“这是最好的时代，也是最坏的时代。”

在经历了自然经济、工业经济以后，人类社会迎来了一个崭新的知识经济时代。作为新

时代的建设者、见证人，面对创新驱动发展战略与“中国梦”的命题，我们要立足国内，放

眼世界，以古鉴今，继往开来，审时度势，阔步前行！

从我国宋代山东刘家“功夫针”铺使用的“白兔”标识到十三、四世纪，陶工、银匠、

面包房须在制品上做上记号或标示姓名的普遍义务，再到1736年苏州布商黄友龙冒用他人

“牌谱”案引发的苏州府颁发禁止类似冒用行为的禁令；从1804年法国《拿破仑民法典》第

一次肯定商标权应与其他财产权同样受到保护，到1857年法国《商标权法》首次确立了全面

注册的商标保护制度，再到1870-1875年，美国、德国、英国注册商标法的颁行。商业标识

起源于行会控制，从一种“义务”演变成一种“权利”，区别了产源，承载着商誉，化身为

资产。

从1331年工艺师约翰·卡姆被英王爱德华三世授予在缝纫与染织技术方面“独专其

利”，到1421年佛罗伦萨的建筑师布鲁内来西发明的“带吊机的驳船”获得三年保护期；从

1474年世界上第一部最接近现代专利制度的法律在威尼斯颁布，到1623年作为近代专利保护

制度起点的英国《垄断法规》的出台。发明创造在改变人们的生活，推动经济、社会发展，

影响世界格局的同时，逐渐走进法律的视野，并实现了从“特权”向“私权”的过渡。

从北宋时期一般人刻印《九经》须经国子监批准，否则禁止刻印的法令，到15世纪末

威尼斯印刷商冯·施贝叶被授予有效期5年的在威尼斯印刷出版的专有权，再到英王玛丽一

世为控制舆论而颁布的《星法院法》，批准设立的钦定“出版商公司”；从1709年英国议会

通过的世界上第一部版权法《安娜法》，到18世纪末法国《表演权法》、《作者权法》的颁

布，版权保护进入一个新的阶段。版权从一开始就与印刷密不可分，对版权的保护与利用呈

现为对印刷的各种限制。科学技术日新月异，版权也被赋予了更多的内涵。

知识产权制度经历了萌芽、初创、普遍建立、进一步发展阶段，在20世纪末进入与贸易

相挂钩的时期。商业标识、发明创造、文艺作品一旦具有经济价值，侵权纠纷便如影随形。

经济全球化的浪潮使知识产权的纠纷突破了国界、地域，成为一个世界性的命题。从2003年

“思科”诉“华为”，到2007、2008、2009年“联想”三次涉案“337调查”；从美国政府

指控俄罗斯企业ElcomSoft，到欧盟《2008年度美国贸易与投资壁垒报告》指责美国知识产

权壁垒。在这场没有硝烟的战争里，自然人、法人、国家、区域联盟、国际组织之间阴谋、

阳谋，争吵、诘责，诉讼、仲裁，妥协、和解。一场场剑拔弩张、寸土必争的谈判落幕，一

系列国际条约、双边（多边）协定的签署，一次次知识产权与经济利益交换的完成，发达国

家高筑壁垒，发展中国家奋起直追。

知识经济时代，谁掌控知识产权，谁就立足于全球产业链的顶端，靠知识生产、知识贸

易、高附加值的知识产品攫取高利。谁位于全球产业链的底端，谁就必须贡献廉价劳动力，

付出环境、资源的代价，给全世界打工。商标、专利、版权即是应对竞争、攻城略地的尖兵

利器，也是攀爬全球产业链的金绳银索。发展知识产权，抢夺优良资源，是这一时代的永恒

主题。21世纪是知识产权的大争之世！

中国古代重农抑商的传统，没有形成商品大规模的流动销售，造成了重“招幌”，轻

“商标”的格局；历史上长期缺乏对发明创造进行必要的保护，中国虽然向世界贡献了“四

大发明”，专利制度却没有在这里生根发芽；“窃书不算偷”、“天下文章一大抄”的传统

观念根深蒂固，使得国人长期不知“版权”为何物。从清政府为了换回列强在中国取消治外

法权的承诺，配合西方列强进行了知识产权法律的修建，到1920年西方列强无意兑现治外法

权的承诺，国民政府明确表示拒绝加入“伯尔尼公约”，再到1928年国民政府借鉴德国法和

日本法的内容，通过《版权法》。从20世纪70年代末，《中外合资经营企业法》出台，知识

产权保护在中国扎根发芽，到20世纪80年代至90年代初，受对外开放政策的驱使，中国人满怀

保护知识产权的热情，完成法律初建，再到20世纪90年代初至本世纪初，中国知识产权在有关

知识产权法律法规的不断修订、完善和知识产权执法活动的不断开展、深化中稳步发展。

据世界知识产权组织称，中国现已首次成为世界上登记在册专利、商标和工业设计最

多的国家。但是，有人又在质疑：中国能否超越低附加值生产转向以创新和专利技术为基石

的经济增长转型，因为目前中国只有为数不多的品牌具有全球影响力。有人还在深思：中国

如何从“商标大国”走向“商标强国”。“科学技术是第一生产力”的普遍认同，使得中国

知识产权创造、运用、保护和管理的能力建设的动力实现了由外而内的转变；社会主义市场

经济的建立与健全，为知识产权制度在中国的茁壮成长提供了肥沃的土壤；《国家知识产权

战略纲要》的颁布实施，使知识产权战略、创新驱动战略与科教兴国战略、人才强国战略并

行，共同构筑实现中国强国梦的基础。

大争之世，中国当大有所为！

今天，中国知识产权面临辉煌发展的新时期。这一新时期被赋予全面推进依法治国、

努力建设法治中国的新要求，面临加快建立和完善公平竞争市场经济秩序、推进创新驱动发

展的新机遇，充满中国知识产权运用和保护已触“深水区”、进入“关键期”的新挑战，也

将经历建立“自贸区”、创建知识产权示范城市、争创亚太知识产权中心的新探索。有人将

中国知识产权发展的新时期称为奔向未来的十年。如何把握住这关键的十年，使中国从一个

知识产权大国转变为一个知识产权强国。习近平总书记在论述建设法治中国时提出的“科学

立法、严格执法、公正司法、全民守法”的方针就是我们新的行动指南。只有坚持知识产权

法律法规的科学立法，加强知识产权保护工作的严格执法，确保知识产权纠纷诉讼的公正司

法，实现知识产权相关领域的全民守法才能满足新要求，把握新机遇，攻克新挑战，完成新

探索，不断开创中国知识产权保护工作的新局面，真正实现法治下的创新驱动发展。以创新

引领经济，用知识产权制度激励与保护创新成果，这是知识经济时代我们的不二选择。大力

提升知识产权的创造、运用、管理和保护水平，使更多的驰名商标公平竞争、享誉世界，更

多的发明创造优化生活、造福民众，更多的优质作品顺畅流通、富足精神！

"It is the best of times; it is the worst of times."

After the natural economy and the industrial economy, human society embraced a brand new era of the knowledge

economy. Guided by the innovation-driven development strategy and the "China dream" proposition, we, as builders

and sculptors of the new era, should seek global development based on domestic resources, use history as a mirror

to open up new vistas, and stride forward by sizing up the situation. Dating back to the Song dynasty, the "Kung

Fu Needle" shop, which was then owned by the Liu family in Shandong province in eastern China, used a "white

rabbit" logo. In the 13th and 14th centuries, potters, silversmiths and bakers were required to mark their products

with symbols or their names. In 1736, the "Suzhou City government" imposed a ban on similar trademarks due to

the case of Huang Youlong, a dealer in cloth in Suzhou. In 1804, the Napoleonic Code in France affirmed for the

first time that trademark rights shall be protected just as other property rights. In 1857, a fully registered trademark

protection system was first founded under the "Manufacture and Goods Mark Act" in France. From 1870 to 1875,

registered trademark-related laws were issued in Germany, the United States, and the United Kingdom. Business

logos were derived from guild control and have changed from obligations to rights. With business logos, sources of

supply are differentiated, business reputation is established, and assets are accumulated.

In 1331, technologist John Cam was granted exclusive rights in sewing, dyeing and weaving by Edward III, King of

England. In 1421, the "barge with a crane" invented by Brunelleschi, who was an architect from Florence, obtained

three years' protection. In 1474, the world's first law that was closest to the modern patent system was issued in

Venice. In 1623, the Statute of Monopolies was issued in the United Kingdom and became the starting point of

the modern patent protection system. Inventions and creations have not only changed people's lives and promoted

economic and social development, but also have gradually entered the legal field and transformed from privileges to

private rights while affecting the world pattern.

In the Northern Song dynasty, ordinary people had to obtain the approval of the Guo Zi Jian (the Imperial College of

Beijing) before engraving or printing the Jiu Jing (nine Confucianist classics). By the end of the 15th century, printer

J.von Speyer was granted exclusive rights of printing and publishing in Venice for five years. Later, Mary I, Queen

of England, issued the Star Chamber Act to control public opinion and authorized and approved the establishment

of a "printing corporation". In 1709, the United Kingdom parliament passed the first copyright act in the world, the

Statute of Anne. By the end of 18th century, the Law on Performance Rights and the Law on Author Rights were

issued in France, indicating that copyright protection had entered a new phase. Copyright has been closely related

to printing from the very beginning, and protection and utilization of copyright are viewed as various limitations on

printing. As science and technology change constantly, copyright is given more connotations.

