1. Type of commercial undertaking of port authority1.1 Pirita port authority is Aktsiaselts /public limited company/ Tallinna Olümpiapurjespordikeskus

which acts on the basis of articles of association and was registered in the Tallinn Commercial Register under registry code 10257237 on 29 August 1997.

2. Port location, territory and marina2.1 Pirita Port is located in the estuary of Pirita River, at the following geographical coordinates

(according to WGS-84): latitude=59°28.1’N, longitude=24°49.3’E.2.2 Postal address is Purje tn 13, 11911 Tallinn.2.3 The size of the port territory is 29,276 m2 and the size of the marina is 120231,72 m2.

3.2 The Harbour Master (Harbour Duty Officer) shall permit the mooring of craft depending on the dimensions thereof. The clearance under keel must be 10% of the draught of a recreational craft.

3.3 The water level bar is located in the port, on the corner between berths D-8 and D-9. To obtain the current water level, + 306 must be added to the indication of the bar and 500 must be deducted from the sum. The all-time maximum water level in Pirita Port has been +135 cm and the minimum -85 cm.

3.4 The maximum dimensions of craft allowed to enter, manoeuvre in and moor in the port are as follows: L = 24 m T = 2.8 m

3.5 Craft exceeding the maximum allowed dimensions are served (entry into, manoeuvring, mooring and leaving the port) in each specific case upon the application of the captain of the craft and based on a written permit of the Harbour Master up to the limits that ensure navigational safety according to weather and manoeuvring conditions.

3.6 The height of a berth from the water surface is 1 metre; in the case of a floating berth it is 0.6 metres.

3.7 The marina of the port is protected by moles: a 530 m long S-mole to the west and south-west and a 510 m long N-mole to the north and north-east. The port is comprised of the berths of the inner port on the left of the river and of the berths located in the marina of the exterior port surrounded by moles. The estuary area of the river is divided into two parts by a 150 m long inland mole running in a NW-SE direction. The port entrance has a width of 50 m and a water depth of 3.5–4.5 m.

4. Limitations due to weather conditions4.1 Entry to and leaving the port is not allowed at wind speeds above 15 m/s and visibility below 50

m. If necessary, a decision is taken by the Harbour Master in cooperation with the captain of a craft, considering the technical specifications of the craft.

4.2 The port is open to winds from the south-west, west and north-west.4.3 The limitations of lifting equipment (mobile cranes upon order) are given in their technical

documentation.

5. Limitations due to environment protection requirements, dangerous cargo etc.5.1 The port does not perform loading, unloading or handling of dangerous substances.5.2 Refuelling in the port takes place only in the filling station of the port by berths K-27 and K-28.

As an exception, refuelling may take place by berth H-19 if the length and draught of craft does not allow mooring next to the quays of the filling station. To this end, a permit must be obtained from the Harbour Master.

6. List of port services- rental of mooring places;- shower, sauna and toilets;- water supply and electricity;- reception of sorted common waste, batteries, bilge water and waste oils;- emptying toilet tanks and chemical toilets;- organising lifting work for launches and yachts (upon order);- winter storage of floating vessels;- paid parking for cars; and- port services from other undertakings: see clause 10.

7. Working hours of port7.1 The Harbour Duty Officer shall work and serve craft around the clock, seven days a week.7.2 The Harbour Master shall have a working week from Monday to Friday, from 08:00 to 16:30,

with a lunch break from 12:00 to 13:00, except national and public holidays according to the procedure established by the Parliament of Estonia.

7.3 Information about all matters pertaining to the work organisation of Pirita Port can be obtained by calling +372 639 8800.

8. Establishing beginning and end of navigation season in port8.1 The navigation season shall begin on 1 April and end on 30 November. Depending on ice and

weather conditions these dates may change.

9. Local time difference9.1 During summer: daylight saving time +3 hours (from the last Sunday in March). After the

transfer to winter: +2 hours (from the last Sunday in October).

II Entry of craft to port1. Notice of intent of entry1.1 When entering Pirita Port, recreational craft and ships must adhere to Government of the

Republic Regulation no. 194 of 19 May 2004 Procedure for Ships and Recreational Craft Entering and Leaving Inland Maritime Waters, Ports and Estonia-owned Waters of Transboundary Water Bodies and Regulation no 50. of the Minister of Economic Affairs and Communications of 19 December 2002 Requirements for Using Recreational Craft.

1.2 Pirita Port performs border guard and customs formalities only for recreational craft. When entering Pirita Port from a foreign country, the captain of a recreational craft shall immediately formalise the entry at the border checkpoint of Pirita Port (recreational craft less than 15 m by berth G-17 and over 15 m by berth H-18). Nobody is entitled to board or disembark recreational craft, deliver cargo or items before the performance of border inspection and customs formalities.

