    AGRICULTURAL AIRCRAFT OPERATIONS

    1. DEFINITIONSThe terms in this part shall have the meaning allocated to the words in

    Part 1 of these regulations.

    CERTIFICATION RULES

    2. CERTIFICATE REQUIRED

    (a) Except for helicopter external-load operators certificatedunder this Part conducting operations provided inparagraph (c) of this Section, no person shall conductagricultural aircraft operations without, or in violation of,

    an Agricultural Aircraft Operator Certificate issued underthis Part.

    (b) An operator may, if it complies with this Part, conductagricultural aircraft operations using a helicopter withexternal dispensing equipment in place without ahelicopter external-load operator certificate.

    (c) The holder of a helicopter external-load operatorscertificate under this Part may conduct an agriculturalaircraft operation involving only the dispensing of water on

    forest fires by helicopter external-load means.

    (d). In a public emergency, a person conducting agriculturalaircraft operations under this Part may, to the extentnecessary, deviate from the operating rules of this Part forrelief and welfare activities approved by an agency of theFederal, State or a Local government.

    (e) Each person who, under the authority of this section,deviates from a rule of this Part shall, within 3 days afterthe deviation send to the Authority a complete report of

    the aircraft operation involved, including a description ofthe operation and the reasons for it.

    3. APPLICATION FOR CERTIFICATE

    An applicant for an Agricultural Aircraft Operator Certificate shallapply in a form and in a manner prescribed by the Authority.

    4. ISSUANCE OF A CERTIFICATE

    (1) The Authority shall issue a Private Agricultural Aircraft OperatorCertificate to an applicant who meets the Requirements of thisPart for that certificate.

    (2) The Authority shall issue a Commercial Agricultural AircraftOperator Certificate to an applicant who meets the Requirementsof this Part for that certificate.

    (3) An applicant for an Agricultural Aircraft Operator Certificatecontaining a prohibition against the dispensing of economicpoisons is not required to demonstrate knowledge specific toeconomic poisons.

    5. AMENDMENT OF CERTIFICATE

    (1) An agricultural aircraft operator certificate may beamended:

    (a) on the Authoritys own initiative; or

    (b) upon application by the holder of that certificate.

    (2) A certificate holder shall submit an application to amendan Agricultural Aircraft Operator Certificate in a form andmanner prescribed by the Authority. The applicant shallfile the application at least 15 days before the date that itproposes the amendment to become effective.

    *(3) The Authority shall grant a request to amend a certificate

    if it determines that safety and public interest so allow.

    (4) Within 30 days after receiving a refusal to amend, theholder may petition the Authority to reconsider the refusal.

    6. CERTIFICATION REQUIREMENTS

    (a) Pilots.

    (1) A private operator-pilot applicant shall hold a current

    Nigerian private, commercial, or airline transport pilotlicence and be properly rated for the aircraft to be used.

    (2) A commercial operator-pilot applicant shall hold, or haveavailable the services of at least one pilot who holds acurrent commercial or airline transport pilot licence issuedby the Authority and who is properly rated for the aircraftto be used.

    (b) Aircraft.

    The applicant shall have at least one certificated and airworthyaircraft, equipped for agricultural operation.

    (c) Knowledge and skill tests.

    The applicant shall show that it has satisfactory knowledge andskill for the following agricultural aircraft operations:

    (1) Knowledge:

    (i) Steps to be taken before starting operations,

    including a survey of the area to be worked.

    (ii) Safe handling of economic poisons and the properdisposal of used containers for those poisons.

    (iii) The general effects of economic poisons andagricultural chemicals on plants, animals, andpersons, and the precautions to be observed in usingpoisons and chemicals.

    (iv) Primary symptoms of poisoning of persons from

    economic poisons, the appropriate emergencymeasures to be taken, and the location of poisoncontrol centres.

    (v) Performance capabilities and operating limitations ofthe aircraft to be used.

    (vi) Safe flight and application procedures.

    (2) Skill in the following manoeuvres, demonstrated at theaircrafts maximum certificated take-off mass or themaximum mass established for the special purpose load,whichever is greater:

    (i) Short-field and soft-field takeoffs foraeroplanes and gyroplanes only.

    (ii) Approaches to the working area.

    (iii) Flare-outs.

    (iv) Swath runs.

    (v) Pull ups and turn arounds.

    (vi) Rapid deceleration or quick stops inhelicopters only.

    7. DURATION OF CERTIFICATE

    An Agricultural Aircraft Operator Certificate is effective for aperiod as specified in Schedule 12 to these Regulations or until itis surrendered, suspended, or revoked.

    8. OPERATING RULES

    (1) GENERAL

    (a) Except as provided in paragraph (c) of thissubsection, this section prescribes rules that applyto persons and aircraft used in agricultural aircraftoperations conducted under this Part.

    (b) The holder of an Agricultural Aircraft Operator

    Certificate may deviate from the provisions of Part 9of these Regulations without a certificate of waiverwhen conducting aerial work operations related toagriculture, horticulture, or forest preservation inaccordance with the operating rules of this section.

    (c) The operating rules of this Part apply to HelicopterExternal Load Certificate holders conducting

    agricultural aircraft operations involving only thedispensing of water on forest fires by helicopterexternal-load means.

    (2) CARRYING OF CERTIFICATE

    (a) No person may operate an aircraft unless a copy ofthe Agricultural Aircraft Operator Certificate iscarried on that aircraft.

    (b) The Registration and Airworthiness Certificatesissued for the aircraft need not be carried in theaircraft provided that those certificates not carriedin the aircraft shall be kept available for inspectionat the base from which the dispensing operation is

    conducted.

    (3) LIMITATIONS ON PRIVATE AGRICULTURAL AIRCRAFT OPERATOR

    No person shall conduct an agricultural aircraft operationunder the authority of a private Agricultural AircraftOperator Certificate:

    (a) for hire or reward

    (b) over a congested area; or

    (c) over any property unless he or she is the owner orlessee of the property, or has ownership or otherproperty interest in the crop located on theproperty.

    (4) MANNER OF DISPENSING

    No person shall dispense, or cause to be dispensed, any

    material or substance in a manner that creates a hazard topersons or property on the surface.

    (5) ECONOMIC POISON DISPENSING

    (a) Except as provided in paragraph (b) of this section,no person may dispense or cause to be dispensed,any economic poison that is registered in Nigeria

    (i) For a use other than that for which it isregistered;

    (ii) Contrary to any safety instructions or uselimitations on its labels; or

    (iii) In violation of any law or regulation ofNigeria.

    (b) This section does not apply to any person dispensing

    economic poison for experimental purposes under:

    (i) the supervision of a Nigerian agency authorisedby law to conduct research in the field ofeconomic poisons; or

    (ii) a permit from Nigeria.

    (6) PERSONNEL

    (a) Information:

    The holder of an Agricultural Aircraft OperatorCertificate shall ensure that each person used in theholders agricultural aircraft operation is informed ofhis or her duties and responsibilities.

    (b) Supervisors:

    No person may supervise an agricultural aircraftoperation unless he or she has met the knowledge

    and skill requirements of this Part.

    (c) Pilot in command:

    No person may act as Pilot-in-Command of anaircraft operated under this Part unless that pilot:

    (i) holds a pilot licence and rating prescribed bythis Part as appropriate to the type ofoperation conducted; and

    (ii) has demonstrated to the holder of the

    Agricultural Aircraft Operator Certificateconducting the operation, or to a supervisordesignated by that certificate holder, that heor she possesses the knowledge and skillrequirements of this Part.

    (7) OPERATIONS IN CONTROLLED AIRSPACE DESIGNATED FOR AN AIRPORT

    (a) Except for flights to and from a dispensing area, noperson shall operate an aircraft within the lateral

    boundaries of the surface area of Class D airspacedesignated for an airport unless authorisation forthat operation has been obtained from the ATCfacility having jurisdiction over that area.

    (b) No person may operate an aircraft in weatherconditions below VFR minima within the lateralboundaries of a Class E airspace area that extendsupward from the surface unless authorisation forthat operation has been obtained from the ATCfacility having jurisdiction over that area.

    (c) A certificate holder may operate an aircraft underspecial VFR weather minima without meeting therequirements prescribed in Part 9 of theseRegulations.

    (8) OPERATION OVER CONGESTED AREAS: GENERAL

    (a) A certificate holder may operate or cause theoperation of an aircraft over a congested area at

    altitudes required if the operation is conductedwith:

    (i) the maximum safety to persons and propertyon the surface, consistent with the operation;and

    (ii) a plan for each operation submitted andapproved by the Authority, which includes:

    (a) Obstructions to flight;

    (b) Emergency landing capabilities of theaircraft to be used; and

    (c) Any necessary co-ordination with airtraffic control.

    (b) Each certificate holder shall ensure that all aircraftoperations are conducted in compliance with theprovisions of paragraph (a) above when operatingover congested areas.

    (9) OPERATION OVER CONGESTED AREAS:PILOTS AND AIRCRAFT

    (a) Pilots:

    Each Pilot-in-Command must have at least:

    (1) 25 hours of Pilot-in-Command flight time inthe make and basic model of the aircraft,including at least 10 hours within thepreceding 12 calendar months; and

    (2) 100 hours of flight experience as Pilot-in-Command in dispensing agricultural materialsor chemicals.

    (b) Aircraft:

    Except for helicopters, each aircraft shall be capableof jettisoning at least one-half of the aircraftsmaximum authorised load of agricultural materialwithin 45 seconds. If the aircraft is equipped to

    release the tank or hopper as a unit, there shall be ameans to prevent inadvertent release by the pilot orother crew member.

    (10) AVAILABILITY OF CERTIFICATE

    Each holder of an Agricultural Aircraft Operator Certificateshall keep that certificate at its home base and shallpresent it for inspection by authorised officers of the

    Authority.

    9. RECORDS AND REPORTS

    (1) RECORDS:COMMERCIAL AGRICULTURAL AIRCRAFT OPERATOR

    (a) Each holder of a Commercial Agricultural AircraftOperator Certificate shall maintain and keepcurrent, at the home base designated in itsapplication, the following records:

    (i) The name and address of each person forwhom agricultural aircraft services wereprovided;

    (ii) The date of the service;

    (iii) The name and quantity of the materialdispensed for each operation conducted; and

    (iv) The name, address, and certificate number of

    each pilot used in agricultural aircraftoperations and the date that the pilot met theknowledge and skill requirements of this Part.

    (b) The records required by this section must be kept forat least 12 months.

    (2) CHANGE OF ADDRESS

    Each holder of an Agricultural Aircraft Operator Certificateshall notify the Authority in writing in advance of anychange in the address of its home base of operations.

    (3) TERMINATION OF OPERATIONS

    Whenever a certificate holder ceases operations under thisPart, he or she shall surrender that certificate to theAuthority.

    10. HELICOPTER EXTERNAL LOADS

    1. The following are exempted from the provision of this Part

    (a) Helicopter manufacturers when developing external-loadattaching means;

    (b) Operations conducted by a person demonstratingcompliance for the issuance of a certificate or

    authorisation under this Part;

    (c) Training flights conducted in preparation for thedemonstration of compliance with this Part; or

    (d) Federal, State or Local Government Agencies conductingoperations with public aircraft.

    2. For the purpose of this Part, a person other than a crew memberor a person who is essential to, and directly connected with theexternal-load operation shall be carried only in approved Class D

    helicopter-load combinations.

    11. CERTIFICATIONRULES

    (1) CERTIFICATE REQUIRED

    No person subject to this Part shall conduct helicopterexternal-load operations without, or in violation of theterms of a Helicopter External-Load Operator Certificate orequivalent authorisation issued by the Authority.

    (2) DURATION OF CERTIFICATE

    Unless surrendered, suspended, or revoked, a HelicopterExternal-Load Operator Certificate expires at the end of thevalidity period specified in Schedule 12 to these Regulations.

    (3) APPLICATION FOR CERTIFICATE ISSUANCE OR RENEWAL

    The application for an initial certificate or renewal of acertificate issued under this Part shall be made in a form,

    and manner, prescribed by the Authority.

    (4) REQUIREMENTS FOR ISSUANCE OF A HELICOPTER EXTERNAL-LOADOPERATOR CERTIFICATE

    (a) If an applicant shows that it complies with this Part,the Authority will issue a Helicopter External-LoadOperator Certificate to it.

    (b) The Authority will issue authorisation to operatespecified helicopters with those classes of

    helicopter-load combinations for which the applicantor certificate holder qualifies under the applicableprovisions of this Part.

    (5) HELICOPTER

    An applicant must have the exclusive use of at least onehelicopter that:

    (a) was type certificated under, and meets the

    requirements of, the pertinent Parts of theseRegulations, which prescribe requirements forhelicopter external-load operations;

    (b) complies with the certification provisions in this Partthat apply to the helicopter-load combinations forwhich authorisation is requested; and

    (c) has a valid Certificate of Airworthiness.

    (6) PERSONNEL

    (a) An applicant shall hold, or have available, theservices of at least one person who holds a currentCommercial or Airline Transport Pilot Licence issuedby the Authority with a rating appropriate for thehelicopter to be used.

    (b) An applicant shall designate one pilot, who may bethe applicant, as Chief Pilot for helicopter external-load operations.

    (c) An applicant may designate qualified pilots as

    assistant chief pilots to perform the functions of thechief pilot when the Chief Pilot is not readilyavailable.

    (d) The Chief Pilot and Assistant Chief Pilots must beacceptable to the Authority and each must hold acurrent Commercial or Airline Transport PilotLicence, with a rating appropriate for the helicopterto be used.

    (e) The holder of a Helicopter External-Load Operator

    Certificate shall report any change in designation ofChief Pilot or Assistant Chief Pilot immediately tothe Authority.

    (f) A newly designated Chief Pilot shall comply with theknowledge and skill requirements of this Part within30 days or the operator may not conduct furtheroperations under the Helicopter External-LoadOperator Licence, unless otherwise authorised bythe Authority.

    (7) AMENDMENT OF CERTIFICATE

    (a) The holder of a Helicopter External-Load Certificatemay apply to the Authority for an amendment of itscertificate, to add or delete a helicopter-loadcombination authorisation.

    (b) The holder of a Helicopter External-Load Certificatemay apply for an amendment to add or delete ahelicopter authorisation by submitting to the

    Authority a new list of helicopters, by registrationnumber, with the classes of helicopter-loadcombinations for which authorisation is requested.

    (8) AVAILABILITY,TRANSFER, AND SURRENDER OF CERTIFICATE

    (a) Each person conducting a helicopter external-loadoperation shall carry a copy of the HelicopterExternal-Load Operator Certificate in each

    helicopter used in the operation.

    (b) A certificate holder shall return his or hercertificate to the Authority:

    (i) If the Authority suspends or revokes itsHelicopter External-Load OperatorCertificate; or

    (ii) If the certificate holder discontinuesoperations and does not resume operations

    within two years.

    12. OPERATING RULES AND RELATED REQUIREMENTS

    (1) OPERATING RULES

    (a) No person shall conduct a helicopter external loadoperation without, or contrary to, theHelicopter/Load Combination Flight Manual

    prescribed in Part 5 of these Regulations.

    (b) No person shall conduct a helicopter external loadoperation unless:

    (i) The helicopter complies with theRequirements in Part 5 of these Regulations.

    (ii) The helicopter and helicopter/loadcombination is authorised under theHelicopter External Load Operator Certificate.

    (c) Before a person may operate a helicopter with anexternal load configuration that differs substantiallyfrom any that person has previously carried out withthat type of helicopter whether or not thehelicopter/load combination is of the same class,that person shall conduct, in a manner that will notendanger persons or property on the surface, such of

    the following flight operational checks as theAuthority determines are appropriate to thehelicopter/load combination:

    (i) A determination that the weight of the

    helicopter/load combination and the locationof its centre of gravity are within approvedlimits, that the external load is securelyfastened, and that the external load does notinterfere with devices provided for itsemergency release.

    (ii) Make an initial lift-off and verify thatcontrollability is satisfactory.

    (iii) While hovering, verify that directional control

    is adequate.

    (iv) Accelerate into forward flight to verify thatno attitude, whether of the helicopter or ofthe external load, is encountered in which thehelicopter is uncontrollable or which isotherwise hazardous.

    (v) In forward flight, check for hazardousoscillations of the external load, but if theexternal load is not visible to the pilot, other

    crew members or ground personnel may makethis check and signal the pilot.

    (vi) Increase the forward airspeed and determinean operational airspeed at which no hazardousoscillation or hazardous aerodynamicturbulence is encountered.

    (d) Notwithstanding the provisions of Part 8 of theseRegulations, the holder of a Helicopter External LoadOperator Certificate may conduct helicopter

    external load operations over congested areas ifthose operations are conducted without hazard topersons or property on the surface and comply withthe following:

    (i) The operator shall develop a plan for eachcomplete operation and obtain approval forthe operation from the Authority.

    (ii) Each flight shall be conducted at an altitude,and on a route, that will allow a jettisonableexternal load to be released, and thehelicopter landed, in an emergency without

    hazard to persons or property on the surface.

    (e) Notwithstanding the provisions of Part 8 of theseRegulations, and except as provided in this Part, theholder of a Helicopter External Load OperatorCertificate may conduct external load operations,including approaches, departures, and loadpositioning manoeuvres necessary for the operation,below 500 feet above the surface and closer than500 feet to persons, vessels, vehicles, andstructures, if the operations are conducted without

    creating a hazard to persons or property on thesurface.

    (f) No person shall conduct helicopter external loadoperations under IFR unless specifically approved bythe Authority.

    (2) CARRIAGE OF PERSONS

    (a) No AOC holder shall allow a person to be carried

    during helicopter external load operations unlessthat person:

    (i) is a flight crew member;

    (ii) is a flight crew member trainee;

    (iii) performs an essential function in connectionwith the external load operation; or

    (iv) is necessary to accomplish the work activity

    directly associated with that operation.

    (b) The PIC shall ensure that all persons are briefedbefore takeoff on all pertinent procedures to befollowed, including normal, abnormal, andemergency procedures and equipment to be usedduring the external load operation.

    (3) CREW MEMBER TRAINING,CURRENCY AND TESTING REQUIREMENTS

    (a) No certificate holder shall use, nor may any personserve as a pilot in helicopter external load

    operations unless that person:

    (i) has successfully demonstrated to theAuthority the knowledge and skill with respectto the helicopter/load combination; and

    (ii) has in his or her personal possession a letterof competency or an appropriate logbookentry indicating compliance with paragraph(a)(i) of this subsection.

    (b) No AOC holder may use, nor may any person serveas, a crew member or other operations personnel inClass D operations unless, within the preceding 12calendar months, that person has successfullycompleted either an approved initial or a recurrenttraining programme.

    (c) Notwithstanding the provisions of paragraph (b) ofthis subsection, a person who has performed ahelicopter external load operation of the same classand in an aircraft of the same type within the past

    12 calendar months need not undergo recurrenttraining.

    13. AIRWORTHINESS REQUIREMENTS

    (1) FLIGHT CHARACTERISTICS REQUIREMENTS

    (a) The applicant must demonstrate to the Authority, byperforming the following operational flight checksthat the helicopter-load combination has satisfactory

    flight characteristics, unless these operational flightchecks have been demonstrated previously and thehelicopter-load combination flight characteristicswere satisfactory. For the purposes of thisdemonstration, the external-load mass including theexternal-load attaching means is the maximum massfor which authorisation is requested.

    (b) Class A helicopter-load combinations:

    The operational flight check must consist of at leastthe following manoeuvres:

    (i) Take off and landing.

    (ii) Demonstration of adequate directional controlwhile hovering.

    (iii) Acceleration from a hover.

    (iv) Horizontal flight at airspeeds up to themaximum airspeed for which authorisation isrequested.

    (c) Classes B and D helicopter-load combinations:

    The operational flight check must consist of at leastthe following manoeuvres:

    (i) Pickup of the external load.

    (ii) Demonstration of adequate directional controlwhile hovering.

    (iii) Acceleration from a hover.

    (iv) Horizontal flight at airspeeds up to themaximum airspeed for which authorisation isrequested.

    (v) Demonstration of appropriate lifting deviceoperation.

    (vi) Manoeuvring of the external load into releaseposition and its release, under probable flightoperation conditions, by means of each of the

    quick-release controls installed on thehelicopter.

    (d) Class C helicopter-load combinations:

    For Class C helicopter-load combinations used inwire-stringing, cable-laying, or similar operations,the operational flight check must consist of the

    manoeuvres, as applicable, prescribed in paragraph(c) of this subsection.

    (2) STRUCTURES AND DESIGN

    (a) External-load attaching means:

    Each external-load attaching means shall beapproved by the Authority.

    (b) Quick release devices:

    Each quick release device shall be approved by theAuthority.

    (c) Mass and centre of gravity:

    (i) Mass.

    The total mass of the helicopter-loadcombination must not exceed the total massapproved for the helicopter during its typecertification.

    (ii) Centre of gravity.

    The location of the centre of gravity must, forall loading conditions, be within the rangeestablished for the helicopter during its typecertification. For Class C helicopter-loadcombinations, the magnitude and direction ofthe loading force must be established at thosevalues for which the effective location of thecentre of gravity remains within itsestablished range.

    (3) OPERATING LIMITATIONS

    In addition to the operating limitations specified in theapproved Helicopter Flight Manual, and to any otherlimitations the Authority may prescribe, the operator shallestablish at least the following limitations and specify themin the Helicopter-Load Combination Flight Manual forhelicopter-load combination operations:

    (a) The helicopter-load combination may be operatedonly within the mass and centre of gravitylimitations established in accordance with this Part.

    (b) The helicopter-load combination may not beoperated with an external load weight exceedingthat used in showing compliance with this Part.

    (c) The helicopter-load combination may not beoperated at airspeeds greater than those establishedin accordance with this Part.

    (d) The helicopter-load combination of Class D may beconducted only in accordance with the following:

    (i) The helicopter to be used must have beentype certificated under transport Category Afor the operating mass and provide hovercapability with one engine inoperative at thatoperating mass and altitude.

    (ii) The helicopter must be equipped to allowdirect radio intercommunication amongrequired crewmembers.

    (iii) The personnel-lifting device must be approved

    by the Authority.

    (iv) The lifting device must have an emergencyrelease requiring two distinct actions.

    (4) HELICOPTER-LOAD COMBINATION FLIGHT MANUAL

    The applicant must prepare a Helicopter-Load CombinationFlight Manual and submit it for approval by the Authority.The limiting height-speed envelope data need not be listed

    as operating limitations. The manual shall specify:

    (a) The operating limitations, normal and emergencyprocedures, performance and other informationestablished under this Part;

    (b) The class of helicopter-load combinations for whichthe airworthiness of the helicopter has beendemonstrated in accordance with this Part; and

    (c) In the information section of the Helicopter-Load

    Combination Flight Manual:

    (i) Information on any peculiarities discoveredwhen operating particular helicopter-loadcombinations;

    (ii) Precautionary advice regarding staticelectricity discharges for Class B, Class C, andClass D helicopter-load combinations; and

    (ii) Any other information essential for safe

    operation with external loads.

    (5) MARKINGS AND PLACARDS

    The following markings and placards must be displayedconspicuously and must be such that they cannot be easilyerased, disfigured, or obscured:

    (a) A placard displayed in the cockpit or cabin statingthe class of helicopter-load combination and the

    occupancy limitation for which the helicopter hasbeen approved.

    (b) A placard, marking, or instruction displayed next tothe external-load attaching means stating themaximum external load approved.

    (6) AIRWORTHINESS CERTIFICATION

    A Helicopter External-Load Operator Certificate holder

    shall have a current and valid Certificate of Airworthinessfor each helicopter type listed by registration number on alist attached to the certificate, when the helicopter isbeing used in operations conducted under this Part.

    GLIDER TOWING

    14. CERTIFICATE REQUIRED

    No person shall act as a tow pilot for a glider unless that person

    has at least a Private Pilot Licence with a category rating for thetow aircraft.

    15. AIRCRAFT REQUIREMENTS

    No person shall operate an aircraft that is towing a glider unlessthe aircraft is equipped with a tow hook and release controlsystem that meet the applicable standards of airworthiness.

    16. EXPERIENCE AND TRAINING REQUIREMENTS

    No person shall act as a tow pilot for a glider unless that personhas:

    (1) logged at least 100 hours of Pilot-in-Command time in thesame aircraft category, class, and type, as the tow aircraft;

    (2) received training in and instructor endorsement for:

    (a) the techniques and procedures essential to the safetowing of gliders, including airspeed limitations;

    (b) emergency procedures;

    (c) signals used; and

    (d) maximum angles of bank.

    (3) Completed and had endorsed at least three flights as thesole manipulator of the controls of an aircraft towing aglider or simulating glider-towing flight procedures whileaccompanied by a pilot who meets the requirements of this

    section; and

    (4) Within the preceding 12 months has:

    (a) made at least three actual glider tows; or

    (b) made at least three flights as Pilot-in-Command of aglider towed by an aircraft.

    BANNER TOWING

    17. CERTIFICATE OR AUTHORISATION REQUIRED

    (1) The Authority shall require each person conductingoperations covered by this Part to hold a certificate orequivalent authorisation.

    (2) The Authority shall issue a certificate or authorisation toeach applicant who qualifies for it under the provisions ofthis Part.

    (3) A helicopter operating under the provision of this Part maytow a banner using an external-load attaching meanswithout a certificate only if the operator has at least a

    Class B authorisation on his or her Operating Certificate.

    18. AIRCRAFT REQUIREMENTS

    (1) No person shall operate an aircraft that is towing a bannerunless the aircraft is equipped with a tow hook and releasecontrol system that meet the applicable standards ofairworthiness.

    (2) No person shall operate a helicopter that is towing a

    banner unless the helicopter has a means to prevent thebanner from becoming entangled in the helicopters tailrotor during all phases of flight, including auto rotations.

    19. EXPERIENCE AND TRAINING REQUIREMENTS

    (1) For non-commercial flights, the pilot of the tow aircraftshall hold at least a valid Private Pilot Licence and have aminimum of 200 hours PIC time.

    (2) When banner towing operations are conducted for hire orreward, the pilot shall have at least a Commercial PilotLicence, and at least a valid Class two medical certificate.A current Instrument Rating is not required.

    (3) All pilots engaged in banner towing operations shalldemonstrate competence to the Authority by performing at

    least one pickup and drop of the maximum number ofletter panels to be used by the certificate holder.

    20. OPERATING RULES

    (1) All banner tow operations shall be conducted only:

    (a) in VFR weather conditions; and

    (b) between the hours of sunrise and sunset.

    (2) No person shall conduct banner towing operations:

    (a) at a height not lower than 1,000 feet overcongested areas or open air assemblies of persons ;

    and

    (b) elsewhere lower than the minimum safe altituderequirements of Part 8 of these Regulations.

    (3) The certificate holder shall notify the air traffic serviceprovider of his or her intention to conduct each bannertowing operation.

    (4) Only essential crew members shall be carried whenconducting banner tow operations.

    (5) When banner tow operations are conducted aroundcongested areas, the pilot shall exercise due care so that,in the event of emergency release of the banner and/ortowrope, it will not cause undue hazard to persons orproperty on the surface.

    (6) Each pilot shall drop the towrope in a pre-designated areaat least 500 feet from persons, buildings, vehicles andaircraft.

    (7) Each pilot conducting banner towing operations shall carryonboard the aircraft a current copy of the Certificate ofAuthorisation allowing banner towing operations.

    SIGHT-SEEING FLIGHTS

    21. CERTIFICATE OR AUTHORISATION REQUIRED

    (1) The Authority shall require each person conductingoperations covered by this Part to hold a certificate orequivalent authorisation.

    (2) The Authority shall issue a certificate or authorisation toeach applicant who qualifies for it under the provisions ofthis Part.

    (3) Each operator under this Part shall hold an operatingcertificate issued under the provisions of Part 9 of theseRegulations.

    22. EXPERIENCE AND TRAINING REQUIREMENTS

    The Requirements of Part 9 of these Regulations apply to alloperations described by this Part.

    23. OPERATING RULES

    The Requirements of Part 9 of these Regulations apply to all

    operations described by this Part.

    FISH SPOTTING

    24. CERTIFICATE OR AUTHORISATION REQUIRED

    (1) The Authority will require each person conductingoperations covered by this Part to hold a certificate orequivalent authorisation.

    (2) The Authority will issue a certificate or authorisation toeach applicant who qualifies for it under the provisions ofthis Part.

    25. OPERATING RULES

    (1) Each operator shall conduct operations so as not toendanger persons or property on the surface nor aircraft in

    flight.

    (2) Minimum cloud clearance requirements and minimumaltitude Requirements of Part 9 of these Regulations do notapply to those persons to whom the Authority hasspecifically approved different minima as a part of anauthorisation under this Part.

    TRAFFIC REPORTING

    26. CERTIFICATE OR AUTHORISATION REQUIRED

    (1) The Authority will require each person conductingoperations covered by this Part to hold a certificate orequivalent authorisation.

    (2) The Authority will issue a certificate or authorisation toeach applicant who qualifies for it under the provisions ofthis Part.

    *TV AND MOVIE OPERATIONS

    27. CERTIFICATE OR AUTHORISATION REQUIRED

    (1) The Authority will require each person conductingoperations covered by this Part to hold a certificate orequivalent authorisation.

    (2) The Authority will issue a certificate or authorisation toeach applicant who qualifies for it under the provisions ofthis Part.

    (3) Each operator shall conduct operations so as not toendanger persons or property on the surface nor aircraft inflight.
