CHIaNG - on leave ============================================= ORDINANCE NO. 2012-003 AN ORDINANCE ADOPTING "MAHAL KONG NAGA" AS OFFICIAL HYMN OF THE CITY OF NAGA, CEBU AND ENJOINING ALL PUBLIC AND PRIVATE SCHOOLS, COLLEGES AND UNIVERSITIES, GOVERNMENT AGENCIES AND INSTRUMENTALITIES, AND OTHER PUBLIC AND PRIVATE ESTABLISHMENTS LOCATED WITHIN THE CITY OF NAGA, CEBU, TO SING THE NAGA HYMN IN EVERY PROGRAM, ASSEMBLAGE AND ACTIVITY Be it ordained by the Sangguniang Panlungsod of the City of NAG A, CEBU, that: Section 1. SHORT TITLE - This Ordinance shall be known as the NAGA HYMN ORDINANCE OF THE CITY OF NAGA, CEBU. Section 2. STATEMENT OF POLICY - In order to preserve and enrich the Nagahanon culture, as well as instill love, loyalty, responsible citizenship and a sense of community-building among residents of the City of Naga, Cebu, the Sangguniang Panlungsod do hereby ordain to adopt the "MAHAL KONG NAGA" as official hymn of the City of Naga, Cebu, in pursuit of Section 16, Title I, Book I of Republic Act Numbered Seventy-One Hundred and Sixty (RA 7160), which declares, viz: " Section 16. General Welfare. Every local government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare. Within their respective territorial jurisdiction, local government units shall ensure and support, among other things, the preservation and enrichment of culture, XXXXX preserve the comfort and convenience of the their inhabitants. " Section 3. GENERAL PROVISION - Pursuant to the provision of Section 2 hereof, all public and private schools, colleges and universities, local and national governrnent agencies/offices and instrumentalities, and other private and public establishment located within the City of Nag a, Cebu, are mandated to sing the NAGA HYMN after the singing of the Philippine National Anthem and/ or the Panunumpa sa Watawat, in every flag raising ceremony, assemblage or other similar activity. Section 4. STANDARD LYRICS AND TEMPO OF THE "NAGA HYMN" - All concerned offices, institutions and establishment are hereby enjoined to sing the following stanzas as the correct lyrics of the "Naga Hymn," as accentuated by its standard musical tempo, to wit: Page 1 of 3 pages-

AN ORDINANCE ADOPTING "MAHAL KONG NAGA" AS OFFICIAL HYMN OF THE CITY OF NAGA, CEBU AND ENJOINING ALL PUBLIC AND PRIVATE

SCHOOLS, COLLEGES AND UNIVERSITIES, GOVERNMENT AGENCIES AND INSTRUMENTALITIES, AND OTHER PUBLIC AND PRIVATE ESTABLISHMENTS LOCATED WITHIN THE CITY OF NAGA, CEBU, TO SING THE NAGA HYMN IN

EVERY PROGRAM, ASSEMBLAGE AND ACTIVITY

Be it ordained by the Sangguniang Panlungsod of the City of NAG A, CEBU, that:

Section 1. SHORT TITLE - This Ordinance shall be known as the NAG A HYMN ORDINANCE OF THE CITY OF NAGA, CEBU.

Section 2. SECTION 5. ADMINISTRATIVE PROVISIONS:

a. It is the duty of the Head of Office, Organizer to see to it that the singing of the NAGA HYMN shall be rendered right after the singing of the Philippine National Anthem and/or the Panunurnpa sa Watawat in events such as, but not limited to flag ceremony in schools, barangays, sessions, programs, assemblage and other similar activity.

b. Singing of the NAGA HYMN shall be given due respect, thus requiring everyone present to stand up while singing the Hymn.

c. It shall be unlawful for anyone to change the lyrics and to create a different tune to suit one's own interpretation of the NAGA HYMN.

Section 6. PENALTY CLAUSE: Violators of any of provisions under Section 5 hereof shall be meted an administrative fine of ONE THOUSAND (Pl,OOO.OO) PESOS per violation committed and/or imprisonment for a period of one (1) to thirty (30) days at the discretion of the proper Court. The fines shall be imposed on the School Administrator/Principal/School Head, Business Manager/Proprietor Head of Office of any GovernmentlPrivate Establishments concerned for violation of letter (a); and to any individual or group of people for violation of letter (b) and (c). Barangay Captains/Tanods, Police Officers are hereby authorized to report, blotter, apprehend violators. The City Treasurer or his authorized representativies and Barangay Treasurers shall collect and issue the corresponding Official Receipts for the fines aforestated, proceeds of which shall accrue to government funds.

Section 7. REPEALING CLAUSE - All previous Resolutions, Memoranda which are inconsistent with this Ordinance are hereby repealed and modified accordingly.

Section 8. SEPARABILITY CLAUSE - In the event that a provision or some provisions hereof are found or decreed to be invalid or unconstitutional, all other provisions hereof hot affected by such pronouncement or decree shall remain to be in full force and effect.

Section 9. EFFECTIVITY CLAUSE - This Ordinance shall take effect after fifteen (15) days following the completion of its full publication in any newspaper of general circulation within the City of Nag a, Cebu.
