Comments From The Legal Community

I have been a member of Jenkins almost as long as I have been an attorney. I carry my Jenkins Law Library card right behind my "bar card" because they are so inextricably linked that I have found that one is no good without the other. Jenkins has enabled me to successfully oppose mortgage companies long before our government ever acknowledged that there was a "mortgage crisis." Working with the USDOJ, Patrick Meehan, Esquire (before he went to Washington and became Congressman Meehan), Jenkins provided the resources I needed to assist over 800 people (myself included) in regaining title to properties fraudulently converted by American Business Mortgage Services (ABFS, Upland Mortgage, ABC Credit). It was one of the most phenomenal efforts I have ever experienced and it was a success, in significant part, because of the equalizing power of my Jenkins Membership. We defeated some of the largest law firms over three to four years of extremely adversarial, contentious and demanding litigation‐‐this would have been IMPOSSIBLE without my Jenkins Membership. However, this does not begin to touch upon the countless victories and positive results made possible because Jenkins was my headquarters. Moreover, most of the people I service are low income and, for a small fee, Jenkins gives me the same power, knowledge and legal assistance wielded by the most prestigious law firms in the world. Jenkins has made me appear to be a one‐person army. However, the truth is, Jenkins' staff, resources and accommodations have helped to steer and power my twenty plus

(20+) years of law practice into a series of triumphs that have greatly impacted the lives of many people in our great city and beyond. I am eternally grateful and forever indebted to this great historic yet relevant institution. Jenkins Law Library levels the field in this challenging legal arena‐‐it is a powerhouse that enlightens and edifies anyone who is willing to spend time with the wealth of information It houses. Last but not least, the CLE classes are not only extremely affordable, but they are convenient, practical and informative‐‐they are the best CLE deal in this Commonwealth. Raymond Agran I am a sole practitioner who depends on Jenkins for essential research, preparation materials for general practice drafting, discovery and trial materials. I do a good deal of work for low income and immigrant clients with small businesses, real estate and will and estate questions. I am a member of the Florida bar, which require lawyers to indicate on the annual registration a minimum number of hours of pro bono work they completed the previous year. This might be another idea for encouraging us to do work for people who cannot afford a lawyer.

Every year, I decide whether it makes financial sense to join Jenkins, the PA Bar Association or the Philadelphia Bar Association. I choose Jenkins because it gives me the tools to help people. Bar Associations are useful networking tools and have great resources, but Jenkins is superior at empowering me to help people at the level I am able. Since I'm not making money helping clients, I can't afford to spend over $1,000 to join a law library, pay for legal research tools, and a bar association. My pro bono clients are people at the edge of the legal system. Without my help it is not clear that anyone would help them. I, too, am in some ways at the edge of the legal system. Losing resources at Jenkins would push me away from continuing to offer pro bono services.

Mason Apostol Jenkins Law Library is invaluable for research. As a solo attorney, I can't afford to have a big library, and I don't have space for it. Jenkins is a shining jewel in the Philadelphia bar, both for lawyers and for pro se litigants, in giving access to facilities usually only available in large firms and law schools to everybody else. Their funding is crucial for justice in the Philadelphia area. They also have great and affordable continuing education classes. As a solo attorney, Jenkins is essential for my research needs.

Juan Baez "We are a three lawyer firm that depends on the resources available to us through the Jenkins Law Library. That's especially true now that we have had to reduce costs after the loss of several major long‐time clients that moved their headquarters to the South and Southwest. For example, we subscribed to the BNA Tax Management Portfolio which costs @$7500 per year ‐ a substantial cost for a small firm. We have cancelled that subscription, and other less costly ones this year, and now rely on the tax and other materials and services provided to us through

our membership in Jenkins. A significant number of our remaining clients are non‐profit charitable organizations, among which is an international relief organization. Their combined revenues account for at least half of this firm's income. Most cannot afford to increase their legal fees. And we simply could not continue to represent them at our current rates if we were required to purchase the materials and services that Jenkins provides. Finally, I think it should be said that the librarians and other staff at Jenkins perform at a very high professional level. For us, it would be an incalculable loss if their services were not available. " Paul Bankes, Member of the Philadelphia Bar Association Jenkins is invaluable to me for secondary source research material David Barry As a service‐driven elder law practice, we sometimes find ourselves helping people of limited resources with legal issues outside of our comfort zone. Without Jenkins, we could not figure out how to help those clients. Some questions cannot be answered by Google: How to litigate a surcharge action in Orphans Court? Did a bank violate consumer protection statutes by telling a surviving spouse she is responsible for paying a mortgage against the marital home when she didn't sign the mortgage? Shrinking Jenkins will be a blow for fair access to legal justice because firms like mine will be less able to help those barely able pay for legal services. Jenkins allows small firm and solo practitioners access to information needed to stay up‐to‐date on the law. Providing adequate representation requires continual reading of the law. Without Jenkins it would have been much less likely that I could build a small practice because the cost of accessing legal materials is so high. Thank you, Jenkins, for helping me to build a practice I am proud of! Keelin Barry Jenkins provides vital research support to solos and small law firms. It is crucial that it receive adequate funding. As a small solo practitioner, I rely on Jenkins' data bases and materials for all my research needs. Without Jenkins, I could not prepare my briefs, motions, filings, etc. I also rely on Jenkins to provide many of my CLE credits. As a solo attorney, I rely on Jenkins for all my legal research. It is very important that Jenkins continues to provide its services to solos and small firms.

Dennis Bartholomew "I have a Pro Bono Practice. I use Jenkins Law Library services every day because it is particular to Philadelphia practice and the location of the library is centrally located between the federal,

state and county courts. All attorneys who practice in this city can avail themselves of the highest level of preparation for court using the Jenkins Law Library. If attorneys of all economic levels do not have access to the best resources, not to just adequately prepare, but to be able to prepare at the highest level of practice, then the citizenry as a whole suffers. Diminishing the fund for the library so that you can hire attorneys is illogical if you are not arming those attorneys with the best possible resources. Being the first law library in the country is definitely something that should be honored. Once destroyed or diminished, it cannot be rebuilt. I whole heartedly support the library. " I’m starting my own practice. Jenkins has been an invaluable tool in that process. Mary Catherine Baur "Yes, we get requests for books that we do not have in our library. Therefore we borrow many books throughout the year from Jenkins. They are also a good reference source when needed. We really need them." Camille Beattie I am a sole practitioner. The long and short of it is this: I truly need this library in order to continue practicing law. Patrick Beattie As a solo practitioner when I was still doing litigation I relied upon Jenkins for all my research both for precedents and applicable statutory laws and authorities.

Joel Beaver, Member of the Philadelphia Bar Association I have been an attorney for over 40 years having been admitted to the bar in 1976. For most of the time I have practiced as a small Corporation with one or two part‐time associates at any given time. Over the years I have done some pro bono work and substantial amounts of limited fee work. A major portion of my continuing legal education has been provided by Jenkins Law Library membership continuing legal education classes. I do substantial amounts of civil rights law, all of which would be vastly more difficult or impossible without the support of Jenkins Law Library and membership therein. Many of my clients would be unable to afford the level of representation I provided were Jenkins unable to provide the support it has provided me in the past. Before I became a lawyer, I used Jenkins for several of my own cases, one of which lasted for 9 years. I have used Jenkins daily since it began offering Fastcase, and a number of databases that small firms would be unable to afford on their own. There are limited resources for pro se litigants to seek justice on their own and Jenkins is the primary source. Their CLE's are important for many of us. Save Jenkins

Jenkins Law Library is the only repository I know of where all Philadelphia City Solicitor Opinion books are available and can be researched electronically through term searches. This is invaluable to attorney's practicing in the Philadelphia City Solicitors Office. For example, as the City Solicitor assigned to counsel the Philadelphia Art Commission, I can research all formal opinions and memorandums of legal advice (MLAs) advising on the powers of the Commission throughout the years since adoption of the Philadelphia Home Rule Charter in 1951. The City Solicitor's Office recently discarded its collection of City Solicitor Opinion books in reliance on the availability of this collection at Jenkins Law Library. Although this body of law may not be of interest to the average general practitioner, as a unique repository of local Philadelphia government law, I hope that I will continue to have access to Jenkins Law Library's collection of Philadelphia City Solicitor Opinion books as it serves as a valuable resource for a local municipal government attorney like me. As law firms and government legal offices downsize and digitize their law libraries, Jenkins Law Library remains the one, single source where a Philadelphia area attorney can obtain professional, personal service for in depth legal research. For example in my municipal government practice for the City of Philadelphia, City Solicitor opinions over many years that touch upon esoteric subjects (like the jurisdiction of the Art Commission over commercial signage proposed to be located over a City Sidewalk) can be easily found at Jenkins. Don't let this valuable resource die.

Harry Begier As a solo‐practitioner, the Jenkins Law Library is the only reason I am able to have a practice. My clients depend on me to advise them on the current issues of the law. Jenkins gives me the opportunity to zealously and effectively represent my clients. I need Jenkins resources: their books and their Lexis and Westlaw computer‐access to effectively and efficiently perform my job as an attorney.

Mijrane Belizaire I have a subscription for case law research but rely on Jenkins for journals, monographs, and specialized treatises. There is really no other equivalent source. I have had the research librarians undertake detailed research and have used the interlibrary loan service. I have also used the library for very specialized local research in municipal law that is not available anywhere else. I have run out of the federal courthouse during trials to research some point that came up in argument. I have taken a few CLE courses at the facility. Many of the texts and periodicals available at the library are not available on my firm's online research subscription. For example, unless a firm subscribes to both Westlaw and Lexis, which is largely wasteful, one has access only to the Patry or the Nimmer copyright treatise. They are very different. The same point could be made for most subject areas. The availability of periodicals is especially spotty on the online subscriptions. When looking at an unfamiliar area

of law, going to the shelves and looking at subject‐organized material is often the best way to get a handle on a topic. Jenkins' assemblage of the yellow PBI publications, otherwise unavailable, is especially helpful on subject peculiar to Pennsylvania law. More generally, a profession in one of the world's great cities should have a research resource.

Sarah Bennett As a small/solo legal practitioner Jenkins is vital to my practice of law. I rely on the library's resources on a regular basis. From research, to CLE's to secondary sources, i use Jenkins in many different ways. If Jenkins loses funding it will be a huge blow to my practice of law and the legal community at large.

David Bercovitch I use the reference librarians. It's a small practice, myself and one associate. I don't have Lexis or Westlaw or anything like that. I use my membership to do legal research. I use the reference staff to copy case and assist me, and pull administrative code for NJ and PA practice and I utilize, especially for NJ administrative code / statutes / case law. It would be a real problem to not have Jenkins around. Edward Berger For sole and small practice attorneys, the Jenkins Law Library is indispensable. Jenkins provides an affordable option for legal research and related resources. Many years ago, when I was court appointed counsel in Philadelphia, Jenkins was a critical resource for me. The proposition that diverting Jenkins funding to increase financial support for indigent client representation while potentially eliminating a critical asset for those who represent many indigent clients is quite absurd and clearly not well thought out. I urge my colleague at the Philadelphia Bar Association to take a very careful look at this issue before supporting the proposed legislation. Paul Birden I have worked with Jenkins since moving to the Philadelphia metro area in 2004 to find and obtain for use as trial exhibits, legal and medical materials that were either unfindable or unreachable. Their research staff is like nothing I have ever seen before. Vital, unique, efficient, reasonably‐priced. If they were gone, there would be a huge void in the legal community of Philadelphia. I am a paralegal who has worked for plaintiffs' mass torts firms in Philadelphia and currently works for a defense firm in center city. Virginia Bishop We use Jenkins when we need a reference that no other entity has, which these days includes pretty much any reference that is in book form. They are a unique, valuable, irreplaceable resource that should not be taken for granted. Jenkins also reaches out to other libraries so that our staff doesn't have to go on a wild goose chase to find something. Please rethink this legislation, which does not take care of any specific entity's needs. Samuel Carter There is absolutely no way a solo or very small firm may compete with big law attorneys without the resources and lower charges of Jenkins Law Library. If Jenkins were to not exist, I would imagine that many, many small practices and solo practitioners will go out of business. The charges for the Jenkins resources, including but not limited to, Lexis and Westlaw, are exorbitant. Further, the average cost of a CLE class is very high, and Jenkins has the lowest price option. In short, Jenkins is the only way that the "playing field" can even begin to be somewhat leveled between the resources of big law and the rest of us. Carol Carty As a sole practitioner primarily representing indigent families, I rely on Jenkins for quality research which I can afford. Thomas Caruso I am a lifelong law librarian, and have depended on Jenkins to provide legal resources to all of the organizations at which I have worked ‐‐ a federal library, a law firm library, and a nonprofit. Our legal community could not survive with the stellar service and archived materials that Jenkins provides. Without this service operating at full capacity, our practice in representing individuals and business entities would be significantly impaired. Through Jenkins, we have centralized access to print and other research tools which otherwise would be cost prohibitive.

They provide one of the only access points for legal information for general citizens of Philadelphia (who can pay a nominal fee to use the library for a day) since the Philadelphia courts library is not open to the public. Cutting their funding so drastically would eliminate these vital services provided by what I believe is the oldest law library in the country. Lori Corso Jenkins is a superb resource which I, as a sole practitioner, utilize on a frequent basis in representing my clients. The loss of the library, or a substantial reduction in the materials and services it supplies, would prove utterly frustrating to my practice of law. As a solo practitioner, I depend on Jenkins Law Library mostly to keep overhead expenses low, so that I can continue to provide legal services to clients who would not be able to afford to retain a medium or large firm. On fee shifting consumer cases, their issues are often considered too small or the opposing side's pockets not deep enough for a larger firm to see the case as worthwhile. Yet, these consumers are harassed by debt collectors, even without owing, and would otherwise go without help. This population relies on solo practitioners and small firms to work with their budgets or take matters with the potential for only a small pay off. Jenkins also makes basic legal research available to the general public ‐ non‐lawyers ‐ who are performing research in order to attain professional, personal or educational goals or projects. I would suggest the reason for the steadfast high quality of legal services in Philadelphia was because of Jenkins Law Library. At the beginning of my career I served as court appointed counsel in Municipal Court, The Court of Common Pleas, and for juveniles in Family Court. I also served in the Dependency Branch of Family Court. Any fee paid to me at that time would have been meaningless without the facilities of Jenkins Law Library to provide the resources necessary to competently represent indigent clients. Jenkins gave me the resources to research motions, to familiarize myself with every aspect of the law, of my obligations under the Code of Professional Responsibility, and to efficiently operate a law office to that I could keep afloat despite the small fee paid for representing indigent clients. That also indirectly served the interest of the judges to provide a high quality of justice with knowledge of all the law pertaining to the case before them. I now use my accounting and legal skills to represent the elderly. I can do so at a reasonable fee, and also perform some pro‐bono work, only because I have the resources of Jenkins Law Library available to me. As the elderly population of the county increases, this is just as important as representation of indigent defendants. I am currently working with a nurse practitioner to give a pro‐bono presentation to other medical professionals about elder abuse ‐ how to recognize it and what to do about it. I used

the facilities of Jenkins, including the databases, to collect the information needed to give the presentation. I am also working on another pro‐bono presentation to accountants, attorneys, and investment advisors on Advance Medical Directives. I could not have produced the presentation without the resources at Jenkins Law Library. Jenkins Law Library is not a luxury service. In order to reach Jenkins one must be willing to leave the comfort of the office and visit the facility to do a good job. It serves attorneys and the general public willing to make the extra effort to do a good job. Legal services without Jenkins would be like a court system without computers. I have also, both before and after retiring, used the "Ask a Librarian" service on occasion when I have not been able to find my answers using the online resources and the Librarians at Jenkins are terrific. They are responsive, find answers quickly, and are a pleasure to deal with. Indeed, I presently live in southern Virginia in an area which has no reasonably accessible law library. Without Jenkins, I would be unable to assist family and friends with their legal issues. In addition, I am working on the initial material for a blog on the Constitution and what its authors meant to achieve by various clauses relevant to current events, The Elephant Under the Rug, (which I intend to release publicly shortly, after I have enough content to publish the inaugural material. I rely on Jenkins' online resources for researching many of the issues about which I write. It would be a tragedy were Jenkins to lose any of its funding as solo practitioners simply do not have the same financial resources as large firms. Without Jenkins, it would be difficult for the many individuals who cannot afford the services of large law firms, with their added overhead expenses, to find affordable legal representation which would have a very negative impact on our justice system and society in general. Please do nothing to reduce Jenkins funding!!!! Let me start with a bit about my background related to the practice of law. In 1985‐86, I was the Law Clerk to the Chief Justice of the Delaware Supreme Court. After that, I worked at one of the top firms in Wilmington, Delaware, and a spinoff from that firm. Needless to say, all those years, I had access to the best legal research tools available. Subsequently, I moved to Pennsylvania, where I was a solo practitioner for many years. (I am now retired, living in Virginia.) It is almost impossible for me to list all the ways Jenkins Law Library ("Jenkins") has, helped me. As a solo litigation practitioner with a practice, Jenkins' incredible array of online research portals and the Jenkins' Librarians research assistance, it was possible for me to draft briefs, pleadings, and other documents reflecting the breadth and depth of research to which I had become accustomed at the Delaware Supreme Court and the top Wilmington firms. Perhaps more importantly, because I had Jenkins' tools and Librarians by my side, I was able to produce documents which reflected a depth of research equal to any in documents I authored as a Law Clerk and at big firms. My reputation among the colleagues with whom I collaborated on many cases depended in no small part on that fact. So, for me, Jenkins not only made it possible for me to do top flight research, but I also staked my professional reputation on Jenkins' resources, all of them. This also gave me the foundation on which to litigate against

some of the largest law firms in Philadelphia. Now that I am retired, I live in a fairly rural area with no access to a local law library. I was surprised at how often I need to do legal research here in Virginia, but, thankfully, Jenkins is still by my side. In my opinion, the Jenkins Law Library is an extraordinary institution which deserves all needed support to continue its awesome services.

I have been a member for about ten (10) years and Jenkins has helped me countless times with research, court filings, litigation needs, and staying up to date on known practice areas and even being the foundation for entry into new practice areas‐ both through CLE classes as well as myriad paper and digital journals. Their online access allows 24/7 access to nearly all of their resources and their hours of operation are convenient to the schedule of busy attorneys. Jenkins also has a rich history. The old law books and portraits are part of the character that makes it so special. It would be a terrible disservice to many of us in the legal community to lose Jenkins because of all that it provides. It would also be a great pity to lose a place so steeped in the history of the practice of law in Philadelphia. Jenkins library is an incredible resource to me, a solo practitioner, to be able to help my clients in their vast legal issues by allowing me to provide top quality representation at prices they can afford. Without Jenkins' resources, at affordable rates, there is no way I could charge the reduced fees I charge to represent clients in their battles against the "big" firms with unlimited resources. Cutting the funding to Jenkins, and thereby limiting its resources to me, or by

increasing the costs to me, would directly impact the fees I have to charge my clients. Since most of my clients do not have much, if any, financial resources, any increase in the cost of my services to them would potentially make them unable to defend themselves or advance their legal claims because it would become cost‐prohibitive. Michael Jacobs As a solo attorney, Jenkins Law Library is vital to me. I cannot maintain my own law library, so my first resort is always to turn to Jenkins. Jenkins also provides excellent continuing legal education and it is my primary CLE provider. The contemplated cut in funds to Jenkins would seriously impact services it could provide and would especially harm many solo attorneys who use its services. Most of the lawyers in Philadelphia are solos and provide vital legal services to the citizens of Philadelphia. Thus, cutting funds available to Jenkins would also ultimately cut legal services to many citizens. As a true solo, Jenkins is my answer, for CLE, for research, and for a place to stop when I'm out and about, to check my voicemail and email. If I have to meet with clients, I would try to book a room at Jenkins, since I practice from a home office and would not meet with clients in my home. Jenkins has been an invaluable resource for me. Jenkins has been an INVALUABLE(!) resource to me and any reduction in its funding, which would ultimately result in increased member dues, would cause a significant detriment to my practice. I am an attorney who deals almost exclusively in the arts where most of my clients are barely making ends‐meat. I am only able to assist them in large part because Jenkins provides me the research and career resources that as a sole practitioner I could never dream of affording on an a la carte basis. I can tell you as a member of the Philadelphia Bar Association, any increase in my dues to Jenkins would be directly compensated for by a reduction in my membership with the bar. I hope the proponents of this change reconsider their efforts as it would hurt the lawyers in fighting it out in the trenches solo and small firm advocacy. The staff are considerate and helpful in directing me to relevant areas. I make use of the modestly priced CLEs to keep my expenses down, and their CLEs have grown better year by year. If I need to do research I have access off‐site to Fastcase and onsite to Westlaw. And I love the intimate atmosphere of a relatively small library. Jenkins has been around a long time and my practice would be diminished if it were to fundamentally change. The funding mechanism up to this point has worked to make Jenkins a viable and responsive resource for the Philadelphia legal community.

My clients typically earn less than $50,000 a year and are not paying me a high hourly rate. I consider Jenkins and ESSENTIAL service for my law practice. I simply could not afford to operate if I needed to pay for the resources provided to me through my Jenkins membership. I know of many solo and small firms in a similar situation. As a solo practitioner, Jenkins Law Library is essential to my practice, which is focused on representing consumer debtors who typically earn less than $30,000 a year. The beauty of Jenkins is it has reference materials that can't be had without exorbitant expense and travel time. It levels the playing field between large law firms with deep pockets and smaller firms by providing the same access to legal resources at the same cost. Loss of this resource would be a loss not just to my practice and my clients but a loss to the public at large. There is no other library I'm aware of in the Philadelphia area with the research resources provided by Jenkins. Jenkins is extremely important. It is a cost‐effective library which levels the playing field between large well to do firms and small or solo firms. Large firms have private law libraries

which they can bill to corporate clients. Small and solo firms and the public need the extensive resources offered by Jenkins to compete. I depend on Jenkins to research law which would be exorbitantly expensive on Lexis or Westlaw. Jenkins offers these resources at a very reasonable price. I served as Executive Director of the New York Law Institute from 2004 ‐ 2015. A three‐pronged revenue stream supported the services of the Institute; dues, fees for service and investment income from an endowment. Within 4 years our endowment lost 30% of its value almost overnight due to the international financial crisis with corresponding reduction in investment income. Consequently endowments can rarely supplant a "predictable" revenue stream especially when they account for 70% of operating revenue as is the case with Jenkins. So it is precarious for proponents of HB 1937 to state that Jenkins "is supported by a multi‐million endowment". Imagine entering into contract for electronic services and have your revenues diminish precipitously within the contract year. It has happened and it can occur again. HB should be rejected and filing fee revenues restored to Jenkins.

Huy Nguyen There is nothing that can replace Jenkins, or the incredible services its Staff provides. there is nowhere else to readily find the legal information that Jenkins provides. Losing Jenkins would completely remove access to vital legal information for those less fortunate in Philadelphia, who have nowhere else to turn. This would be a huge mistake, in my opinion. Judith Noble I go out of my way to get legal service and be serviced by the Jenkins Law Library. I live in Montgomery County and avoid the Montgomery County and Bucks County Libraries because of the superiority of Jenkins. In recent years I have visited the library infrequently, but I have visited its website quite often for the wide array of resources that are available there which, even if offered on Westlaw or Lexis, would be expensive. When I have visited, it has always been apparent how important a resource Jenkins is for the lay public. There is no doubt that appointed criminal defense counsel should be well paid. But depleting Jenkins funding should never have been a thought. At various times over the last decades, I have utilized the services of Jenkins Law Library many times (and in many locations). It has been an essential resource to me, both when I was at Community Legal Services and since. And it is obvious on a quick visit that it provides a unique resource to non‐lawyers in Philadelphia. Jim Prendergast, Jr. I'm one of those lawyers who had become jaded at the ever‐rising cost of MCLE's over the years. I've been around long enough to remember when it was just CLE before the addition of the M. With the ability to satisfy the 12 hour yearly requirement for Jenkins' unmatched low price of $100, you're not feeling like one of the barrister sheep being led to the annual slaughter of some of the long established, well recognized providers, shall I say? Dating myself even further I can remember when the library was housed in the Widener Building on the other end of Chestnut Street. The current physical plant is a literal sanctuary of jurisprudence. Whether it's a brief, a memo, a motion or pleadings, I know I can pack up my lap top and spread everything out on one of those long wired tables at Jenkins and be ready to produce a product that will stand toe to toe (and more often than not exceed) the countering submission from one of my big firm opponents. Let me date myself a little further, I remember when the library was open on Saturdays from 9‐12 and looked forward to jaunting downtown. When the library did away with Saturday hours, I was quite dismayed but they've more than made up for the loss with their powerful online research engines available 24 hours 7 days a week. And that's been just great, cause now as I get older I can sleep in on Saturdays. It provides services to my law firm, individual attorneys and members of the public who are experiencing legal problems. Its extinction would be an incomparable loss. Philadelphia is a city of firsts, and to lose the oldest law library in the country is not a first to be proud of. Moreover, it would hinder future ABA approved paralegals from gaining "hands on research skills" that cannot be replicated via Lexis or Westlaw.

In addition, the ability to contact a researcher at Jenkins to assist in the search for a myriad of items is invaluable. It would be a travesty to allow a jewel like Jenkins fade into oblivion after over 200 years of operation. It will also be a blow to small solo practitioners such as myself.

I use it regularly, and every time I am there I see lay people, who presumably have legal issues but cannot afford a lawyer, and are doing their own research. I also see these people getting assistance from the Jenkins librarians. This law library is important to the entire City of Philadelphia. Richard Sexton As a relatively new member the Pennsylvania Bar and the legal profession, I have found Jenkins to be an invaluable resource. I essentially work as a solo practitioner and although I share office space with other attorneys, the costs associated with a full Lexis or Westlaw subscription is prohibitive. (Aside from my Jenkins's membership, I have a limited Lexis subscription). Jenkins provides access to those platforms including its own extensive database of briefs and opinions dating back to the early part of the 20th century. Beyond those features, Jenkins also has an incredible physical book and reference collection that includes titles that are simply not accessible to attorneys elsewhere unless they are part of a large firm with the necessary resources to provide those things in house. Aside from the immense information resources, the physical space of Jenkins Law Library provides me and other lawyers that simply cannot afford office space to accommodate a law library or multiple conference rooms, an amazing location to conduct research, prepare briefs and other legal documents, printer and copying options, as well as rooms to conduct private meetings or conferences. The staff at Jenkins are incredibly knowledgeable and helpful concerning where to locate certain resources as well as to provide recommendations on what materials would best serve whatever project I may be working on. Closing Jenkins would truly impair my ability to continue my legal practice as it is currently arranged, which focuses on criminal and civil appellate work as well as criminal trial work. While I do not use the Law Library every day (I would estimate I am there at least once per week on average), I certainly take advantage almost daily of Jenkins' online platform to do preliminary research. And when my limited Lexis subscription does not cover items that I need to prepare briefs or trial motions, I invariably head over to Jenkins to access those items. Finally, for attorneys like myself, Jenkins is the only true law library in Philadelphia, aside from the local law school libraries, where one

can conduct serious research and legal writing in an environment designed for such activities. Please do not deny the necessary funding to keep Jenkins alive. Thank you. Harry Sher I do not understand the hostile attitude toward knowledge and the ability to attain it at some reasonable price when the profession is constantly under attack for not providing good services at reasonable prices. If the cost of data and knowledge goes up its a zero sum game, either you charge more or you settle for incompetency. Either way its a black mark to the profession and a sell out of their true calling. They cripple what is most fair and equitable and truly equal opportunity to all. There are almost no other alternatives open to lawyers like me. I am a one man band and regard myself as conscientious and dedicated to improving my capabilities and to not proving to be an embarrassment to the profession I was called to. Without the resources available at Jenkins it is impossible to carry on any meaningful research on anything more than simple run of the mill legal problems. These resources include not only access to electronic data bases otherwise not available because of prohibitive costs, but also advice from highly competent and trained staff as well as the ability to obtain photocopies, etc. of valuable treatises and articles. As the law becomes more complex true competence in knowledge and representation will require more support for good law libraries‐‐‐not less. Without Jenkins the odds are that I would NEVER be able to provide competent services to my clients and draw even more disrepute upon the bar.

The General Assembly threatens to rob Peter to pay Paul by redirecting financial support for Jenkins to the FJD for payment of defense counsel representing indigent defendants. Instead, it should recognize its obligation to fund adequately both sources of essential services to the legal community instead of jeopardizing a respected Philadelphia institution and the ability of many practitioners to represent their clients in a cost‐effective and comprehensive manner. Since then, my practice has helped people from all socio‐economic backgrounds, including indigent individuals. The affordability of a Jenkins membership helps me keep prices low for my clients. ultimately paid for by clients, who are often underprivileged or in unfortunate situations. Please keep the cost of Jenkins low, and affordable, which will help keep representation of individuals affordable as well. Brad Shuttleworth First, full disclosure: I met my wife at Jenkins Law Library, and she still works there. Nevertheless, I was a big Jenkins fan before we met. When I started out as a young solo practitioner, my practice was possible because of Jenkins. All of my work is research‐intensive. Without having access to Westlaw and Lexis, I would not have been able to start my practice, and I could not have afforded anything like the research package that I can access at Jenkins. Also, as a younger attorney, there were times when I wanted to expand my practice but needed to read some of those old‐fashioned resources known as "books." They are very good for when you don't know how much you don't know ‐ Westlaw is less useful for that. There is no greater resource than Jenkins for the emerging youngest generation of attorneys in Philadelphia, a generation that will be forged in an atmosphere of job scarcity and will really have to hustle. They need Jenkins, badly.

Henry Sias I am a solo attorney. Without Jenkins, I would not be able to afford an electronic research database. Access to Fastcase is very important to my practice. I am a solo practitioner with a very small operating budget. I cannot afford expensive search tools, and access through Jenkins at a reasonable price helps me to keep costs low for my clients. Aside from being a hardship on many lawyers, the result of taking funding from Jenkins would lead to the public being underrepresented as most people cannot afford the prices affluent law firms tend to charge, and they would would no longer have the option of using a less affluent firm that charges an amount most people would find affordable.

Law libraries need to be available for the public. A low‐income mother trying to learn about dealing with an irresponsible landlord, or a person who lost their job and has debt collection pending, or someone who is dealing with a divorce, all should have a place to go to learn about their rights and how to get through the legal system. Money from this resource should not be taken to fund indigent defense. The city should step up and manage its budget and fund indigent defense as they are required to, rather than cutting a legal resource that serves the whole area. Law libraries are valuable and should be supported and protected. Once you take away these funds, the library will be destroyed and it will never be replaced. So many private firm collections have been downsized and archival material that has not been digitized is often only accessible at Jenkins. Even with access to numerous services, e.g. Westlaw, WoltersKluwer etc., there are items which only Jenkins can provide, and their ILL service is top‐notch.

Janet Steiner I am a member of the Jenkins law library, and I find it a very valuable resource, as an employee of a small firm that was not have the resources to have an extensive law library. That said, when I have been there, the library proves its worth by the number of non‐lawyers going there for access to legal materials. These individuals are represent themselves, either by choice or because they cannot afford an attorney, and having the law library there allows these individuals to have access to resources that allow these individuals to represent themselves. Without access to the library, these individuals would not be able to protect and exercise their rights to the extent they currently are. I have been a Pro Se litigant for over 15 years in the Family court Division of the court of Common Pleas for Philadelphia County. I have been caught up in the dysfunction that is the Philadelphia Court system defending my paternal rights. I just recently have been sued again by an attorney and her client who use the Family Court as their personal legal club to attack me and my daughter who resides with me. Without the resource of the Jenkins Law Library the course of my child’s and my entire life would have been different. The library has been a sanctuary where I have been able to do research and prepare the documents to protect my rights in a court system which simply cycles litigation in order to keep its docket full and resolve nothing. With the help of Jenkins I have defended my rights and kept balance in an otherwise chaotic experience. This resource although not fully utilized by many citizens is in my mind as important as any Miranda or other fundamental civil rights. I can only hope that with the current budget crisis in Harrisburg this basic resource available to the common citizen will not be removed and make the court system even more inaccessible to a Pro Se litigant. I don't believe that we need to "rob Peter to pay Paul" by depriving Jenkins of filing fees in order to increase fees for court‐appointed attorneys. There has to be another way to move forward so that court appointed attorneys are fairly paid AND have access to the excellent resources provided by Jenkins ‐‐ resources which are critical to their work. I am a sole practitioner, and I heavily rely on Jenkins in my practice. I can't imagine maintaining my practice without the resources Jenkins offers. The staff is incredibly helpful and knowledgeable; the access to Lexis and Westlaw are vital to my work; and the remote access to databases via the internet is something I use nearly every day. A budget cut for Jenkins will mean a significant rise in costs for us since we use the Jenkins collection to supplement our own. In addition, we supplement our research staff with the research services Jenkins provides. We will bear the cost of any Jenkins budget cut. Our Jenkins membership has helped to close a gap in services here in a small county law library. They provide us with access to things we are in no shape to pay for, and with that are helping to provide equal access to justice for ALL law library users. The access to so many vital databases that Jenkins provides gives the librarians on the front lines of legal information the ammunition that our patrons, both lawyers and self‐represented parties, need in order to represent their case to the highest extent. Our membership to Jenkins Law Library provides more than I feel I could ever put in to words. As a legal resource center providing assistance to indigent and self‐represented parties, the wealth of knowledge and content provided to us by our membership helps us greatly in our capacity to serve. Simple things such as the PA Legal Forms database, something we couldn't afford as a stand‐alone subscription, have provided our patrons with an enormous amount of information and the confidence to be able to navigate the PA courts on their own. Several years ago, my wife and I decided to start our own small firm, after working separately for over a decade at different firms. We no longer live in or center our practice out of Philadelphia, but we return several times a year to take advantage of the extensive hard‐copy resources of Jenkins. We also make ongoing use of the online resources provided by our Jenkins membership. Together, the Jenkins library and online resources allow our two‐attorney firm to represent clients in a zealous manner, while helping us to keep client costs and fees reasonable. There are increasingly few resources that small‐firm attorneys can use, to level the playing field. County law libraries in most rural Pennsylvania counties are downsized or non‐existent. Law school libraries throughout the Commonwealth may be open to local attorneys during limited hours, but as many law schools downsize their book resources, they are less useful for local practitioners who only have access to book resources, and not online resources limited to faculty, staff, and students. Jenkins Law Library has helped us and our clients, by providing us with access to up‐to‐date case law, statutes, regulations, practice guides, forms, and countless secondary sources. In the present legal market in our area, we would not be able to exist if we were forced to pay the monthly going‐rate of the major nationwide online research providers. Jenkins Law Library serves a very useful purpose. In this age of increasingly larger firms and consolidation, it allows motivated attorneys in small‐ and medium‐sized firms to "keep up" with

I have used Jenkins law library as a student for my LLM courses and through my entire career as a practicing lawyer. Jenkins serves everyone in the Legal Community and also provides access to the public. When I received my Masters in Law, one of my topics was “Economic Evidence in Antitrust Case, I used Jenkins as my resource for Supreme Court briefs. Jenkins allowed me to take the bound briefs out since I was working during the day and commuting for classes at NYU at night. While I was working on appeals, I frequently looked at briefs and records in cases while formulating my arguments. Some of these cases were the matters of first impression. One example is whether or not being HIV positive could be admitted for purposes of damage calculation. When I ceased being a student, I continued using Jenkins law library in every firm I worked, while I worked at SEPTA and even now in semi‐retirement working on cases with other attorneys. I don’t think that the attorneys in large firms truly appreciate that there are couriers from their offices on a regular basis picking up books. Nor do I think that many attorneys have any idea of the amount of money Jenkins needs to support its collection. I do. While at SEPTA, I was involved in the contracts for online research and for books. Specialized reporters add substantial amounts to a monthly bill and do not give you access to the treatises that Jenkins has. Even large firms do not have this type of collection and that is why they use the resources of Jenkins. Jenkins collection cannot be duplicated online and if there are cutbacks updates will not be available. A year or two from now and the Bar Association realizes that a mistake was made to update the library will cost even more. Jenkins has cut back on staff; however, cutting back on the collection would be devastating. Without Jenkins, where are you going to find a book concerning practice in the United States Supreme Court? Moreover, without Jenkins the majority of practicing lawyers would not have access to the BNA and CCH collections. Recently while working on a matter involving the FLSA, I needed to look at old wage and hour opinions going back to 1968. Where are you going to find that? Moreover, many of the wage and hour cases are not reported; therefore, access to the BNA Wage and Hour Cases is critical. Likewise, I was working on a potential immigration case with another attorney. Again, Jenkins came to our assistance with treatises that outlined the visa issues that were potentially at issue. A cut back in funding to Jenkins would impact the legal community and the public in general. Joan Zubras Jenkins is very important to me. Jenkins' hours of operation are convenient. Their librarians diligently and cheerfully provide valuable assistance to me, other lawyers, and non‐lawyer members of the public in the library and on the telephone, and for members, by live chat over the internet. I oppose any reduction of Jenkins' funding. Counsel fees should be funded by another source. As more and more law firms and lawyers move away from the traditional (expensive) office spaces, I believe Jenkins Law Library will become even more vital to our city's legal community.
