The Health Council for GCC is pleased to announce

the above mentioned tender and hereby invites you

to bid for this tender according to the following

terms and conditions:

Vendors represented by local agents who are dealing, directly or indirectly in tobacco trade, will not be allowed to participate in the SGH tenders.

I: Bids Preparation and Submission وتقديم العرض أوال: إعداد

1- In case of discrepancy, the conditions written in Arabic

shall prevail.

2- Only the registered companies and their registered

branches shall be allowed to participate in the Tender.

3- Original and alternative bids along with the Cover

Letter shall be placed by the manufacturer inside the

Tender's envelope as communicated to bidders by the

Health Council. Such documents must be serialized

according to the numbers of the tender items

4- Bids shall be made on the original letterhead paper extracted from the CD, along with original copy of the

Cover Letter. Bids and Cover Letter shall bear the bidder's official seal, and must be signed in either blue or red ink, but not black. A true copy of the bids (in electronic form) shall be provided on a CD. Bids which do not comply with these requirements will be overlooked, knowing that bids submitted on paper are the primary. In case of discrepancy, or if prices are different

between the paper bid and that on the CD, then the

Committee shall be entitled to exclude the bid

altogether.

5- Bidders shall write the following details on the cover of

the CD:

A) Company's name/ registration no.

B) Company's nationality

C) Tender name and type

D) The group participating in the tender.

6- A bid shall remain valid for 356 days from the date of

opening the envelopes.

7- No bids will be received after 03:00 of the Bids Receipt

Day.

8- A receipt original proving the purchase of a copy of the

tender's documents shall be attached to the bids

submitted by the bidder.

A) Before sending notice of the award, the Health

Council (based on request from any Member State

and Participating Party), may request increase or

decrease of any item with whatever percentage

without need to show reasons, and a bidder shall

abide by its bid based on this basis.

B) After notifying of the award, the Member States

and Participating Parties shall ensure that the

decrease is maximum of 50% of the awarded item

for each member state and participating party,

and each state and participating party may request

the addition of new quantities (at any percentage)

during the bid's validity period, and a bidder shall

abide by its bid on this basis.

C) The prices quoted by bidder shall remain

applicable for one calendar year from the date of

award notice. (however, for tenders on orthopedic

and spine surgery supplies, rehabilitation supplies,

linens & medical uniforms, otorhinolaryngology,

head and neck surgery supplies and

ophthalmology supplies, quoted prices shall

remain applicable for two calendar years from the

date of award notice.

D) In case the quantities were altered either by

increase or decrease after the award notice,

Ministries of Health in the GCC and the

participating parties shall update such quantities

on the Gulf Joint Procurement Program or send an

email in this regard to the Health Council.

10- The Committee shall have the right to exclude bidder

whose CD does not include a copy of its bid.

11- If there is any difference between the Technical

Specifications and the unit or package size, a bidder

shall indicate in its bid that this is an "alternative" bid,

provided that the following must be observed:

A. A red ink statement must be written on the original

bid indicating that it is associated with an

alternative bid;

B. The alternative bid must be sealed and signed by

the company and made on a copy of the original

bid papers; this must be indicated by bidder in the

(Comments Field) in the CD.

C. A bidder may submit two alternative bids at

maximum.

D. The Committee is entitled to accept or reject such

alternative bid.

12- The Company's registration number with the Health

Council must be indicated on each of the bid's papers.

13- As for the medical supplies companies, they must be

registered with the SFDA, and a proof on such

registration must be submitted upon purchasing the

tender documents.

14- As for the veterinary medicines and vaccines

companies, they must be registered with the SFDA,

and a proof on this registration must be provided

upon purchasing the tender documents. If the

company is not registered with the SFDA, a proof on

registration of the company with one of the Reference

Countries approved by the SFDA must be submitted.

15- Upon submission of bids, bidders shall indicate on the

Cover Letter and in the "Comment" field all

particulars related to its bid for sources not registered

with the Health Council. Such indication must be

made clearly in red ink for all Joint Procurement

Tenders .

