DECENTRALIZATION IN CONTINENTAL LEGAL SYSTEMS

Summary

Author has studied static and dynamic side of decentralization. He defined the concept

and six key characteristics of the notion of decentralization. Absence of functional

decentralization is properly proven. Decentralization is successfully separated from other

concepts (centralization, deconcentration, devolution, autonomy and dereliction).

Further he analyses European principles of decentralization, number of general and

specific principles of territorial organization and typical competences of units of

decentralization, and defines analyses and explains new subjects in decentralization process.

Elements of convergence and divergence were defined and identified after comparative

analysis of decentralization systems in ten continentals legal system (including Republic of

Serbia).