The intellectual property system experienced four stages of seeding, infancy, popularization and further

development, and was linked to trade by the end of 20th century. Once assigned economic value, business logos,

inventions and creations, and literary and artistic works became susceptible to infringement. With the tide of

economic globalization, intellectual property rights infringements have gone beyond regional and national

boundaries and become a worldwide phenomena. In 2003, Cisco sued Huawei. In 2007, 2008 and 2009, Lenovo

was involved in three Section 337 investigations. Later, the U.S. government filed a charge against Russian

ElcomSoft, and the European Union criticized the United States for its barriers to intellectual property rights in the

2008 Report on United States Barriers to Trade and Investment. In this smokeless war, there were covert or overt

conspiracies, disputes, retorts, lawsuits, arbitrations, compromises and reconciliation among natural persons, legal

persons, countries, regional alliances and international organizations. With the completion of intense and highly

disputed negotiations, the signing of a series of international treaties and bilateral or multilateral agreements, and the

realization of exchanges of intellectual property rights and economic profits, developed countries stayed in walled

compounds whereas developing countries began to catch up fast. In ancient China, business followed a pattern of

focusing on billboards rather than trademarks due to the pro-agriculture and anti-business tradition and the lack of

large-scale mobile commodity sales. Historically, there has been a lack of necessary protection for inventions and

creations. Consequently, the patent system hasn’t taken hold in China despite its "four great inventions". Due to

the ingrained traditional thinking that "stealing books is not stealing" and that "all articles are created by copying,"

Chinese have long been ignorant of copyright. In order for western powers to continue their commitment of

extraterritoriality in China, the Qing government coordinated with them and established the intellectual property

law. In 1920, the "Chinese National government" made clear that it was impossible for China to join the Berne

Convention because the western powers had no intention of meeting their commitments. Then in 1928, the "Chinese

National government" passed the Copyright Act based on copyright regulations in Germany and Japan. The Law

of the People's Republic of China on Chinese-Foreign Joint Ventures came into effect in the late 1970s, and the

intellectual property rights protection system took hold in China between the late 1980s and the early 1990s. Spurred

by the opening policy, China developed initial intellectual property laws, and constantly revised relevant laws and

regulations to achieve steady improvement between the early 1990s and the beginning of this century.

Some people questioned China's ability to shift from low value-added production to an economy founded on

innovation and patent technologies because currently only a few Chinese brands have a global impact. However,

according to the World Intellectual Property Organization, China has, for the first time, become the country with

most registered patents, trademarks and industrial designs. Others pondered how China would grow from big

to powerful in terms of trademarks. The general consensus is now that "Science and technology are the primary

productive forces," China's motivation for building the intellectual property system has changed from external

to internal. The establishment and improvement of the socialist market economy has created fertile ground for

the vigorous development of the intellectual property system in China. Furthermore, along with the issuing and

implementation of the Outline of the National Intellectual Property Strategy, the intellectual property strategy and

innovation-driven strategy are given equal attention as the science and education strategy and talent strategy, which

constitute the basis for realizing the China dream of being powerful.

In the era of the knowledge economy, whoever controls intellectual property will be at the high end of the global

industrial chain and gain high profits by relying on knowledge production, knowledge trade and high value-added

knowledge products. On the contrary, whoever is at the low end of the global industrial chain will offer cheap

labor and environmental resources for the whole world. In the 21st century, China has bright prospects despite

fierce competition from intellectual property rights. In this era of the knowledge economy, we are left no choices

but to promote economic growth through innovation, inspire and protect innovation with the intellectual property

system, and drive a new round of economic development based on intellectual property. In addition, we should

greatly improve the creation, application, management and protection of intellectual property rights. In this way,

more domestic trademarks can compete on fair ground and become world renowned, more inventions and creations

can bring benefits for people and improve their lives, and more quality works can be easily disseminated to enrich

people's minds.

2013年9月12日下午，由全国打击侵犯知识产权和

制售假冒伪劣商品工作领导小组办公室（以下简称“领

导小组办公室”）主办，中国外商投资企业协会优质品

牌保护委员会（以下简称“品保委”）协办的企业知识

产权保护座谈会在广州成功召开。领导小组办公室柴海

涛副主任、综合处张晶处长、林忠处长、督查联络组谭

剑处长、法规信息组彭增田副处长，商务部驻广州特派

员办事处来晓燕处长，品保委主席张为安、副主席陈小

东、杨海江、王志平，政府合作委员会主席钟清明、宣

传委员会主席张玉国、法律委员会主席云轩、副主席于

帮清，个人护理品行业工作组协调员陈东荣以及40余位

品保委会员代表参加了本次座谈会。

首先，柴海涛副主任介绍了中国政府在保护知识产

权和打击假冒方面的主要工作。他指出，在今后的工作

中，中国政府将在以下几个方面加大工作力度：第一，

尽快建立行政执法的处罚结果向全社会主动公开的工作

机制；第二，进一步做好行政执法和刑事司法之间的衔

接，推动建立各级政府信息交流的平台，有效地使构成

犯罪的案件及时移交给刑事司法渠道解决；第三，推动

政府软件正版化；第四，领导小组办公室将制定年度绩

效考评办法，评价各个部门和省市在保护知识产权和打

击假冒方面的工作，鼓励先进，督促后进。

品保委会员公司代表就以下问题进行了提问：刑

事打击知识产权犯罪案件中的透明度问题和权利人的知

情权及参与权；有关知识产权的法律、法规的修改问题

及建议；完善侵犯商标权犯罪立法、执法工作—权利人

视角；商业秘密保护的问题及建议，侵权商品的存储和

销毁问题及建议；著作权侵权问题及建议；企业名称侵

权和影子公司问题及建议；网上销售侵权商品问题及建

议；出口环节定牌加工有关的商标侵权问题。

领导小组办公室领导就相关问题进行了回答。首

先，谭剑处长指出，经过不断修改，《案件信息公开意

见》会尽快出台。关于侵权商品的销毁问题，目前实现经

济环保销毁还存在一定的困难。他表示，领导小组更倾向

于谁生产和销售，谁承担销毁费用。至于如何在《环境保

护法》和其他法律中进行相关修订，值得共同探讨。关于

张为安主席提到的企业标准登记问题，涉及两个方面，国

家规定的有两类标准：一类是国家强制性标准，不涉及商

业秘密和著作权，是向全社会推广的；另外一类标准是

推荐性标准和企业标准，这类标准含有商业秘密和著作

权，质检部门有保管和保护的义务。关于王志平副主席提

到的网络售假问题是全球性的问题，范围特别广，而且还

在不断蔓延，目前主要的解决办法是跨国联合执法，有

效的方法还需要进一步探讨，欢迎权利人提供意见、建

议。

接着，张晶处长指出，中国知识产权保护工作还

需要不断完善。中国法律和外国法律在法律规定上存在

差异性。中国刑事判罚主要有两个层面：对人身自由的

限制和附加刑。判罚的罚金要上交国库，不给被害人。

但是，行政处罚的罚款，赔偿时部分罚款要给被害人。

中国给被害人的金额赔偿主要体现在民事法律和合同法

律中。对于权利人提到的两法衔接过程中检察院立案、

透明度和判罚结果问题，张晶处长表示，检察院立案非

常慎重。未立案原因主要是：第一，要保护人身权；第

二，立案后，进入司法程序，会涉及到错案追究制度，

一旦出现问题，案件就会被驳回；第三，国家司法成本

问题，张晶处长建议加大行政和前期监管力度。对于权

利人提到的程序公开问题，张晶处长指出，中国的刑事

法律主要是对国家公权力的保护，《刑法》界定的四个

The Seminar on Protecting Enterprises’ IP Rights, organized by the Office of the National Leading Group on the Fight Against IPR Infringement and Making and Selling Fake and Shoddy Quality

