    OpeninguplegalservicesThegovernmentsproposaltoopenupthelegalservicessectortoforeignparticipationinalimitedwaymaymarktheendofIndiaspolicyofbarringinternationallawfirmsfromenteringthecountryandofkeepingdomesticfirmsandlawyersinsulatedfromthegrowingglobalmarketfortradeinlegalservices.ThegovernmentsaysithasboththeBarCouncilofIndiaandtheSocietyofIndianLawFirms(SILF)onboard.Theproposedentryofforeignfirmswillbelimitedtoaspectsotherthanlitigationandtointernationalcommercialarbitration.Thepresenceofoverseaslawyersinforumsoflitigationisofcourseruledout.Itisunlikelythatforeignfirmswillbeinterestedinlitigationwork,whichisbyandlargeorganisedandregulatedonnationallines.Further,unlessthereisreciprocitywithregardtorecognitionoflegalqualificationsamongmembercountries,itwillnotbepossibleforvisitinglegalprofessionalstoovercomebasiceligibilitynorms.EversincetheGeneralAgreementonTradeinServiceswasadoptedbymembercountriesoftheWorldTradeOrganisation(WTO),thepotentialforlegalprofessionalstoofferservicesoutsidetheirnationaljurisdictionhasexpandedexponentially.Apartfromdraftingofagreementsandcontractsandrenderinggeneraladvicetooverseasclientsondomesticlegalregimesandframeworks,advocatesandlawfirmsnowplayabigroleinstartingnewbusinesses,mergersandacquisitions,advisingoninvestments,complyingwithregulationsandobtainingclearances.

    Atthesametime,therehasbeendisquietinthelegalfraternityaboutthepossibleadverseimplicationsoftheentryofforeignfirmswhich,presumably,arebetterorganisedandhavebetterresourcestocornerthelegalservicesmarket.Somewenttocourtandobtainedfavourableordersbarringtheentryofoverseasplayers.ThecourtshavesofarsaidforeignfirmscannotpractiseinIndiawithoutadheringtotheAdvocatesAct.However,theMadrasHighCourthasallowedoverseasprofessionalstoflyintoofferadvicetoclientsoninternationallegalissues,andparticipateininternationalcommercialarbitration.ThematterisnowintheSupremeCourt,butifthegovernmentcancarrythelegalfraternityalongonitsproposals,Indiawillbeinapositiontobenefitfromopeningupthesector.However,allstakeholdersmustseetoitthatitdoesnothaveanadverseimpacteitheronthecostoflitigationoronthelivelihoodofhundredsofthousandsofpeopleenrolledasadvocatesinthecountry.AkeyconsiderationwouldbewhetherIndiaoughtnottotryandgetashareintheestimated$20billionglobalannualtradeinlegalservices.Thecountrynowhasbetterlawschoolsandavastpooloflegaltalentthereisnoreasonwhyitshouldnotsucceed.
