تعلن لجنه المناقصات المركزية بناءاً على طلب وزارة الصحة عن طرح توريد و تركيب بدالة إلكترونية2011/2012 /68المناقصة ص/ م خ ع /

ــعة ) ــ 100س + ــب1000 ــك حس ــبيعي وذل ــفى الطب الط ( لمستش الشروط العامة والخاصة والمواصفات الفنية للممارسة والمبينة فيما

بعد.

( معلومات عن مقدمي العطاءات2مادة )

يشترط فيمن يتقدم بعطاء في هذه المناقصة ما يلي :-

أن يكون كويتيًا تاجراً فرداً كان أو شركة مقيداً في السجل التجاري-1 ومسجالً لدي غرفة تجارة وصناعة الكويت ويجوز أن يكون أجنبياً

بشرط أن يكون له شريك أو وكيل كويتي تاجر بعقد رسمي موثقطبقاً لألنظمة المعمول بها في دولة الكويت.

أال يكون عضواً في لجنه المناقصات المركزية وال موظفاً في الجهة-2الحكومية طالبة المناقصة.

على مقدم العطاء أن يبين عنوانه في دولة الكويت وتعتبر جميع-3 المراسالت واإلخطارات واإلعالنات القضائية التي توجه إليه في هذا العنوان بمثابة إعالن صحيح وعليه أن يخطر الوزارة بكل تغيير يطرأ

على هذا العنوان، وإذا لم يتم هذا اإلخطار تعتبر جميع المراسالت التي ترسل إليه على العنوان القديم صحيحة ونافذة وبمثابة إعالن

قانوني سليم.

( نموذج العطاء3مادة )




يكتب العطاء بالحبر أو باآللة الطابعة ويجب تقديمه ضمن وثائق المناقصة الرسمية التي ال يجوز إدخال أي تعديل على البيانات الواردة بها وعلى مقدم العطاء الذي يحدث أي كشط أو شطب أو تغيير في أي من البيانات الخاصة بالعطاء المقدم منه سواء

في األسعار اإلفرادية أو السعر اإلجمالي والكميات أو حاصل الضرب أو غيرها أن يقوم بالشطب على األرقام والبيانات الخطأ

بالمداد األحمر ثم يعيد كتابة األرقام الصحيحة رقماً وأحرفاً بالمداد األحمر والتوقيع إلى جانب التصحيح مقرونا بختم

المؤسسة أو الشركة التي يمثلها وإال سيعتبر العطاء باطالً طبقاًإلحكام قانون المناقصات العامة.

يجب أن تورد هذه الوثائق في المظاريف الرسمية المخصصة لذلك ويلزم ختمها بالشمع األحمر مع عدم ذكر اسم مرسلها أو وضع أي

إشارة أو عالمة تدل عليه ويعنون مظروف العطاء بعنوان لجنة المناقصات المركزية ويكتب عليه المناقصة رقـم : ص/ م خ ع /

يقبل تقديم العطاءات حتى الساعة الواحدة من بعد ظهر يوم : م على األكثر علماً بأنه لن2011الموافق : / /

يلتفت إلى أي عطاء يتم تقديمه بعد الميعاد المحدد لذلك، ولن يعتد بأي تغيير أو تعديل يتم الحقاً في أسعار العطاءات بعد تقديمها إلى

لجنة المناقصات المركزية.

( األثمـــان5مادة )

يجب أن تقدم العطاءات بطريقة يبين فيها قيمة كل بند على حده-1 حسب ترتيب جداول الفئات ويجب أن تكتب األثمان باألرقام

والحروف دون أي كشط أو تحشير وعند االختالف تكون العبرةبالمبلغ األقل.




تسعر جميع العطاءات بالعملة الرسمية والسعر اإلجمالي للعطاء هو-2 السعر الذي سيعتد به في إجراء المقارنة بين العطاءات وإذا تبين عند

التدقيق أن األسعار اإلفرادية في التفصيالت غير مطابقة للسعر اإلجمالي فالعبرة دائما بالسعر اإلجمالي إال إذا كان الخطأ فيه

بالزيادة عن مجموع األسعار اإلفرادية ففي هذه الحالة يعتد بالمجموعالصحيح كل ذلك دون اإلخالل بالفقرة التاليـة :ـ

% )خمسة بالمائة ( من السعر5) إذا كان الخطأ الحسابي يجاوز اإلجمالي أستبعد العطاء ما لم ترى اللجنة بإجماع الحاضرين قبوله

العتبارات تتعلق بالمصلحة العامة (.

إذا وجد عند التدقيق أن بعض األسعار اإلفرادية غير معقولة قامت-3 اللجنة بتعديلها مع المناقص الفائز قبل ترسية المناقصة عليه في

حدود السعر اإلجمالي.

يجب على مقدم العطاء أن يالحظ أن أسعاره الواردة بالعطاء هي-4 التي ستتم المحاسبة النهائية عليها بغض النظر عن تقلبات األسعار

أو سعر العملة أو الرسوم الجمركية أو أية رسوم أخرى.

يجب على مقدم العطاء إذا أجرى أي خصم أو إضافة في سعر عطائه-5 اإلجمالي أو سعر أي بند من بنود العطاء أن يثبت الخصم أو الزيادة

في كل من جدول الكميات واألسعار وصيغة العطاء وكل خصم أو زيادة ترد في كتاب مستقل أو في وثيقة من وثائق المناقصة, عدا

جدول الكميات واألسعار وصيغة العطاء سيعتبر كان لم يكن ولنيلتفت إليه أو يعتد به بأية حال.

( المدة التي اليجوز فيها سحب العطاء6مادة )

(90يقبل مقدم العطاء أن يبقى عطائه قائما ال يمكن سحبه لمدة ) يوما من تاريخ فتح مظاريف

( التأمين األولى7مادة )




ــا يجب على المناقص ان يودع مع عطائه لحساب وزارة الصحه تأمين % )إثنــان بالمائــة( من قيمــة2اوليا بصــفة كفالــة مصــرفية بقيمــة

العطاء في صورة شيك مصدق أو كتــاب ضــمان من احــد المصــارف المحليــه المعتمــده فى دولــة الكــويت غــير مشــروط وخــال من أى تحفظات و غير قابلة لإللغاء و يجب أن يكـــون هــذا التــأمين صــالحاــوب ــير مصحـــ ــاء الغ ــاء و لن يلتفت الى العط ــريان العط ــدة س لم

بالتأمين االولى . ويرد هذا التأمين لكل من لـم ترسى عليــه المناقصــه عنــدما يقـــوم المناقص الـذى رسـت عليــه المناقصـه بتقــديم التــأمين النهــائى وــه العطــاء توقيع العقـد ، وكذلك يرد هذا التأمـين الى من يرسو علي

( من هذه الشروط9اذا قــام بدفع التأمين النهائى تنفيذا للمادة ) واليجوز لمقدم العطاء المطالبــة بأيــة فائــده عن هــذا التــأمين كمــا

اليجوز لدائني المناقص الحجز عليه .

( قبول العطاء8مادة )

يقبل العطاء إذا تقدم المناقص بأقل سعر إجمالي وكان متماشياً مع-1 متطلبات وثائق المناقصة ومع ذلك يجوز تفضيل ممارس تقدم بسعر

أكبر أو إلغاء المناقصة دون إبداء األسباب وذلك طبًقا للشروط 37واألحكام المنصوص عليها في قانون المناقصات العامة رقـم :

م. 1964لسنة

تخطر الوزارة كتابة المناقص الذي رست علية المناقصة بقبول عطائه-2 وبرسو المناقصة علية وال يترتب على إرساء المناقصة وإبالغ

المناقص بذلك أي حق له قبل الدولة في حالة العـدول عن الترسية م في شأن المناقصات1964 لسنة 37طبقاً ألحكام القانون رقـم :

العامة، وال يعتبر متعاقد إال من تاريخ التوقيع على العقد وفقاً ألحكامالفقرة التالية :-

- تطلب الوزارة من المناقص الفائز الحضور إليها لتوقيع العقد خاللمدة أربعة أيام من تاريخ إخطاره بذلك.