Goods (the Leading Group Office), co-organized by the Quality Brands Protection Committee of China Association of Enterprises with Foreign Investment (QBPC) was successfully held in Guangzhou on September 12th. Chai Haitao, Deputy Director of the Leading Group Office, Zhang Jing and Lin Zhong, Chief of the Division of Comprehensive Affairs, Tan Jian, Chief of the Division of Supervision and Liaison, Peng Zengtian, Deputy Chief of the Division of Legal Affairs and Information, Lai Xiaoyan, Chief of the Representative Office of the Ministry of Commerce of China (MOFCOM) in Guangzhou, Jack Chang, QBPC Chairman, Colin Chen, Edward Yang and Steven Wang, QBPC Vice Chairmen, Jimmy Zhong, Chairman of QBPC Government Cooperation Committee, Hugo Zhang, Chairman of QBPC Communication Committee, Yun Xuan, Chairman of QBPC Legal Committee, Michael Yu, Vice Chairman of QBPC Legal Committee, Ken Chen, Coordinator of QBPC Personal Care IWG and more than 40 QBPC member representatives attended the seminar.Initially, Chai Haitao introduced the priorities of the Chinese government in IPR protection and fighting against counterfeiting. He pointed out that, in the future, the Chinese government will enhance its efforts in the following aspects: 1) In the shortest possible period of time, to establish the working mechanism where the penalty results of administrative law enforcement will be proactively opened to the public; 2) further promote the harmonization of the administrative and Judicial IP enforcement. The establishment of the information-sharing platform among governments at all levels will be promoted to ensure timely transfer of criminal cases to the criminal and judicial channels; 3) promote the use of copyrighted software among government agencies; 4) set up the annual performance evaluation methods and evaluate the work of relevant departments, provinces and cities in terms of IPR protection and fighting against counterfeiting.Then, QBPC member companies raised the following questions: transparency in criminal strike on the IP criminal cases and right owners’ right to know and participate; comments and suggestions on the revision

of relevant laws and regulations; improving the legislation on trademark infringement from the perspective of right owners and enhance law enforcement; comments and suggestions on trade secret protection; comments and suggestions on the storage and destruction of infringing goods; comments and suggestion on copyright infringement; comments and suggestion on trade name infringement and shadow company; comments and suggestion on online sales of infringing goods; OEM IP issues.Afterwards, the Leading Group Office provided suggestions on these issues. First of all, Tan Jian pointed out that, Opinions on the Publicity of Case Information will be issued as soon as possible after revisions. However, at present, it is difficult to realize the destruction of infringing goods in an economic and environmental friendly way. Tan said that the Leading Group Office is more inclined to the idea that the person who produces and sells fake goods pay for destruction. It’s worth discussing how to make changes in the Environmental Protection Law and other related laws. standard on enterprise registration mentioned by Jack Chang, there are two types of standard prescribed by China: one is the national mandatory standard, which does not involve trade secret and copyright and is promoted among the whole society; the other type is the recommended standard and enterprise standard, which involves trade secret and copyright, and quality supervision departments have the obligation to prote them. Steven Wang pointed out that online sales of counterfeits is a global issue and continues to expand. At present, the common practice is to rely on cross-border enforcement while more effective methods need to be further explored and the suggestions from right owners are welcomed.Then, Zhang Jing pointed out that differences exist between Chinese law and foreign laws and China's IPR protection work needs constant improvement. China's criminal penalty contains two main aspects: restrictions on personal freedom and supplementary punishments. Penalty fines are to be turned over to China Treasury rather than the victim, while in cases of administrative penalty, part of the fine are given to the victim. In China, money compensation for the victim is mainly manifested in civil law and contract law. As for case-filing, transparency and penalty results of procuratorates mentioned by right holders, Zhang said that procuratorates

最后，柴海涛副主任作总结发言。他向品保委对

中国政府相关工作一如既往的支持和近几年来对中国政

府知识产权保护工作给予的积极评价表示感谢。柴海涛

副主任指出，品保委代表提出的问题很前沿，有助于在

政策制定时看的更远。大家在中国保护创新驱动发展战

略和保护知识产权方面目标一致。柴海涛指出，本次会

议主要聚焦六点问题。第一，规范利益冲突和消除地方

保护的问题。随着中国创新发展战略的提出，中国在消

除地方保护主义的认知水平已经和经济刚发展时有所不

同；在利益冲突规范问题上，希望业界和政府达成更多

的共识，形成政治决心和统一认识。第二，权利人在司

法程序中如何落实权利的问题。领导小组办公室会认真

听取大家的意见，看在整个司法程序中，是否能够在符

合现有法律法规的基础上，完善和落实权利人的知情权

和参与权。第三，本次座谈会关注了许多知识产权保护

新领域，如商业秘密。中国没有统一的商业秘密保护

法，而是散见在各种不同层级的法律法规中，需要加强

关注和研究解决办法。第四，加快修法，跟上实践。

目标比较集中的是《刑法》、《竞争法》、《著作权

法》、《专利法》等。领导小组办公室会把品保委的意

见及时转达到相关部门。第五，侵权产品的环保处理。

领导小组29个部门参与机制后来加入了环境保护部，本

身就是对该问题的重视。环境保护部已经把侵权产品的

无害化处理纳入到环保部固体废料处理的管理体系中。

第六，提高执法的执行力度。

file cases in very prudential manner and several reasons can explain why a case cannot be placed on file for investigation and prosecution: first, to protect personal rights; second, after entering the judicial process, if the miscarriage accountability system found out any problem, the case will be rejected; third, judicial cost. Zhang proposed that efforts should be enhanced in early administrative and supervision stage. As for the issue of opening procedures to the public raised by right holders, Zhang pointed out that China's criminal law mainly protects state power. The four elements defined by Criminal Law are: subject, object, subjective and objective aspects. It is also advised by Zhang that the victim may file incidental civil actions to ensure more effective protection of their rights. In addition, right owners may also find a lawyer to track the case. Under the Chinese law, a lawyer can't get involved in a case before filing, only after the initiation of an arrest (during the investigation) can lawyers provide legal advice and lawyers may discuss the case after prosecution and public prosecution. It is suggested that further discussion should be held between right holders and the Leading Group Office to jointly get the job done. Finally, Chai Haitao made concluding remarks. He thanked QBPC for its firm support and positive evaluation on IPR protection and the work of the Chinese government in recent years. He figured that the questions raised by QBPC representatives were very forefront which are helpful to policy making. He pointed out that we have a common goal in terms of innovative development strategy and IPR protection. Chai concluded that this meeting primarily focused on six issues. First, manage conflicts of

interest and eliminate local protection. after China's innovative development strategy being proposed, China has a new understanding of eliminating local protectionism. in terms of interest conflicts, it is advised that the industry sector and government reach political consensus and common understanding. Second, how to implement right owners’ rights in the judicial process. The Leading Group Office will draw everyone's views seriously and seek to improve and implement the right owners’ rights to know and participate in the whole judicial process in compliance with existing laws and regulations. thirdly, in this seminar, much attention was paid to new areas of IPR protection, such as trade secret. There’s still no unified trade secret protection law in China, instead, they scatter in different laws and regulations and need increased attention and research solutions; fourthly, accelerate the revision of laws to keep up with practice, especially the Criminal Law, competition law, Copyright Law, Patent Law and so on. The Leading Group Office will convey QBPC’s suggestions to relevant departments; fifth, environmental friendly way of counterfeits disposal. The Department of Environmental Protection joined the 29 departments of the Leading Group, which shows its great concern to this issue. The Department of Environmental Protection has incorporated harmless disposal of infringing products into the management system of solid waste disposal; sixth, enhance the efforts of law enforcement. Finally, Chai suggested that QBPC representatives provide their speech in the written form so that the Leading Group Office may collect, summarize, analyze and report after the meeting and provide reliable evidence when making policy proposals.

The September General Membership Meetings of the Quality

Brands Protection Committee of China Association of Enterprises

with Foreign Investment (QBPC) was held in Guangzhou on

September 12-13, 2013. More than 160 representatives from over 100 QBPC

member companies attended this meeting. In the morning of September 13,

the General meeting and MSC Training were held.

“The 2012 Year-end Membership Survey Report was introduced by

the Membership Service Committee Chairperson Cecilia Dou.” QBPC

Chairman Jack Chang and Vice Chairman Ron Davis gave welcome remarks

to the attendees of the meeting.

Chairman Dou mainly gave a brief introduction of the 2012 membership

survey results, focusing mainly on Member’s Perceptions of Problems

and Member’s Perceptions of Government and Anti-Counterfeiting/Piracy

Efforts.

Next was the QBPC-RusBrand MOU Signing Ceremony hosted by Jack

Chang, QBPC Chairman and Chuck Qi, QBPC Customs Committee

Chairman. Alexey Popovichev, Executive Director of RusBrand and

Daniel Fedorkov, Regional Brand Protection Director Russia, CIS & ECE,

Beiersdorf AG, gave presentations on RusBrand and shared their insights on

IPR protection in the region during the MOU signing ceremony. Established

in 2002, RusBrand now has more than 60 multinational member companies.

After that, QBPC Chairman Jack Chang and QBPC Vice Chairmen John

Matheson and Edward Yang shared their thoughts and comments on the

latest developments and challenges in Criminal Enforcement of IPR in

China.

One of the most lively sessions was the presentation by Yiwu ECID. Officers

Wang Hua and Chen Jianzhong communicated with members regarding the

Initiatives of Anti-counterfeiting in Yiwu and strengthening collaboration

between Yiwu ECID and QBPC. They explained their work against online

anti-counterfeiting and indicated their intention to sign a MOU with QBPC.