1.3 When arriving from inland maritime waters of Estonia, all craft that have made a contract with Pirita Port shall moor at the mooring place specified in the contract and formalise the arrival in the log of entries and departures. Craft that have not made a contract with Pirita Port to rent a berth shall agree on their mooring place with the Harbour Duty Officer. The mooring places for non-contractual craft are located in the guests’ basin – berths G-15, G-17, H-18, H-19 and H-20. After having agreed on the mooring place, the captain of the craft shall formalise the arrival in the guests’ log of entries and departures.

1.4 The Harbour Master (Harbour Duty Officer) shall notify the border guard authorities about a recreational craft or ship which has arrived at Pirita Port from a foreign country and which has not been subject to border inspection and shall ensure that the members of the crew and passengers do not leave and that nobody boards the recreational craft or ship from the shore and that no goods or items are taken from the recreational craft or ship to the shore or from the shore to the recreational craft or ship until the arrival of the border guard unit.

3. Information required to apply for permit of entry3.1 Craft whose draught is more than 2.8 m must agree on entry into Pirita Port with the Harbour Master in advance. Information presented to this end includes the length, beam and draught of the craft, need for help in mooring and information about border guard and customs formalities.

4. Pilotage upon entry4.1 If necessary, a pilot can be ordered from the Tallinn pilotage area via fax +372 605 3881,

information by telephone +372 605 3888 or +372 52 68 432.

5. Procedure for issue of permit of entry5.1 A permit of entry to the port shall be granted by the Harbour Master (Harbour Duty Officer),

agreeing thereon with relevant authorities, if necessary.

6. Arrangement of entrance formalities pursuant to quarantine, customs and border guard regime. Required documents

6.1 The captain of a recreational craft is obliged to submit the list of persons aboard the vessel to the border guard authorities immediately upon its arrival from a foreign country.

6.2 If there are any goods to be declared on a recreational craft, the captain of the recreational craft shall present to the customs authority official performing customs supervision over the port the documents meant for the performance of customs formalities of recreational craft.

6.3 If there are no goods to be declared on a recreational craft, a declaration of a recreational craft shall be presented to the supervisory official.

III Traffic of craft in marina of port

1. Traffic of craft in marina of port1.1 “International Regulations for Preventing Collisions at Sea” shall apply to traffic of recreational

craft or other water craft in the marina of Pirita Port.1.2 In the case of simultaneous entry and exit of craft to and from the port, the departing craft shall

have priority, except in case of emergency.1.3 As regards the traffic of passenger craft in the marina of Pirita Port, during the departure and

arrival of such craft the captains of other vessels shall be obliged not to hinder the traffic thereof (i.e. to give way).

1.4 When moving and manoeuvring in the marina of the port, the captain of the craft must choose a speed which avoids any stern wave, but not above three knots, and which allows safe traffic or manoeuvring in terms of both the craft of the captain and other craft.

1.5 Craft may be translocated only with the permission of the Harbour Master or the Harbour Duty Officer.

2. Requirements for traffic of craft in normal and special conditions2.1 Entry to and leaving the port is not allowed at wind speeds above 14 m/s and visibility below 50

m. If necessary, a decision is taken by the Harbour Master in cooperation with the captain of the craft, considering the technical specifications of the craft.

3. Mooring3.1 Craft that have signed a contract with Pirita Port shall moor in the place specified in the contract.

In special conditions (in the case of strong winds) a craft may moor at a berth providing better protection, if this has been agreed with the Harbour Master in advance.

3.2 Craft that have not signed a contract with Pirita Port shall moor at the guest mooring places assigned by the Harbour Master (Harbour Duty Officer).

3.3 Mooring ends and buoy ends must be fastened and fenders must be placed in a way which ensures the safety of the craft and the adjacent vessels in all weather.

3.4 Upon the order of the Harbour Master (Harbour Duty Officer), the user of a vessel shall add fenders and berthing ropes respectively in order to ensure the safe standing of vessels in the port.

4. Towing4.1 Pirita Port does not have a tug. Towing may be performed in the port only with the permission of

the Harbour Master.

5. Traffic in the case of ice conditions and ordering an icebreaker5.1 Pirita Port is not covered by the national icebreaker service; in case of icing, the port is closed to

navigation.

6. Special requirements depending on class of craft or nature of cargo6.1 Special requirements for craft are set by the port administration as and when necessary.