إذا تخلف المناقص عن التقدم لتوقيع العقد في الميعاد المحدد أو عن ( من هذه9تقديم التأمـين النهائي المنصوص عليه في المادة رقـم : )




الشروط أو انسحب ألي من األسباب، خسر تأمينه األولى دون إخالل بحق الوزارة في الرجوع علية بالتعويضات وفى هذه الحالة يجوز للجنة المناقصات المركزية أن تلغى المناقصة بناء على طلب الوزارة وتعيد طرحها من جديد أو ترسيتها على المناقص التالي سعرا وفقا ألحكام

قانون المناقصات العامة وفي جميع الحاالت يلتزم المناقص المتخلف عن توقيع العقد بتعويض الوزارة عن كافة األضرار التي لحقت بها

نتيجة إللغاء المناقصة وإعادة طرحها من جديد أو ترسيتها علىالمناقص التالي له في السعر.

( التأمين النهائي9مادة ) يجـب على المناقص بعـد اخطاره بقبول عطائه ان يودع قبل توقيع

% ) عشــرة بالمائـة (10العقـد بصفة كفالة مصـرفية مبلــغ قـــدره من مجموع قيمة العقد لصالح وزارة الصحه بموجب شيك مصدق أو بكتاب ضــمان غــير مشــروط وخــال من اى تحفظــــات وغــير قابــل لاللغاء من مصرف محلــى معتمــد فى دولة الكــــويت ســــــــــارى المفعـــول طيلــــة مــــدة تنفــــيذ العقــــد ولمــــدة ثالثــــين يـومـــا بعــدهـــا بصفــــة تــأمين لضــمان تنفــــيذ العقــــد علــــى الــوجــــه األكمــل وال تــدفـع فـــوائــد عــن هــذا التأمــين واليجــوز لــدائني

المناقص الحجز عليه . يبقـى هــذا التأمــــين لـــدى الــوزارة الى أن يتم تنفــــيذ العقــــد و للـــوزارة أن تخصـــــــم منــه قيمــــة الغـرامـــات و المصــاريف و التعـــويضات الــتى تســتحق على المتعهــــد بمـوجـــب العقــــد و فىــد خالل ــم يجب على المتعه ــذا الخص ــثل هــ ــول مــ ــة حصــ حــالــ سبعــة أيام من تاريــخ اخطــــاره بــذلك أن بــذلك يكمــــل التأمــــين فاذا قصر فى ذلــك كــان للـــوزارة الحـــق فى أن تكمــــل التأمــــين ممـا يستحـق لــه لـديهـا من أية مبالــغ أخــرى فاذا لـم يكــــن لــــه مبالــغ مستحقــــه الصــرف و عجــــز عن تكملــــة التأمــــين خــــالل المهــــله المشــار اليهــــا فــان للــوزارة الحــــق فى فســخ العقــــد

( من هــذه الشــروط و ذلــك بكتــاب موصــى عليــه16طبقــا للمادة ) دون حاجه التخــاذ أية اجراءات قضائيــه مــع حــــفظ حـــق الــوزارة فى الرجــوع عليه بكافة المصاريف بالتعـويضات المترتبه على ذلك

.




( المواصفـات10مادة ) يجب أن يكون العطاء المقدم حسب المواصفات المعتمدة والموضحة بوثائق المناقصة التي يجب على مقدم العطاء أن يطلع عليها ويعتبر تقديم العطاء إقرارا منه باطالعه على هذه المواصفات وقبوله لها،

كما يفترض في مقدم العطاء إطالعه الكامل على جميع البنود موضوع المناقصة والمحددة في جداول الكميات التي تتضمنها هذه الشروط

والوقوف على حالتها على الطبيعة.

كما يجب أن تكون جميع المواد واألعمال والتفاصيل التي يتم تنفيذها لهذه المناقصة وفقا لتعليمات الوزارة كما تخضع بين الحين واآلخر ألية اختبارات قد يطلب مهندسي الوزارة إجراؤها وعلى المقاول أن يقدم

المساعدة واألدوات واآلالت والعمال والمواد الالزمة عادة للفحصوقياس واختبار أي عمل ونوعية ووزن وكمية أي مادة مستعملة.

( التنفيذ والفحص واالستالم11مادة )

يجب على المتعهد تنفيذ األعمال المتعاقد عليها في المواعيد-1واألماكن المحددة بالعقد طبقاً للمواصفات والبيانات المعتمدة.

تفحص المعدات الموردة واألعمال المنفذة بمعرفة مندوبي الوزارة-2 قبل استالمها وعلى المقاول أن يحضر الفحص بنفسه فإذا لم يحضر

ولم يرسل مندوبا عنه، كان للوزارة الحق في فحص األعمال واستالمها دون أن يكون للمقاول الحق في إبداء أي اعتراض على ما

تم من إجراءات.

وإذا وجدت األعمال غير مطابقة للشروط المتفق عليها يتم رفضها-3 ويتعين علي المقاول أن يقوم بإزالتها فورا فإذا تأخر حق للوزارة

إزالتها علي حسابه دون تحمل أية مسئولية عما قد يصيبها من فقدأو نقص أو تلف.

وإذا رفضت بعض األعمال أو جزء منها طبقا لما تقدم كان للوزارة-4الخيار بين :-

أ - أن تنفذ علي حساب المقاول بدال منها و بالطريقة التي تراها مع الرجوع عليه بفروق األسعار فضال عن غرامة التأخير في التوريد

% ) خمسة عشر بالمائة ( من قيمة األعمال المنفذة على15والتنفيذ و حسابه كمصاريف إدارية كل ذلك دون حاجه إلي إنذار أو اتخاذ أية

إجراءات قضائية.




ب- أن تطلب من المقاول أن ينفذ بدال منها في مهله معينه مع توقيعغرامة التأخير.

ج - أن تقرر فسخ العقد وتوقيع الجزاءات والمطالبة بالتعويضات من هذه الشروط.16المنصوص عليها بالمادة

( مدة التنفيذ وغرامة التأخير12مادة ) يتعين على المتعهد أن يقوم بتوريد المواد المطلوبة وتنفيذ األعمال

في المكان المتفق عليه، وفقا لألسلوب المنصوص عليه بالشروط ( من10الخاصة وفي المدة المحددة له بها وذلك طبقا لما ورد بالبند )

الشروط الخاصة.

وتنفيذفإذا قصر أو تأخر المتعهد في توريد كل المواد المطلوبة أو جزء منها عن المدة المحددة في الشروط الخاصة وبنوداألعمال

العقد فان للوزارة الحــــــــــق في أن توقــــــع عليه غرامـــــه د.ك ( )مائة دينار كويتي ( عن كل يوم من أيام100قـــــــدرها )

% من القيمة الكلية للعقد. 10التأخير ، وبما ال يتجاوز

وتستحق هذه الغرامة بمجرد حصول التأخير ودون حاجة إلى تنبيه أو إنذار أو التجاء إلى القضاء أو اشتراط حصول الضرر الذي يعتبر محققا

في كافة األحوال، ويجوز للوزارة حسب تقديرها المطلق وعند الوصول إلى الحد األعلى لغرامة التأخير يحق للوزارة فسخ العقد مع المتعهد أو

التنفيذ على حسابه و مصادرة كفالة التنفيذ مع الرجوع عليه بكل مايترتب على ذلك من تعويضات و فرق أسعار و مصاريف .

