Responding to Benavides et al. vs. La Joya ISD, the district released this statement along with several redacted personnel files to bolster their claims that it terminated each plaintiff for valid reasons or they resigned/declined reinstatement. The one-year contract also includes a provision that administration can reassign employees, while the last document supposedly shows poor performance of one unnamed plaintiff.

The La Ioya Independent School District vigorously denies the allegations made by

Plaintiffs in the latest lawsuit brought by the Law Officesof Ramon Garcia. Aswith the

previous lawsuits filed against the District by Ramon Garcia, it appears that this matter is

politically motivated and not necessarily based on actual facts. Mr. Garcia's previous

history offrivolous claims against the District iswell documented. Included in Mr. Garcia's

lawsuit are plaintiffs that were discharged by the Districtfor clear cases ofmisconduct.

One Plaintiff is a former male bus driver who was involved in an inappropriate relationship

with a young female student and with a history of violence in his private affairs. Another

Plaintiff was discharged due to incurring over 50 absences in one school year and after

repeated warnings that this conduct was unacceptable. One Plaintiff, also a bus driver was

discharged over 3 years ago for unprofessional conduct, specifically for use ofvulgar

language over the District's radio system. Two employees received poor evaluations fromtheir immediate supervisor and were terminated in the best interest of the District. One

Plaintiff voluntarily resigned in order to accept a position as an administrator at a public

charter school. Two Plaintiffs were involved in the District's plan to open an independent

radio station which due to various reasons never materialized. One refused an offer oftransfer at the same pay and chose to resign, the other was laid off because funds were

never budgeted and the position eliminated since the station was unable to open.

Another group of Plaintiffs were merely transferred or reassigned with no loss of payor

seniority. The reasons for this varied and include reassignment to campuses with growing

student populations. One Plaintiff was reassigned because ofpoor performance by hisstudents. The District's Administration is annually challenged with allocating the District's

personnel in a manner that will best suit the needs of the students and ensure the efficient

delivery of instruction. Many other employees were transferred or reassigned at the start

of this school year.

The District acknowledges that a group of employees were laid off in May of this year.

However, the District acted quickly to resolve the issue and by August 3, 2011 the Board

approved the rehiring of every employee in this group. However, keep in . mind, the

employees were on summer vacation and did not suffer any loss of wages. It appears that at

the instructions of Ramon Garcia, all of these employees refused the offers of reinstatement

and ignored the invitation of returning to gainful employment.

The mission goal of the LJISDis to provide a quality education to its students as efficiently

as possible, in the best interests of the community and its taxpayers. Lawsuits with ulterior

motives such as the one filed by Ramon Garcia not only create financial problems for the

District but detract from the focus of its mission goal at the expense of the students. Despitethe frivolous distractions, the District remains focused on its students and advancing its

TEARecognized status.