IV Craft standing in port

1. Requirements for moored craft1.1 Craft may stand in Pirita Port only after entry into a rental contract for use of the port (where the

place of the berth and the port charges have been specified) and advance payment of the rent bill. Craft that have not entered into a rental contract for use of Pirita Port shall be treated and charged as guest craft (according to the price list of the port). Berths G-15, G-17, H-18, H-19, H-20 shall be used for the mooring of guest craft. A contract for use of Pirita Port shall be made with the port by the owner of the craft or a person authorised by them.

1.2 The orders of the Harbour Master regarding the standing or translocating of craft in the port shall be binding on the owners and users thereof.

1.3 The mooring ends of craft must be fastened in a way which ensures the safety of the craft and their neighbouring craft in the port in all weather.

1.4 In stormy weather (wind strength of more than 14 m/s) the owners of craft shall themselves be liable for the safe standing of their craft in the port. If the owner of a craft is not in Tallinn, they shall be obliged to give the port the contact telephone number for the person responsible for the craft.

1.5 All craft standing in the port must have a proper marking (name or number on the craft).1.6 The captain must ensure the safe entrance and exit of people to and from the craft and the

protection of the property thereon. The port shall not accept any liability for the property of the owner of the craft or for the vessel.

1.7 Mooring at refuelling berths K-27 and K-28 may take place only for fuel and freshwater loading, disposal of waste or pumping out toilet tanks and bilge water. In refuelling, the captain of the craft shall ensure safe refuelling in order to avoid any pollution.

1.8 Use of shore electricity must be agreed on with the Harbour Master. The owners of the craft must switch off shore electricity at wind speeds above 14 m/s.

1.9 Floating and shoring of craft must be agreed on with the Harbour Master in advance. The owner of the craft or their representative shall be responsible for ensuring safety.

1.10 For wintering craft in the territory of Pirita Port, the owner thereof must enter into a relevant contract with the Harbour Master. Craft wintering in the territory of Pirita Port must be hoisted onto a keel block or a trailer ensuring the safe standing of the craft.

1.11 All keel blocks and trailers of a craft must bear the name or number of the craft. Keel blocks and trailers must be cleaned and painted. The tyres of trailers must be full. Keel blocks without markings which are left in the port shall be considered to have no owner and shall be removed.

1.12 In the summer period from 1 May to 31 October the storage of keel blocks and boat trailers in the territory of the port is a fee-charging service.

1.13 The following is forbidden in the port:- using the toilet rooms of craft which have no containers for collecting faecal water;- storing canisters, oil and fuel drums on a berth;- throwing garbage into the water or onto the berth;- putting waste anywhere other than the designated container;- boarding craft without the permission of the captain of the craft or the person representing them;- keeping unvaccinated animals on board;- playing loud music on craft or disturbing the peace in the port in other ways from 22:00 to

09:00; and- swimming in the port marina.

2. Interior work and deck work on moored craft2.1 The owner of a craft must agree with the Harbour Master (Harbour Duty Officer) on all work

entailing high levels of noise and waste. When cleaning the underwater part of the craft of old paint and applying new paint in spring, the owner of the craft must ensure the cleanliness of the port territory. The area under the craft must be covered with plastic sheeting.

2.2 Welding work and other work involving an open flame on craft and in the port territory are only permitted with the consent of the Harbour Master (Harbour Duty Officer). After such permission has been obtained, the Harbour Master (Harbour Duty Officer) must be notified of the commencement and completion of such work.

2.3 The Harbour Master (Harbour Duty Officer) must be notified of overboard work and measures must be taken to ensure the preservation of the cleanliness of the water in the port marina.

V Craft leaving port

1. Notice of intent of departure1.1 In departing for internal waters of Estonia:1.1.1 Before departing from the port the captain of a recreational craft or ship shall formalise the

departure in the log of entries and departures with the Harbour Duty Officer.1.2 In departing for foreign waters:1.2.1 Pirita Port performs border guard and customs formalities only for recreational craft. The

captain of a recreational craft shall notify the border guard authorities of their departure from the port at least 1 hour before departing from the port, and after the payment of port charges formalise the departure from the port in the log of entries and departures with the Harbour Duty Officer.

2. Communication upon craft leaving port2.1 Contact number of port: +372 639 8980

3. Information required to apply for departure permit3.1 The following information shall be presented to the port:

- name or number of craft;- time of departure;- destination;- name of captain; and- number of passengers.

4. Pilotage upon craft leaving port4.1 If necessary, a pilot can be ordered from the Tallinn pilotage area via fax +372 605 3881,

information by telephone +372 605 3888 or +372 52 68 432.

5. Procedure for issue of departure permit5.1 Craft that wish to leave the port may depart after formalising their departure with the Harbour

Duty Officer.5.2 In departing for foreign waters, after the formalisation of the aforementioned the captain of a

recreational craft must go to berths G-17 or H-18 to complete border guard and customs formalities.