( التنازل عن العقد13ماده )

ال يجوز للمتعهد أن يتنازل عن العقد أو جزء منه للغير إال بموافقة كتابيه مسبقة من الوزارة وفى هذه الحالة يظل المتعهد مسئوال مع المتنازل إليه مسئوليه تضامنية عن تنفيذ جميع أحكام العقد وحتى

تمام تنفيذه.( تعديل العقد14ماده )

تحتفظ الوزارة لنفسها بالحق في تعديل كمية األعمال محل العقد % ) خمسة و عشرون بالمائة ( من25زيادة أو نقصانا في حدود




إجمالي قيمة العقد وفي حالة الزيادة يلتزم المتعهد بتوريد الكمية الزائدة بذات الشروط و المواصفات واألسعار الواردة بالعقد مع زيادة

( من هذه الشروط بنفس9قيمة الكفالة المنصوص عليها بالمادة ) نسبة الزيادة ، على أن تكون سارية المفعول طوال مدة العقد و لمدة

ثالثون يوما بعدها.

( الخصم من مستحقات المقاول15ماده )

كل المبالغ المستحقة علي المتعهد تجاه الوزارة تطبيقا ألحكام العقد سواء بصفة غرامات أو تعويضات أو مصاريف أو غيرها يكون للوزارة

الحق في خصمها من التأمين النهائي أو من أية مبالغ أخرى مستحقه للمقاول لدي الوزارة بناءا علي هذا العقد أو أي عقد أخر لديها أو لدى إي وزارة أخرى من وزارات الدولة أو أي هيئة حكومية أخرى، دون أن

يكون للمتعهد الحق في المعارضة وبغير حاجه إلى إنذار أو تنبيه أواتخاذ أية إجراءات قضائية.

( فسخ العقد16ماده )

عالوة على أي حق آخر منصوص عليه في هذه الشروط أو في العقد الذي سيبرم مع المناقص الفائزأو بمقتضى أحكام القانون فإنه يحق

للوزارة أن تفسخ العقد ألي سبب من األسباب التالية :-

إذا أخل المتعهد بأي شرط من شروط العقد. أ- ب- إذا ارتكب أو من ينوب عنه شيئا من قبيل الغش .

ج- إذا رشا أو حاول أن يرشو أي من العاملين بالوزارة بطريق مباشرأو غير مباشر.

د- إذا أفلس أو قدم طلب تفليسة. هـ- إذا اظهر بطئا أو إهماال في تنفيذ التزاماته على نحو ينبئ بأنه لن

ينفذ أعمال العقد في الموعد المحدد له.




و – اذا تنازل عن تنفبذ التزاماته المنصوص عليها بالعقد دون الحصولعلى موافقة الوزارة المسبقة والكتابية على هذا التنازل .

ويتم فسخ العقد بموجب كتاب موصى عليه دون حاجه التخاذ أيةإجراءات قضائية ويترتب علي ذلك ما يلي:-

- أن يصبح التأمين النهائي حقاً خالصاً للوزارة دون حاجه إلى تنبيه1 أو إنذار أو اتخاذ أية إجراءات قضائية.

- أن تنفذ الوزارة ما تبقي دون تنفيذ من العقد بالطريقة التي تراها2 مع الرجوع علي المقاول بكافه ما يستحق لها من تعويضات أو

مصاريف.

( أحكام عامه17ماده )

يلتزم المتعهد في حاله الشحن الجوي وسفر موظفيه باستخدام طائرات مؤسسة الخطوط الجوية الكويتية أو شركات الطيران األخرى

التي لها حق النقل للركاب والبضائع طبقا لالتفاقيات الثنائية التي أبرمتها دولة الكويت وفقا للضوابط المنصوص عليها في قرار مجلس

م معدالً بقراره المتخذ بجلسته رقـم :1985 لسنة 21الوزراء رقـم : م.1987 / 4 / 13 المنعقدة بتاريـخ : 87 / 18

(18مادة ) يتعين على المتعهد االلتزام بشراء ما يحتاجه من مواد أو أدوات او

االت او اجهزة او معدات من المنتجات الوطنية أو المنتجات ذات لسنه6المنشأ الوطني وفقاً لقرار وزير التجارة والصناعة رقـم :

م وتعتبر أحكام هذا1987 لسنه 23 والمعدل بالقرار رقـم : 1987 القرار جزءا ال يتجزأ من العقد ويترتب على اإلخالل بها توقيع غرامة

% من قيمة المشتريات فضالً عن الجزاءات األخرى20ال تقل عن المقررة على إخالل المتعهد بالتزاماته التعاقدية، مع اإللتزام بأحكام

و تعديالته متممه64 / 37تعتبر أحكام قانون المناقصات العامة رقـم : ومكمله لهذه الشروط، و العقد الذي سيبرم مع المناقص الفائز.

(20مادة )

في شان2000 لسنة 19على المناقص االلتزام بأحكام القانون رقم دعم العمالة الوطنية وتشجيعها للعمل في الجهات غير الحكومية

بتحديد2008/ خامسا لسنة 1104وتعديالته وقرار مجلس الوزراء رقم نسبة العمالة الوطنية لدى الجهات غير الحكومية وتعديالته وعلى المناقص أن يرفق ضمن مستنداته شهادة استيفاء نسبة العمالة

الوطنية الصادرة من وزارة الشئون االجتماعية والعمل وإال سوف 19يستبعد عطائه وفقا ألحكام المادة السادسة من القانون رقم

المشار إليه وقرارات لجنة المناقصات المركزية فى هذا2000لسنة الشأن .

(21مادة )

يلتزم المتعهد بتمكين أي مقاول آخر تكلفة الوزارة بأعمال خارج نطاق العقد وداخل موقع العمل وتقديم التسهيالت التي تمكنه من

إنجاز مهمته دون أن يحق له المطالبة بأي مبالغ عن ذلك. (22مادة )

سيبرم العقد في دوله الكويت وتسرى عليه أحكام القوانين واللوائح الكويتية وتختص المحاكم الكويتية بالفصل في المنازعات التي قد

تنشأ بسبب تنفيذه أو تفسيره.(23مادة )

لسنة3يلتزم المناقص بأحكام مرسوم ضريبة الدخل الكويتية رقم على2008 لسنة 2 و 1970 لسنة 34 المعدل بالقانونين رقمي 1955

/أوال/ ب و ج الصادر في738ضوء ما جاء في قرار مجلس الوزراء رقم في هذا الشأن .14/7/2008 المنعقد بتاريخ 2/2008-35إجتماعه رقم

العربية.

وتنفيذاً لمقررات الدورة السابعة للمجلس األعلى لمجلس التعاون 5 - 2التي عقدت في دولة اإلمارات العربية المتحدة في الفترة من

فقد تقرر ما يلي :-1986نوفمبر

أوال: إعطاء األولوية في المشتريات الحكومية للمنتجات الوطنية والمنتجات ذات المنشأ الوطني لكل من : المملكة العربية

المنتج الوطني : كل منتج تم إنتاجه في دوله الكويت حسبا.القوانين والنظم المعمول بها.

المنتجات ذات المنشأ الوطني: هي المنتجات التي ال تقل نسبهب. القيمة المضافة الناشئة عن إنتاجها فى إحدى الدول األعضاء عن

وال تقل نسبه ملكيه% من قيمتها النهائية عن إتمام اإلنتاج 40% وفق شهادة المنشأ.51مواطني دول المجلس في المنشأة عن

تعطى المنتجات الوطنية أفضلية في األسعار على مثيالتها منج. % وعلى مثيالتها من10المنتجات أال جنبيه بنسبه ال تقل عن

% و في حالة5المنتجات ذات المنشأ الوطني بنسبة ال تزيد عن عدم توفر المنتج الوطني تعطى المنتجات ذات المنشأ الوطني

% على مثيالتها من المنتجات األجنبية.10أفضلية في حالة عدم كفاية كمية المنتجات الوطنية لتلبية احتياجاتد.

األجهزة الحكومية كاملة من منتج معين, تقوم هذه األجهزة بتلبية باقي احتياجاتها من المنتجات ذات المنشأ الوطني ثم بعد ذلك




المنتجات األجنبية مع مراعاة ما ورد في الفقرة ) أ ( أعاله وشرطيالجودة والتسليم.