保委谅解备忘录签订仪式、品保委照明行业工作小组和

汽车行业工作小组、义乌经侦大队交流会、福建经侦大

品保委宣传委员会主席张玉国主持了第二场小组讨

The Committee Panel was held in the afternoon of September 12.The 1st panel was hosted by Conan Chen, QBPC Best Practice/Enforcement Committee Chair. He briefly reviewed the projects of

BEPC: a Training Program for Heilongjiang Provincial and Hefei Municipal ECID in NPUC?; a Signing Ceremony for the MOU between the ECID of Changzhou PSB and the QBPC, QBPC Lighting IWG and Auto IWG; an Exchange Meeting with Yiwu ECID; an Exchange Meeting with Fujian ECID/PSB; and A Research Program on ACF Investigation in China for QBPC Members' Benefit.The 2nd panel was hosted by Hugo Zhang, QBPC Communication Committee Chair. He introduced the QBPC Website’s upgrade since 2012 and the main functions.The 3rd panel was chaired by Chuck Qi, QBPC Customs Committee Chair. He briefly reviewed the work of the Customs Committee including the Annual Exchange Meeting with GACC, the Exchange Meeting with GACC & US CBP/ICE, Customs-to-Members Training & Interactive Exchange, Capacity Building Training supporting Customs Enforcement and the GACC-QBPC Roundtable.The 4th panel discussion was chaired by Jimmy Zhong, QBPC Government

Cooperation Committee Chair. He introduced the Exchange Meeting with Guangdong Law Enforcement Agencies.The 5th panel discussion was hosted by Heart Chen, QBPC Legal Committee Vice Chair. She adopted a “2-2-1-4” formula for the Legal Committee update, which means: 2 new projects approved in 9/2013, 2 research paper drafts finished, 1 legislative review done and 4 upcoming events. Jack Chang, QBPC Chairman, gave members an introduction to the new trademark law.The last panel discussion was chaired by Qu Xiaoyang, QBPC Patent and Innovation Committee Chair and Sam Li, Vice Chair of Patent and Innovation Committee. They gave an overview of the Damages in IPR Litigation project with the Beijing First Intermediate People’s Court, the Evidence in IPR Litigation project with the Jiangsu Higher People’s Court (Legal), the Service Invention Regulations and 4th Amendments to the Patent Law project with MIIT, the Patents and Standards project with CNIS, the Shanghai IP Judges Training Program, the Workshop on FRAND and Standards-related Essential Patent Litigation and, Comments on Article 33 of Patent Law with SPC and Trade Secret Protection with SPC (Legal/New).

1. 加强与学术机构的合作。我们大多数的项目都

是与法院及政府部门合作的要更加注重与学术机构的合

作。学术机构是很有影响力的。比如，上海市高级人民

法院2013年6月发布的《职务发明创造发明人或设计人

奖励、报酬纠纷审理指引》就吸收了不少一流大学的意

见。法律委员会与北京师范大学合作的刑法修正项目也

是一个很好的例子。

2. 组织相关案例及经验分享。委员会定期组织有

关专利侵权案件的学习让更多会员也可以分享一些有益

的经验和典型案例。例如如何行使专利权，如何聘用好

的外部顾问，怎样提高会员的能力，使他们更好的为公

司服务。

3. 建议建立一个专家数据库。讨论中，有些会员

代表建议委员会建立一个专家数据库。会员为不同的公

司工作，有着不同的专业背景，建立这样的专家数据

库，可以帮助提升会议讨论的效果，更加集中地就我们

关心的议题进行交流。

4. 建议翻译一些有影响力的英文知识产权书籍。

《人民公安报》创办于1984年10月5日，由中华人

民共和国公安部、人民公安报社主办，是机关报。《人

民公安报》已成为全国300多万公安民警及社会各界读者

学法、用法的良师益友，在全国报刊中形成了自己鲜明

On September 12th, the QBPC Patent and Innovation Committee Lunch Meeting was held to discuss future committee work.At the beginning of the discussion, Dr. S. Sam Li, Vice Chair

of the Patent and Innovation Committee, reviewed committee activities from 2006 to 2012 and then outlined a future strategy for the committee to enhance its services to the membership, strengthen outside partnership and encourage member participation. Sam said that we should be more focused on following up and effectively communicating committee projects so that more members can benefit. He said that the project leaders should not be limited to committee chairs but also include any member representative who is willing to lead. Moreover, committee leaders should help grow QBPC staff for better member services. After Sam’s introductory remarks, Committee Chair Xiaoyang Qu moderated a lively discussion. Here is a summary of the key points.1.Strengthen the collaboration with academic institutions: most of our projects are in collaboration with courts and government agencies. We should pay more attention to academic institutions. They are influential. For example, the newest Trial Guideline on Reward and Remuneration for Service Invention published by Shanghai High Court absorbed many comments from top universities. The criminal law amendment project, for which the Legal Committee worked with Beijing Normal University, is a good example.

2.Conducting case studies: the Committee discussed the need to conduct case studies in patent infringement matters. It was suggested that members could share best practices, for example, how to enforce patent rights, how to engage a good outside counsel and how to improve their capacity to serve their companies.3.Create different expertise database: the Committee should create a database of expertise. We work for different companies and have acquired different expertise. Such a database would be helpful in elevating our discussion, focusing on issues and communicating our concerns. 4.Translate influential English IP books: We could translate and publish some influential English IP books. They provide valuable thoughts that could be helpful for China. 5.Improving meeting arrangements: in a conference setting, usually there are too many participants for in depth discussion. Some members don’t have the opportunity to speak. We could organize smaller scale meetings to follow up on questions that some members care deeply about. The meetings need not be high level, but should provide opportunities for in depth discussions. 6.Diversify the meeting format: we could setup discussions in a way which is more conducive to conversation, such as to have discussions in places away from the usual classroom-like setting and we could provide drinks.7.Other: one member expressed his interest in the evidence project, which will have a conference in November. Courts’ practices on evidence vary in different districts.

On August 22, 2013, China Police Daily (CPD) and the Quality Brands Protection Committee of China Association of Enterprises with Foreign Investment (QBPC) conducted in-depth discussions

on jointly initiating public welfare activities and projects. The signing ceremony of the Memorandum of Understanding (MOU) was held with the following consensuses from both sides. Founded on October 5, 1984, CPD is an official newspaper of the Ministry of Public Security of China. CPD has been very popular among more than 3 million public security officers and readers learning and using laws, developing its own distinctive characteristics among all the newspapers in China.CPD and the QBPC discussed about the initiation of joint public welfare activities in universities and communities related to IPR protection. It was decided that promotional activities such as lectures, seminars, salons and contests in universities will be held to improve the IPR protection awareness and identification skills of consumers, and enhance their resistance to all kinds of fake and shoddy quality goods. CPD and the QBPC also plan to hold high-level forums on IPR protection by inviting legal experts, officers from law enforcement and judicial departments, embassy representatives and representatives from multinational companies to discuss how to deal with intellectual property crime under the new situation, with the aim to build international high-level IPR protection forum.In the signing ceremony, consensus on in-depth cooperation between QBPC and the subordinate media of CPD was also reached. with Foreign Investment (QBPC), signed Memorandum of Understanding (MOU) on the 12th of September 2013. The MOU focuses largely on two major areas of cooperation: the promotion of the Interface Public-Members (IPM), the WCO’s online tool to foster cooperation between Customs administrations and the private sector, and the training of field Customs officers. “We believe that this MOU will further strengthen QBPC’s mission to contribute to intellectual property protection in the People’s Republic of China. The WCO’s tools and experts will allow us to work more efficiently with Chinese local Customs by providing them with more effective training”

said QBPC Chairman, Jack Chang. “Increased international cooperation is critical in the fight against counterfeiting and the WCO and its members are determined to work with all organizations concerned by this threat. As the scope of counterfeit goods increases, so does the danger to the health and safety of consumers. Hence the importance of raising awareness among Customs officers and delivering more capacity building tools and training” said WCO Secretary General, Kunio Mikuriya.Both Organizations are committed to improving the protection and enforcement of IPR and this MOU will facilitate the accomplishment of joint, innovative and complementary actions in this field. From 4:00 p.m. to 6:00 p.m. August 14th, 2013, the Exchange Meeting between Quality Brand Protection Committee of China Association of Enterprises with Foreign Investment (QBPC) and Economic Crime

Investigation Division(ECID) of Yiwu Municipal Public Security Bureau (PSB) was held in Shanghai. representatives from 11 member companies attended the meeting. The Exchange Meeting was hosted by the chairman of Best Practice/ Enforcement Committee (BPEC) Conan Chen. The Political Instructor of the ECID Chen Jianzhong, and Chief Wang Hua of the 3rd Division of the ECID of Yiwu PSB had a pleasant and productive discussion with the QBPC members. QBPC Chairman Jack Chang and Vice Chairman Colin Chen attended this meeting to support the communication desires that joined the discussion. The trip of Yiwu ECID had two primary goals: the first was to develop some investigative cases which could be managed through ‘Battle Cluster’ and get some suggestions on intellectual property criminal protection from QBPC members; the second was to communicate their thoughts on building long-term relationships between Yiwu ECID and QBPC, and discuss the execution of Memorandum of Understanding (MOU). Chen Jianzhong and Wang Hua stated their the MOU could strengthen the cooperation between QBPC and Yiwu ECID in long term. And Yiwu ECID will communicate related case clues and suggestions to all members of QBPC in a timely manner. Yiwu ECID would like to closely cooperate with the members of QBPC and promote the IP protection work of Yiwu.Considering the character of the lawbreakers in manufacturing and selling fake and shoddy goods in Yiwu and the effectiveness of Yiwu ECID in anti-counterfeiting, Yiwu ECID hoped the members of the QBPC could actively provide clues of cases, which could be managed by means of ‘Battle Cluster’ in the following three categories: 1. Clues of Taobao on-line shops selling counterfeits. Yiwu ECID executed ‘Inquiry Cooperation Agreement’with Taobao, and possesses the advantage in reviewing the on-line data of suspected targets and could carry out real time investigation. But the clues should be reviewed and prioritized by the complainant first, including factors such as the funding time, sale amount(must reach 50

thousand RMB), selling price. The QBPC member companies should provide the names of 8-20 Taobao shops selling fakes and shoddy goods, across 3 provinces and submit all the information at the same time. 2. The information regarding major counterfeit manufacturers and clues of its sales network. 3.Since Yiwu is the largest distributing center of small commodities in the world, ECID also welcomes members to provide information on cases which could be handled together with foreign police force. Even though the agreement of anti-counterfeit action of Ministry of Public Security has flexibility in the right of jurisdiction, Yiwu ECID still hoped the members could take the prior consideration of Yiwu ECID before submitting the cases. 8月14日下午，马荣飞副主席介绍了品保委的架