5.3 In order to depart for foreign waters, the following documents must be presented:- crew list and list of passengers – to the border guard authorities and the customs authority

performing customs supervision over the port; and- declaration of the property of the crew – to the customs authority performing customs

supervision over the port.5.4 The Harbour Master or the Harbour Duty Officer may prohibit the departure of a craft if an order has been received to this end from national organisations or if port charges have not been paid. State supervisory authorities may prohibit the departure of a ship or recreational craft from the port if:

- the documents of the craft are not in order or the craft is not seaworthy;- the crew has not been formed as required; or- there are any factors posing a hazard to safe navigation, human health or the environment.

5.5 After completing the border and customs inspection, recreational craft must leave the port immediately.

5.6 Craft over 24 metres must report their departure from the port to Tallinn VTS via radio on VHF channel 13, call sign “Tallinn VTS”.

VI Port services and charges

1. Port services are specified in clause 6 of the general part of these rules.2. The price list of Pirita Port is available from the Harbour Master and via the website

www.piritatop.ee.

VII Rules of passenger service in port

1. No passenger services are provided in Pirita Port owned by AS Tallinna Olümpiapurjespordikeskus.

VIII Medical aid in port

1. There is no medical aid station at the port; first aid can be administered in the office of the Harbour Duty Officer. 2. The telephone number for calling an ambulance is 112.

IX Fire safety requirements at port and organisation of rescue operations

1. Fire safety requirements on vessels standing in port1.1 The rescue and fire-fighting equipment of the craft standing in the port must be in working order

and conform to the established requirements.1.2 All work entailing a fire risk on craft must be agreed on with the Harbour Master (Harbour Duty

Officer) in writing.1.3 Extinguishing a fire on a craft is led by the captain of such a craft or the person representing the

captain.

2. Fire safety requirements in territory, buildings and facilities of port2.1 The rules for ensuring fire safety in the territory, buildings and facilities of the port are stipulated

in the general fire safety instructions of the port available from the Harbour Master (Harbour Duty Officer).

2.2 Work involving an open flame may only be performed in the port territory with the written permission of the Harbour Master (Harbour Duty Officer).

2.3 It is forbidden to obstruct access routes leading to craft standing in the port, to fire-fighting equipment or to supplies.

2.4 Smoking is only allowed in the prescribed places.

3. Location of rescue and fire-fighting equipment3.1 Rescue posts (a lifebuoy with a throwing line etc.) are located on the berths of the port in visible

places.3.2 Primary fire-extinguishing appliances are to be found in the office of the Harbour Duty Officer

and at the border guard. 1.2 There is a fire hydrant, which is appropriately marked, in the port.

4. Action plan for emergency situations4.1 Any and all emergency situations occurring at the port (including oil spills) must be immediately

made known to the Rescue Board (by calling 112), to the Harbour Master (Harbour Duty Officer) and to other authorities depending on the situation. Action must be taken according to the relevant action plans, which can be reviewed in the office of the Harbour Master or the Harbour Duty Officer.

4.2 If a person falls into the water in the port marina, the first person noticing this must:- throw a lifebuoy into the water near the person, leaving the other end of the line on the shore or on board the craft;- sound the alarm “man overboard” and call for help (if necessary, by calling 112)- maintain eye contact with the person in the water and lead them to the lifebuoy;- help them out of the water; and- administer first aid to them.

4.3 In the case of a fire at the port or on board a craft standing in the port, all other craft must make ready their fire-fighting and rescue equipment, including the main engine, to provide assistance in extinguishing the fire, and must be ready to evacuate, if necessary.

XI Liability for violation of port rules

1. All persons present in Pirita Port must follow the orders of the administration of AS Tallinna Olümpiapurjespordikeskus and the Harbour Master (Harbour Duty Officer).

2. The Harbour Master shall have the right to require that the captains of craft present in the port follow the port’s rules and technical safety requirements.

3. The captains of craft, organisations and individuals who have caused property damage to the port via wrongful behaviour must compensate damage pursuant to the law of the Republic of Estonia.

4. The remedies prescribed in law shall be applied to the owners of craft who do not pay port charges on time or who refuse to pay port charges; the services of Pirita Port may be denied to such persons in the future.

5. The captains of craft, organisations and individuals who have caused water pollution in the port marina involving crude oil, oil, faecal matter or in any other way via wrongful behaviour shall bear liability pursuant to the law of the Republic of Estonia.

The persons at fault shall also compensate the port for damage incurred in relation to eliminating the pollution.