ألغراض األفضلية المنصوص عليها في الفقرة ) أ ( تحتسب األسعاره. أعاله على أساس أسعار تسليم مستودعات المشترى و في الحاالت

التي تعفى فيها المنتجات األجنبية المستوردة من الرسوم الجمركية أو غيرها تضاف قيمتها عند احتساب األسعار لغرض

المقارنة.

يشترط في المنتجات الوطنية والمنتجات ذات المنشأ الوطنيو. والمنتجات األجنبية مطابقتها لمواصفات هيئة المواصفات

والمقاييس لدول مجلس التعاون المعتمدة من قبل الدولة المشترية أو المواصفات المعمول بها في الدولة أن وجدت فأن لم يوجد أي

منهما يعمل بالمواصفات العالمية.

تلتزم كافة األجهزة الحكومية ) الوزارات والمؤسسات الحكومية.1 والهيئات العامة والشركات الحكومية أو الشركات التي تساهم فيها

% من رأسمالها ( بتأمين كافة51الحكومة بنسبة ال تقل عن احتياجاتها من المشتريات الوطنية أو المنتجات ذات المنشأ الوطني

بما في ذلك كافة المنتجات االستخراجية والزراعية والحيوانية والصناعية سواء كانت في صورتها األولية أو في أي مرحلة من

مراحل التجهيز أو التصنيع التالية مع مراعاة شروط السعر والجودةوالتسليم.

تراعى كافة األجهزة الحكومية عند تنظيم عقودها الخاصة بالتوريد أو.2 األشغال العامة أو الصيانة أو التشغيل أو غيرها تضمين العقود نصاً

واضحاً يلزم المورد أو المقاول أو المتعهد بشراء ما يحتاجه من مواد أو أدوات من المنتجات الوطنية أو المنتجات ذات المنشأ الوطني

وفقاً لما ورد في الفقرة ) أ ( من المادة الثانية أعاله ويعتبر اإلخالل %20يترتب علية غرامة ال تقل عنبااللتزام بهذا النص إخالالً بالعقد

من قيمة المشتريات إضافة إلي تطبيق الشروط المنصوص عليها في العقد واألحكام النظامية بهذا الخصوص تراعى كافة األجهزة

الحكومية عند تعاقدها مع االستشاريين للقيام بأعمال التصميم ووضع المواصفات والشروط العامة والخاصة لمشروعاتها النص

بشكل واضح في نماذج العقود ومواصفات العمل المطلوب أن يتم تأمين كافة المستلزمات من المنتجات الوطنية أو المنتجات ذات

المنشأ الوطني المتوفرة التي تفي بالغرض المطلوب وتنفيذا لذلك




يلتزم االستشاري أو الجهة الفنية في الجهاز الحكومي عند وضع المواصفات أن تكون متوافقة مع مواصفات المنتجات الوطنية أو

المنتجات ذات المنشأ الوطني المتوفرة ويعتبر إخالل االستشاري أو المقاول بااللتزام بذلك إخالال بشروط العقد المبرم بين الطرفين

ويترتب علية تطبيق األحكام الواردة في العقد أو النظام بشأن إخاللالمتعاقد بالتزاماته.

ألي مقاول أجنبي يتولى تنفيذ المشاريع الحكومية سواء كانال يجوز .3 مقاوال مباشرا أو من الباطن، إنشاء أي وحده إنتاجيه لتأمين

المستلزمات اإلنشائية للمشروعات, ويلتزم بشراء كافة المستلزمات من المنتجات الوطنية أو المنتجات ذات المنشأ الوطني أن وجدت

وينص على هذا الشرط في نماذج العقود التي تبرمها األجهزة الحكومية وتطبق في حالة اإلخالل بذلك نفس الجزاءات المنصوص

عليها في المادة الخامسة أعاله. تقوم األجهزة الحكومية بالنص في إعالنات طلب التوريد أو طرح.4

المناقصات للمشتريات أو المشروعات أو أعمال الصيانة أو التشغيل وفى نماذج العقود التي تبرمها لهذا الغرض على إخضاعها للقواعد الموحدة إلعطاء األولوية للمنتجات الوطنية والمنتجات ذات المنشأ

الوطني.

مع عدم اإلخالل بأية عقوبة نظامية أخرى يجوز إلغاء التعاقد مع.5 المورد أو المقاول أو المتعهد ومنعه من التعامل مع أي جهات

حكومية مدة سنتين في حالة ارتكابه للغش أو التحايل بتقديمه بيانات غير صحيحة عن المنتجات بما في ذلك وضع عالمات المنتجات

الوطنية أو المنتجات ذات المنشأ الوطني على منتجات أجنبية. م1987ثانيا- يبدأ العمل بهذا القرار اعتبارا من أول مارس

ثالثا- على وكيل الوزارة تنفيذ ذلك وينشر في الجريدة الرسمية.

من المادة األولى من القرار آنف الذكر8أوال : يعدل البند رقـم : ليصبح نصه كالتالي:-

مع عدم اإلخالل بأية عقوبة نظامية أخرى يجوز إلغاء التعاقد مع المورد أو المقاول أو المتعهد ومنعه من التعامل مع أية جهات حكومية

مدة سنتين في حالة ارتكابه للغش أو التحايل وذلك بتقديمه بيانات غير صحيحة عن المنتجات بما في ذلك وضع عالمات منتجات أجنبية

وإبالغ الدول األعضاء بذلك وإبالغ الدولة المصدرة بشهادة المنشأ بذلك التخاذ العقوبات المناسبة بحق من يمارس الغش أو التحايل و كذلك

إبالغ بقية الدول األعضاء التخاذ ما تراه مناسبا من إجراءات.

على وكيل الوزارة تنفيذ ذلك وينشر بالجريدة الرسمية.ثانيا :

م في شأن1964 من أكتوبر 11وعلى المرسوم األميري المؤرخ في: تحديد المواد العسكرية لوزارة الدفاع وقوات األمن المستثناة من

وافق مجلس األمة على القانون اآلتي نصه، وقد صدقنا عليهوأصدرناه.

مادة أولى

تسرى أحكام هذا القانون على الجهات اآلتية:

- الجهات الحكومية بما فيها الوزارات واإلدارات العامة التي يتألف1منها الجهاز اإلداري للدولة.

- بلدية الكويت.2- الهيئات العامة والمؤسسات.3 - الشركات المملوكة للدولة بالكامل أو التي يكون لها أو ألحد4

األشخاص االعتبارية العامة األخرى نصيبه في رأس مالها ال يقل عنخمسين في المائة.

مادة ثانية




يجب في جميع عقود التوريد والشراء وااللتزام واألشغال العامة بما فيها صفقات األسلحة والمواد العسكرية بجميع أنواعها وأي عقد آخر

من أي نوع كان التي تبرمها الجهات المشار إليها في المادة السابقة، أيا كان نوعها أو طريقة إبرامها، والتي ال تقل قيمتها عن مائة ألف دينار، سواء تم عن طريق المناقصة الدولية أو المحلية أو عن طريق المناقصة أو التكليف المباشر، أن يتضمن العقد نصا صريحا عما إذا

كان الطرف المتعاقد مع أي من تلك الجهات قد دفع أو سيدفع أو قدم أو سيقدم عمولة نقدية أو عينية أو منفعة من أي نوع كانت، لوسيط

ظاهر أو مستتر في العقد من عدمه وفى حالة النص على دفعها يجب أن يكون للطرف المذكور وكيل معتمد له موطن فعلى أو موطن

مختار في الكويت، وأن يكشف في العقد عن اسم الوسيط بالكامل وصفته ومهنته أو وظيفته وموطنه ومحل عمله، هو أو من يمثله،

وعلى األخص عن تحديد مقدار العمولة أو نسبتها ونوعها وشخص مندفعت أو ستدفع إليه ومكان دفعها.