构、主要作用以及品保委与全国执法机构的成功合作经

验，作了题为“侵犯知识产权案件中行政执法与刑事司

法的衔接”的主题演讲。在该演讲中他严密的分析了知

识产权行政执法与刑事司法衔接现存的问题及原因，并

进一步提出了解决问题的意见、建议。

On Aug. 14th, 2013, Quality Brand Protection Committee of China Association of Enterprises with Foreign Investment (QBPC) and Heilongjiang provincial and Hefei municipal Economic Crime

Investigation Division (ECID) jointly held the IP criminal protection training with the excellent assistance of China Criminal Police College (CCPC) in Shenyang city. All together, 147 PSB officials from Heilongjiang and Hefei and 15 QBPC members attended this training class. Steven Wang, Vice-Chair of QBPC and Kavin Ma, BPEC’s Vice Chair also attended and delivered theme speeches. At the afternoon of Aug. 14th, Kavin Ma introduced the structure and main functions of QBPC and the wonderful cooperation experiences between QBPC and law enforcement agencies throughout the nation. Then Kavin delivered his speech with the theme of “The cohesion of the IP administrative law enforcement and the criminal enforcement”. During his speech, he closely analyzed the existing issues and reasons for the cohesion of IP administrative law enforcement and the criminal enforcement, as well as some detailed suggestions to solve above problems.Haijian Ma from Novartis delivered his speech with the theme of “How does the brand owner best cooperate with PSB in IP criminal case”. The presentation comprehensively recounted the methods that “brand owner assists in the investigation of PSB”, the necessity that brand owner assists

After the meeting, PSB Officials expressed that the meeting would help them further raise their awareness of IP protection, strengthen cooperation with IP Owners, and laid a solid foundation for IP protection in the future. In a word, the productive training class strengthened the relationship between QBPC and Heilongjiang provincial and Hefei municipal ECID and will be also greatly helpful for the cooperation between GSC and Anhui Public Order Department in the future.

馨燕分别介绍了各自公司相关产品的鉴别知识，及其在

与执法机关合作中取得的成绩，并提出了有益建议。

They also showed the success they had made with the law enforcement agencies and put forward some beneficial suggestions.This training achieved good results, both sides said they would like to seek for wider and more in-depth cooperation in the field of intellectual property rights protection.

2013年10月10日至12日，由北京市高级人民法院和

中国外商投资协会优质品牌保护委员会（以下简称“品

保委”）共同主办的商标司法审判疑难问题研讨会在北

京成功举行。来自最高人民法院、国家工商行政管理总

局商标评审委员会北京市高级人民法院、北京市第一、

第二、第三中级人民法院、北京各区以及上海市、江苏

省、山东省、浙江省、广东省高级人民法院和国家工商

行政管理总局商标评审委员会的领导和专家参加了本次

会议。参会代表还有来自清华大学、山东大学、华东政

法大学的学者，国内企业的法务人员、律师事务所及知

识产权代理机构的专家等。品保委副主席张艳、品保委

法律委员会主席云轩、副主席李亚平、刘淼、于帮清、

陈心及20家品保委会员公司代表参加了本次会议。会议

共分五个议题，分别是驰名商标保护、定牌加工中的商

标使用、地理标志的注册与保护、商标侵权中的在先使

用抗辩、商标声誉的延续。

10月10日上午，北京市高级人民法院知识产权庭

庭长陈锦川、品保委副主席张艳首先向会议致辞。随后

进入第一个议题“驰名商标保护”，由北京市第一中级

人民法院知识产权庭副庭长仪军主持。来自一中院的芮

松艳审判长以“驰名商标的反淡化保护”为题进行了介

绍。芮松艳审判长主要介绍了驰名商标是否淡化的判断

主体、淡化的认定原则，并创造性的提出了关于驰名商

标淡化认定的三个层次的认知。江苏省高级人民法院知

识产权庭副庭长顾涛以“驰名商标司法保护若干问题”

为题进行了探讨。顾法官首先介绍了江苏法院涉驰名商

标案件的基本情况，然后就跨类保护与驰名商标司法认

定、淡化理论在同类或类似商品、服务领域的应用等几

个问题进行了探讨。

下午的会议主题是“定牌加工中的商标使用”，由

品保委法律委员会副主席于帮清主持。来自山东省高级

人民法院的于志涛法官和浙江省高级人民法院的王晓波

法官都就“定牌加工中的商标使用行为是否构成侵权”

进行了探讨，并结合本院及相关法院的案件进行了进一

步说明。品保委法律委员会副主席陈心在随后的自由讨

论中发言，她认为定牌加工中的商标使用行为构成侵

权，并且进一步从正反两个方面进行了论证。

10月11日上午的研讨主题是“地理标志的注册与保

护”，由北京市高级人民法院谢甄珂法官主持。北京市

丰台区人民法院叶晓法官首先就“地理标志商标的司法

保护”进行介绍，叶法官重点分析了地理标志侵权在司

法审判中遇到的有关认定和证据的问题。随后来自国家

工商行政管理总局商标评审委员会法务处副处长徐琳就

行政机关有关地理标志的注册与保护、地理标志在中国

的发展历史及现行的发展情况进行了介绍。

下午的会议主题是“商标侵权中的在先使用抗

辩”，由品保委法律委员会副主席李亚平先生主持。来自

北京市第三中级人民法院知识产权庭的蒋利玮法官从新

《商标法》第59条3款的理解和使用角度解读了商标的在

先使用抗辩。来自广东省高级人民法院民三庭的邓燕辉法

官从现行《商标法》对在先使用的规定及存在的问题、广

东法院的司法实践经验、新《商标法》对在先使用的规定

及尚需探索解决的问题三个方面谈了自己的看法。

10月12日上午的会议主题是“商标声誉的延续”，

来自北京市高级人民法院的周波法官及国家工商总局商

标评审委员会的孙明娟审查员分别就“注册商标专用权

的独立性与商誉的延续性”及“商标声誉延续问题探

析”进行了探讨。

最后北京市高级人民法院知识产权庭副庭长张雪松

及品保委法律委员会主席云轩做了总结发言。张副庭长

认为本次研讨会涉及代表的领域广、研讨充分，北京高

院专门的调研组会就相关意见进行整理归纳。云轩主席

认为，本次研讨会形式开放、讨论激烈、效果非常好。

感谢北京高院及会议协办方为此次会议付出的巨大努

力，使会议取得了圆满成功。

From October 10 to 12 in 2013, the seminar on difficult issues in trademark trial hosted together by Beijing Higher People's Court and Quality Brands Protection Committee (QBPC) of China Association

of Enterprises with Foreign Investment was successfully held in Beijing. Leaders and experts from Supreme People's Court, Beijing Higher People's Court, the Beijing First Intermediate People's Court, Beijing Second Intermediate People's Court, and Beijing Third Intermediate People's Court of Beijing, District Courts in Beijing, Shanghai, Jiangsu, Shandong, Zhejiang, and Guangdong, as well as State Administration for Industry & Commerce of the People's Republic of China Trademark Appeal Board participated in the seminar. Seminar participants also included scholars from Tsinghua University, Shandong University, East China University of Political Science and Law, legal personnel from domestic enterprises, and experts from law firms and intellectual property agencies. Zhang Yan, Vice Chair of QBPC, Yun Xuan, Chair of QBPC Legal Committee, George Li, Liu Miao, Michael Yu, and Heart Chen, Vice Chairs of QBPC Legal Committee, and representatives from 20 QBPC member companies attended the seminar. The seminar was divided into 5 topics: Well-known trademark protection; Trademark use in Original Equipment Manufacturer (OEM); Registration and protection of geographical indications; Plea of prior use rights in trademark infringement; Trademark reputation continuation.In the morning of October 10, Chen Jinchuan, Chief Judge of the Intellectual Property Tribunal of Beijing Higher People's Court, and Zhang Yan, Vice Chair of QBPC addressed the seminar. Then, Yi Jun, Deputy Chief Judge of the Intellectual Property Tribunal of First Intermediate People's Court, hosted the discussion of the first topic "Well-Known Trademark Protection". Rui Songyan, Presiding Judge of the First Intermediate People's Court of Beijing, discussed the topic "Anti-Dilution Protection on Well-Known Trademark". Chief Judge Rui mainly introduced subjects for determining well-known trademark dilution and dilution affirmative principle, and creatively proposed three-level cognition of well-known trademark dilution affirmation. Gu Tao, Deputy Chief Judge of the Intellectual Property Tribunal of Jiangsu Higher People's Court, discussed the topic "Several Issues About Judicial Protection on Well-Known Trademark". Judge Gu firstly introduced basic information about involved well-known trademark cases, and then discussed issues such as across-class protection, well-known trademark judicial protection, and application of the dilution theory to the same or similar product and service areas. Trademark use in OEM was the topic of the seminar in the afternoon that was hosted by Michael Yu, Vice Chair of QBPC Legal Committee. Yu

