Vereinbarung zur Weitergabe von lebendem Pflanzenmaterial durch den Botanischen Garten der Universität Düsseldorf (1)
Seit Inkrafttreten des Übereinkommens über die Biologische Vielfalt (CBD, Rio de Janeiro, 1992 ) ergibt sich für Botanische Gärten und vergleichbare Einrichtungen, besonders im Zusammenhang mit dem Austausch von pflanzlichem Material, die Notwendigkeit zur Beachtung insbesondere des Artikels 15 der CBD (Zugang zu genetischen Ressourcen).
Der Garten ist bestrebt, die Erhaltung, Nachhaltigkeit der Nutzung und Erforschung der Biologischen Vielfalt zu fördern. Er erwartet deshalb von seinen Partnern bei der Aufnahme, Bewahrung und Weitergabe von pflanzlichem Material, das sie stets im Geiste der CBD und des Übereinkommens über den internationalen Handel mit gefährdeten Arten (CITES) sowie unter Beachtung aller relevanten Konventionen und Gesetze zum Schutz der Biologischen Vielfalt handeln.
Vor diesem Hintergrund wird nur solchen Personen und Institutionen Pflanzenmaterial aus der Sammlung des Gartens ausgehändigt, die nachstehende Bedingungen anerkennen:
1. Das ausgehändigte Material steht auf Grundlage dieser Vereinbarung für das Gemeinwohl, insbesondere für wissenschaftliche Untersuchungen, Bildungszwecke sowie Belange des Naturschutzes, zur Verfügung.
2. Mit der Übernahme des Pflanzenmaterials verpflichtet sich der Empfänger, die mit dem Material verbundene Information angemessen zu dokumentieren und zu bewahren.
3. Für den Fall, dass mit dem bereitgestellten Material wissenschaftliche Publikationen erarbeitet werden, erwartet der Garten, dass auf die Herkunft des Materials hingewiesen und ihm diese Schriften unaufgefordert zugesandt werden.
4. Kommerzielle Nutzungsinteressen des Empfängers sind in dieser Vereinbarung nicht erfasst. Eine Nutzung zu kommerziellen Zwecken ist Gegenstand einer separaten Vereinbarung mit dem Ursprungsland. Sie unterliegt den Bestimmungen der CBD, das heißt, der Nutzer ist zu einer Vorteilsbeteiligung des Ursprungslandes verpflichtet und hat der mit der Umsetzung der CBD beauftragten Stelle relevante Informationen mitzuteilen.
5. Der Garten wird relevante Informationen über die Weitergabe des Materials der mit der Umsetzung der CBD beauftragten Stelle auf Anfrage mitteilen (2).
6. Die Weitergabe des Pflanzenmaterials ist nur auf Grundlage und unter Verwendung dieser oder entsprechender Vereinbarungen möglich.
Mit der Samenbestellung werden die obengenannten Vereinbarungen akzeptiert. (1) Im Folgenden bezeichnet als „Garten“ (2) Im Idealfall der National Focal Point im Heimatland des Gartens

Agreement on the supply of plant material by the Botanic Garden of Düsseldorf University (1)
Since the Convention on Biological Diversity (CBD, Rio de Janeiro, 1992) came into force, it has become necessary for Botanic Gardens to comply in particular with Article 15 of this convention (access to genetic resources), especially in connection with the exchange of plant material. Accordingly, the garden only passes on plant material to others under the condition that the recipient acts in the spirit of CBD.
The garden is dedicated to conservation, sustainable use and research of biological diversity. With regard to the acquisition, maintenance and supply of plant material, the garden therefore expects its partners to act in a manner that is consistent to the letter and the spirit of CBD, the Convention on International Trade in Endangered Species (CITES) and in compliance with any other relevant conventions and laws relating to the protection of biological diversity.
Consequently, only those persons and institutions will recieve plant material from the garden`s collection who accept the following conditions:
1. On the basis of this agreement, the material is intended to serve the common good, particularly scientific study, education and the interests of environmental protection.
2. Upon accepting plant material from the garden, the recipient is oblidged to document and preserve information relating to the material appropriately.
3. If scientific publications result from studies on the plant material provided, the origin of the material is to be cited. In addition, these publications are expected to be sent the garden automatically without any further request.
4. Intended commercial use by the recipient is not covered by this agreement. Any commercialisation is the object of a separate agreement with the country of origin. This agreement underlies the provisions of CBD, i.e. the user is oblidged to share benefits with the country of origin and to forward relevant information to the authority instructed with the implementation of CBD.
5. The garden will on request forward information on the material supply to the authority instructed with the implementation of CBD (2).
6. Plant material may only be supplied to others on the basis and under the conditions of this or a corresponding agreement.