16- Bidders shall document the notes relative to their bids

submitted in the tenders in Arabic and English

languages under the "Comment" filed (if needed).

17- :

A) As for pharmaceuticals: the bid paper shall indicate

all information related to an item, including:

1. Pharmaceutical form

2. Substance strength and concentration

3. Package size

4. Country of origin

5. Shelf life

6. The price registered with the SFDA as well as

the Gulf-level price (if any) must be included in

USD against the unit of each item mentioned in

the tender.

7. The Unified Customs Code

B) As for the medical materials, a bid paper shall

indicate all information relative to the concerned

item, including:

1- Country of origin

2- Shelf life

3- Size/measurements

4- Package size

5- Catalogue number

6- Substance strength and concentration

7- Sterilization method

8- The Unified Customs Code.

17. :-

18- Upon awarding an item of the tender relative to

pharmaceuticals, the concerned product must be

registered in the Kingdom of Saudi Arabia (SFDA) or

centrally registered.

19- :

A) If an item was awarded to a bidder, and it was 19. :-

found that the bidder has marketed the same at a

lower price (for any State or Participating Party, or

in the local market as per KSA/CIF Price (USD)), then

the MS or PP may oblige the bidder to adopt the

same lower price. Failure by the bidder to abide by

this obligation shall lead to cancellation of ordered

quantity and procurement of the items at the

bidder's account, and the bidder shall bear the

price difference (if any). And this incident will be

taken into account to negatively affect the bidder's

profile upon awarding of any latter tenders

according to the Law followed by the Health

Council.

B) If an item was awarded to any bidder and it was

found that the item price is higher than the

registration price in Saudi Arabia (as per the

KSA/CIF price $) or higher than the price at Gulf-

level, then the MS and PP shall be entitled to adopt

the KSA/CIF Price ($) and deem it to be the price of

the awarded item.

20- Exclusion shall apply to bids submitted for items not

included in the list of the registered manufacturer's

products or which have a catalogue number different

from the tested/assessed catalogue, or different from

the catalogue mentioned in the qualification file

product list.

21- If a bidder submitted a bid including the same

catalogue number for more than one item of the

tender, then the same must be explicitly indicated in

the bidder's bid (under the "Comments" filed), and

the repeated item must also be indicated on the Cover

Letter. Failure by the bidder to abide by this shall result

in the exclusion of such items.

22- If package size deviated from the item specifications,

then the lower bid in accordance with the size price

(mg or ml) shall be selected.

23- All bidders shall abide by the catalogue number

mentioned in this respective bids. If a bidder requested

the changing of catalogue number following award

notice, then the MS may accept or reject the same,

provided that the specifications of accepted bid shall

remain unchanged.

24- Cover Letter shall indicate the number of original bids,

as well as the total number of alternative bids.

25- Upon changing its name or merger with other

company, a bidder shall submit the official documents

proving the same, and must update its data

maintained by the Health Council one month prior to

purchasing the tender documents.

26- In case of merger or purchase by other company, a

bidder shall submit a letter on both the letterhead of

the former company and the letterhead of the new

company. Such letter shall be certified from the

Chamber of Commerce in the country of origin and

must indicate the former and new name of the

company in the Coverage letters and bid documents

for each item.

27- After being notified of the awarding of every tender,

bidder shall maintain local agent/distributor. And a

bidder shall authorize such agent to purchase the

tender documents, receive the awarding letters from

the Health Council, and complete the supply processes

with the MS and PP, and such authorization shall be

carried out as per the Authorization Form attached to

the tender documents. Bidders who have no local

agent/distributor in any of the MPs shall appoint an

agent/distributor in one of the MPs within (45) days

from the date of awarding notice. However, failure by

bidders to do so shall entitle the Health Council to

confiscate the primary bank guarantee and suspend

awarding the item(s) for the next tender. And if such

incident recurred the bidder's participation in future

tenders shall be suspended.

28- In case the bidder provided invalid information in the

bid regarding the product registration or agent's form

or related to fake names, the Health Council may take

penal actions against the company by confiscating the

initial bank guarantee and consider the Company's

exclusion from participating in the coming tenders.