Zhitao, judge from Shandong Higher People's Court, and Wang Xiaobo, judge from Zhejiang Higher People's Court, discussed the issue that whether trademark use behaviors in OEM should be considered infringement, and provided further explanation based on specific cases from local or relevant courts. Heart Chen, Vice Chair of QBPC shared her opinions in the subsequent free discussion. She said that trademark use behaviors in OEM should be considered infringement and then demonstrated her opinions from positive and negative aspects. "Registration and Protection of Geographical Indications" was the topic of the seminar in the morning of October 11, hosted by Xie Zhenke from Beijing Higher People's Court. Ye Xiao, judge from Fengtai District People's Court in Beijing, introduced "Judicial Protection on Geographical Indication Trademark". Judge Ye emphatically analyzed issues about affirmation and evidence of geographical indication infringement in judicial judgment. Later on, Xu Lin, Deputy Director of Legal Department of Trademark Appeal Board of State Administration for Industry & Commerce of the People's Republic of China introduced registration and protection of geographical indications related to administrative organizations, and development history and current trend of geographical indications in China. "Plea of Prior Use Rights in Trademark Infringement" was the topic of the seminar in the afternoon of October 11, hosted by George Li, Vice Chair of QBPC Legal Committee. Jiang Liwei, judge from the Intellectual Property Tribunal of Beijing Third Intermediate People's Court, explained the plea of prior use rights for trademark according to the understanding and use of Section 3 of Article 59 of the new Trademark Law. Deng Yanhui, judge from the Third Civil Tribunal of Guangdong Higher People's Court, shared personal opinions about regulations of the current trademark law on prior use and existing problems, judicial experience of Guangdong courts, regulations of the new trademark law on prior use and problems that need to be solved. "Trademark Reputation Continuation" was the topic discussed in the seminar in the morning of October 12. Zhou Bo, judge from Beijing Higher People's Court, and Sun Mingjuan, examiner of Trademark Appeal Board of State Administration for Industry & Commerce of the People's Republic of China, discussed issues about "Independence of Exclusive Rights to Use a Registered Trademark and Continuation of Reputation" and "Trademark Reputation Continuation Analysis". At last, Zhang Xuesong, Deputy Chief Judge of the Intellectual Property Tribunal of Beijing Higher People's Court, and Yun Xuan, Chair of QBPC Legal Committee, made conclusive statements. 犯知识产权及制售伪劣商品刑事犯罪工作交流会。广东

省公安厅党委副书记、副厅长何广平，广东省公安厅经

侦局局长黄守应，副局长吴义来，来自广东省法院和

广东省检察院，以及来自广东省21地市公安局的40位代

表参加了本次交流会。品保委主席张为安，副主席陈

小东、王志平、杨海江，最佳案例/执法委员会主席陈

超，副主席刘涛，法律委员会主席云轩、政府合作委员

省打假专项行动提供了很多有价值的情报和线索，并协

助公安机关侦破了大批大案要案。何广平指出，本次交

流会将有利于加强广东省公安机关和品保委的合作，进

一步明确今后的合作方式和任务。接着，品保委主席张

为安致辞。张为安指出，在2012-2013品保委会员不记

名投票中，公安经侦部门被推举为中国最有效力的执法

部门。张为安主席表示，品保委要勇于宣传中国刑事知

识产权保护取得的进展。广东省公安厅经侦局副局长吴

义来详细介绍了广东省公安机关打击侵犯知识产权和打

击制假售假的工作情况。来自广州、深圳和揭阳市公安

局经侦支队的代表详细讲解了经典案例侦办情况。

28日下午至29日上午，来自品保委汽车行业工作

组、个人护理品行业工作组、玩具及授权行业工作组、

照明行业工作组、创意行业工作组和奢侈品行业工作组

的代表分别介绍了各个行业工作组的整体情况，共同面

临的问题和典型案例。

29日上午，广东省法院刑二庭法官蒋倩倩介绍了近

三年来广东省法院审理侵犯知识产权及制售伪劣商品刑

事案件的基本情况和常见问题。广东省检察院侦查监督

一处科长陈明杰介绍了广东省检察机关保护知识产权的

工作情况。

最后，广东省公安厅经侦局副局长吴义来作总结

发言。吴义来副局长指出，本次交流会内容十分丰富，

广东省公安系统会认真吸纳品保委好的建议，进一步推

进双方在信息交流共享，立案取证、案件侦办等方面的

合作。随后，品保委副主席王志平代表品保委作总结发

言，感谢广东省公安系统对品保委会员知识产权保护工

作所做的贡献，并强调双方应加强合作，共同努力解决

面临的困难，实现共赢。

He said that QBPC had provided great support to the IPR protection work of Guangdong PSB/ECID over the years and provided many valuable case clues to Guangdong’s special operation on fighting against counterfeiting and had assisted Guangdong PSBs in investigating many major cases. He pointed out that this exchange meeting would enhance the cooperation between Guangdong PSBs and the QBPC and would specify the tasks of future cooperation. QBPC Chairman Jack Chang then said that PSB/ECIDs were voted as the most efficient law enforcement departments in China in QBPC’s 2012-2013 membership survey. He said that QBPC should promote the achievements in criminal IPR protection in China. After that, Wu Yilai, Deputy Director of Guangdong PSB/ECID introduced the IPR protection work of Guangdong PSBs and their efforts in fighting against making and selling of counterfeit products. Chen Mingjie, Chief of the 1st Investigation and Supervision Department of the People's Procuratorate of Guangdong introduced their IPR protection work.Wu Yilai, Deputy Director of Guangdong PSB/ECID made the closing remarks. 少分两期完成，建成后，权利人可直接在网上进行相关操

作。第一期备案部分将于2013年10月1日投入使用。

最后，双方就邮递渠道新政对权利人的影响、海关

知识产权备案系统、侵权物品查扣、恶意抢注、举证、查

扣物品拍照要求等相关问题进行了积极深入的探讨，气氛

十分热烈，取得了良好的效果。

10月31日，由中国海关总署、杭州海关、义乌海关

和中国外商投资企业协会优质品牌保护委员会（以下简

称“品保委”）联合主办的海关与企业座谈会在浙江省

义乌市顺利召开。来自海关总署、海关总署广东分署和

全国各地25个海关的60多名海关代表以及品保委60多位

会员参加了本次座谈会。

海关总署政策法规司知识产权处处长李群英主持会

议。首先，义乌海关关长林江致欢迎辞。林江关长简要

介绍了义乌的进出口特点和义乌海关近年来在知识产权

海关保护方面的情况以及所取得的成绩。他表示在义乌

建立中国知识产权保护展示厅彰显了中国政府保护知识

产权的决心，同时欢迎各地海关代表和品保委广大会员

对展示厅的建设提供建议和支持。

随后，杭州海关法规处处长傅建平与品保委主席张

为安共同签署了杭州海关与品保委合作备忘录。该合作

备忘录旨在有效制止和打击进出口环节侵犯知识产权行

为，保护中国外商投资企业优质品牌，进一步发挥知识

产权海关保护在促进国家经济、科技发展及维护公平竞

争的对外贸易秩序方面的重要作用。

最后，海关总署政策法规司知识产权处处长李群英

介绍了中国海关近期知识产权保护工作的热点问题，主要

包括：新商标法的实施对海关执法的影响、修订《知识产

权海关保护条例》的初步设想、海关与公安机关在案件移

交过程中遇到的问题和知识产权海关保护备案系统。

10月31日下午，在义乌海关领导的陪同下，与会

海关关员和品保委会员参观了义乌港及二期海关监管场

所，以及中国海关知识产权保护展示厅。在整个参观过

程中，品保委会员与海关关员进行了充分的互动。义乌

海关鼓励品保委会员积极参与到中国海关知识产权保护

展示厅建设中来，品保委会员不仅介绍了相关品牌知

识，还对展示厅的建设提供了意见和建议。

品保委海关委员会组织会员与义乌海关就海关向

公安机关移送刑事案件进行了专题交流。在交流会上，

义乌海关法规处知识产权科科长龚宁宁首先介绍了义乌

The Seminar between China Customs and the Quality Brands

Protection Committee (QBPC) of China Association of Enterprises

with Foreign Investment (CAEFI) jointly organized by the General

Administration of Customs of China (GACC), Hangzhou Customs, Yiwu

Customs and the QBPC was successfully held in Yiwu on October 31st.

Over 60 customs officials from GACC, Guangdong Sub-Administration

of China Customs and 25 local customs and more than 60 QBPC members

attended this seminar.

Li Qunying, Director of the IP Division of the Department of Policy and

Legal Affairs of the GACC hosted the seminar. Lin Jiang, Director General

of Yiwu Customs made the welcome speech. He briefly introduced the

export features of Yiwu and the IPR protection work and achievements

of Yiwu Customs over the years. He said that the establishment of the

IPR Protection Exhibition Hall of China Customs in Yiwu showed the

determination of the Chinese government in IPR protection. He welcomed

customs representatives and QBPC members to provide comments and

suggestions on the exhibition hall.

Then, Fu Jianping, Director of the Laws and Regulations Department

of Hangzhou Customs and QBPC Chairman Jack Chang co-signed the

Memorandum of Understanding (MOU) between Hangzhou Customs and

the QBPC. The MOU aims at effectively stopping and cracking down

on IPR infringement during import and export and protecting the quality

brands of foreign-invested enterprises in China. It also aims at enhancing

the important role of China Customs in promoting the national economy,

technological development and maintaining fair competition.

Finally, Li Qunying, Director of the IP Division of the Department of

ideas of revising the Regulation on Customs Protection of IPR, the problems

encountered during case transfer from customs to the police, and the

Recordation System of Customs IPR protection.

In the afternoon, Yiwu Customs officers, customs representatives and QBPC

members visited Yiwu Port, the 2nd location of the customs’ supervision

activities, and the IPR Protection Exhibition Hall of China Customs.

QBPC members held discussions with customs officials, during which

Yiwu Customs encouraged QBPC members to actively participate in the

construction of the exhibition hall. QBPC members also introduced their

brands to customs officials and provided comments and suggestions to the

construction of the exhibition hall.

QBPC Customs Committee and Yiwu Customs then lead an exchange

on transferring the criminal cases from customs to the police. In the

exchange meeting, Gong Ningning, Chief of the IPR Division of the

Laws and Regulations Department of Yiwu Customs firstly introduced

the investigation work of criminal cases in Yiwu and problems they face.

She stressed that the harmonization of the administrative and judicial IP

enforcement requires the joint efforts from the police, customs and right

owners. Zhou Ming, Deputy Chief of the IPR Division of the Laws and

Regulations Department of Yiwu Customs briefed the group on the handling

of specific cases involving QBPC members and successful experiences.

QBPC members also communicated with Yiwu Customs on the specific

problems in criminal cases and put forward many suggestions.

Thanks to the active participation of customs officials and QBPC members,

the event was a great success.

2013年9月5日到6日，山东省工业企业知识产权运

用能力实务研讨会在淄博市举办。会议由工业和信息化

部知识产权管理办公室、工业和信息化部电子知识产权

中心、山东省经济和信息化委员会共同主办。来自山东

省工业企业的70多名企业管理者和知识产权专业人员参

加了研讨会。工信部科技司副司长韩俊、山东省经信委

李莎参加会议并讲话。

韩副司长指出知识产权对工业企业十分重要，此次

培训为工业企业提供了很好的学习机会。但对知识产权

运用能力的提高，政府只能起到推动作用，企业才是主

力。

品保委政府合作委员会主席钟清明先生、赛迪研究

院张义忠教授，年利达律师事务所Adrian Fisher先生和

北京慧远咨询有限公司的张艳女士出席会议并就相关专题

进行授课。品保委政府合作委员会主席、索尼公司副总裁

钟清明先生以“知识产权管理策略”为题，从管理的高

度，详细向学员介绍了在知识经济时代，如何制定知识产

权策略，进行相应的知识产权管理和运作，以及知识产

权管理策略新的发展趋势。会上还同学员进行了问答互

动。

此次研讨会授课老师准备充分，与会人员认真听讲

并踊跃提问，成效显著，受到参训人员的一致好评。

The IP Training for Industrial Enterprises was held at Zibo City

of Shandong province from September 5th and 6th 2013 This

training was co-sponsored by Shandong Economic and Information

Technology Committee, the IP Management Office and E-IP Center of

Ministry of the Industry and Information Technology (MIIT). More than

70 managers and IP professionals from industrial enterprises of Shandong

Province participated in the training. Han Jun, Deputy Director General

of the Science and Technology Department of MIIT and Li Sha from the

Economic and Information Technology Committee of Shandong Province

attended the meeting and delivered a speeches.

On the morning of September 5, Han Jun made the opening speech and

pointed out that intellectual property rights are very important for industrial

enterprises and this training provides a good learning opportunity. However, in

terms of improving the capacity of IPR utilization, the government only plays

a coordinating role while the industrial enterprises are the driving force.

QBPC Government Cooperation Committee Chairman Jimmy Zhong, CCID

Institute Professor Zhang Yizhong, Adrian Fisher of Linklaters and and

Zhang Yan from Beijing Huiyuan Consulting Co., Ltd. attended the meeting

and gave lectures on relevant topics. Jimmy Zhong, Chairman of QBPC

Government Cooperation Committee and Vice President of Sony gave a

lecture entitled "Intellectual Property Management Strategy". In this speech,

Zhong, gave a detailed introduction from management level about how to

develop IP strategies, make appropriate management and operation plans,

as well as development trends in IP management and strategies in the era of

the knowledge-driven economy. There was also an active Q&A interaction

during the meeting.

With well-prepared lecturers and active trainees, this training was widely

commended for its notable achievements.

Under the guidance of the SME Department of the Ministry of the

Industry and Information Technology (MIIT), the E-IP Center

of MIIT, Zhejiang Commission of Economy and Information

Technology (ZCEIT), Zhejiang SME Bureau and Zhejiang SME Science

Technology Training Center and the Quality Brand Protection Committee of

China Association of Enterprises with Foreign Investment (QBPC) jointly

hosted the IP training in Hangzhou from September 11th to 12th 2015.

Representatives from E-IP Center of MIIT, ZCEIT attended the training and

over 100 enterprise representatives, were also present.

Lecturers for this training were mainly from QBPC, Samsung, Dolby and

Linklaters LLC, who were senior experts in the field of IPR management

practices. The topics included SMEs Trademark Protection, Patent Mining

and Management, SMEs Overseas IP Protection and Technical Achievement

Transformation. The training provided a systematic, comprehensive and

fundamental introduction to the basic requirements of enterprises. The

trainees found the training course relevant to their daily business and that it

offered them practical and helpful knowledge.

一、新《商标法修正案》将于2014年5月1日正式实施1. The New Trademark Law Amendment Will Be Put into Effect on May 1, 2014

这是全国第三次修改《商标法》，全文改动较大，64条规定修改了57处。其中“声音”要素纳入商标构成、“驰名商

标”禁止用于宣传等成为吸引人眼球的亮点。

在此次《商标法》修改过程中，品保委积极参与，并且有很多建议得到了采纳。包含品保委建议的新修订内容如下：

1. 把“查处侵犯注册商标专用权案件”的用语修改为“查处商标违法案件”（新修订商标法第14条第二款）。

2. 商标注册人办理续展手续期限由6个月调整为12个月（新修订商标法第40条第一款）。

3. 将“连续三年停止使用的” 可撤销注册商标修改为“没有正当理由连续三年不使用的”（新修订商标法第49条第

二款）。

4. 行政复议期限由15日调整为30日（新修订商标法第34条、35条、44条、45条及54条）。

5. 把“没收、销毁侵权商品和用于制造侵权商品、伪造注册商标标识的工具”修改为“没收、销毁侵权商品和主要

用于制造侵权商品、伪造注册商标标识的工具”（新修订商标法第60条）。

6. 从人大11月28日公布的第一次审议稿的第一段第59条中，删除了“免予其他处罚”的用语。

同时，《商标法实施条例》也在积极修订中，品保委已就国家工商总局商标局的第一稿提出了修订意见。

This is the third time to amend Trademark Law(“TML”), and it is a big change. There are 57 amendments in 64 articles. “Sound” was put into the Trademark, and “well-known trademark” is prohibited to be used for advertise, which caught many persons’ eyes as the shining points.QBPC took an active part in this process, and many suggestions from QBPC were adopted by NPC Standing Committee.QBPC’s contributions:1. Changed the wordings of “handling a case infringing the exclusive rights to a registered trademark” to “handling a trademark case in violation of the laws” (Para. 2, Art. 14) 2. Fixing the gap between renewal of trademark registration and Customs Record: 12 months vs. 6 months(Para. 1, Art. 40) 3. Three year Non-use cancellation without justifiable reasons (Para. 2, Art. 49) 4. Changed from the deadline within 15-day to 30-day for filing administrative appeals (Art. 34; Para. 3, Art. 35; Para. 2 & 3, Art. 44; Para. 2, Art. 45 & Art. 54) 5. Confiscation, destruction of tools used predominantly for manufacturing infringing goods and counterfeiting labels of registered trademarks: predominantly vs. exclusively (Para. 2, Art. 60) 6. Deleted the wordings of “and immune the seller with other punishments” from Para. 1, Art. 59 of the NPC 1st review draft released on Nov. 28, 2012(Para. 2, Art. 60) Meanwhile, the Implementing Regulations to TML is in the amending process, and QBPC provided its comments on the first draft to the Trademark Office of SAIC.

二、十二届全国人大常委会立法规划2. Legislation Plan of the 12th Standing Committee of NPC

2013年10月30日十二届全国人大常委会发布立法规划，将立法项目分为3类。第一类是指条件比较成熟、本届任期内

拟提请审议的立法项目共47件，目前已通过商标法、消费者权益保护法、旅游法；第二类是指需要抓紧工作、条件成熟时

提请审议的立法项目21件；第三类是具有一定的立法必要性和可行性，但涉及问题较为复杂，立法条件尚不完全具备、需

要有关方面继续研究论证的立法项目。

值得注意的是，与品保委工作相关的专利法、著作权法、种子法、标准化法、刑法修正案、电子商务法、反不正当竞

争法等都在前两类项目中。

On Oct30th, the 12th NPC Standing Committee released Legislation Plan which divided the legislation items into three types. 1. 47 relatively mature items which will be reviewed by the NPC within this term. Trademark Law, Consumer protection Act and Tourism Law have already been passed.2. 21 items which should be made out fast and be reviewed when the time is suitable. 3. Some other items which are relative necessary and feasible, but also have many complicated problems so that need more researches. Patent Law, Copyright Law, Seed Law, Standardization Law, Criminal Law Amendment, E-commerce Law and Anti-unfair Competition Law are all listed to be reviewed in the first two types of 12th NPC Standing Committee’s Legislation Plan. These laws are related to QBPC’s projects.