مادة ثالثة

على كل من يدفع أو يقدم، وكل من يتلقى بأي صفة، عمولة أو هدية أو عطية أو منحة أو ما أشبه تحت أي تسمية، ولو كانت جانبية كمقابل

استشاره، أو مصاريف إدارية، أو خدمات من أي نوع كانت تحقق منفعة مادية أو أدبية، أو يعد أو يتلقى وعدا بشيء من ذلك، بمناسبة

إبرام عقد مما هو منصوص عليه في المادة السابقة أو في أثناء تنفيذه، أن يقدم خالل الثالثين يوما التالية للدفع أو القبض أو الوعد،

إلى الجهة المتعاقد معها، إقرارا كتابيا تفصيليا عن مقدار العمولة ونوع العملة ومكان الوفاء بها وأداته. وعلى هذه الجهة إخطار ديوان

المحاسبة بذلك فور تقديم اإلقرار مشفوعا بصورة منه.

ويسرى حكم الفترة السابقة على العقود المبرمة قبل تاريخ العمل بهذا القانون وال تزال سارية سواء بدأ تنفيذها أو لم يبدأ، ويكون ميعاد

تقديم اإلقرار بالنسبة إليها هو الثالثون يوما التالية لهذا التاريخ.

مادة رابعة




يعاقب كل من لم يقدم اإلقرار المنصوص عليه في المادة الثالثة في الموعد المحدد لذلك بغرامة تعادل قيمة العمولة أو المنفعة موضوع

الجريمة، فضال عن إلزامه برد ما يعادل قيمتها إلى الدولة. مادة خامسة

يعاقب كل من قدم أو يقدم بياناً غير مطابق للواقع، أو يخفى واقعة تتعلق بما هو مقرر في المادة الثالثة من هذا القانون، بالحبس مدة ال

تزيد على ثالثة سنوات وبغرامة تعادل قيمة العمولة أو المنفعة موضوع الجريمة، أو بإحدى هاتين العقوبتين، فضال عن إلزامه برد

قيمة العمولة أو المنفعة موضوع الجريمة.

مادة سادسة

تتولى النيابة العامة سلطة التحقيق والتصرف واالدعاء في الجرائمالمنصوص عليها فى هذا القانون.

مادة سابعة

على الوزراء، كل فيما يخصه، تنفيذ هذا القانون.

الشروط الخاصة

: توريد وتركيب بدالة إلكترونية سعة ) األعمال المطلوبة.1 ( لمستشفى الطب الطبيعي طبقا للمواصفات100+1000

يجب على المقاول قبل تقديم عطائه القيام بمعاينة الموقع.2 معاينة نافية للجهالة وكذلك األماكن المحيطة به وعليه فإنه

سوف يتم اعتبار تقديم عطائه قد تم بناء على المعلومات الخاصة بأحوال وشكل وطبيعة الموقع وحجم وطبيعة األشغال

والمواد الالزمة إلكمال العمل والطرق المؤدية إلى الموقع وغيرها من المعلومات الكافية النجاز العمل المطلوب والتي قد

تؤثر في عطائه مستقبال وال يعتد بأي ادعاء له في هذا الشأنقبل أو بعد إبرام العقد.

تعتبر األسعار المحددة في جداول الفئات إلى جانب كل بند من.3 بنود األعمال المطلوبة شاملة كل مسئوليات المقاول والتزاماته

تجاه هذا العقد وكل ما يلزم لتنفيذ العمل على أكمل وجه وال يمكن للمقاول المطالبة بأي تعويضات نتيجة أي أخطاء يرتكبها

بهذا الخصوص.

السعر اإلجمالي لجميع بنود ومتطلبات هذا العقد هو السعر الذي.4 سيعتد به في إجراء المقارنة بين العطاءات المختلفة وعلى

المقاول أن يقدم بيان كامل مفصل لقيمة األعمال المختلفة كال على حدة على أن تجمل كل هذه البنود في إجمالي قيمة العطاء المقدم منه كما يتحتم عليه أن يقدم كشف تفصيلي لفئات جميع

بنود األعمال المختلفة والتي ترد في قائمة الكميات ولن يقبلأي عطاء غير متضمن لهذه البيانات.

يجب على مقدم العطاء أن يقدم جميع الكتالوجات والتفاصيل.5 مزودة بمعلومات كافية طبقامع العطاء وتعتبر العروض الغير

لما تم تحديده بالمواصفات غير كاملة فنيا ويحق للوزارةاستبعادها

يحق للوزارة تعديل الكميات المطلوبة بجداول الكميات المرفقة.6

% ( خمسة وعشرون25بالزيادة أو النقصان بحدود نسبة ) بالمائة من الكميات المتعاقد عليها بنفس األسعار الواردة

بالعطاء . يلتزم مقدم العطاء بإعادة الموقع إلي ما كان عليه وفي حالة.7

تخلفه عن التنفيذ فانه يحق للوزارة التنفيذ علي حسابه وخصما. من مستحقاته

يلتزم مقدم العطاء بتوفير عمالة فنية مدربة ومؤهلة لتنفيذ.8 األعمال المسندة إليه وإذا ثبت عدم كفاءة أي منهم فانه يحق




للوزارة أن تطلب منه استبداله بآخر وفي مدة ال تتجاوز أسبوع من تاريخ االبالغ .

يلتزم مقدم العطاء بتنفيذ األعمال في أثناء الدوام الرسمي وإذا.9 تطلب التنفيذ في غير أوقات الدوام الرسمي فيجب علية أخد

. تصريح مكتوب للفترة التي يراد التنفيذ خاللها

. ( يوم من تاريخ استالم الموقع100) : مدة التنفيذ.10

المواصفات الفنية ألعمال الشبكة الهاتفية جديدةيلتزم مقدم العطاء بتوريد وتركيب شبكة هاتفية داخلية.1

لتغطية الموقع بحيث يمكن االستفادة من الشبكة الموجودة وكوابلفعال مع عمل كل ما يلزم من إضافة لنقاط جديدة

وصناديق الربط وصناديق التوزيع حتى يتم تغطيةأرضية الموقع بالكامل ومع احتساب الزيادة المستقبلية وإزالة

صناديق التوزيع القديمة إن وجدت وكانت ال تصلح لالستخدام بالتنسيق مع مهندس االتصاالت بالمنطقة الصحية التابع لها

الموقع .




يلتزم مقدم العطاء بتنفيذ جميع األعمال طبقا للمواصفات.2 الفنية وتعليمات مهندس الوزارة المشرف علي تنفيذ األعمال

يجب تمديد وتوصيل جميع المخارج إلى صندوق التوزيع.10 الرئيسي بالمبني مع عمل مخططات توضيحية لمسارات

الكوابل بين نقاط الهاتف وصناديق التوزيع الفرعية وصندوقالتوزيع الرئيسي.




يجب أن يكون صندوق التوزيع وصناديق التوزيع الفرعية ذات.11 سعة تتناسب وعدد نقاط الهاتف الموصلة به مع احتساب

يلتزم مقدم العطاء بتسليم مكتب الشئون الهندسية المختص.15 ( نسخة من المخططات التنفيذية لألعمال المنفذة2عدد )

( نسخة من جداول التوزيع لجميع النقاط التي2 )وكذلك عدد تم تنفيذها .

يلتزم مقدم العطاء بتقديم مخططات تصميميه لدراستها.16واعتمادها قبل البدء بالتنفيذ .

TECHNICAL SPECIFICATION1. GENERAL

1.1-The technical specifications, together with the attached legal conditions

prescribe the minimum requirements for supply of a fully Digital and IP features

for a private Automatic Branch Exchange Switching System , which shall be




delivered, installed, programmed, tested and operated in PHYSICAL

MEDICINE hospital .

A. The following specifications provide the technical and operational requirements

of the digital and IP PABX system which must be in compliance with ITU

recommendations .

B. The system shall be capable of connection to both analogue and digital public

network interfaces, and must support Integrated Services Digital Networks

(ISDN) and IP Trunks.

C. The PBX must be able to provide support for:

IP communication devices (IP desktop, Wireless IP, multimedia PCs, SIP

phones, or H.323 terminal devices)

Legacy TDM communication devices (digital terminals, analog terminals)

Local or remote network management systems

The PBX should provide the links necessary to integrate multimedia and

business applications via open standard interfaces that deal with the most recent

IP and Web technology standards.

The PBX system must be composed of two distinct parts: the hardware

components supporting the communications interfaces and the software that

controls the communications.

D. It must be possible to transmit simultaneous voice and data communications over

copper telephone network cables.

E. The Main Machine Language (MML) for the system must be according to

international recommendations and in plain English language.

F. Hard disk drives and Magneto-Optical Drives (MOD) shall be used for initial

program loading, diagnostic procedures and for customer data backup.




Tape-based systems or floppy drives will not be accepted.

G. The system cabinets shall be of metal. The location and fitting of various

elements in the cabinets shall be planned taking maintenance into consideration.

All components used shall be of rugged construction and shall have adequate

margins to provide continuous service with minimum maintenance.

H. The range of facilities provided in the system should be flexible and easy to use.

I. It must be possible for the system to allow an outside calling party to be able to

dial directly over PTT lines an internal extension without the help of operators

i.e. system should be capable of providing DID facility.

J. The system must be able to network with other EPABX systems and Key

Telephone systems using industry-standard protocols such as:

QSIG BC

DPNSS

DSS1

H323

SIP

K. The system must have a telephone directory capable of storing at least 3000

subscriber numbers.

L. The system must have dual processors with individual power supplies to provide

100% redundancy. One processor shall be in operation mode and the other in

standby mode. The switch over from working to standby shall be automatic

without any interruption to the ongoing calls and should not affect the normal

operation of the PBX in anyway .




1.2-The Bidder shall reply to each Para or sub-Para of the specifications, using the

same numerical order. In the case of compliance “complied with" shall be used

followed by detailed explanation and Manufacturer technical requirements. The

Bidder shall refer to any extra details, drawings, catalogues etc.. very clearly. The

Bidder must provide a manufacturer compliance statement for every component

of the system, also he shall supply a table of each component with its price, and

any component not listed shall be considered as not to be delivered. The Bidder

shall fill the itemized section and place the catalogue of each item presented

behind its form. Also the Bidder shall fill a table from the manufacturer

documents.

1.3-The Bidder shall fill the table with the page of the manufacturer documents

when there is deviation from any item in these specifications the advantages

obtained with comprehensive reasons shall be described in details. Particular and

general conditions shall be fulfilled and any enquiries shall be answered. The

Bidder shall fill schedules and formats.

1.4-The Tender is undivided and alternative offers will be considered and accepted

2.2 - UPGRADING OF THE SYSTEM

The proposed system should be based on “open” software architecture and

standardized to encourage the functional integration with the information

systems. Software control of the real-time communications should be based on

the LINUX operating system.

The system call server must be based on software that can be updated and

managed easily

3. MECHANICAL REQUIREMENTS

3.1- CABINETS, SHELVES AND COMPONENTS;

The system shall be of a metal cabinet or stackable modules design, with front

doors completely dust proofed. The Bidder shall give the dimension of the

cabinet's (heights, width and depth), weight without plug-in components and

method of connecting the cabinets with the operator consoles. Location and




fitting of the various elements in the cabinets shall be planned taking

maintenance convenience into consideration. All components used shall be

rugged construction and shall have adequate margin to withstand the rigorous of

continuous service with a minimum of maintenance. Any component for

assembly shall be capable to be replaced by one as equivalent types, the

characteristics of which shall be within the limits of the manufacturer’s

tolerance, without affecting the reliability or the ability of the system.

3.2- SURFACE FINISH

All external metal surface shall be treated prior to finishing with metal spray

galvanizing, plating or otherwise be treated to provide a standard and good

quality base for duco-enamel or similar finish. All metal surfaces, internal to the

equipment and not normally visible from the exterior, shall be suitable protected

against corrosion.

3.3- ANTI-VIBRATION

Sufficient anti-vibration feature shall be provided in the equipment to prevent

trouble free in performance during installation and operation in service.

3.4- ENVIRONMENTAL CONDITIONS

All the equipment to be supplied shall be of the best quality and shall be fully

tropicalised. The system shall be installed in air-conditioned room having

temperature in the range of 0 ' C - 45 C. with relative humidity in the range of 10

- 95%. Special attention shall be given to high dust contents in the atmosphere

from time to time and special steps to prevent the ingress of dust shall be

provided. The Bidder shall state the environmental conditions which apply to the 28

reliable working of the system offered, specially for the transistors, IC's, central

processing equipment and memories, disks, magnetic tapes etc...

4. SYSTEM TECHNOLOGY

4.1- Card slots shall be universal i.e. slots must be capable of being utilized for

CO Trunks, Digital Trunks, Primary Rate Interface Trunks, Digital Lines

data terminals etc.

4.2- The offered system shall be adaptable to any radio paging system.

5. SOFTWARE TECHNOLOGY

The system shall be a software driven one, to allow for high degree of flexibility,

to give the user the capability of moves, change in the system numbering plan,

system features and extensions grouping.

A- FLEXIBILITY OF THE SYSTEM

The system design shall provide for flexibility in the initial system

configuration and later ensures easy modification and troubleshooting. In

general, the system service technical shall be able to do all configurations,




maintenance, diagnostics and administration reports without any help from

the manufacturer.

B- BYPASSING TRUNK LINES

The system shall have the capability of bypassing the trunk lines and hot

lines to all the predetermined extensions in the case of failure of the system.

C- INCOMING AND OUTGOING TIMED AUTO- DISCONNECTION

The system must have via software the ability to disconnect the seized trunk

assigned to it after a controlled programmed time. This feature must be

implemented or removed at the discretion of the user. The off time of

disconnection must be variable and the user shall control its length.

D- PABX System Management

* The system function like directory management, changing of extensions, class

of service etc … should be done by web – browser applications.

* This should be easy to use applications without the need of special commands.

* The system should have remote access through internet and intranet

E- Call Management System:

A Windows-based call management system, including suitable PC and printer

must be provided in order to analyze the traffic through the PABX system.

The following features should be available:

• Name and number of extension, calling line identity, call destination.

• User selected display resolution, parameter and type.

• Directory facility for internal and external names numbers and addresses.

• Call costing by metering or cost tables.

• Traffic analysis.

• User programmable carrier price tables.

• Preferred reports can be saved as templates for easy access later.

• Scheduled reports.




• Reports for account codes.

6. SYSTEM FEATURES AND FACILITIES

The Bidder will describe which of the following features that can be offered to

the users without restriction, and how they operate when different. The offered

system must support the following services without the need for any external or

additional server to support them.

a. Voice prompts or guides (multi language)To take maximum advantage of the ease of operation offered by the system (in

particular for analog terminal users), the system should guide users during the

various steps needed to activate specific features by means of voice guides that

indicate the services available at each stage of a call. This service should be as

complete as possible. At least three different languages are required (Language

1, Language 2 and Language 3), and the vocal guides will be distributed to

users according to the language associated with each user. There should never

be two or more different languages on the same voice prompt; the combination

of different languages on the same voice guide will not be accepted.

b. Call (dial) by nameUsers whose terminal is equipped with a display and alphabetic keyboard

should have the capability to call, to transfer, or forward calls to other internal

or external parties by entering their NAME.

The name will be searched for in two ways: last name & first name or initials.

The database must be an application centralized within the telephone system

and synchronized with management operations, in order to keep the data up to

date. To facilitate management operations, when a name is fixed to a speed dial

number, the name and number information will appear automatically in the

database used by the call by name feature. This service must not be limited to a




simple call, but must also be used in all call states (e.g., consultation calls,

terminal programming of call forwarding and automatic callback, or other

service).

To simplify management, user names are associated with terminal numbers in

the call by name database. The name and number association is not restricted

to calling services, but for all management and accounting services associated

with the specific terminal. The database will support up to 60,000 names.

c. Intercommunication groups A work group consists of a set of general-purpose users having a specific

professional association. Each member of the group needs the capability to

handle calls for another member when the latter is absent or busy. To perform

such coverage, the group requires the following configuration: One or more

DID lines will be programmed for the group. Every member should be

informed of the state of the lines (busy, free, or on-hold) and the status of the

terminals that are members of the group. Information reported on all

terminals will be able to take two forms, visual only or visual and tone, to

indicate the following states:

Free terminal

Busy terminal

Terminal receiving a call (ringing)

Every member of the group will be able to answer all direct calls, to put the

lines individual or common hold, and to transfer the calls by a direct call key,

by dialing, or vocally. The Bidder will indicate the maximum number of

members of a work group; the minimum requirement for users belonging to a

work group is 20 members.




d. Supervised work group In this work group, the members are not general-purpose; in their absence,

their calls are handled by a workstation that may be termed a coverage or

supervision terminal (i.e., a terminal that indicates when a terminal has picked

up or has hung up). The coverage or supervision terminal will be equipped to

monitor and indicate the status of all terminals in the group. The following

status information will appear at the coverage in two ways, visual indication

and tone indication:

Busy terminal

Terminal receiving a call (ringing)

The members of the group will be equipped with the analog terminals, each

with a specific DID number; each terminal will have the capability to call the

group or team leader or manager by a specific code or digit. The group leader

will have the capability of answering all calls to members of the group, and of

calling each one of them directly via a key on their set. Bidder will indicate the

maximum number of members in such a work group; the minimum

requirement for users belonging to a work group is 10 members.

e. Text messagingUsers whose terminal is equipped with a display and alphabetic keyboard must

be able to access a text messaging service, allowing them to exchange short

messages from terminal to terminal.

The messages will be stored in the mailbox of the designated user. The name of

the sender, as well as the date and time of the message will be automatically

attached to each message. In addition to the basic utilities of storing and

deleting messages common to this type of service, the message recipient will

have the capability to initiate a call back to the sender by a simple means, or

respond via a text message. The user will also be able to switch their terminal




over to absent state, in which case the user's terminal will generate a text

message to every incoming internal or external call (e.g in meeting room No.

231).

To facilitate use of the service, the user will have a choice of several types of

messages:

Fully preprogrammed -- corresponding to the current

Partially preprogrammed -- to be completed by the user

Free text -- to be composed entirely by the user

f. Automated attendant The proposed PBX system should be equipped with an automated attendant

system that, under designated conditions, welcomes outside callers, and

proposes (in an interactive manner) a way to reach a desired service or pre-

defined party. The interactive dialogue will be based upon DTMF; errors

(incorrect entries) will be sent to an information message and returned to the

earlier point in the menu. If a DTMF entry is not received, the call will

automatically overflow, after a programmable timed parameter, to a pre-

determined number. The requirements are as follows:

Day menu:

The switch over to the night or day message must take place automatically,

reflecting the switchover of the IP PBX system.

The transfer of a call to an internal party or service must be supervised by the

application. If the desired service or party is free or forwarded, the call will be

transferred; if it is busy, the caller will receive a busy signal or will be directed

toward the "Direct call to a busy terminal welcome message." When needed,

the service will take the place of the attendant group for an hour; nevertheless,

the traffic continues to be important, and it will be necessary to install a system

that can handle six (6) simultaneous connections. Bidder will specify whether

the proposed system is integrated or outside of the IP PBX system, and

describe in detail the system capacity, as well as the system modularity.

g. Service substitution Substitution should be available to the entire set of terminals in the installation.

If a digital terminal substitutes an equivalent terminal in its place, the assigned

configuration (key programming, lamps, display, etc.) will all be in effect. If an

analog terminal substitutes the terminal, only the internal and external rights

will be in effect.

h. Direct Inward System Access – DISA The PBX system will allow a user who is calling from outside of the system to

establish an internal or external system connection from his or her DTMF

telephone. Access to the service will be protected by a general secret code and

the access to the personal line by an individual secret code.




i. Remote management of the telephone The PBX system will allow a user who is outside of the system to modify the

answering modes of his or her telephone terminal (voice messaging, external

callback, etc.) Access to the service will be protected by a general secret code or

will be automated according to the caller ID transmitted by the network.

Access to terminal management is protected by individual secret code.

j. Integrated Voice MessagingThe basic PBX system must be equipped with a voice messaging application

that can be managed from the system management platform.

This should be an integrated system that provides the best possible inter-

operation without the need of an additional external server

Bidder will describe all the services available to the users and the voice

messaging system administrator, the maximum number of voice mailboxes, the

maximum recording capacity, and number simultaneous links that can be

handled. In addition to the services described below, the specific requirements

are: All User voice mailboxes, 64 simultaneous links, and min of 200 hours of

recording.

k. Customizable announcementsWhen a call is forwarded to the voice messaging system, the box holder will be

able to choose between two personalized announcements. If the personal

announcement has not been recorded, the standard system announcement will

be substituted automatically.

l. Recording of calls The holder of a voice mailbox will be able to take advantage of this service to

record internal or external calls. Recorded calls will receive the same service as

messages that have been left by callers. The minimum recording length will be




10 minutes; Ministry prefers that this service be automatically proposed to

digital terminal users.

m. Forwarding of voice mail messagesThe box holder will be able to send a copy of previously received messages to

other boxes (with or without requesting acknowledgement of receipt).

n. Call forward to the voice messaging system from a box holderWhen a box holder agrees to have his or her call forwarded, or after a set

amount of time that there is no response, the internal or external caller is

automatically directed to the voice messaging system. After the caller hears the

announcement, the caller can record a message or decide to be forwarded to an

attendant or a specific terminal.

o. Call by nameTo provide universal access, it must be possible to select a voice mailbox by its

name by using the telephone dialing keypad. The caller will be guided in this

operation by voice prompts. The service should be as available to an outside

caller, in which case, the caller will be given the choice to deposit a message or

having the system call the desired party directly.

p. Multiple languagesTo ensure consistency with the system voice prompts, the proposed system

should be multi-lingual, offering four different languages. The service voice

prompts played to a user will follow the same language the user has selected in

the IP PBX system. In no case will a mix or combination of languages on the

same voice prompt be accepted.

q. Overflow of internal calls After a pre-defined delay, the system will offer voicemail to internal callers for

those who have a voice mailbox.




r. Message waiting indicationA LED on the terminal should indicate the presence of one or more waiting

messages. Users who have terminals without a LED should be advised by a

voice prompt that there are messages waiting, when the user picks up the

handset to make a call. Bidder will describe the operating modes of this service

feature.

s. Broadcast lists The box holder will have access to general and personal distribution or

broadcast lists.

t. Silence detectionThe voice messaging systems must provide silence detection to avoid recording

of blanks at beginning or end of recording

u. Message review or access The box holder can review or access waiting messages from any internal

terminal or an external terminal via the general telephone network. When

using a digital terminal, the display will offer dynamic context-sensitive soft

keys that operate the message system features on an interactive basis: fast

forward, stop, rewind, storage, continue, previous message, etc

v. Access security Security and privacy for the recording of personal announcements and in the

review of messages will be assured by a personal code.

w. Message storage The messaging system will store messages automatically, for a programmable

period of time, after which the message will be automatically erased; only a

specific action to erase a message will override the storage of the message, and

erase it immediately.




x. Automated attendantThe messaging system should offer an integrated and interactive automated

attendant service.

The application of messaging should propose a service of integrated and

interactive automatic operator. The user either calling or routed to the AA will

receive a welcome message, and be able to select a language for the following

interactions. At least two (2) different languages must be supported by the

application.

8. SYSTEM EXTENSIONS FEATURES

The following features shall be provided as minimum to all the types of telephones:

A- EXTENSIONS TO EXTENSION CALL

Dialling extension number directly shall make the connection among the

extension among the extension line.

B- CALL TRANSFER




Any extension shall have the facility of transferring the calls to any other

extensions.

C- INQUIRY CALL

This facility to allow an extension which is connected to public exchange or tie

line call, to hold this call and originate an inquiry to another extension and get

back the former.

D- CALL WAITING

When a busy extension receives a call, a call waiting tone and indication shall be

given.

E- CUT-IN FACILITY

Extension provided with this facility shall be able to dial a prefix in case the

wanted extension is busy. A warning tone is transmitted to the two talking

parties to terminate the call. The ring is transmitted to the called extension and

the connection is established when lifting the handset.

F- CALL FORWARDING

Incoming calls to any extension having this facility and do not answer within a

predetermined period of time, it shall be automatically transferred to another

extension as programmed.

G- GROUP HUNTING

An automatic hunting facility shall be provided for a number of extensions

forming a group. Upon dialling the group key number starts hunting for a free

extension within the group. Each extension number or the group shall have its

own extension number.




H- TIE LINES

Tie lines calls to another system shall be initiated in the same manner as internal

calls after dialling the tie line code.

I- HOT LINE

This facility is similar to the above one, except that, when the extension user lifts

the handset, he/she will be connected directly to a pre-determined extension.

J- CONFERENCE CALL

This is to enable a number of extensions simultaneously connected together to

establish a conference call.

K- FOLLOW- ME

This is to enable the extension user to forward all the incoming calls to another

extension number.

L-DISTINCTIVE RINGING

This is to enable the extension user upon receiving a call, to distinguish whether

the call is from external line or from an internal extension within the system.

M - MUSIC ON HOLD

When the calling extension presses the hold button, the calling party shall be

placed on music for a pre-determined period of time.

N-DIRECT OUTWARD DIALLING

By dialling a certain digit, unrestricted extensions have the possibility to reach an

external public exchange line.




O- ATTENDANT CONSOLES FEATURE

The attendant consoles should be windows based consoles with 17 inch LCD

monitor and CPU. Each operator should have access to the directory of internal

and external numbers. All such applications should be easy to use web browser

applications.

These features relate to the capabilities of the attendant, which must be totally

digitally for speech and signalling.

1- Override

The attendant can bypass forwarding or do not disturb modes programmed

on a phone by using an override feature.

2- Called Party Call Resources

When the called party is busy or does not answer, the following call resources

should be available on attendant keys:

Callback request

Text message

Voice mail (on no answer only, when the called phone is not forwarded

to voice mail)

Paging

Associate

Assistant

The attendant should be able to send mini text messages to a user’s display:

Programmed message

Pre-programmed message completed by entering digit: date, hour

Pre-programmed message completed by any variable part (text and

Fully programmable message (twenty characters maximum)

The attendant must be able to pick up extension calls by using the individual

call pick-up feature.

4- Transfer on no Answer

The attendant must be able to transfer internal or external calls without

waiting for an answer (transfer during ringing phase):

Transfer the call: the station called is rung.

Call the station and then alternate and/or transfer the call.

5- Transfer on Busy

The attendant should be able to transfer an internal or external call to a

busy station.

6- Barge-in on Busy or Partially Busy

The attendant console must be able to barge-in on the call of a busy extension.

With the following conditions:

The attendant console is not allowed to barge-in if the called station

already has a barge-in or a conference call.

The barge-in feature is not offered if the called party or the station

connected with the called party is protected against barge-in.

7- Three-party Conference

An attendant must be able to set up a three-party conference, and then

transfer the conference to another user. In a conference set up by an

attendant, one of the parties must be able to be another attendant.

8- Trunk Assignment with/without Restriction (Transfer with Privilege)

This feature enables an attendant to transfer a trunk and public dial tone to

an internal user. The user can then dial an external number with or without

restriction. The attendant can request the call charges at the end of the call.

9- Call Transfer to other Attendant




The attendant console must be able to transfer calls without announcement

(no conversation between attendants) to another selected attendant.

10-Chained Call

This feature allows an external call (transferred by the attendant to an

internal station) to automatically return to the attendant at the end of the call.

The attendant can then transfer the external caller to another station.

11-Charging Recall

This feature allows the attendant to display the number of charge units or the

cost of an external call transferred to an extension at the end of the call.

12-Phone Reservation

This feature allows the attendant to reserve a phone to, for example, transfer

an important external call.

13-Class of Service

The attendant console (in idle state) must be able to change the class of service

for any phone.

14-Public Trunk Access Restriction

The attendant console (in idle state) must be able to change the public trunk

access and restriction for any phone.

15-User Station Creation/Modification/Deletion

The attendant console must be able to create, modify, or delete a station.

16-Input of Directory Name in Phone Book

The attendant console can create or modify directory names in the phone

book.

10. POWER EQUIPMENT

10.1- POWER PLANT CABLING :

All the conductors, distribution feeders and fixing necessary for interconnection

of various items of power equipment shall be provided. The cable shall be

manufactured by approved supplier for the type of voltage/current rated. System

shall work on 220-240V System will be connected to a battery system with

charger for full operation for 10 hours in case of power failure

10.3- FUSE PROTECTION:

There shall be adequate fuse protection for all types of circuits in order to avoid

damage to the equipment. Blown fuse should be easily identified by visual

inspection,. The Bidder shall provide details about the fuse types applied and

their classification.

11. FAULTY RECOVERY AND RESTART OF SYSTEM OPERATION

In case of processor trouble, as much as possible the recovery shall take place

without initiation of temporary memory or hardware, i.e. an emergency control




circuit shall be actuated to recover the system for the trouble condition and to

restart the processing from the point at which it was suspended due to trouble,

thereby not affecting the calls in progress.

12. SECURITY PASSWORD

Security password shall be assigned to the following:

A- Maintenance personal i.e. that is to protect their telephone sets against

unauthorized users. This security pass word shall allow extension user having

different facilities including Voice Mail Box to get an access to the required

service through any other extension, simply be entering the security password.

B- CHANGE OF PASSWORD:

Changing or deleting the security pass word shall be possible. Bidder shall

submit full details in this regard.

13. INSTALLATION REQUIREMENTS

A) The Bidder shall include in their offers the cost of all the installation materials

for the satisfactory operation of the system, including cables, wires, tools etc., A

list of these materials should be submitted.

B)The persons employed by the Contractor must be qualified in accordance with the

nature of the work they are assigned to accomplish and be supervised as function

of the job and the risk involved in its execution.

C) The Contractor is responsible for any prejudice that may be caused by a lack of

discretion of his personal. In the case of negligence by personal, whether in the

execution of the work or in its behavior, the Ministry as sole judge can require

replacement of these persons within a time, set by the Ministry, without any

possibility of opposition by the Contractor.




D) The Contractor must remove all discards and residues of materials or

equipment's. The work space must be cleaned up every day before his

personnel's departure.

E) Finishing, installation and pre-cut-over test shall proceeded according to a pre-

assigned procedure, with the results to be recorded in documentary standard

schedule.

14. DOCUMENTS

Bidder are requested to submit the following documents and information in 2 (two)

sets with full details. These documents shall consist of instruction books manuals

or CD and diagrams etc....

A) System Equipment.

B) Maintenance and supervising.

C) Test and Measuring Equipment.

D) Power Equipment.

E) Installation manuals.

F) Programming Manuals and Code Numbers or Passwords.

g) A Summary of Programming and Costs.

16. TRAINING

The Contractor shall provide local training for the system for 5 ministry personal

18. NETWORK

The contractor must supply & install a new network and doing all the necessary

required cabling for any additional lines including the future expansion.

19. MAIN DISTRIBUTION FRAME ( MDF )

The contractor shall supply, install and terminate the Main Distribution Frame to the wired capacity of the EPABX. All incoming Central Office Lines must be protected with Carbon protection. The MDF terminals should be quick-connecting type, indoor to reduce maintenance time