29- A bidder shall apply the Bar-Code system on all

products supplied under the Joint Procurement

Tenders. And upon importation, bidders shall add the

Universal Bar-Code to every product.

30- Any additional writings on the bid papers shall be

made by non-erasable ink in the "Comments" filed.

And no modification or scrape may be made to the Bid

Form provided to bidders by the Health Council.

31- The bidder's purchase of the tender documents and

submission of a bid shall constitute an approval by the

bidder to the general and technical terms of the

tender, and no reservation will be considered. Failure

by a bidder to abide by this shall entitle the Committee

to either accept or reject the bidder's bid.

39- All medical supplies companies shall participate in the

Joint Procurement Tenders according to the

manufacturer's products listed in the Registration

Profile as approved by the Health Council. If a

company participated in bidding on an item that is not

included in the manufacturer's list of products and the

visit report, then procedures shall be taken against

such company.

40- In the Cover Letter, bidder shall mention the groups of

43- Items related to heart medications and diabetes shall

be awarded to two companies; one of them Brand

company and the other is Generic Company, and the

MS and PP shall have the right to choose among these

44- All companies wishing to contract or compete for the

contracts of the Ministry of Health in KSA shall

perform investments in the Kingdom by a percentage

of no less than (40%) of each contract it concludes

45- Bidder shall indicate the number of catalogue for each

item for which it requests evaluation. And upon

introducing the evaluation result in the Electronic

Linking Program, the MS must indicate the catalogue

number for each item; an item without associated

catalogue number shall not be considered for

evaluation.

46- When specifications of any item are modified, all past

evaluation results shall be cancelled. And companies

shall apply for evaluation of such item in accordance

with the new specifications. This shall not apply to

modifications relative to sizes or package

measurements which do not affect the product usage.

1- Manufacturer shall submit its bid on two original

copies within an appropriate envelop sealed with the

bidder's seal. Such bid shall include the price for

supply and install of all medical devices with a

guarantee period of 5 years, in addition to a

Preventive Maintenance Program that shows the

number of annual maintenance visits per device

according to the manufacturer's instructions, and

showing the single price and total price for each item

and the whole items, provided that such prices must

include the cost related to the supply and installation

of the devices, as well as the training on operation and

testing, and maintenance works throughout the

guarantee period.

2- Manufacturer must maintain each copy in a folder that

indicates the name of the applying company, tender

name, and group of items. Such folder shall contain

the following documents:

a. The price for each item

b. Price for maintenance works (including the spare

parts and another one excluding these parts) for a

period of 5 years after the expiry of guarantee

period.

c. The number of annual preventive maintenance

visits and details of maintenance works according

to the manufacturer's instructions must be

indicated.

d. The schedule of GCC Health Council Specifications

should be attached. Any bid that fails to fill the

fields of required specifications will be overlooked.

e. Detailed technical offer.

f. The original catalogue of the Company including

all specifications, drawings and plans.

g. manufacturer shall comply with all prices related

to supplies and consumables during the guarantee

period which were submitted along with the bid

documents.

h. Location for maintenance and support, number

and certification of engineers and their expertise in

5- The preventive visits schedule must include a number

of annual visits for the maintenance works according

And this schedule is considered obligatory and shall be

complied with during the guarantee period. And a

failure fine shall be imposed in case of delay in

implementing preventive maintenance works during

the guarantee period according to these annexes.

7- Prices of spare parts: for each supplied device, the

manufacturer shall submit a statement on the prices of

spare parts according to their types and classifications

manufacturer must apply these prices during the

A) Bidder shall Acknowledge that all data and

documents submitted within the bid are binding

on the manufacturer in case of awarding, whether

during the guarantee period or thereafter, and the

bids which fail to fill out the maintenance tables

shall be excluded.

B) Prices offered in the aforementioned tables shall

be basis for the calculation of device cost after the

expiry of guarantee period.

D) Original offers shall be sent along with the Cover

Letter by the manufacturer within the tender's

envelop provided by the Health Council. Such

offers must be serially numbered according to the

items of the tender.

E) No alternative bid will be accepted for the medical

F) A valid initial guarantee letter of 1% of the bid

price and acceptable by the Health Council shall

be provided. Such letter shall remain valid for 365

G) Upon sending notice of award, the Member States

and Participating Parties shall ensure that the

decrease proportion is a maximum of (30%) of the

awarded item for each State and participating

Party shall be entitled to request the addition of

quantities of any proportion during the bid validity

period, and a company must abide by its bid on

this basis.

II – Samples : ثانيا : العينــــات

1- No sample is required for the previously

awarded items with the same catalogue number

in the previous Medical Supplies Tender within

the past 4 years; the database available in the

records of the Joint Procurement Program at the

Health Council shall be deemed enough in

terms of testing and assessment of the items

approved for each company. However, if the

Committee requested a sample, the company's

agent shall provide such sample on the same

day. However, if the item is new and was not

tested or assessed before, the below

requirements shall apply.

A- Pharmaceuticals Tender

Bidder shall submit one sample for the drug

items contained in the submitted bids and

which were not previously awarded. As for

the remaining bids, it will be sufficient for

bidder to submit a copy of the outer and

inner packaging with the leaflet, including

the various concentrations for each item.

Upon providing the samples, companies

shall ensure that the outer and inner

packaging for these samples are matching

with the packaging registered in the

Member States of reference laboratories or

central registration. Companies shall provide

samples for awarded items to the MS and PP

in case they were requested to do so.

catalogue number during the past 4 years, a

sample is not required. However, if the

Committee requested a sample, the

company/company's representative must

provide it on the same day. However, if the

company is new or the catalogue number is

new and was not assessed or tested, then

the Company must provide one sample only

for each item in the least unit, provided that

the companies must provide the MP and PP

with samples for the awarded items with the

same technical specifications presented in

the respective bid within one week from the

date of the complementary meeting. In case

of providing samples that are noncompliant

with the awarded items, the clause (4) of

paragraph (6) of Companies Qualification

Regulation shall apply. This clause provides

for cancellation of registration of company

because of commercial fraud.

C) Tender for Linens & Medical Uniforms

1) No alternative bids may be submitted;

only one original bid. Alternative bids are

excluded.

2) Samples must be submitted upon the

submission of the bids in the tender.

3) Samples submitted shall be free of any

logo for the manufacturer, whether

printed or woven; only an easy to remove

sticker may be placed on cloths samples,

and the Health Council shall have the

right to exclude noncompliant samples.

D) Tender for oral and dental care supplies

Bidders must submit a separate file that

contains all copies of catalogues for the

items subject of bid, and each group shall

be numbered serially according to the item

number in the bid documents.

E) As for the tender for supplies of otolaryngology

supplies, the samples shall be summited as

follows:

1. If items are of the same type and differ in

size only, then one sample in final form

shall be submitted (original pack as

marketed) for any size, and a colored

catalogue copy shall be sufficient for the

remaining sizes.

2. If the items differ in terms of type of

components, then one sample shall be

submitted (in final form as registered and

marketed) for each single item.

F) A colored catalogue copy for each item and size

(attached to the bid documents) shall be

submitted for each concerned item, provided

that such catalogue contains all detailed

information for the item.

3- The Gulf item must be indicated on each sample

submitted. In case the required data are not

mentioned on the sample, the bidder's bid shall be

excluded with respect to items on which the

required data are not indicated.

4- Bidders shall submit a list of the samples

indicating the name of manufacturer, number of

samples, and expiry date. Such samples shall be

submitted by the bidder's agent in the Kingdom

along with all details related to the items, and

samples must be serialized according to the Gulf

numbering (GGN) system in typed form, otherwise

the samples shall be rejected.

5- A copy of the abovementioned list shall be pasted

on each carton, in more than one place on the

carton. Another copy of the abovementioned list

shall be submitted to the Health Council by the

bidder's local agent or branch (by hand delivery) in

order to be maintained.

carton of goods, and the storage conditions must be

indicated whenever necessary.

III – Prices : ثالثا : األسعـــار

1- Bidder shall provide one price only for each item

(to include the itemized price and total price per

item). Prices shall be Warehouse Delivery (W.W)

in the tender) and in no more than 4 decimal

"Comment" field will not be considered since there is

fields dedicated for these data in the Bid Form.

4-Bidders shall indicate the registration price with the

SDFA (KSA/CIF $ price), and the Gulf pricing for the

same (if any) according to each section within the

specifications.

8- The Warehouse Delivery Price (W.W) shall include

the custom fees for item that are not exempted from

with the need that the code contained in the

respect to the items exempted from custom fees in

the bid papers, as well as the invoices and shipment

documents.

9- Bidders may not submit bids for sources/factories

not centrally registered or situated in one of the

Reference Countries at least, and in case such bids

are submitted, the Health Council shall be entitled to

confiscate the Primary Bank Guarantee.

10- In case the bidder provided free-of-charge

quantities of the same item in its bid, such free

quantities shall be considered as discount to be added

to the original price of items, and the bidder shall

abide by the same.

Medical Equipment’s Tender مناقصة األجهزة الطبية:

1- Manufacturer shall provide one price for each

item in USD (itemized price and total price per

item). Such price shall include (supply,

installation, operation, training and guarantee for

5 calendar years) from the manufacturer's

warehouses to the site determined by the MPs

and PPs.

IV – Bank Guarantee: : رابعا : الضمان البنكــي

1. Cover Letter shall indicate the total value of the

bid based on the highest price, as well as the

amount of primary bank guarantee associated

with the bid. Bidder shall indicate in the Cover

Letter names of its branches involved with such

bid and covered with such guarantee.

2. Bidders shall provide a primary bank guarantee in

US dollar; the guarantee must be issued in the

name of the Gulf Health Council; and the value of

the guarantee shall be 1% of the total of highest

bid. The guarantee shall be issued by a local bank

in the Kingdom of Saudi Arabia, and shall remain

valid for one calendar year from the date of

opening the envelops; it must be renewable up to

the date of receipt of the final bank guarantees to

be opened in favor of each Member State with a

local bank in such state. If the primary bank

guarantee was provided by the bidder's local

agent or distributor, it must be indicated that the

guarantee is submitted on behalf of the bidder,

and relevant tender number must be indicated.

3. Primary bank guarantees submitted to the Health

Council after the Closing Date shall not be

considered and the bid related thereto shall be

rejected.

4. After awarding, the concerned bidder shall

5. A certified true copy of the final bank guarantee

opened in favor of each MS (the concerned

ministry, or participating parties) with a local bank

at such State to the Health Council. The primary

bank guarantee shall be released after

ascertaining that all MS and PP received their

respective final bank guarantee. And the Health

Council shall be entitled to confiscate the primary

bank guarantee after ten weeks of sending the

award notice in case the bidder failed to submit a

proof on providing a copy of the final bank

guarantee to each Member State and Participating

Party.

6. A final bank guarantee is not required from

bidders who were awarded with a tender of USD

5000 or less.

1- Payment will be made for items suppled to all

States after the final delivery (i.e. after the delivery

of goods to the warehouses and after being finally

Payment shall be made in Saudi Riyals. The

exchange rate with the US Dollar shall be

determined upon signing the contract between

the bidder's local agent and Ministry of

Health/Ministry of Environment, Water and

Agriculture, or the departments concerned with

the other Participating Parties.

Payment will be made for items after the final

delivery (i.e. after the delivery of goods to the

warehouses and after being finally accepted), and

payment shall be made in Saudi Riyals, where

exchange rate with the US Dollar shall be

determined upon signing the contract.

7- Companies shall pay two percent (2%) of the total

of supplied items to the ministries of health in the

Member States/Participating Parties, as follows:

A) Companies shall deposit the amount of this

percentage of items value in favor of the

Participating Parties and ministries of health in

the Member States (which did not activate

direct collection procedure for this

percentage). Such deposit shall be made to the

account designated for this purpose by the

Health Council; in return, the relevant

company shall receive an official receipt to be

submitted to the competent authorities in

ministries of health of the Member

States/Participating Parties whereby the

payments for the supplied items are paid; no

payments shall be made except upon

submission of the said receipt.

