(iii) You are also required to contact chief Engineer, Civil Engineerihg Dept.Port House, 3rd Floor, Ballard Estate, Mumbai- 400001 for therinalization of any pre-requisites at each location.

(iv) The entire work should be carried out in accordance with thespecirications., drawings, etc., that, are to be installed by you at MbpT.The utmost care should be taken Lo inaintain standard and permissiblepower output of base/relay statioii at each location and avoid anymobile radiation hacards. You shall be held responsible if found byconcerned legitimate authority that the radiation level is more thanpermissible limit.

You Shall depute throughout the execution of the tender work, aSupervisor/Engineer to complete the entire work in an effective manner.The names of the authorized persons who will execute the works shouldbe provided to MbFT.

(vi) You will have to arrange your own vehicle for transportation of men &materials. The safe custody of all equipments till successful operation atrespective sites of MbpT shall be the {sole responsibility of yours.

(vii) The detailed site survey for rina.Iization of pre-requisites at each locationmay be carried out at the earliest.

3. PELIVERYPERIQP:

The entire system shall be delivered, ins[a!lled and commissioned within aperiod of 32 weeks from the date of issuance of Letter of Intent. Any delay on thisaccount will attract Liquidated Damages as specifi6d below in Para No.4.

4. ELQUIDATED DAMAGPS£

In the event of failing to commence or complete the work within a period of 32weeks, Liquidated Damages shall be levied @ 0.2{5°/o of the Contract Price of work fordelay of each week or part of a w6ek subject to maximum ceiling of 5% of theContract Price of work.

6. EEBEESJ2ELIAYMENT:

MBPT shall provide the necessary invoice foi. charging annual leaserents/Licence Fee for the 15 MbFT sites for 5 years lease as detailed in Schedulesand also provide service tax registration number, so as to enable you to reimburseservice tax on lease rent/Licence Fee to MBFT.

WHEREAS the Board invited bids for the wori{ of Tender No.FA/E&T/200/2014 i.e.Renting out 15MbpT spaces for installation of Mobile Network Towers at various MbpTProperties for 5 years Lease.

AND WHEREAS the Contractor submitted his/theirmemts quotations by his/their/its biddated 14/01/2015 which bid was subject to the terms and conditions as contained jnhis/their/her/its letters referred to in the Schedule `A' hereto respectively and which bidsubject to the said terms and conditions was accepted by the Board by the letter Of FA &

1. In this Agreement the words and expressions shall have the same meaning as arerespectively assigned to the min the conditions of Contract hereinafter referred to.

2. The following documents shall be deemed to form and be read and construed as

part of this Agreement viz.2.1.1 Thesaidbid.

2.1.2 Instructions to bidders including addendum to bidders.2.1.3 The general conditions, including the special conditions of contract.2.1.4 The schedule of Quantities and Rates and other schedules.2.1.5 The Contractors and the FA&CAO's letters referred to in the Schedule "A-hereto,

and2.1.6 The acceptance of the Bid by the said letterdated l7th day of June 2015 from the

FA&CAO of the Board to the contractors.

3. In..consideration of the payments to be made by the Board to the contractors asherein under mentioned the Contractors DO and each of them DOT severally and

jointly HEREBY CONVENT with the Board to carry out and complete within thestipulated period (time being the essence of this contract) the work of building/operating/ maintaining 15 Mobile Towers hereto/ and all other ancillary work asdescribed in the Drawings in accordance win the specifications and in conformityin all respects with the provisions of the Contract and to maintain/ guarantee thesame as provided in the conditions of Contracv Specifications (hereafter`collectively called "the Contract Work").
