlighting
the proposed design methodology, codal provisions and loading requirements
etc. for all the components of the proposed RuB/ROB.
7. The GAD for submission to Railway Authority shall be prepared and submitted.
8. Consultant shall get the design and working/detailed drawings proof checked from
any of the Indian Institute of Technology (IITs)/NIT at his own cost. The
consultants shall also modify/revise the designs and drawings on the basis of
changes/modifications suggested by the proof consultant or Employer without any
additional payment.
9. Feasibility checking of General Arrangement Drawing (GAD) for RuB/
ROB and do necessary correction, if required. The traffic bypass
arrangement/diversion to be used during the construction period should be prepared.

The planning as a whole should be functional and aesthetically appealing
and complying with all requirements of Railways, State Govt., Local Authorities,
IRC and MOST.. In case of any modification in GAD consultant shall submit
corrected copy of GAD in hard as well as in soft copy (in CDs)..
10. Consultant shall submit the proposed land acquisition plans and detail Plan for
proposed relocation of Overhead/Underground utilities.
11. Based on the approved GAD, preliminary design, surveys and Geotechnical
investigation, the consultant shall prepare detailed layout plans showing
approach roads, bridge etc., prepare detailed engineering design, design calculations
and drawings including detailed construction working drawings for all items of
works. The drawings shall be prepared on computer in standard CAD formats. The
entire final approved designs and estimates shall be submitted duly signed in
original in 6 copies along with CDs.
12. Consultant shall submit preliminary engineering design and drawings for all
items of works along with Bill of Quantities with calculations for all quantities,
cost estimate, analysis of rates and detailed specifications for all the items
of the work for invitation of tenders for fixing executing agencies. The cost
estimate is to prepare based on latest RUDA’s SOR/ PWD’s SOR or Market Rate as case
may be with updated escalation and as per instruction of Engineer.
13. Consultant shall also submit and assist in getting the approval of detailed estimate
from the client along with Bill of Quantities with Calculations for all the
quantities, analysis of rates and detailed specifications for all the items of the work
14. After the approval of estimate by client, the consultant shall submit detailed
design delivery program with proposed RuB/ROB in consultation with RUDA to
match the construction program at site.
15. Carry out investigations as may be required for the purpose of formulation
of an effective cross Drainage system and design the drainage system for both
surface and subsurface.
16. On approval of the feasibility report selection of the alternative to be adopted. Consultant
shall prepare detailed design for this approved RuB/ROB and submit necessary
documents for tendering purpose.
17. Consultant shall technically scrutinize the various offers thus received from the bidders
and submit the report for the final selection of agency. Based on the above documents,

RUDA shall call for the bids for construction of the ROB/RUB from the qualified and
capable contractors.
18. Once the agency for the construction of the work is finalized, consultant shall release
detailed working drawings 'good for construction' as per mutually agreed work schedule
so as to match the construction programme of the ROB/RUB reviewed from time to time
by the contractor and approved by RUDA. This includes plans with 3D, Auto Cad
Drawings based upon the analysis with the required systems. Extensive three
dimensional inference management, with low and high existing structures is
required to be seen before finalizing any plans.
19. Consultant shall supply free of cost all drawings (Hard copies and softcopy) of
appropriate size in sufficient copies as directed by the Engineer.
20. Consultant shall provide complete design support during construction stage
including temporary works design, road diversions, checking of executing agencies
scaffolding/shuttering arrangements etc.
21. Preparation of detailed Girders launching scheme(in case of RoB) / Box pushing plan
(in case of RuB)along with complete methodology and getting the same approved
from Railway.
22. Consultant shall visit the site during the contract period, without any extra cost,
as directed by the Engineer in case of any problem relating to
design/drawings. There will be no limit on number of necessary site visits of
the consultant and decision of the Engineer shall be final.
23. Proper quality control of the work on regular basis. The consultant shall ensure
that the work is executed conforming to the approved design, drawings
and specifications. The period for execution of each bridge has been proposed as 24
months including monsoon. The consultant shall prepare and submit a detailed
Quality Assurance Plan before execution of work. The Engineers to be deployed by
the Consultant shall work under the direction of the Engineer-in-charge. They
shall be bound to carry out all duties related with the work assigned by the Engineer-in-
charge or his representative.
24. To work as representative of RUDA at various levels for seeking appraisal and approvals
from GOG / GOI & from nodal agency and as per the process prescribed under JNNURM
guidelines