B) Ministries of health in the Members States

(which activated the direct collection

procedure for this percentage) shall deduct

such percentage out of the amount payable to

each company in return for the supplied items.

C) Companies shall verify first with the ministries

of health about the possibility of direct

deduction of this percentage before depositing

any amount in favor of the Health Council.

D) As for the tenders of medicines and veterinary

vaccines, the percentage of 2% collected from

the companies shall be in favor of the GCC

Health Council. And companies deposit those

amounts in the account designated for this

purpose by the GCC Health Council, in

accordance with the applicable legal

mechanism.

VI : Fines سادسا: الغرامــات

1. When the delivery of the full and valid Final

Bank Guarantee, initial invoices and

authorization letters is delayed beyond the

specified deadline (45 days) from the date of PO

as issued by the beneficiaries, then the Health

Council shall be entitled to:

a) Deduct 5% of the value of initial guarantee

up to the first week of delay;

b) Deduct 10% of the value of initial guarantee

up to the end of 2nd week of delay;

c) Deduct 15% of the value of initial guarantee

up to the end of 3rd week of delay;

d) Deduct 20% of the value of initial guarantee

up to the end of 4th week of delay;

e) After 4 weeks delay the Health Council shall

be entitled to confiscate the whole amount

of initial guarantee

However, if the approval by Members States

and Participating Parties was delayed for

more than 3 months from the date of award,

then the initial bank guarantee shall be

released.

2. Upon the bidder's withdrawal of its bid from

the tender process, the following shall be

taken:

A- If bidder withdrew its bid before the opening

of envelops, then no obligations on the bidder

shall arise;

B- If bidder withdrew its bid after the opening of

the envelops, the primary bank guarantee shall

be confiscated by the Health Council;

C- If bidder withdrew its bid after being advised

of the award notice, the Health Council shall,

based on request by the Member States,

award the tender to the next compliant bid.

However, if this is not possible because lack of

other bids, the Member States and

Participating Parties may procure items directly

from the local market (without notifying the

supplier) and charge the price difference to the

withdrawing bidder in both cases.

D- If bidder requested the changing of the price

for awarded item, then such request shall be

rejected if the new price is higher than the

awarded price, and if the bidder did not abide

by the awarded price, the award notice shall

be cancelled and the primary bank guarantee

shall be confiscated. And award shall be

referred to the tender to the next compliant

bid. However, if this is not possible because

lack of other bids, the Member States and

Participating Parties may procure items directly

from the local market (without notifying the

supplier) and charge the price difference to the

withdrawing bidder in both cases.

3. If the bidder failed to meet its contractual

obligations with respect to supplying process

provided for in the contract, the Member States

and Participating Parties shall be entitled to

apply the following:

A. To reject goods after expiry of the period for

supply of the first batch, and then the

Member States and Participating Parties shall

be entitled to procure the quantities at the

expense of the supplier, and this may be

carried out directly upon on quotation

irrespective of the price or source in order to

avoid shortage of inventory. In which case the

bidder shall bear the differences of price, and

shall be subject to Supply Fine of 20% of the

value of delayed goods, after being notified by

official registered letter, and allowed 15 days

grace period to rectify the situation.

B. Goods may be accepted after granting the

bidder a grace period in order to be able to

perform the supply, with the imposition of

delay fine which shall be calculated as follows:

- 1% of the value of the item(s) (or part of item)

up to the end of the first week of delay;

- 3% for the delay up to the end of the second

week;

- 6% for the delay up to the end of the third

week;

- 10% for the delay up to the end of the fourth

week;

- 15% for the delay up to the end of the fifth

week;

- And a maximum of 20% for delay of five

weeks, and Member States shall be entitled

during or after the said grace period to

confiscate the final bank guarantee and cancel

the supply order, or apply the provisions of

paragraph (A) if it deemed the bidder lacks

credibility in supplying the goods.

