UNIVERSITY POLICY
It is important to recognize the key difference between inventor/ authorship and ownership. UiTM owns the IP rights to inventions made by employees as part of their employment duties (unless it states specifically otherwise in their employment contract). However, as a legally recognised inventor/author you will benefit financially from any revenues generated from your invention.
IP is property, just like: land building shares car You can: own it sell it lease (license) it give it away in a will And it has value-just like any other property….
PATENT
A patent is an exclusive right granted for an invention (product or a process)
that provides a new way of doing something or offers a new technical solution to a
problem.
What is Patent?
• Essentially patent is a document issued by the relevant government authority, conferring a monopoly on the creator of a novel invention
• In exchange for the State conferred monopoly, the inventor reveals the secret of his invention.
• The monopoly, which is for specified number of years, gives the owner of the patent the exclusive right to exploit the invention
What is an “Invention” and “Patentable Invention”? – Patents Act 1983
• S. 12 (1) – An invention means an idea of an inventor which permits in practice the solution to a specific problem in the field of technology.
• S12 (2) – An invention may be or may relate
to a product or process.
Product or process
• Section 3 - Product – means any thing which appears
in tangible form and includes any apparatus, article, device, equipment, handicraft, implement, machine, substance and composition
- Process – includes art, new use or method

1) New (novelty)
• Section 14 (1) - An invention is new if it is not
anticipated by prior art. - What is prior art?
Section 14 (2) Prior art shall consist of— (a) everything disclosed to the public, anywhere in the world, by written publication, by oral disclosure, by use or in any other way, prior to the priority date of the patent application claiming the invention; (b) the contents of a domestic patent application having an earlier priority date than the patent application referred to in paragraph (a) to the extent that such contents are included in the patent granted on the basis of the said domestic patent application.
• A disclosure made under Section 14 paragraph (2)(a) shall be disregarded if such disclosure occurred within one year preceding the date of the patent application and if such disclosure was by reason or in consequence of acts committed by the applicant or his predecessor in title.
• In other words, within 12 months of the disclosure, the product or process must be filed in MYIPO in order to preserve the novelty.
INVENTIVE STEP
• SECTION 15 (PA 1983) • 15. An invention shall be considered as involving an inventive step if,
having regard to any matter which forms part of the prior art under paragraph 14(2)(a), such inventive step would not have been obvious to a person having ordinary skill in the art.
• Example of inventive steps: formulation of a way to solve a particular new problem or unrecognized problem, or the way of solving a known/long-standing problem, or leaving out one step of the existing practice.
INVENTIVE STEP
• An obvious invention is not inventive. • Especially to a normally skilled person in the art. • PHOSITA : person having the skill in the art.
INDUSTRIAL APPLICATION : S16
• An invention shall be considered industrially applicable if it can be made or used in any kind of industry. (PA 1983)
• Industrial property shall be understood in the broadest sense and shall apply not only to industry and commerce proper, but likewise to agricultural and extractive industries and to all manufactured or natural products, for example, wines, grain, tobacco leaf, fruit, cattle, minerals, mineral waters, beer, flowers, and flour. (Article 1(3) Paris Convention)
Discoveries of materials or substances already existing in nature;
Scientific theories or mathematical methods;
Plants and animals other than microorganisms, and essentially biological processes for the production of plants and animals, other than non-biological and microbiological processes;(man made)
Schemes, rules or methods, such as those for doing business, performing purely mental acts or playing games;
Methods of treatment for humans or animals, or diagnostic methods practiced on humans or animals (but not products for use in such methods).

Morality and Public Order Grounds
• Section 31. (1) The grant of a patent shall not be refused and a patent shall not be invalidated on the ground that the performance of any act in respect of the claimed invention is prohibited by any law or regulation, except where the performance of that act would be contrary to public order or morality.

• Invention made by an employee, but: • Invention not made in the course of employment, or • Invention does not relates to the field of activities of his
employer and was not made using data or means placed at his disposal by his employer, or
• Invention relate to the field of activities of employer but was not using data or means placed at his disposal by his employer.
• Invention belongs to employee.

HOW LONG DOES A PATENT LAST ?
The UI System
• Section 17 • “Utility Innovation” means any innovation
which creates a new product or process, or any new improvement of a known product or process, which is capable of industrial application, and includes an invention.

• UI can be protected in Malaysia provided it is new
• There is no requirement for an inventive step.

PATENT SPECIFICATION 1.0 Purpose • This guideline is to help researcher prepare the specification
document 2.0 Guideline On Writing Product Specification Field of Invention • The field of invention is a general broad statement describing the
art or technology to which the invention relates. Abstract • The abstract is a short summary of the invention and how it can
be used. The abstract should consist the following: Description of the invention and what it is used for. Description of the main components and how they work. Fairly short, not more than 150 words
2.3 Description of Invention • The description starts off with general background information
and progresses to more detailed information about the invention (could be product or process and its parts).
• The description must be written as complete and thorough as
any new information to the patent / industrial design application cannot be added once it is filed. Changes can only be made to the subject matter that could be reasonably be inferred from the original drawings or description.
2.4 Claims • Each claim should be a single sentence, and where a claim
sets forth a number of elements or steps, each element or step of the claims should be separated by a line indentation
• The claims must particularly point out and distinctly claims the subject matter which is regarded as the invention. The claims define the scope of the protection of the patent and it is the main highlight of the product specification.
2.5 Drawing(s) and Description of Drawing(s) • The drawings of a patent/industrial design application
describe the Invention visually, using a chemical or mechanical structure, charts and graphs, and detailed relationships of features.
• The drawings contain references (numeric and alphabetic) that relate the feature described in the specification to a corresponding feature or portion shown in the drawing/image
PRIOR ART SEARCH 1.0 What is Prior Art?
Prior art refers to scientific and technical information that exists before the effective date of a given patent application.
Prior art may include:
• Previous patents • Trade journal articles • Publications (including data books and catalogs) • Public discussions (conference and seminar) • Trade shows • Brochures • Products, devices & equipment
Why search for Prior Art?
Prior art search will help you to: • Understand your competition • Avoid patent infringement • Write your patent application • Learn more about your field of invention • Save the cost of patenting process
Note: • The results of a good patent search should reveal any
identical, similar, or partially similar inventions to the one you wish to patent.

4.0 How to Search for Prior Art? An on-line prior art search can be done by a keyword search. Keyword search
• List the keywords that you would use to describe the invention
• Think of all possible aspects of the invention and choose keyword that describe each aspect