DETAILED TERMS OF REFERENCE
1.0 Terms Of Reference:
The scope of the work shall consist of carrying out the following activities in
connection with the Railway Under Bridge/ railway Over Bridges (ROBs) proposed to be
constructed at Raiya road, Rajkot. The scope described hereunder Appendix B is only indicative
in nature and shall not be limited to the same
2.0 Study:
This shall consist of preparation of a detailed Project Report containing:
a) Technical Feasibility; various option and alternatives
b) Preliminary Designs and Cost estimation;
c) Financial projections for Project Finance, phasing of costs and Financing
Plan for Financial Feasibility;
d) Operational costs projection and analysis;
3.0 Detailed Project Report:
This consists of services to establish design parameters/equipment/machineries as
per IRC/MOST/BIS norms include the following:
3.1 Analysis of several alternatives.
The alternatives should be complete in all respects including owning and
operating costs and financial implications. Such analysis shall also include
various structures with its advantages, disadvantages and suitability for
the project, and consultant’s recommendations for selection of suitable
structure. This category includes the preparation of conceptual and
preliminary design and drawings including the following:
a) Designing and documenting the works based on the guidelines contained
in IRC/BIS/MOST for specifications, and normal design engineering
practices;
b) Recommending the most suitable alternatives like RuB / RoB with option
of 2-lanes, 3-lane, 4-lanes with or without cycle track/ pedestrian facilities

suggesting its merits/demerits to facilitate RUDA official to take
appropriate decision
c) Preparation of preliminary drawings for each and final design.
d) Preparation of conceptual drawings based on preliminary designs;
3.2 Design Norms:
1. The design shall be carried out in terms of specifications of latest
editions(and up-to-date correction/amendment/errata) of IRS (Indian
Railways Standards), IRC (Indian Road Congress) and ISI (Indian
Standard Institution) now BIS (Bureau of Indian Standards),
international codes wherever applicable and as desired by the
Client/Employer.
2. Vertical Clearance for further electrification (if not existing) shall be
provided corresponding to ONE requirements or any future track re-
profiling in vertical frame, as desired by Railway.
3. The girder may be of Precast pre-stressed concrete (Post tensioned),
steel or composite or R.C.C/PSC Beams/Slabs etc. depending upon the
field conditions and economy. End launching/crane erection of Girders
from the approach road may be preferred.
4. The approaches of the bridges may be Reinforced earth work or earth
slopes or viaduct depending upon the site conditions and requirements of the
Client. The decision of the Engineer-in-charge shall be final in this
regard. The consultant shall provide alternatives with cost benefit
analysis and full justification for the proposed alternatives.
3.3 Detailed Project Report: a) Project report, preliminary plans and estimates and project implementation schedules
b) The consultants shall carry out the conceptual and detailed engineering design,
prepare engineering drawings and cost estimates for all project components.
c) The consultants shall submit the following as the outcome of their services:
1. Conceptual Project Report
2. Draft Project Report
3. Final Detailed Project Report (DPR).
4. Draft tender document.

and appropriate technology options.

AutoCAD 12 & later version. In each of the above case the consultant shall make
available computer compact disk in two copies. All drawing must be provided in
Auto CAD format and all reports/details in MS Office format.

THE EVALUATION PROCEDURE
Proposal fulfilling the MINIMUM REQUIREMENT OF PERSONNEL
NUMBERS,QUALIFICATION AND EXPERIENCE IN RESPECTIVE CATEGORIES WITH
THE FIRM as per Appendix requirements of T.O.R. only shall be evaluated on the basis of
responsiveness to the Terms of Reference, applying the evaluation criteria, sub criteria and point
system specified in the Data Sheet. A proposal shall be rejected at this stage if it does not respond
to requirement of T.O.R. and also it shall be declared fail, if does not achieve the Minimum
Technical Score indicated in the Data Sheet.
The Consultant shall submit supporting authenticated / certified documents to his Technical
proposal in physical form in the same format as submitted on website within 7 days after opening
of Technical Bid. The Client will verify submitted supporting documents on the basis of their
responsiveness to the Terms of Reference. If there is any anomaly between physical submitted
supporting documents and technical proposal forms submitted on website, at this stage the Client
shall reject the Consultant’s Proposal.
1.1 The Technical Evaluation procedures shall consist of a marking system.
1.2 Evaluation of Technical Competence:
