Free consent given voluntarily and without any ‘coercion, intimidation or manipulation’強要・脅迫・不正操作がないこと

prior Consent should be sought in advance of starting projects, ensuring enough time for affected communities to discuss within the communities 活動が開始される以前に合意が模索され、先住民族側の協議・意見調整の段階で十分な時間が確保されること

informed to be provided sufficient information on proposed projects---their nature, size, progress, and, objective, as well as scope of their impact and so on提案されたプロジェクトの性質や規模・進行度・影響範囲、プロジェクトの目的等を網羅した情報が提供されること

consent decisions made by communities collectively and independently through their own process of decision-making, which includes the options to withhold or say ‘no’集団としてのコミュニティが彼ら独自の意思決定プロセスのもとに選択した決定であり、保留するあるいはNoという選択も含むものとする

2 Origins of the concept of FPIC FPICの由来

• The UNDRIP is referred to as an international standard by other UN human rights bodies（Ward(2011))

(1)Self-determination 自己決定 • Article 3(UNDRIP)

• Article 19,32(UNDRIP) States shall consult and cooperate in good faith with the indigenous peoples concerned ･･･in order to obtain their free, prior and informed consent ･･･.

Article 10(UNDRIP) ･･･No relocation shall take place without the free, prior and informed consent of the indigenous peoples concerned･･･

Article 29(UNDRIP) States shall take effective measures to ensure that no storage or disposal of hazardous materials shall take place in the lands or ter- ritories of indigenous peoples without their free, prior and informed consent.

2）How project proponents implement FPIC when the REDD+ projects are undertaken in the form of alliance with host country’s governments? 政府を含む連合体として実施されるREDD+でFPICをどう実施すればよいのか

3)To what extent should REDD project proponents be involved in identifying and recognizing rights holders and their land/territories/resource use? コミュニティの利用する土地・資源の特定をどこまで出来るのか

4)How should the guidelines deal with the gap between traditional way of thinking on gender issue and decision making process and the concept of FPIC? ジェンダーや意思決定プロセス等の伝統的な考え方をFPICプロセスのなかでどう考えたらよいか

5)Should the guidelines distinguish indigenous peoples from local communities? 先住民族と非先住民族との区別をすべきか