三、北京高院出台《专利侵权判定指南》3. Beijing Higher People's Court Issued Guidelines for Determination of Patent Infringement

北京市高级人民法院10月9日制定并下发《专利侵权判定指南》，指南共133条，15800余字，对专利权保护范围的确

定、侵权判定、专利侵权抗辩等做出了全面的、具有操作性的规定。

指南总结了北京法院审理专利案件中的一些成熟经验和做法，修改删除了原意见中一些不适应目前司法实践的内容。

该指南主要对以下内容进行了完善：一是对等同特征的判断做出详细规定；二是对功能性特征的侵权判定规则做出全

面、完整的规定；三是对权利要求的解释时机做出类型化规范；四是明确“整体观察、综合判断”的内涵；五是对每种具

体侵权行为做出明确规定；六是将“间接侵权”纳入大陆法系的“共同侵权”的范畴；七是将侵权抗辩按照不同类型做了

全面规定。

Beijing Higher People’s Court issued Guidelines for Determination of Patent Infringement and sent it to the subordinate courts. The Guidelines totally has 133 articles, more than 15800 words. It made some comprehensive and operational stipulations which included the scope of patent protection, the infringement determination, and the patent infringement defense. The Guidelines summarized some practiced experience and practice of the courts in Beijing. It also amended or deleted some articles which are not adaptable to the judicial practice now.The Guidelines mainly dealt with the contents below: 1. It specified the equivalent characteristics determination.2. It made comprehensive stipulations for the functional characteristics of infringing decision rules.3. It made typed regulations for the explain time of the claim of rights.4. It defined the connotations of “observe entirely, judge synthetically”.5. It explicitly stipulated every kind of the specific infringement acts.6. It brought “indirect infringement” into the category of the “joint infringement” in civil law system.7. It explicitly stipulated infringement defense according to different types.

四、最高法院将出台指导性案例适用细则4. The Supreme People's Court Will Issue the Detailed Rules for the Guiding Cases

最高人民法院将出台指导性案例的适用细则。明确指导性案例的效力，“该细则已经成稿，目前正在征求相关方面意

见，预计今年年底或明年年初出台”。

法官裁判并不能直接援引指导性案例，作为裁判依据适用。根据《最高人民法院关于案例指导工作的规定》第七条，

最高人民法院发布的指导性案例，各级人民法院审判类似案件时应当参照。指导性案例具有事实上的拘束力，但“应当参

照”的效力如何，却并不明确。

即将出台的案例指导细则规定，当法官在审理类似案件时，应当参照指导性案例而未参照的，必须有能够令人信服的

理由，理由不成立的必须按照指导性案例处理。

The Supreme People's Court will issue the detailed rules for the guiding cases to specify the effectiveness of the guiding cases. The detailed rules have been drafted and now are under the stage of opinion solicitation. It is expected the rules will be issued at the end of this year or early next year.The judgment of the judges shall not cite directly the guiding cases, which shall be applicable as the basis of the judgment. According to Article 7 of the Provisions of the Supreme People's Court on Case Guiding Work, the people's courts shall make reference to the guiding cases published by the Supreme People's Court when trying the cases. The guiding cases have the de facto binding force, but the effectiveness of the "reference" is not clear.According to the new detailed rules, if a judge does not refer to the guiding cases when trying a similar case, he or she shall have convincible reasons; otherwise the cases shall be tried according to the guiding cases.

五、全国人大常委会修改消费者权益保护法5. NPC Standing Committee revises Law on the Protection of Consumer Rights and Interests.

2013年10月25日，十二届全国人大常委会第五次会议表决通过了《全国人民代表大会常务委员会关于修改〈中华人

民共和国消费者权益保护法〉的决定》。国家主席习近平签署第7号主席令予以公布。这一决定自2014年3月15日起施行。

《消费者权益保护法》根据这一决定作了相应修改，重新公布。

修改后的法律增加规定，经营者采用网络、电视、电话、邮购等方式销售商品，消费者有权自收到商品之日起七日

内退货，且无需说明理由，但消费者定做的、鲜活易腐的、在线下载或者消费者拆封的音像制品、计算机软件等数字化商

品，交付的报纸、期刊以及其他根据商品性质并经消费者在购买时确认不宜退货的商品除外。

修改后的法律强调，经营者及其工作人员对收集的消费者个人信息必须严格保密，不得泄密、出售或者非法向他人提

供。经营者应当采取技术措施和其他必要措施，确保信息安全，防止消费者个人信息泄露、丢失。同时规定，经营者未经

消费者同意或者请求，或者消费者明确表示拒绝的，不得向其发送商业性信息。

根据修改后的法律，广告经营者、发布者设计、制作、发布关系消费者生命健康商品或者服务的虚假广告，造成消费

者损害的，应当与提供该商品或者服务的经营者承担连带责任。

新修改的法律还规定，经营者明知商品或者服务存在缺陷，仍然向消费者提供，造成消费者或者其他受害人死亡或者

健康严重损害的，受害人有权要求经营者赔偿损失，并有权要求所受损失二倍以下的惩罚性赔偿。

On October 25, the fifth Session of the 12th NPC Standing Committee adopted by vote the Decision of the National People's Congress on Revising the "Law of the People's Republic of China on the Protection of Consumer Rights and Interests". Chinese President Xi Jinping signed the President Order No. 7. The Decision shall come into force on March 15, 2014. The Law on the Protection of Consumer Rights and Interests will be revised accordingly pursuant to the Decision and promulgated anew.The revised law adds provisions stating that if operators adopt the Internet, television, telephone, mail-order, etc. to sell goods, consumers are entitled to return the goods without justification within seven days from the date of receiving them, except tailor-made, fresh perishable goods, audio and video products, computer software and other digital products online downloaded or unpacked by consumers, delivered newspapers or periodicals, and other goods unsuitable for return based on their nature and confirmed by consumers when buying them.The revised law stresses that operators and their staff must keep strictly confidential consumers' personal information collected and shall not divulge, sell or illegally provide information to others. Operators shall take technical measures and other necessary measures to ensure information security, in order to prevent disclosure or loss of consumers' personal information. Meanwhile, operators shall not send commercial information to consumers without their consent or request, or when consumers have explicitly expressed rejection.According to the revised law, where advertising agents or publishers design, produce, or publish false advertisements on goods or services relating to life and health of consumers, causing damage to consumers, they shall bear joint and several liabilities with operators providing such goods or services.The newly revised law also stipulates that if operators clearly know the defects of goods or services but still provide them to consumers, causing death of consumers or other victims or serious damage to their health, the victims have the right to claim indemnification for loss from operators and punitive damages less than twice the loss suffered.

What experience moved you the most?When I was child, I left Beijing and drifted from place to place for years. At this remote town in Shanxi Province, my mother said she would attach me to her with a safety pin and never part with me. The words brought an ultimate sense of security to me. Now my mother, old and sick, lives in Beijing with me.

Who is the historical figure you admire the most?Socrates. Should it be “an unjust law is no law at all" or “an unjust law is still a law after all”? “An unjust law shall still be complied by me” may sound pedantic but also demonstrates the respect for the supremacy of rules.

What experience moved you the most?All touching moments are similar in nature and it is difficult to tell which one touched me the most. Recently, two friends from afar expressed their concerns for the safety of my family in the Ya'an earthquake. No matter how frequent we contact each other, this kind of moving relationship is always in my mind.

What experience moved you the most?My host family in San Diego who took care of me when I just arrived there to start my graduate school at the University of California, San Diego, with only $100 in my pocket. The hostess, Betsy, was introduced to me by the school’s international center. After one mail correspondence (no email back then), we established contact. She picked up at the airport and took me to stay a couple of days with her family. We went to beaches, watched movie and ate at fine restaurants. Afterwards, she gathered everything I needed to start my student life, things that I need in bedroom, kitchen and study, and sent me to school.

Who is the historical figure you admire the most?Deng Xiaoping. I admired his theories and ideas to liberate the minds and pursue development through a pragmatic and realistic approach.

What is your favorite sport?Tennis, though I have not played in months. Hope to return to the court.What book, movie or album you have read or appreciated recently?I have not dug into a book for quite some time. What experience moved you the most?I am easily moved by trivia of life. In particular, I am always touched by the greatness of those who live at the bottom of the social hierarchy but yet not only face life in an optimistic manner but also reach out to care for others in need.

幼时离京颠沛流离数年。在山西一个偏僻的小镇，母亲说，要用别针把我带在身上，不

论到哪里都不分开。幼年的我顿感无比安全。现在年迈病重的母亲在北京和我在一起。

是学院国际中心介绍给我的。在一封信（当时还没有电邮）之后，我们建立了联系。她

从机场接我和她一家人小住了几日。我们游玩沙滩，观看电影，还在一家优雅的餐厅用

餐。之后，她帮我收拾了学生生活所需的所有物品，包括卧室、厨房和学习用品，然后

把我送到了学校。

在乐观地对待生活并且关爱帮助他人时，为他们的伟大而感动。