4. Upon awarding, the Companies Assessment

System shall be applied. Such system will consist

of 50% for product quality and 50% for

compliance with supplying, based the reports

received from Member States and Participating

Parties with respect to the product quality and

degree of compliance by companies, subject to

compliance with the provisions of paragraph

(3/A) above.

5. If international or local reports were issued

stating that adverse reactions or problems

happened with respect to any medicines or

medical products, then each State shall have

the right to decrease or increase the remaining

quantity of the tendered items without any

financial obligation, and the Member State or

Participating Party shall be compensated for the

supplied quantity. The Ministry shall be entitled

to collect and destruct the supplied quantities in

the presence of a representative of the

concerned company, and the Ministry may

request compensation for the so destructed

quantities according to the relevant minutes,

and the company shall bear destruction costs.

6. If the supplied goods violated the tender terms

of specifications, the approved bid of the

bidder, or the specifications approved in the

country of origin, then the company shall

replace 25% of the quantity of the

noncompliant goods within one month of the

date of supply thereof, provided that the

supplying of the remaining quantity shall be

carried out within the next month following the

date of supply thereof.

7. If the supplied goods violated the tender terms,

or they were not compliant with the required

technical specifications, then the concerned

company shall withdraw these goods within

two weeks from the date of being notified with

the same. Failure by the company to withdraw

goods for destruction purposes within the said

period, the beneficiary party shall destruct such

goods at the expense of the Company, and a

fine of 0.5% of the value of such goods shall be

imposed on company for each week of delay.

As for the Kingdom of Saudi Arabia with

respect to tenders for pharmaceuticals and

laboratory detectors and solutions which are

proved invalid, the concerned company shall

destruct the same within two weeks from the

date of being notified with the same. Such

destruction shall be carried out by companies

specialized in processing of medical and

pharmaceutical products.

8. If a change occurred to the physical

characteristics of any batch of the supplied

items during the storage period and within the

validity period, the supplier shall call the

quantity and replace/destruct it, and shall

provide a proof on the same within the time

limit set out in the paragraphs (4) and (5)

above.

A. If the quantity was not replaced within the

prescribed period, the fine of Failure to Supply

B. If the same problem occurred with the same

items and by the same company, then the

beneficiary party shall be entitled to reject the

order quantity and request that the goods be

insured at the expense of the supplier.

9. In case the company failed to supply items in

the prescribed timelines, or the company

violated any terms or specifications, this shall be

taken into account upon awarding the tender

as a point of weakness, and the company's bids

may be excluded.

2. If the manufacturer failed to meet its contractual

obligations relative to supply of items as provided

for in the terms, the Member States and

Participating Parties shall be entitled to:

التعاقديــة بالتوريــد المنصــوص عليــه فــي الشــروط فــإن

اإلجراءات التالية:

A) Reject the respective device following the

expiry of the supply period contained in the

terms, and the Member States shall be

entitled to procure such device at the

expense of the concerned supplier directly

from another source no matter what the

price or origin is in order to avoid interruption

of the service, and the supplier shall bear the

difference of prices and Failure to Supply Fine

by 20% of the value of the delayed device,

provided that a warning letter and a grace

period of (15) must be granted to the

supplier to rectify the situation.

B) Accept the device after granting the

manufacturer a grace period in order to be

able to supply, install, operate the device,

provided that the following delay fine shall

be applied as follows:

1- 1% of the value of the item(s) (or part

thereof) up to the end of the 1st week

2- 3% for the delay up to the end of the 2nd

week

3- 6% for the delay up to the end of the 3rd

4- 10% for the delay up to the end of the 4th

week

% للتأخير حتى نهاية األسبوع الرابع10 -

5- 15% for the delay up to the end of the 5th

week.

And a maximum of 20% (i.e. when delay exceeds

5 weeks). The Member States and participating

parties shall be entitled, during or after the grace

period, to confiscate the final bank guarantee and

cancel the award of the item which the company

failed to supply, or alternatively apply the provision

of paragraph (A) if they deemed that the Company

is not serious in supplying those items.
